Same-Sex Divorce CLE Image
Join us for a timely CLE exploring the variety of issues confronting the LGBT community if marriages come to an end

As the fight for marriage equality advances, addressing the legal issues affecting married same-sex couples who choose to divorce also becomes paramount. In many instances, our community's continued inequality under the law can make issues involved with the break-up of our marriages even more complicated. This CLE program aims to provide attendees a solid understanding of the state of the laws affecting divorce and the agreements that may be relevant to ensuring a more orderly dissolution.

This program will address, among other topics:

1.  Same-sex pre- and post-marital agreements, including lessons learned from opposite-sex marital agreements

2. Same-sex divorce and lessons learned from opposite-sex divorce and preparation for dissolution proceedings

3. State and federal tax issues affecting same-sex pre- and post-marital agreements and divorce

4. Ethical considerations in representing both spouses in drafting marital agreements

 

Sub-topic covered will include, among others: (a) spousal maintenance; (b) enforceability of agreements in jurisdictions without marriage equality; (c) unique issues for couples with children, including custody determinations; and (d) the relevance of DOMA to these topics.
