Feds Issue Clarification on Community Rule for Non Residential Programs

Late yesterday, the U.S. Department of Health and Human Services-Center for Medicare & Medicaid Services issued further clarification on its position of ensuring that Home and Community Based Funds are used exclusively for community based programs, and not "institutional services".

The clarifications for day and employment programs and other non-residential services are similar to earlier regulations released by CMS for residential programs.

ADDP Attorney Tara Zelter is preparing an analysis which will be shared later this week.

At first blush it appears that CMS is once again givng latitude to each state to furrther define and clarify its plan for providing services  with an emphasis on an outcomes based approach.
