Q: What happened to the day-long conference we all knew as "NYPPS" or "Planned Giving Day"?
A: The Board voted to postpone the Annual Conference in large part due to escalating costs of holding a day-long event in mid-town Manhattan. In lieu of this conference we are planning an inaugural Awards Luncheon on October 2nd. Please stay tuned as more details are posted on the PPGGNY website.

Speaker: Anne K. Bucciarelli, CFA
 Fundraising is a critical lever for many nonprofits today. This brief session will discuss planned giving considerations from a donor's point of view in today's market and legislative environment. Bucciarelli is a Specialist in the Wealth Management Group of AllianceBernstein and is responsible for wealth management research. She provides customized advice on complex financial issues for private clients and their advisors on wealth transfer strategies and asset allocation decisions including concentrated stock exposure and planning for corporate executives. Bucciarelli is also responsible for providing investment advice and solutions to corporate retirement plans, foundations and endowments. She has been the coauthor of and a contributor to the firm's published research on several topics. Bucciarelli joined Bernstein Global Wealth Management in 2004, became an analyst in the Wealth Management Group in 2006, and she assumed her current position in 2010. She earned her BA in finance and information systems from Loyola University of Chicago, magna cum laude and with honors. A Chartered Financial Analyst (CFA) since 2011, she is also a member of the New York Society of Security Analysts (NYSSA) and is a founding member of the American Brain Foundation Ambassador Program. Is the "Putnam" Affidavit Only a New York State of Mind?
 In April of 2012, Jill Miller, Esq., the principal of Jill Miller & Associates, P.C., a trusts and estates law firm in New York City, presented a PPGGNY seminar on bequest administration. As an experienced fundraiser and certified paralegal, I found the talk compelling. In a follow-up discussion, Ms. Miller and I spoke about the question of whether the curious instrument she cited, the "Putnam" affidavit, was merely a New York State invention, or whether something like it exists in other states.

The affidavit under question receives its nickname from the Matter of Ada W. Putnam, Deceased. (Edith I. Smith, Appellant; Richard H. Mitchell, Respondent*). This 1931 appellate case featured a residuary estate left to the respondent attorney who drew up the will. In the end, the appellant failed to prove undue influence. But the idea of removing suspicion of undue influence through the use of a statutory written disclosure acknowledgment became connected.
Ms. Miller cautioned planned giving officers to check for fully executed "Putnam" affidavits when their charities receive residuary bequests from substantial estates of New York State residents and the attorney draftsperson also serves as executor. In the state, lack of such an affidavit can affect the size of the residuary estate, thereby leaving more money to the charity (and less money to the attorney, whose commissions are affected by the lack of a fully executed document).
Required under NY SCPA Section 2307-a, the affidavit comes to the fore when a drafting attorney also functions as executor.
