UN report on Canada's human rights record a 'wake-up call'

23/07/2015 - The United Nations Human Rights Committee has accused Canada of failing to take effective action on a range of issues, including missing and murdered aboriginal women, political audits of charities, and the federal government's anti-terror legislation. The report, published Thursday, is the first substantive review of the country's human rights record under Prime Minister Stephen Harper's Conservative government. [...] Criticisms voiced by Canadian civil rights groups over a contentious piece of anti-terrorism legislation were also echoed by human rights officials in the report. Citing the possibility that the sweeping changes made under Bill C-51 - which became law last month - breach the international covenant on civil and political rights, the committee recommended the government make revisions to ensure "adequate legal safeguards" are in place to protect Canadians' rights.

La Loi antiterroriste fédérale contestée en cour

Radio-Canada 21/07/2015 - L'Association canadienne des libertés civiles et le groupe Canadian Journalists for Free Expression ont déposé mardi matin à Toronto une demande de contestation judiciaire de la Loi antiterroriste de 2015, dite « loi C-51 », espérant en faire un enjeu électoral. Selon les deux groupes, la Loi antiterroriste est « inconstitutionnelle », car elle viole la Charte canadienne des droits et libertés. Ils la jugent encore plus pernicieuse que la Loi sur les mesures de guerre utilisée durant la crise d'Octobre 1970 au Québec. De son côté, le groupe Canadian Journalists for Free Expression affirme que la Loi antiterroriste mènera à la « censure ». Le recours a été déposé devant la Cour supérieure de l'Ontario. Nouveaux pouvoirs contestés : - Pouvoirs accrus pour le Service canadien du renseignement de sécurité permettant à ses agents de déjouer de présumés complots terroristes et non pas seulement d'enquêter; - Élargissement des pouvoirs liés à la liste des voyageurs interdits; - Plus facile pour la GRC d'obtenir une ordonnance de la cour afin de limiter les mouvements d'un suspect; - Prolongation de la période de détention préventive jusqu'à 7 jours, sans accusation; - Création d'un nouvel acte criminel, soit la promotion d'un acte terroriste.

The Canadian Press 21/07/2015 - The RCMP is concerned new anti-terrorism legislation might hurt - not help - its security efforts overseas, internal notes say. The Canadian Security Intelligence Service's new powers to disrupt threats "could inadvertently jeopardize existing relationships" the Mounties have fostered if authorities discover what CSIS is doing, RCMP briefing notes warn. There will be additional pressure on the Mounties to co-ordinate with the spy service so that criminal investigations are not "negatively affected," add the notes, prepared for RCMP deputy commissioner Mike Cabana's appearance at a Senate committee. The Canadian Press used the Access to Information Act to obtain the detailed documents, drafted in advance of Cabana's April 20 testimony on the government's sweeping security bill, known as C-51. The bill, which has since become law, explicitly empowers CSIS to thwart security threats - going well beyond its traditional information-gathering role - by meddling with extremist websites, diverting illicit shipments or engaging in myriad other schemes. The newly disclosed notes underscore the need for a federal security czar to oversee and direct the anti-terrorism activities of Canadian agencies that might otherwise trip over one another, said University of Ottawa law professor Craig Forcese.

rabble.ca 20/07/2015 - On July 8, the Standing Senate Committee on National Security and Defence released its interim report on Countering the Terrorist Threat in Canada: the result of a nine-month-long investigation into the problem of radicalization and violent extremism in Canada. However, instead of producing new insights, the report simply reproduces old and discredited stereotypes. [...] Disappointingly and disturbingly, the Senate Committee's report exemplifies the problems with the Conservative Party's ideological -- as opposed to empirical -- approach to counterterrorism. The committee's fixation on Islam and Muslims is bewildering, considering that the most fatal incident of post-9/11 terrorist violence cited in the report -- Anders Breivik's shooting spree, which killed 77 Norwegian citizens in July 2011 -- was the product of right-wing, racist, anti-Muslim ideology: not radical Islam. Moreover, Lieutenant Sylvain Guertin, Chief of the Sûreté du Québec's Division of Investigations on Extremist Threats, was quoted in the report as stating that "the majority of the service's active files deal with the extreme right": again, not radical Islam. [...] Since the committee's threat assessment is clearly not based on attention to research, facts, or data (including facts and data collected in the course of its own investigation), it is apparently driven by some other motivation. Indeed, it is difficult to interpret the report as anything another than cynical manipulation of racist stereotypes to rationalize expansion of the national security state.

Petition: Call a Coroner's Inquest in to Abdi's death 

End Immigration Detention Network - Abdi had been in immigration prison without charges, trial or date of release for three years at the time of his death in a maximum security prison in Lindsay, Ontario. Days after his death, 88 immigration detainees imprisoned at the same prison, the Central East Correction Centre, defied sanctions to issue a joint petition calling for an inquiry into their friend's death. We at the End Immigration Detention Network have just been able to access to this petition. It reads:
* Coroner's inquest must happen and made public.
* Thorough inquest, must include talking to detainees.
* Implementation (of recommendations) from the inquest must be made immediately.
* The parties responsible must be made accountable.

The ICLMG is a national coalition of thirty-eight Canadian civil society organizations that was established in the aftermath of the September, 2001 terrorist attacks in the United States.
