Are You Ready for Medicare's New Payment Models? We expect that CMS will finalize the rule to implement MACRA in November. If finalized as drafted the reporting period will begin on January 1, 2017. If you fail to follow the rule in 2017 (the reporting year) you will be penalized in 2019. That means that practices must start taking steps to be ready now. Read AMA's checklist and start planning now. MSNJ filed comments requesting that the reporting period not commence on January 1. But even if CMS delays the first reporting period, practices must comply with the rule during 2017 or be penalized in 2019. Read more.

The data is available to all. The press digests the data and makes it available to the public in a user friendly manner. Physicians Advocacy Institute Weighs in on Mega-Mergers Physicians Advocacy Institute (PAI), of which MSNJ is a founding member, has weighed in on the Department of Justice's legal challenges to the two proposed insurance mega mergers. Larry Downs, MSNJ's CEO, serves on PAI's compliance committee.

Drug Abuse
US Surgeon General, Vice Admiral Vivek H. Murthy, MD, MBA, is on a national tour to promote opioid abuse prevention and reduction strategies and came to New Jersey this week. In addition to the Surgeon General's effort, the President recently signed the Comprehensive Addiction and Recovery Act (CARA). Though the law is not fully funded, advocates are hopeful for the expansion of prevention and treatment options. See AMA's support for the bill. Read more.

 | Cardiologist Agrees to Three Year Exclusion from Federal Healthcare Programs A Florida cardiologist has agreed to pay $2 million, release claims to $5.3 million, be excluded from participation in any federal health care program for three years, and upon exclusion expiration, be placed in a three year integrity program by the Office of the Inspector General. This settlement will resolve allegations that he billed Medicare and other federal programs for "excessive, medically unnecessary and inadequately documented peripheral artery interventional services and related procedures." The federal government also alleged that he routinely and indiscriminately waived the 20% Medicare co-payment. Read the Department of Justice press release.

Advocate Health Care Settles Potential HIPAA Penalties for $5.55 Million
Advocate Health Care Network has agreed to settle with the US Department of Health and Human Services, Office for Civil Rights for $5.55 million for multiple potential HIPAA violations involving electronic protected health information (ePHI). The breaches involved its subsidiary, Advocate Medical Group ("AMG"). The combined breaches affected the ePHI of approximately 4 million individuals. The ePHI included demographic information, clinical information, health insurance information, patient names, addresses, credit card numbers and their expiration dates, and dates of birth. Read more.
