Greetings!
I am starting to get overwhelmed with the political process again - this summer I watched the RNC in Tampa, and the DNC in Charlotte. Now I am seeing television ads popping up every night. I have seen just about every candidate approve at least one, if not several of the commercials about their perspective race. As a voter I want to exercise my right to vote for the best candidate, but once you get past the top tier elections that everyone focuses on, it is a little mind numbing. Then there are those eleven (actually numbered 1-12) state constitutional amendments, which to be honest I didn't even know were going to be on the ballot, until just a few weeks ago. During the September FICAP Dinner Meeting, our lobbyist Dave Ramba tried to clear up some of the mud regarding the constitutional amendments. There are four (4) Property Tax Deductions Amendments, including one that gives disabled veteran an extra deduction. You can find additional information about the Constitutional Amendments located under the Election 2012 section of In the Mix. Even though our funds have been a little tighter this year, our PAC has made some contributions to candidates during the 2012 campaign. I look forward to the fall time of year, as it appears we have made it through yet another hurricane season, relatively unscathed. The weather is starting to cool off and football is back on TV. Something that is coming up in many of my conversations with others in our industry is talk of a small uptick in business. While we are far from the good times we were experiencing just a few short years ago, things appear to be a little better. This brings about an air of confidence in the market that maybe, just maybe leads me to believe we are on a very slow climb out of the cellar. The independent producer and the associates, who have supported those individual producers during the past several years, have adapted to these harsh times. We have seen various initiatives utilized in our individual businesses that have helped us stay in a competitive position to service and support our customer base in these extremely difficult times. As we make that journey to slowly climb out of this huge downturn, you can be assured that the independent producer will adapt and continue to offer the personal attention that is the foundation of the FICAP way. On another note, FICAP is reviving one of the past programs to recognize those residential builders who build completely with masonry wall systems. The "Best Home on the Block" program will be rolled out later this year in Polk County. Our plans are to expand this program to other markets in 2013. It is our way of recognizing those builders that use Concrete Block for construction of homes in Florida. Stay tuned for more information about this from the FICAP office. FICAP officially endorses Frank Bruno

Florida Voters Have Long Ballots on Election Day

FICAP Produces Opportunity
I was relaxing on the beach the other day and saw a tangle of dried out seaweed. It was easy to shift things around, add a few stems, and create a bouquet that resembled flowers. The more focused I became on creating something, the more unfocused I became from the day's hassles. Sometimes, what looks like a mess is actually an opportunity waiting to blossom.
The Producer Board of FICAP met on September 18th and dumped what appeared to be hassles on the table. As discussions began taking place, ideas began building upon each other and plans emerged for new opportunities. That, my friends, is one of the strengths of FICAP.
Just one of the many ideas to blossom from the discussions is for FICAP to go back to their roots; focusing not just on growing the business of FICAP, but on nurturing relationships within the industry. In 2013, Producer members of FICAP will host most of the monthly meetings at one of their facilities, which provides more intimate and personable settings. If you're not attending the meetings, then you are missing out. Period.
FICAP Producers are also taking a closer look at the companies who support them by actively participating in association events and supporting the association financially. If you think your participation went unnoticed, you were wrong. Attendance, goal group participation, and financial support were each reviewed and will be monitored more closely. Participation matters and when there's a need, producers will look to those closely tied to the association for help first.
Our 2012 convention slogan remains true...FICAP Rocks! We hope to see you at our Fall BBQ on October 30th.

Q: My company has just signed up to receive payments electronically from a large tract builder. We must check a box on a Partial Lien Release form before their system will deposit the funds into our bank account. After we receive the funds, they want us to go back into the builder's system and check a box on a Final Lien Release form. Can the builder or a potential owner rely on releases that are not actually signed by an authorized person in our company?
A: There are no appellate cases dealing with on line forms, but I suspect they would hold up. As long as your customer is not likely to bounce a check, I am okay with checking the Partial Lien Release Box. But I would ask for the initial box to state that the Partial Release is Conditional. After receipt of the funds, you could go back into the builder's system and check a box on a another form that states the release is a Partial Release or a Final Release, if final payment has been made.
