Last week's survey results...

Are you aware of the 7 rules that define a "true contractor" according to Government law?  

 

  • No

  • Yes, because my wife is in business administration, but I'm betting a lot of sub contractors don't, especially those that work for the same client all the time.
     

This is the worst result we have had for a survey since they started 7 years ago (Just 2 respondents).

 The result indicates that few in the industry are aware of the consequences of falling foul of the law should you be employing subbies and not doing the correct paperwork. Read John Hadfield's comments below.

 

John Hadfield, well known industry consultant submitted this survey, so we asked John to outline the 7 rules together with other information that our readers need to, or should know. John responded with the following:.....

 

......I suggest that maybe 10% or less do understand the serious nature of the exposure they have. Reality is if you are paying for what you call a sub contractor or contractor and feel you are free of employee obligations - there are 7 clear defining 'rules' that must be adhered to. 
If any one of these rules are not fulfilled in the spirit of the law, chances are that person you called a subbie is in reality a employee. 
The result will be you have then a large issue - like all previous super contributions, holiday pay, loadings, workers comp etc etc....oops!
So, best advice is understand your obligations BEFORE you hire,. here is a simple couple of questions:

1. Is the person you employ gaining 80% of their income from your business?
2. If they make a mistake do they have to fix it and do you have that in writing?
3. Do they supply all their own tools?
4. Can they start and finish whenever they like
5. Do they totally determine what and how they complete the project?
6. Can the ;contractor' delegate your projects to others without your OK?
7. Is the contractor genuinely an independant business and has the rights as such to not do one of your projects.
Short and sweet - Can you say yes to all 7? and are those "contractors' totally responsible for all and any breaches in WH&S and you have total confidence they are true independent businesses - rather than - an arrangement that may be deemed by the ATO as avoidance of employee obligations?

 Little Bruce and Jenny are only 10 years old, but they know they are in love.


One day they decide that they want to get married, so Bruce goes to Jenny's father to ask him for her hand. Bruce bravely walks up to him and says, "Mr. Smith, me and Jenny are in love and I want to ask you for her hand in marriage."

Thinking that this was just the cutest thing, Mr. Smith replies, "Well Bruce, you are only 10. Where will you two live?"

Without even taking a moment to think about it, Bruce replies, "In Jenny's room. It's bigger than mine and we can both fit there nicely." Mr. Smith says with a huge grin, "Okay, then how will you live? You're not old enough to get a job. You'll need to support Jenny."

Again, Bruce instantly replies, "Our allowance, Jenny makes five bucks a week and I make 10 bucks a week. That's about 60 bucks a month, so that should do us just fine."

Mr. Smith is impressed Bruce has put so much thought into this.

"Well Bruce, it seems like you have everything figured out. I just have one more question. What will you do if the two of you should have little children of your own?"

Bruce just shrugs his shoulders and says, "Well, we've been lucky so far."

Mr. Smith no longer thinks the little shit is adorable.
