Audits and Inventories.
 
A great tool for anyone having to conduct an Audit or Inventory and not knowing where to start! This video was made for the law enforcement professional who has been given the task of "Auditing or Inventorying" the Property Room.  With years of cop experience "chasing bad guys" for a living, you have no idea where to start.  

Auditing and Inventories provides a step by step process that will guide you through the process. Don't wait till you make the headline before you audit and inventory the unit.

Items of evidence are routinely processed for latent fingerprints using a   variety of powders and/or chemicals. If items of   significant value are submitted, we contact the agency and notify them that the   processing of this evidence may actually destroy the item or significantly diminish its value.  We only proceed with the owner's approval for  processing. According   to the MSDS (Material Safety Data Sheet) for certain  powders/chemicals,  they are deemed hazardous and possibly  carcinogenic. In our crime lab, these items are labeled "chemically treated" and we verbally report to the submitting agency upon release that the items are hazardous and should not be handled without gloves.     However, depending on the circumstances the victim may be entitled to have the evidence released back to them (by the agency) after court etc. Since these items have been deemed hazardous, we recommend to the submitting  department they should not be released.  Obviously, that doesn't satisfy   most agencies/victims and they wish to have the items returned and   attempt to clean the items themselves. The questions becomes, what is   our liability (risk management) for this process?  Joe - What do other states do?

It should be noted the letter further indicted that the State's Attorney  had assisted in developing a form to formally notify citizens that the  item(s) had been chemically treated. The letter also includes the  actual form that had been written with using language that pertains South Dakota.

Thank you for sharing your question and new waiver for inclusion in the  newsletter. The answer to your question from discussions in our classes  is that most departments don't formally notice the owner that there may an inherent risk. This is not to say it's not done, but it's generally not the norm.  

 

I applaud your agency in addressing the issue so that the citizen can make an informed decision. Since your form was specific to  your state, I am providing a generic form for our newsletter that  may be a more universal solution for our members. To all of our readers  the issue of releasing chemically treated evidence should be discussed  with your department's legal counsel for their legal opinion.*
