The Consumer Financial Protection Bureau (CFPB) has issued revised Fair Credit Reporting Act forms for use by consumer reporting agencies effective January 1, 2013. The only substantive change from the forms currently in use is to replace references to the Federal Trade Commission with references to the CFPB. The Dodd Frank legislation gave authority over the FCRA to the new bureau. Here are links to the new forms:
Notice to Users of Consumer Reports
This form must be provided to employer clients. It explains their obligations under the FCRA.
Summary of Your Rights Under the FCRA --This form is the standard form that is provided by employers and consumer reporting agencies (CRA's) to job applicants and when certain other actions are taken, including when an employer takes adverse action based on an investigative consumer report. CRA's must provide a copy to employers who retain them.
Notice to Furnishers of Information
This form describes responsibilities of furnishers of information.
The CFPB now has rulemaking and enforcement authority under the FCRA. We will continue to monitor activities of the bureau and keep you apprised of any proposals from the CFPB.
