Terri Lynn Land to Join ABC Members on March 19

ABC of Michigan has confirmed our keynote speaker will be Governor Rick Snyder and a special guest speaker, Terri Lynn Land, candidate for US Senate, has also confirmed that she will join us at the 2014 ABC of Michigan Legislative Day on March 19th. Almost 20 lawmakers have also confirmed their attendance, with more RSVPs coming in every day!

 

ABC members who attend will have the opportunity to meet with lawmakers over breakfast to discuss the issues important to Merit Shop contractors. We plan to have the room filled with ABC members to show support for the governor and lawmakers. For that reason we purposely keep the per-member ticket cost as affordable as possible. But for this to be a success we need sponsors to allow us to keep the cost low and still make this a top-notch event.

 

Please consider sponsoring and attending this year. Sponsorships are sold on first-come, first-served basis. The top opportunities are going fast but there are still some available. ABC Joins Pledge to Hire 100,000 Veterans in Next 5 Years

Associated Builders and Contractors (ABC) Feb. 10 joined construction industry leaders from more than 100 companies in support of their pledge to employ 100,000 veterans in the next five years - a commitment that was made during the U.S. Department of Labor's (DOL) Veterans' Employment in Construction National Symposium.

"ABC believes in supporting our troops by providing them with the employment opportunities available in the construction industry," said ABC 2014 National Chairman and President and CEO of Compass Partners, LLC Dan Brodbeck. "With a projected nationwide shortage of nearly two million workers, ABC is committed to filling this skills gap, starting with our veterans."

The construction industry is anticipated to gain roughly 1.6 million new jobs by 2022 while facing a lack of experienced laborers and the retirement of an estimated one-sixth of the current construction workforce. The pledge to hire more veterans in construction not only honors servicemembers' sacrifice in a tangible way, but also addresses the skills gap seen throughout the country.

First Lady Michelle Obama and DOL Secretary Thomas Perez announced the pledge as a part of an initiative to address the challenges and opportunities America's service members and veterans face when transitioning back into civilian employment.  

 

Training veterans and transitioning service members on industry recognized and nationally portable credentials are essential to ensuring they demonstrate employable skills that are valued by construction firms. NCCER has leveraged their Build Your Future campaign to provide exceptional resources for veterans interested in construction careers. Utilizing BYF's Military Crosswalk, veterans can identify how their Military Occupational Skill (MOS) codes align with NCCER's industry-recognized, portable credentials.

Governor's FY 15 Budget Focuses on Jobs, Education, Public Safety

Gov. Rick Snyder's proposed fiscal year 2015 budget seeks to continue Michigan's comeback by "significantly investing in core priorities that will drive job creation, student success in the classroom, stronger communities, increased public health and safety, and tax relief for low- to middle-income families." The governor also offered a 2016 projected budget.

 

The recommended budget includes additional educational funding; funds to implement expanded Medicaid coverage; infrastructure improvements funding; funding to try to encourage jobs growth (including funds to help community colleges re-tool equipment for high-wage, high-skill and high-demand occupations); funding for seniors & Veterans services; creation of a state-level office focused on "attracting job-creating immigrants to Michigan"; increased public safety funding; additional funding for natural resources conservation; local government funding; and payments to the Budget Stabilization Fund (Rainy Day Fund) and Michigan Health Savings Fund. 

 

The goal is to pass the state's budget by June 1. The state's new fiscal year begins Oct. 1. Details on the budget and specific dollar amounts numbers for each priority are available at michigan.gov/gov.

NLRB Again Seeks to Shorten Union Election Timeframes
The National Labor Relations Board (NLRB) Feb. 5 reissued a proposal that would drastically shorten the timeframe between when a union files a representation petition and an election takes place from the current average of 38 days to as few as 10.
 
"This proposal is a solution in search of a problem," said ABC Vice President of Government Affairs Geoff Burr. "Unions already are winning 64 percent of elections and more than 94 percent of those elections occur within 56 days-exceeding the NLRB's own goals related to election timeframes. 
 
Some of the changes include:
  • requiring that any pre-election hearings begin within seven days of a hearing notice being served and that a post-hearing be held within 14 days of the final tally of votes in the election; 
  • deferring until after the election litigation for eligibility issues that involve less than 20 percent of the bargaining unit; 
  • eliminating pre-election appeals of NLRB regional director rulings and requiring all appeals be included in a single post-election request; 
  • reducing from 7 days to 2 days the amount of time an employer is allotted to provide a list of eligible voters;
  • requiring the voter list to be submitted electronically and include emails and phone numbers for the first time; and 
  • requiring (with some exceptions) all parties and the NLRB to transmit election petitions and election notices electronically.
If finalized, the reissued ambush elections proposal would work hand in glove with the Department of Labor's (DOL) proposed persuader rule, which would deprive employees of their right to obtain balanced and informed input from both sides as they decide whether to be represented by a union. DOL plans to finalize the persuader rule as early as March 2014.

Stakeholder comments will be due on or before April 7, 2014. A public hearing also will take place during the public comment period at a date and time to be determined. Further details and background on the rule is available here.
IRS Issues Final Obamacare Rule; Additional Delays for Some
The Department of Treasury (Treasury) and the Internal Revenue Service (IRS) Feb. 10 issued a final rule implementing the employer mandate provisions included in the Affordable Care Act (ACA). The final rule makes some changes to the proposed rule issued in December 2012, including phasing in provisions for businesses with 50 to 99 full-time employees and those that offer coverage to most but not yet all of their full-time workers. Generally, ACA mandates that employers with 50 or more full-time equivalent employees offer a certain level of health coverage or be subject to new taxes. 
 
A fact sheet issued by the Treasury provides an overview of the phase-in included in the final rule: 
  • While the employer responsibility provisions will generally apply to larger firms with 100 or more full-time employees starting in 2015, they will not apply until 2016 to employers with at least 50 but fewer than 100 full-time employees if the employer provides an appropriate certification described in the final rules.
  • Employers that are subject to the employer responsibility provisions in 2015 must offer coverage to at least 70 percent of full-time employees as one of the conditions for avoiding an assessable payment, rather than the 95 percent which will begin in 2016 and beyond.
