Subject: SENATE BILL 766 ON UNMANNED AIRCRAFT; VETO OF
Dear Governor Scott:
Immediately prior to adjourning, the Legislature passed SB-766, a bill which would now prohibit the use of unmanned aerial vehicles (UAV), or drones, for the taking of video or photographs of private property or people if there is a "reasonable expectation of privacy." Essentially, any location that can't be seen by passers-by can't be watched by someone with a drone.
This bill is now destined for your personal review and signature to make it the law. Sir, I regretfully believe that the Florida Legislature has been apparently extremely short sighted in their passage of this apparently ill-conceived and inadequate bill, that threatens to totally prohibit licensed private investigators from utilizing the economical and less intrusive 'aerial platform' provided by Unmanned Aerial Vehicles / Drones to acquire invaluable evidence by taking video or pictures of private property or people during the performance of their licensed activity.
Should this bill be signed into law, it would result in the continued necessity for licensed private investigators to employ / depend upon costly fixed wing aircraft and helicopters for required lawful aerial surveillance activities.
Licensed private investigators / agencies, attorneys, insurance companies, and private security agencies certainly have monitored this bill, and were relieved when it was recently reported to have been tabled. No doubt its passage has sent shock waves, due to the fact that the use of drones in lawful pursuit of evidence acquisition, locating property, and evaluation of site security integrity, etc., is perhaps no longer possible!
This bill precludes the entire licensed professional private investigations industry from the ethical and judicious use of this new technology; which specifically provides an efficient alternative aerial platform for licensed surveillance activities routinely performed, via noisy and quite obtrusive helicopters or fixed wing aircraft.
Governor Scott, the certain judicious production of evidence available for collection by this new technology in Criminal, Civil and Administrative cases by our industry has been prohibited by this particular bill.
Also, this impacts not only defendants/respondents from the ability to present clear and convincing evidence, but also affects the complainant/petitioner in a plethora of case types as well. The legislature has apparently ignored the potential anticipated monetary burden their bill causes due to the prohibition of the use of this advanced technology by licensed professional investigators.
This bill's negative impact is not just placed upon the shoulders of the individual licensed investigators serving their clients, but also upon the shoulders of the People of the State of Florida in additional costs from the egregious number of alleged workplace related, and other medical frauds perpetrated; which could be otherwise detected and prevented by ethical and judicious application of this technology for specific lawful surveillance cases.
Governor Scott, I respectfully request that you please veto this bill without hesitation. Afterward a new bill can be drafted that will properly provide for the lawful use of this technology by professional licensed investigators, who are currently entrusted by the State of Florida to conduct surveillance to collect video and photographic evidence in the performance of their duties, while curtailing fraud, injustice and working to gather evidence of facts to help reveal the truth above all else.
