Recap of FSMA & Re-Inspection Fees
About 48 million people (1 in 6 Americans) get sick, 128,000 are hospitalized, and 3,000 die each year from foodborne diseases, according to recent data from the Centers for Disease Control and Prevention. This is a significant public health burden that is largely preventable. Hence the emergence of the Food Safety Modernization Act (FSMA), relevant highlights of which are:
- Preventive controls - For the first time, FDA has a legislative mandate to require comprehensive, prevention-based controls across the food supply.
- Inspection and Compliance- The legislation recognizes that inspection is an important means of holding industry accountable for its responsibility to produce safe food; thus, the law specifies how often FDA should inspect food producers.
If a facility fails an FDA inspection and a re-inspection is required, the FY2015 fee schedule is:
- $217 per hour - if domestic travel is required
- $305 per hour - if foreign travel is required
For example, if three inspectors take six hours to determine compliance upon a re-inspection, a domestically-based facility will be billed for $3906.00.
