Q Dear Joe, In reading the material in your book "Property and Evidence By The Book, on page ix, there is a paragraph lead with Property Seized -- Search Warrant, and toward the end of the paragraph, it says that "Some agencies have written a release to the owner as part of the Warrant that is signed by the Judge" This would
help us out considerably. Do you know of anyone I could contact for more info? Thanks, Vikki in South Dakota A Dear Vikki in South DakotaVickie In Florida Vicki, this has been long practice in some department's in California and several other states. Basically the investigating officer while preparing the search warrant writes in a pre- approval in a statement that allows a victim's property to be returned immediately after seizure as opposed to being submitted to the property where it may sit for months. This type of wording needs to be fully discussed and approved with both the prosecutor and court before meeting with the Magistrate. The following wording is provided as an example for disussion. "I further swear this is a true detailed account of all the property taken by me pursuant to the search warrant, and pursuant to Penal Code (appropriate statutory section ), this property will be retained in my custody until a final disposition has been rendered, whereupon all property, except contraband which will be destroyed, will be returned to its rightful owner or disposed of according to any other court order. Further, by this return, I am authorized, without necessity of further court order, to return seized item(s) to any known owner(s) if such item(s) have been photographically documented". Note: Only attempt this type of action with approved by the prosecutor and court. Hope this give you some food for though! Joe |
