VA Health System Needs Comprehensive Overhaul
A bipartisan panel created in 2014, the Commission on Care, has issued its report and recommends a wholesale overhaul of the Veterans Affairs health system. Among the report's 17 recommendations is one to set up community networks staffed by independent providers who are credentialed by the VA. Another recommendation is to allow providers to work at the top of their licensure and skill level, including optimized use of advanced practice registered nurses (APRNs). Read more. 
 
MSNJ has been a leader in seeking transparency and reform of the VA health system over the past few years. Our efforts have resulted in AMA policy which urges The Joint Commission to make public its findings after its resurvey of VA facilities to ensure quality of care and patient safety.  MSNJ's president, Joseph Costabile, MD, has made healthcare delivery for veterans a priority. 
MSNJ Asks Congress to Modify the Sunshine Law
MSNJ has signed onto a letter to Senator Barrasso in support of S.2978, the "Protect Continuing Physician Education & Patient Care Act" which would correct CMS's misinterpretation of the Sunshine Act---requiring the reporting of value for medical textbooks, reprints of peer-reviewed scientific clinical journal articles and abstracts as not being exempt under the provision "educational materials that directly benefit patients or are intended for patient use." The bill would also clarify that CME that meets the standard for independence would also be exempt from Sunshine Act reporting. MSNJ has been a long-time advocate on these two issues.
 
MSNJ Weighs in on Professional Responsibility Reporting Act
Last week MSNJ filed comments with the Division of Consumer Affairs and Department of Health concerning proposed regulations to implement the Healthcare Professional Responsibility & Reporting Enhancement Act. The act was passed in 2005 in the wake of the murder of patients by a nurse while employed in New Jersey. It requires healthcare entities to report information related to competence and adverse patient safety events. We urged the state to reconsider the requirement for a healthcare entity to provide performance evaluations to other inquiring entities as these evaluations may contain information not related to patient care and safety. We also urged that the reporting requirement related to voluntary resignation or relinquishment of privileges be clarified to exclude circumstances unrelated to patient care, such as a leave of absence to care for a sick family member. Finally, we urged that reports only be made after a provider has been given notice of an investigation. This, because the proposal permits reporting of a voluntary separation that occurs even upon the mere "expression of an intention" by any member of the medical or administrative staff to conduct a review that might trigger a reporting obligation.
 
2015 Open Payments Financial Data Released
CMS published the 2015 Open Payments Financial Data along with newly submitted and updated payment records for 2013 and 2014. In 2015, health care industry manufacturers reported $7.52 billion in payments and ownership and investment interests to physicians and teaching hospitals. This amount is comprised of 11.90 million total records attributable to 618,931 physicians and 1,116 teaching hospitals. CMS is scheduled to refresh the Open Payments data in early 2017 to reflect updates to the data. More information.  
Form to Request Additions of Qualifying Conditions to the New Jersey Medicinal Marijuana Program
The Department of Health posted a petition form to request approval of additional medical conditions to be added to the New Jersey Medicinal Marijuana Program. Petitions will be accepted from August 1 through August 31. Access the petition and public notice, which includes requirements for the petition.

MSNJ congratulates Dr. William F. Muhr and Dr. Emmanuel F. Ashong on being recognized by South Jersey Biz as two of twenty healthcare professionals who are shaping the future of medicine in South Jersey. Dr. Muhr is the CEO of South Jersey Radiology and has been a member since 1991. Dr. Ashong is the Director of Medical Education and Medical Director of Osborn Family Health Center at our Lady of Lourdes Medical Center. Dr. Ashong has been a member since 1998, serving a member of the MSNJ Continuing Medical Education Committee for all these years, and Vice-Chair for the last 15 years. Dr. Ashong has also been awarded the Lourdes' Health System 2016 Healing Spirit Award.
HIPAA Settlement
Catholic Health Care Services of the Archdiocese of Philadelphia (CHCS) has agreed to pay $650,000 in potential violations of the HIPAA Security Rule after the theft of a CHCS mobile device compromised the protected health information of 412 nursing home residents. Read the resolution agreement and corrective action plan.

Currently in its 5th year, the 2016 New Jersey Health Care Monitor has become an important barometer for the state of the practice of medicine in New Jersey.
