 MSNJ Celebrates its 250th Anniversary
Nearly 300 physicians, families, and friends attended the 250th Anniversary Gala on July 23 in New Brunswick, the date and site of the formation of the Medical Society of New Jersey. Mishael Azam Honored by Middlesex County

On the 200th Anniversary of Middlesex County and 250th Anniversary of MSNJ, Mishael Azam was honored with the 2016 Reverend Doctor Robert McKean President's Award for her untiring effort to address legislative and regulatory challenges facing New Jersey physicians and their patients.

MSNJ Weighs-in On VHA System Rule Proposal

This week MSNJ filed comments on the Veterans Health Affairs rule proposal that would permit nurses to render services in the VA system, independently, and without physician supervision. The proposal would also permit CRNAs to administer anesthesia without the same level of physician supervision that is required by New Jersey laws and regulations. On behalf of MSNJ, our President Joseph P. Costabile, MD, who also serves as Captain in the 4th Medical Battalion under the 4th Marine Logistics Group, urged the VHA not to adopt the proposal and, instead, to provide our veterans with the same level of care that is afforded all citizens in the state. Dr. Costabile has made healthcare delivery to veterans a priority for his presidency. MSNJ also signed on to the AMA's comments and those of the Coalition of State Medical Societies, an advocacy group of ten state medical societies.
 
Physicians Advocacy Institute Lauds DOJ's Decision to Challenge Mega-Mergers---Plans Next Steps

The Physicians Advocacy Institute (PAI), of which MSNJ is a founding member, applauds the decision of the U.S. Department of Justice (DOJ) to take legal action to block health insurance company mergers being proposed by Aetna and Humana and Anthem and Cigna. PAI urged the DOJ to make this move months ago based on the anticompetitive impact that these proposed mergers would have on the market for health insurance in states across the nation. PAI continues to work on the merger matters to ensure the DOJ's success in litigation and its continuing efforts to protect competition in healthcare delivery. Larry Downs, MSNJ's CEO, serves on the Compliance Committee of PAI.

Connecticut's Consumer Protection Law Establishes UCR for Out of Network Emergency Services---State Designates Fair Health as it Benchmark

Connecticut designated Fair Health's claims repository as the official database for determining reimbursement for emergency services rendered by out of network physicians. Under Connecticut's "Benchmark Database Public Act" which became effective last month, out of network physicians may bill the insurer directly for emergency services. Reimbursement will be the greater of: the in network rate; Medicare's rate, or the usual, customary and reasonable rate based on the eightieth (80th) percentile of all
charges for the particular healthcare services performed by a healthcare provider in the same or similar specialty and provided in the same geographical area. Read more
DOBI Announces Recovery of $3.5 million in PIP Insurance Fraud Cases

The New Jersey Department of Banking & Insurance announced the recovery of $3.5 million in fines, penalties, and attorneys' fees in PIP insurance fraud cases against a number of healthcare practitioners and facilities. The case was originally brought by Allstate Insurance against Gregorio LaJara and alleged a broad fraudulent scheme against it and other insurance companies to collect personal injury protection benefits. Allstate recovered over $20 million in damages, attorneys' fees, settlements and judgments. At issue was the operation of ten chiropractic facilities through a scheme that included physicians, chiropractors, medical imaging, pain management, medical equipment and their services and billing practices. NJ Supreme Court: Defendants in Insurance Fraud Cases are Entitled to a Jury Trial

The New Jersey Supreme Court ruled in Allstate New Jersey Insurance Co. v. Lajara that two of the defendants in the IFPA cases, a physician and an imaging company, are entitled to a jury trial. At issue was whether the relief sought for violations of the Insurance Fraud Prevention Act (IFPA), which includes treble damages, required the traditional common law right of a trial by jury. In an opinion that traced the formation of our country and New Jersey's first Constitution, the Supreme Court found that defendants in IFPA matters are entitled to a jury trial. MSNJ filed an amicus brief in the matter of Allstate v. Northfield Medical Center which is currently pending before the New Jersey Supreme Court. There, we argue that the standard of proof in IFPA cases requires actual knowledge of a violation.
Insurance Coverage for Physician Assistants

The Physician Assistant Modernization Act becomes effective on August 1. The Board of Medical Examiners, in consultation with the Physician Assistant Advisory Committee, advised in a letter that they intend to propose regulations that will require either malpractice coverage or a letter of credit in the amount of $1 million per occurrence and $3 million per policy year. Practices are urged to review the professional liability coverage for their physician assistants.

The next meeting of the Revolving Reference Committee is Monday, August 22 at 7:00 pm via webinar. All resolutions must be vetted by your County Medical Society prior to submission to MSNJ. Resolutions are due from the County Medical Societies by August 10. Read the instructions on writing a resolution.
