NJ Primary Election
New Jersey's primary election was on Tuesday. Clinton won the Democratic primary and Trump won the Republican primary. Read the full details on the presidential, congressional and local June races.
Drug Abuse
As previously reported, MSNJ has been helping physicians learn best practices through free CME courses and other means, in order to help reduce opioid diversion and misuse. However, we oppose legislative mandates on the practice of medicine. MSNJ opposed S2035, which would limit opioid prescriptions, even for patients in severe pain, in the Senate Health Committee on Monday. Read our letter.

OMNIA Litigation Update
In response to ten Tier 2 hospitals' legal challenge to state approval of the Horizon OMNIA program, an appellate division court found that the plans comply with the state's network adequacy requirements and that the approval process was adequate.  The court also found that the Department of Banking & Insurance was not required to determine whether the OMNIA program was in the public interest.In general, the court took a restrained approach bound by the limits of authority granted to the Department. It acknowledged that legislation was necessary to support the Tier 2 hospitals' arguments. Read more.

Two cases filed by Tier 2 hospitals against Horizon will proceed. This week, the same appellate division panel that affirmed the Department's approval of OMNIA, considered whether Horizon documents may be discovered by the Tier 2 hospitals. The hospitals believe that the documents are essential to prove their claims; Horizon argues that the documents contain trade secrets. Trinitas has announced that it is dropping out of its suit and joining a value based partnership with Horizon. Read more. This week the appellate division also heard argument on whether Horizon documents which contain information about the OMNIA Alliance are discoverable by the Tier 2 hospitals.  
Practice Alert! Federal Rule on Nondiscrimination in Health Programs and Activities
The US Department of Health & Human Services has finalized its rule requiring nondiscrimination in health programs and activities. It is meant to improve health equity under the Affordable Care Act and prohibits discrimination based on race, color, national origin, sex, and or disability. The rule prohibits discriminatory practices by health care providers who accept Medicare and Medicaid.  Importantly, it includes new provisions with respect to patients with limited English proficiency and the deaf.

Medicaid FFS Provider Re-validation Required; Termination Effective July 1 for Non-Compliance
NJ Medicaid has been in the process of re-enrolling and re-validating physicians who participate in the NJ Medicaid Fee-for-Service (FFS) program, since July 2015. Under the Affordable Care Act, this process must be completed by September 2016. Physicians who have not responded to NJ Medicaid's requests for re-validation/re-enrollment by JULY 1 will be terminated from the program. Termination will also negatively impact physicians who participate with Medicaid Managed Care plans and use the State's eligibility system for information.  If you received a re-validation/re-enrollment request from NJ Medicaid, it is important that you return the application as soon as possible to avoid termination. 20th Health Commissioner gets Sworn in
On Tuesday, Cathleen D. Bennett was sworn in as the 20th Commissioner of the New Jersey Department of Health. She joined the Department as Director of Policy and Strategic Planning in August 2010, where she directed strategic public health and healthcare delivery initiatives including healthcare quality assessment, health statistics and informatics, population health and health equity, regional health planning, and health information technology. New Consumer Tools Explain HIPAA Right to Access Health Information
The Office for Civil Rights (OCR) and the Office of the National Coordinator for Health IT released new consumer tools that explain the HIPAA right to access health information:
Novitas' Interactive Voice Recognition Unit
Read Novitas Solutions' third educational article in the campaign to raise awareness regarding the enhancement to Novitas' Interactive Voice Recognition (IVR) Unit that will allow providers to conduct and unlimited number of claim corrections for select Medicare Part B claims via the Novitas IVR.
Medicare Opt-Out Reminder
CMS recently updated its manual language to reflect changes in the Medicare opt-out procedures, due to MACRA.  Physicians who have opted-out are reminded that:
  • If your opt-out affidavit was signed BEFORE June 16, 2015: Your opt-out status will expire 2 years after the effective date. If you wish to remain opted-out, a renewal affidavit must be filed within 30 days of the expiration of the current opt-out period.
  • If your opt-out affidavit was signed AFTER June 16, 2015: Your opt-out status will automatically renew every two years. If you no longer wish to be opted-out, you will need to cancel the renewal at least 30 days prior to the start of the next opt-out period.
