New Overtime Pay Rules Announced
On May 18, 2016, President Obama and Secretary Perez announced the publication of the Department of Labor's final rule updating the overtime regulations, which will automatically extend overtime pay protections to over 4 million workers within the first year of implementation.
Key Provisions of the Final Rule The Final Rule focuses primarily on updating the salary and compensation levels needed for Executive, Administrative and Professional workers to be exempt. Specifically, the Final Rule: 1. Sets the standard salary level at the 40th percentile of earnings of full-time salaried workers in the lowest-wage Census Region, currently the South ($913 per week; $47,476 annually for a full-year worker);
2. Sets the total annual compensation requirement for highly compensated employees (HCE) subject to a minimal duties test to the annual equivalent of the 90th percentile of full-time salaried workers nationally ($134,004); and
3. Establishes a mechanism for automatically updating the salary and compensation levels every three years to maintain the levels at the above percentiles and to ensure that they continue to provide useful and effective tests for exemption.
Additionally, the Final Rule amends the salary basis test to allow employers to use nondiscretionary bonuses and incentive payments (including commissions) to satisfy up to 10 percent of the new standard salary level. The effective date of the final rule is December 1, 2016. The initial increases to the standard salary level (from $455 to $913 per week) and HCE total annual compensation requirement (from $100,000 to $134,004 per year) will be effective on that date. Future automatic updates to those thresholds will occur every three years, beginning on January 1, 2020.

Wild West Extravaganza
Stampede week will be the next 'big event' week here in Cody. We are now preparing for the Wild West Extravaganza Arts and Crafts Fair set to take place July 2-4 next to City Park. This will be the second year the Chamber has managed Extravaganza and we are again happy to welcome both local members and out of town vendors to the event. Did you know that as a Chamber member, there are discounted booth options? Non-profit rate is $25, arts and crafts vendor is $175, and food vendors are $375. This price is for all three days of the event.

Bridge and slide repairs, pavement improvements set on Chief Joseph Scenic Highway A $3.84 million highway improvement project is scheduled to begin this month north of Cody on Wyoming 296 (Chief Joseph Scenic Highway).
The project includes $1.7 million in repairs to a slide in Paint Creek Canyon that began moving last May, repairs to the Pat O'Hara Creek bridge, and a 13.32-mile pavement rehabilitation project of Chief Joseph Scenic Highway from its intersection with Wyoming 120 to the top of Dean Indian Pass (milepost 33.20). Wyoming Department of Transportation resident engineer Todd Frost of Cody said prime contractor Oftedal Construction, Inc., of Casper is scheduled to begin work May 30, weather permitting, with scaling of loose rock in Paint Creek Canyon and epoxy deck overlay work on the Pat O'Hara Creek bridge. "One-way traffic will be moved over the Pat O'Hara Creek bridge with the use of traffic signals, and traffic will be flagged where the rock scaling work is taking place in Paint Creek Canyon," Frost said. Frost said the contractor is scheduled for slide repairs in Paint Creek Canyon from mid-June to August. "During the slide repairs, traffic will be carried on a one-way detour with traffic signals and flaggers. Traffic delays of up to 20 minutes are expected during this work," Frost said. The Paint Creek slide repairs are between mileposts 35.58 and 35.90, just east of Northwest College's A.L. Mickelson Field Station. The contractor's schedule calls for paving in August. During paving, traffic delays of up to 20 minutes with flaggers and a pilot car operation will be used. Chip sealing of the project is scheduled in June 2017. The Chief Joseph Scenic Highway project is between mileposts 33.20 (the top of Dead Indian Pass) and 46.20 (the intersection of Wyoming 296 and Wyoming 120). The Wyoming Transportation Commission awarded the $3.84 million project to Oftedal Construction, Inc., this month. The contractor's scope of work includes shoulder flattening, a 1 1/2-inch pavement overlay, a chip seal, and slide repair in Paint Creek Canyon, with new reinforced fill, the epoxy overlay of the Pat O'Hara Creek bridge and other work on 13.32 miles of Wyoming 296 (Chief Joseph Scenic Highway) north of Cody. City of Cody - Did You Know?
If you are a commercial business owner and you own the property within which your business is housed and the property is appropriately zoned, you have certain rights allowed by the City code to perform your own improvements. A commercial property owner may act as their own general contractor for commercial property or residential property in which they do not reside subject to the conditions and limitations of the City Code. Where a property owner is acting in this capacity, all work shall be performed by licensed subcontractors, and the property owner shall not perform any of the work, except as otherwise allowed by this section. All work shall be permitted and inspected by the building official, and shall comply with the current codes in effect. A property owner may complete minor alterations, repairs, improvements, such as minor trim work, carpeting, painting, flooring, window coverings and other cosmetic work. Property owners, who are not licensed contractors, shall not perform work which involves structural components, electrical, plumbing, mechanical work, roofing, or any other work which is required by City code shall be performed by a person with a class A, B or C contractor's license.
If you are leasing/renting property within which you are conducting your business, all work shall be permitted and inspected by the building official, and shall comply with the current codes in effect. The City of Cody has "Home Rule" regarding the regulation and enforcement of building codes as they apply to commercial buildings. The "Home Rule" designation allows the City to be more responsive to the construction and inspection needs of the business community of Cody. The "Home Rule" benefits however come at a cost; regarding commercial construction, the City must adopt all the building code requirements as adopted by the State.
