A message from your new NCISS President

Dear Members and Colleagues:

 

As I begin the role serving as your President of the National Council of Investigation & Security Services (NCISS). The most influential association in the United States of America whose main focus is being "Your Voice in Washington and Across America" as it relates to National and monitoring Statewide issues concerning the Security and Investigation professions.

 

My term begins on a high note, largely due to the leadership of our immediate past President Robert Heales and immediate past Chairman Jim Zimmer. Thank you.

 

The NCISS leadership team combined with the vast knowledge base of prior Past Presidents concerning our core mission positions the council to move forward with some very exciting initiatives such as the Legislative Advocacy Hub and the State Legislative Awareness Monitoring (SLAM) program under the umbrella of the State Association Advisory Board (SAAB).

 

During the next few months leading to our 40th anniversary in 2015, you will be hearing details regarding the initiatives. I invite you all to join us in Washington, DC April 11th through 15 for the next installment of "HIT THE HILL" The hotel Monaco in Alexandra will be our host hotel again. NCISS Annual Awards

Duffy Award - Francie Koehler

The Duffy Award is the highest recognition which an NCISS member may achieve.  It is named in the honor of John J. Duffy, NCISS's first President, who, along with his wife Eleanor,  founded Per Mar Security in Davenport,  Iowa.   John Duffy was the primary spark plug getting NCISS started in 1975 and the Duffy family has continued the tradition by providing unequivocal support for the Council.  The Award reads, To Francie Koehler, "who by her specific deeds and accomplishments has exhibited the highest standards of conduct and service to the private investigation and security service industries."

 

Wunder Memorial Award - Terry Myer

The Wunder Award was created to recognize persons whose contributions to the profession are not always in the limelight but who by their continual dedication, hold NCISS together.  The Wunder Award was created to recognize persons whose contributions to the profession are not always in the limelight but who by their continual dedication, hold NCISS together.  The Award reads: "For Dedication, Leadership and Distinguished Service To The Private Investigation And Security Professions."

 

Vinson Award - Bill Fletcher

The Vinson Award has been presented annually since 2012 to an elected Director, Committee Chair, or other member in recognition of outstanding leadership, dedication, and service to the National Council of Investigation and Security Services.  This year there were several equally exceptional nominees for presented to the Executive Committee for consideration.  For his continued support as a member and enthusiasm as an At Large Director, bringing several members from North Carolina to the annual meeting and Hit the Hill, is awarded to Bill Fletcher.

State Legislation Awareness Monitoring Program

One of the most exciting new benefits is the improvement of two of the most important purposes and benefits of NCISS...  

 

NCISS continues to monitor those legislative issues that impact professional investigators and security personnel throughout the country.  Of concern is federal legislation and rule making, as well as with states and their associations on local matters. The SAAB / SLAM Program is a cooperation of member state associations to assist with responding to their legislative needs, while increasing the strength of NCISS responding to federal legislation and regulation. In addition, the SAAB / SLAM Program benefits NCISS membership through increased networking, leadership mentoring and continuity, with the ability to proactively monitor and appropriately respond.

 

To make this work, NCISS needs to know what legislation your state is interested in monitoring. The Legislative Advocacy Hub is based on keywords to find specific legislation among the thousands that are introduced nationwide every year.

Recent Legislative Alerts from NCISS 

S 1737/HR 1010 - Minimum Wage Fairness Act, Harkin (D-La)

S 1737 was introduced on 11/19/13 and placed on the Senate Legislative calendar (bypassing committee).

The bill would provide for an increase in the federal minimum wage progressively from $8.20/hr for the first 6 months, $9.15/hr six months later, then $10.10/hr the following year.

Many NCISS member security companies would be harmed by an increased minimum wage requirement, and would be forced to curtail the number of jobs offered.

 

HR.1755/S. 815 - Employment Non Discrimination Act of 2013 (ENDA), Sen. Merkley (D-WV)

S. 815 passed the Senate and is under consideration in the House, where it was referred to five separate committees.

This legislation would ban employers from firing, refusing to hire or discriminating against workers or job applicants based on their sexual orientation or gender identity.

ENDA would make it increasingly difficult and expensive to terminate problem employees, offering them another path for vexatious litigation.

National Labor Relations Board (NLRB) -- The "Ambush" Rule
On March 11, 2014, the NLRB proposed new regulations that would radically change the process for union representation elections, effectively shortening election time frames and limiting employees' opportunity to hear from employers before making a crucial workplace decision. The shorter the election, the less time employers and employees have to communicate about the impact of unionization or about a specific union attempting to organize the workplace.

The proposed rule is based on a false premise, violates employer speech rights, and denies employees the ability to make an informed decision about representation.

 

S. 2025 "The Data Broker Accountability and Transparency Act," by Sen. Rockefeller (D-WV)
S. 2025 contains a prohibition of "pretexting" by data brokers, prohibiting "obtaining or solicitation to obtain personal information by false pretenses." While it is unclear if the definition of data broker would extend to PIs, prohibiting the use of pretexting by PIs would deprive them of a valuable and necessary tool.

Using false pretenses to acquire information for illegal purposes is already itself illegal. PIs use a variety of "benign" pretexts to gather information or identify individuals for numerous legitimate reasons, including identifying "deadbeat" parents, locating debtors, finding defense witnesses, investigating fraud, locating hidden assets and ill-gotten gains, etc.

Congress must insure that private investigators are not swept into the definition of data brokers, and should include a specific statutory exemption.

 

HR 1312/S 639 "The Geological Privacy and Surveillance Act," by Representative Jason Chaffetz (R-UT) and Senator Ron Wyden (D-OR)

The legislation would require consent of the subject when using of GPS technology for tracking individuals.

NCISS opposes the legislation. The use of the devices for surveillance significantly reduces accident risk during lawful surveillance. 


HR 645 "Equal Employment for All Act," by Rep. Steve Cohen (D-TN.)

Would prohibit current or prospective employers from using a consumer credit report for either employment purposes or for taking adverse employment actions.

NCISS is pleased to welcome APIA as an association member.  Alabama is now a state with mandatory licensing and has been approved to offer CEs through its conference.

 

Passing of member Stacy Smallwood

It is with deep sadness that we announce the death of our good friend and a Colorado State Association (PPIAC) board member Stacy Smallwood who passed away peacefully this week. Stacy was a great investigator and a friend to a lot of us, he will certainly be missed. Please keep Stacy and his family in your thoughts and prayers.

NCISS will update any information on funeral plans/services once we receive them.
