Do We Have A Pattern Of Police Entrapment In Canada?

The Huffington Post 03/08/2016 - The unusual factor here isn't that entrapment was used, but the decision of the judge to accept it as entrapment. In fact, in 2014, Human Rights Watch released a report named: "US: Terrorism Prosecution Often an Illusion." The document closely examined 27 federal "terrorist" cases in the U.S. and showed how, among others methods, entrapment became a systematic tactic adopted by the federal American law enforcement agents to "create" terrorist plots and later "foil" them. This was what the deputy director at Human Rights Watch and one of the authors of the report concluded: "But take a closer look and you realize that many of these people would never have committed a crime if not for law enforcement encouraging, pressuring, and sometimes paying them to commit terrorist acts." Furthermore, the report points to the fact that "nearly 50 percent of the federal counterterrorism convictions since September 11, 2001, resulted from informant-based cases. Almost 30 percent were sting operations in which the informant played an active role in the underlying plot." [...] In Canada, no such an investigations were conducted to determine the role of police forces play in terrorist plots.

B.C. bomb plotters set free after judge rules RCMP entrapped pair

The Globe and Mail 29/07/2016 - A British Columbia couple convicted of terrorism charges have had their verdicts tossed out in a scathing court decision that flays the RCMP for its "egregious" conduct in manipulating naive suspects into carrying out a police-manufactured crime. But John Nuttall and Amanda Korody were quickly re-arrested and placed under a peace bond before finally being released. The Crown also immediately filed an appeal. B.C. Supreme Court Justice Catherine Bruce said the Mounties used trickery, deceit and veiled threats to engineer the terrorist acts for which Nuttall and Korody were arrested on Canada Day three years ago. The couple believed they were planting pressure-cooker bombs to kill and maim crowds gathered to celebrate at the B.C. legislature. "The world has enough terrorists. We do not need the police to create more," Bruce said in a landmark ruling Friday as she characterized the RCMP's methods as "multi-faceted and systematic manipulation. There is clearly a need to curtail the actions of police ... to ensure that future undercover investigations do not follow the same path."

The righteous fight against Ottawa's anti-terror law goes on: Editorial

The Toronto Star 02/08/2016 - The climate of fear in which Bill C-51 was passed still prevails today. With terror in the news almost daily, the political temptation to leave these policies in place is undeniably great and will very likely remain so for the foreseeable future. Fear of the potential fallout in case of a tragedy can be politically paralyzing. But the Liberals must now find the courage they lacked when they supported the bill even as they were aware of its fatal flaws. Public consultations may well prove an important part of designing a policy that addresses our complex security challenges while respecting Canadians' civil liberties. They should not, however, be used as a delay tactic. There's nothing Canadians can say to justify Bill C-51's violations of our civil rights. The government should do the brave and righteous thing: scrap the worst aspects of the law at the first opportunity.

Matthew Behrens: Trudeau continues Harper assault on human rights

rabble.ca 29/07/2016 - Another recent state security case that received little attention allows the RCMP and CSIS to carry on their usual abuse of human rights in vulnerable communities. Again, the Trudeau government chose to fight this on the wrong side. In this instance, seven months after the Parliament Hill shooting, a person in Ottawa had their home invaded and materials seized by the RCMP, which carried with it a warrant allowing it to seize "any document, data and/or Internet search history related to Islam." Other search terms looked for included the Government of Canada, "combat politics," and the Canadian Armed Forces. All legal searches, for those wondering... The individual whose house was raided was not charged, nor informed of why possession of any document related to Islam could be connected to a crime. Among the items seized by the RCMP were recordings of recitations of the Holy Quran. Seeking answers, the person sought a copy of the Information to Obtain (ITO) in support of the warrant, which had been sealed by the Ontario court. This was denied because the court maintained the individual failed to demonstrate that the order was unlawful. In a December 2015 court hearing, a judge found that the rights of a non-accused person to know why their home was subject to a raid and seizure of materials was not the same as those of an accused person. The judge also found that the burden of proof that the search warrant was obtained unlawfully is on the individual who was subject to the raid. But how can that be proven when the information needed to prove that is sealed and beyond reach? In addition, what inflammatory allegations are in that sealed packet of information to obtain a search warrant that could be harmful to the individual? After all, it appears to have been connected -- without any explanation -- in some way to the Parliament Hill shootings, and under C-51, a whole range of government agencies can be sharing this information freely not only amongst themselves but with foreign agencies as well. This does not bode well for the individual in question, especially when it comes to overseas travel and the potential for detention and interrogation. In other words, the very issues still being raised by Almalki, El Maati and Nureddin, and still being resisted by the Trudeau government.

Mohamed Harkat girds himself for another fight to stay

The Toronto Star 02/08/2016 - Mohamed Harkat - an Algerian who says he was wrongly accused of being an Al Qaeda sleeper agent - hopes he can finally win his freedom and the right to stay in Canada. "What the government is doing is wrong, and it's not fair," Harkat said in an exclusive interview with the Star. "And they got the wrong guy." Harkat, who came to Canada in 1995 and claimed refugee status, has been fighting deportation since his arrest on a national security certificate in December 2002. He still dreams of one day becoming a Canadian citizen, even though his life in Canada has been very different from what he'd expected. "I thought one day I would have children, a house, a family... everything is destroyed. When I met Sophie, we had a plan to buy a house and have children." The 47-year-old Harkat says he's innocent and will face torture and persecution in his native Algeria if he is deported.

The Toronto Star 31/07/2016 - This is far from solely a US problem. There is a larger pattern of harm committed by law enforcement officers against black people with mental illness. Sociologists Wendy Chan and Dorothy Chunn found that Canadian police officers are more likely to use force on those who they perceive to be mentally ill; particularly if they are also racialized. Blackness, in particular, is dangerous in-and-of itself. According to a 2006 report by criminologist Scot Wortely, black residents, while just over 3% of the Ontario population, make up around one-third of all of the deaths caused by police force, and are 10 times more likely to be shot by the police than white residents. Due to the double stigmatization at the intersections of blackness and mental health, death is too frequently the police's solution to distress.

Ricochet 02/08/2016 - Défendre la liberté de manifester sans itinéraire, donc, n'est pas simplement une position, idéologique ou pragmatique, de non-coopération avec la police ou un refus de prendre en compte les intérêts des autres utilisateurs de la voie publique. C'est défendre la possibilité d'organiser notre action sociale de façon horizontale et non hiérarchique. C'est refuser que les personnes qui manifestent ne doivent être que les figurantes d'une chorégraphie décidée ailleurs. C'est refuser que quelques personnes puissent se sentir légitimées d'imposer leur volonté à quelques milliers. C'est permettre aux gens de se joindre à une manifestation sans se demander anxieusement à chaque coin de rue si cette manifestation est toujours légale. C'est pourquoi, entre autres raisons, nous en appellerons de la partie du jugement de la Cour supérieure du Québec qui porte sur l'itinéraire.

Ricochet 02/08/2016 - Ces autorités «éclairées» ont répondu au terrorisme d'Al-Qaïda par un terrorisme d'État hautement plus meurtrier, alimentant ainsi le cycle de la violence sans fin dans lequel le monde semble aujourd'hui embourbé. «Les pays d'Amérique et d'Europe conduisent, au nom de la paix, de la sécurité et de la démocratie, de puissantes expéditions militaires qui font des dizaines de milliers de victimes et qui détruisent parfois des États entiers - l'Irak, l'Afghanistan, la Libye, le Soudan, la Yougoslavie, le Mali, la Centrafrique -, installant, avec la complicité de politiciens locaux, une paix le plus souvent précaire», écrit Bibeau. Ces campagnes se retrouvent régulièrement justifiées par des discours produits par de «puissantes machines à stéréotypes», ajoute-t-il. Le barbare, c'est l'Autre.

House of Commons petition - Call upon the Government of Canada to urge Honduran authorities to:
1. Agree to an investigation into Ms. Cáceres' murder;
2. Fully implement IACHR precautionary measures for the Cáceres family and COPINH;
3. Demilitarize Lenca territory;
4. Cancel the Energy Development Company's (DESA) Agua Zarca hydroelectric project granted without the Lenca peoples' free, prior and informed consent;

ICLMG - Canada's numerous national security agencies - including CSEC, CSIS, the RCMP and CBSA - have inadequate or simply no oversight or review mechanisms. This has led to human rights violations such as the rendition to torture of Canadiancitizens Maher Arar,
Abdullah Almalki, Ahmad El-Maati and Muayyed Nurredin, among others. In 2006, Justice O'Connor concluded the Arar Commission with several recommendations to prevent such atrocities from happening again: Canadian national security agencies must be subjected to robust, integrated and comprehensive oversight and review. Years have passed and the federal government has yet to implement the recommendations.

Free Khaled Al-Qazzaz - Write to your MP to ask them to urge the Egyptian authorities to remove the travel ban on Canadian resident Khaled Al-Qazzaz so he can finally be free after being detained without charges for a year and a half and released since January 2015 but prevented from leaving the country.

Waleed Abu Al Khair représente bon nombre de militants pacifiques, y compris son beau-frère Raif Badawi, blogueur emprisonné et condamné à 1 000 coups de fouet.
