In the month of May, Lobbyit continued follow-up from April's Hit The Hill event, discussing drone legislation with target offices, monitoring the FAA's developing drone rule, and meeting with several Senate offices regarding the USA Freedom Act, which places limits on the government's ability to use various means of domestic surveillance.

Stakeholder Activity

During NCISS's Hit the Hill (HTH) event in April, we heard differing accounts of what will happen legislatively with respect to drone regulation. While Senate Commerce Committee counsel indicated that they were comfortable with the Federal Aviation Administration's (FAA) approach to drone regulation, Congressman Ted Yoho (R-Fl03) - whose district includes 5 drone manufacturers -- stated to the collected NCISS attendees that waiting for the FAA was a mistake, and that he would like to see Congress address the matter sooner rather than later.

Consequently, Lobbyit conducted follow-up meetings with target House offices, including House Energy and Commerce, to discuss the matter. While such legislation is only in the contemplative stage, it would likely include protections for a variety of legitimate public and private sector activities, obviating the need for drone users to seek waivers from the FAA for certain activities, including those involving public health and safety (i.e. assessing utility infrastructure conditions, agricultural surveys, etc.). Both the Committee and Member offices were favorably disposed toward carving out an exception for legitimate investigative activities by licensed private investigators (the licensing requirement being the first-line check on legitimacy).

The Committee has asked NCISS for ideas on how to best draft an exclusion for private investigators. If NCISS members have ideas on how to go about structuring an exclusion for our industry, please contact the NCISS/Lobbyit government affairs team so these can be passed on to the relevant Congressional parties.

In the Senate, May also saw the USA Freedom Act come to the Senate floor for a vote. This legislation contains several restrictions on the Federal Government's domestic surveillance authorities. NCISS/Lobbyit have watched this legislation closely, staying in touch with the bill's sponsors and committees of jurisdiction to ensure that the legislation does not inadvertently sweep legitimate private sector activities, like those conducted by private investigators, into their expansive definitions.

To date, applications of such prohibitions have been limited to State actors acting in official capacities, thereby leaving our profession largely untouched. When the Patriot Act comes up for reauthorization, however, we'll have to be similarly vigilant.

Fortunately, the Freedom Act did not pass the Senate. It was brought up as essentially a "test vote" by the leadership, and as a way to fill time while negotiators worked on a temporary fix for the Highway Trust Fund.
