A message from your NCISS President
Thank You!
Dear Members and Colleagues:

This will be my last Advocate report as President of our great Association. My term will conclude on the 40th anniversary at our annual "HIT THE HILL" legislative gathering in the Nation's Capital. Those of you that are attending, I will personally get to greet you and offer my thanks and support for all of your help during my 18-month term. To our members and supporters that cannot be with me in the Nation's Capital, let me take the time right now and say thanks. It has been an honor leading such a great group of Security and Investigative professionals from all across the country.
 
I leave this office in the very capable hands of President Elect Dean Beers and his cabinet of talented Officers and Directors. One of the things I am proudest of during my terms as a Regional Director moving through the positions leading to the President's office is that we have developed a fantastic supportive working relationship that enabled a number of great accomplishments that will continue with your new President.
 
Our Association will face a number of challenges nationally, this year we will elect a new President, many of the relationships we have developed over the years with your respective Senators and Representatives may become obsolete due to the election. The thing our Association does well is cultivate new relationships. This is why it is so important that we stay on top of the pieces of legislation that are moving to ensure our voice is heard.

We are "The National Voice of the Private Investigation & Security Professions." Our State Associations and their individual members are counting on NCISS to be vigilant at all times protecting our businesses through legislative lobbying.
  
Advocacy Hub
NCISS continues to show leadership and its commitment to State Association outreach with the release of the new Advocacy Hub (AH). The AH is a wonderful tool for State Associations to monitor legislation effecting their state. The AH not only identifies certain pieces legislation, it can be helpful with call to action letters from your members to your Congressional and House Representatives.

In November it was announced that the new website was up!  The new site has a new feel, look and information to keep all members informed of the mission of NCISS and successes for which your support is both needed and appreciated.

 

Navigation is easy.  We have added a new Vendors & Sponsors page - please visit and contact them for how they can help you as a member of NCISS.  The member directory is listed with contact information, or you can move to the search page and specify the criteria you need to find a member to assist you.

 

The final steps are to have online membership applications, dues renewals and conference registrations all online and easier for members.  As this is being finalized, be sure and continue to make your dues and conference payments directly to Carol by email or fax.

Special Your Advocate!
A special 40th Anniversary / Hit the Hill Conference issue of the NCISS Your Advocate has been mailed to every member and is available online.  This issue is updated with the latest federal legislative and regulatory news from our Legislative Committee and our legislative advocate, Lobbyit. 

With the help of membership, Lobbyit has been able to arrange another Capitol Hill luncheon and also a reception, each with keynote speakers.

State Legislation Awareness Monitoring (SLAM)
Lobbyit has set up NCISS's "state-level" tracking, continues to identify hundreds of bills in 30 active states. The most important, by state, are below.  To view bills impacting private investigators, private patrol operators, or security guards in your state, go to www.NCISS.org to the Advocacy Hub (direct link http://goo.gl/QSCcgc) and follow the State Legislation link (direct link http://goo.gl/RPcv0W). You can search alphabetically by State or click on your state on the United States map provided at the top of the page (current example above). If your state is not listed, it means that either your state was either not in session or there were no bills introduced that met our search parameters. If you know of a bill in your state that we need to become aware, please contact your Regional Director.
 
To be both effective and current, NCISS and Lobbyit need suggestions for legislative and regulatory keywords to track activities at the state and federal levels. Please contact your Regional Director to provide these keywords.

Be sure and check your state for current legislation to monitor in support or oppose.  NCISS members are encouraged to contact their Regional Directors for suggested guidance and support.

Region News and State Association Updates
Region 5 (Andrea Orozco) - Professional Private Investigators Association of Colorado (www.PPIAC.org)
The Legislative Committee, headed by NCISS Regional Director, and PPIAC VP of Legislative Affairs, Andrea Orozco and PPIAC President Ryan Johnston, followed the recommended strategy of the PPIAC lobbyist to watch another attempt at an 'Emerging Technologies' bill left to die by its sponsor.  This was possible through developed personal relationships from successful licensing attempts.
 
Region 5 Professional Association of Wisconsin Licensed Investigators (www.PAWLI.com)
Dean Gluth (RD 1) has been a member of PAWLI and attending their conferences over the last six years and representing NCISS. Dean Beers was invited to speak on ethics. Dean B. had Dean G. come up first after starting the ethics presentation with how important ethics are to NCISS and how violating ethics is often what causes legislators to propose restrictive laws to our professions. Dean G. had all the current NCISS members (6) come up and talk about why they joined. By the end of the conference, NCISS had nine new members from PAWLI - every board member and more than doubled the current PAWLIM membership in NCISS. The importance of Two Halves - your state association and NCISS and the informative Your Advocate were talked about the remainder of the conference.

Insurance Fraud Investigators Entitled to Overtime Pay Under FLSA

Insurance fraud investigators are not exempt from the overtime pay requirements mandated by the Fair Labor Standards Act (FLSA), according to the 4th U.S. Circuit Court of Appeals.

As part of its insurance business, GEICO General Insurance Company hires security investigators to work in its claims department for the purpose of investigating claims that are suspected of being fraudulent. The FLSA requires employers to pay overtime for each hour their employees work in excess of 40 hours per week. However, individuals who are employed in a bona fide executive, administrative or professional capacity are exempt from the FLSA's overtime pay requirements. The exemption requires, among other things, that the employee's duties are performed in an office or in a nonmanual work setting, are directly related to the management of the company, and include the exercise of discretion and independent judgment.
