A message from your new NCISS President
Join us for Hit the Hill!

Dear Members and Colleagues:

 

I begin my message with the news that 1st Vice President Tom Shamshak is stepping down.  Tom has accepted a position which requires him to resign from any association board positions.  Please see Tom's message, below.  Tom has been a strong member and leader of NCISS, and will remain a member, with big shoes to fill at the next board meeting. 

 

The National Council of Investigation and Security Services (NCISS) officers, board of directors and staff are putting the final touches on the 2015 "HIT THE HILL" Mid-term event. This promises to be an exciting event and we look forward to seeing all of our supporters in the nation's capital.

 

The time is now to finalize your travel plans and register your attendance and join the NCISS 2015 Mid Term HIT THE HILL event. The historic Hotel Monaco in Old Town Alexandria will be our host hotel again this year. Please visit

Mid-term elections this November have concluded, this means the balance of power has shifted, several members of Congress and the House have moved on. In addition, the staffers have also changed. This means new relationships will need to be made with those new members and their staffers. NCISS understands how important staffers are in the process. Often, they are the gate keepers that have a tremendous amount of influence regarding what constituent concerns make it to your representatives' ear for action.

 

Your elected officials need to hear from you. More importantly, they need to see you!!!! They need to know about your business and how bills that are passed or not passed effect you. Put a face on your issue and tell your story.

 

That's where the importance of HITTING THE HILL comes in play. The Hill needs to know about what's important to our industry and your business.

 

Advocacy Hub

NCISS continues to show leadership and its commitment to State Association outreach with the release of the new Advocacy Hub (AH). The AH is a wonderful tool for State Associations to monitor legislation effecting their state. The AH not only identifies certain pieces legislation, it can be helpful with call to action letters from your members to your Congressional and House Representatives.

State Association Advisory Board and
State Legislation Awareness Monitoring Program

One of the most exciting new benefits is the improvement of two of the most important purposes and benefits of NCISS...  

 

NCISS continues to monitor those legislative issues that impact professional investigators and security personnel throughout the country.  Each month the Vice Presidents hold a conference call to discuss current issues from the Legislative Committee and Lobbyit.  Following that, each Vice President holds a conference call with their assigned Regional Directors and At Large Directors.  This is the key communication in the SAAB/SLAM Program committee.

 

As seen in the monthly Lobbyit report to members, both state and federal legislative activity has been most active in the areas of drones and GPS use by our professions, law enforcement and private citizens.  These activities center around privacy, the same primary purpose of most legislation NCISS encounters.  Next are data breaches of data providers.  The new 114th Congress and state legislatures are busy - and that is why your membership, and more important - your active role, in NCISS is so important and appreciated! 

 

Of concern is federal legislation and rule making, as well as with states and their associations on local matters. The SAAB / SLAM Program is a cooperation of member state associations to assist with responding to their legislative needs, while increasing the strength of NCISS responding to federal legislation and regulation. In addition, the SAAB / SLAM Program benefits NCISS membership through increased networking, leadership mentoring and continuity, with the ability to proactively monitor and appropriately respond.

 

To make this work, NCISS needs to know what legislation your state is interested in monitoring. The Legislative Advocacy Hub is based on keywords to find specific legislation among the thousands that are introduced nationwide every year.

Legislative Watch - Security & Investigations
What is the 114th Congress planning?
  • Communications Act Update: The Communications and Technology Subcommittee has already set the stage for an update to the Communications Act - a law written in the telegraph era and last updated when Palm Pilots were at the cutting edge.
  • Protecting Consumers and Commerce in the Internet Age: The Commerce, Manufacturing, and Trade Subcommittee manages the modern manifestation of the committee's historic role overseeing interstate and foreign commerce. Today, that commerce increasingly occurs in cyberspace, which is why the committee and the CMT subcommittee in particular will be focused on data security and the implications of cyber threats to American commerce.

Federal data breach legislation is expected to pre-empt existing state laws and establish one federal data breach notification standard. In addition, the legislation is expected to establish a federal data security standard that is technology-neutral.

 

Issues NCISS and Lobbyit are watching closely:

  • What are the key elements of a Federal data security and breach notification bill?
  • What are important components of a trigger for notifying consumers after a breach?
  • When should companies notify consumers after a breach?
  • What factors go into that decision?
  • Does including a data security requirement in this bill add value for consumers and businesses navigating the current patchwork of State laws?
  • What types of information lead to identity theft? Financial fraud?
  • What elements of a breach notification bill are most critical to reduce the complexity associated with the existing 47 different State laws?
  • What can be done to protect against customer over notification?

Data Privacy/Security: S 177 - Data Security and Breach Notification Act

It is also possible that a consumer privacy bill is included as part of a final data breach legislative package. Sources are reporting increased bi-partisan optimism for action on data breach policy during the 114th Congress.

 

Labor: S 288 - National Labor Relations Board (NLRB) Reform Act

The bill would add a sixth member to the board, ensuring a deadlock on contentious issues. Under the current system, the NLRB has 5 board members usually split 3-2 in favor of the President's party.

Firearms: HR47 - To ensure secure gun storage and gun safety devices

Would repeal existing exemptions to the federal ban on transferring firearms without a gun storage or safety device. Rep. Sheila Jackson Lee (D-TX) introduced the bill on 1/6/15.

 Fellow NCISS Colleagues:

It is with mixed emotion that I share the following information with you.

Days ago, I tendered my Letter of Resignation to NCISS President James Huckabee. I have to step down as the 1st VP because of a change in my employment circumstances. I have accepted a management position with Securitas Security Services USA, Inc, and my new employer has a policy regulating employees' involvement with "Outside Employment and Conflicts of Interest". Since Securitas is a member of the National Association of Security Companies (NASCO), I have to step down from my position as an elected officer with NCISS. However, I plan to retain my membership with NCISS, and look forward to encouraging NASCO to collaborate with NCISS on common issues.

I am truly saddened that I have to step down as the 1st VP. I joined NCISS in 2002 and considered it an honor and privilege to have served as a member of the Legislative Committee - Investigations for 7 years and then moving on to serve as a Regional Director, Secretary, 3rd VP, 2nd VP, and lastly 1st VP.

The future of NCISS is in the competent hands of an exceptionally talented and dedicated team of Officers and Directors. I wish them and all of you the very best in your advocacy of the investigative and security industries. Fraternally,

From Dean Gluth, Regional Director (Region 1)

Dean reports that Indiana has a bill to reduce government agencies, which includes the licensing of several professions - from beauticians to private investigators.  NCISS is working with InSPI to monitor this activity.

 

From Wisconsin are bills to regulate drones and GPS.  Presently these would allow only use by law enforcement with a search warrant.  PAWLI has submitted a position statement opposing this legislation, which is available from Dean - [email protected].  NCISS is working with PAWLI to monitor this legislation.   

 

From Larry Flannery, Regional Director (Region 3)

With the help of At-Large Directors Bill Fletcher and Audra Coleman, Larry has been monitoring additional drone and licensing activity in North Carolina.  A recent NC court decision determined some overreach in how states license professions.  NCISS is working with NCAPI to monitor this legislation. 

 

They are also monitoring legislation in South Carolina that would permit GPS devices on vehicles when placed by the owner of the vehicle.  NCISS is working with SCALI to monitor this activity.    

 

James Huckabee and Terry Myer visit TALI (Region 4) 

Terry represented NCISS the mid-term TALI conference with our president, James Huckabee. With over 200 attendees, TALI rolled out the hospitality. We had such a good time and tried to educate everyone about the Advocacy Hub and generated a lot of interest. We were able to sign up 10 new members. TALI President Carol Tharp has offered NCISS an hour to speak at the August conference.

    

Members of NCISS continue to attend state and national conferences to engage our profession in supporting the mission of NCISS.  Thanks!

PPIAC is watching a newly introduced drone regulation bill.  The bill started out about drones and invasion of reasonable expectation of privacy, but morphed into long lens cameras and then any recording device. This could be potentially dangerous to our profession.
