A Message from the CEO:
The Physicians Foundation is still taking responses for its fourth national survey, one of the largest physician surveys ever undertaken in the United States. MSNJ encourages all physicians to take this 10-12 minute survey that will allow physicians to share their thoughts on health reform, electronic medical records, new methods of physician reimbursement, ICD-10, and a variety of other topics. Participants will be entered to win one of five $500 Amazon gift cards and one $5,000 Amazon gift card. A full copy of the final survey report will be emailed to all physicians who participate. OMNIA Litigation Update
The appellate division denied the motion of the Association of New Jersey Chiropractors for permission to file an amicus brief in the law suit brought by Tier 2 hospitals against the New Jersey Department of Banking & Insurance. The court previously granted MSNJ's motion to file an amicus brief. The case was heard on May 25. We await a decision.

OCR Clarification of Permissible Fees for Copies of PHI
The Office for Civil Rights (OCR) provided clarification about the amount that an individual may be charged for a copy of their protected health information (PHI) in a new FAQ. The FAQ specifically clarifies that $6.50 is not the maximum amount that can be charged for all individual requests for a copy of PHI under the right of access. Entities may choose the fee calculation method that is most appropriate for their circumstances, within the boundaries of what is permissible under the Privacy Rule. More information.

Medicare Opt-Out Reminder
CMS recently updated its manual language to reflect changes in the Medicare opt-out procedures, due to MACRA. Physicians who have opted-out are reminded that:
- If your opt-out affidavit was signed BEFORE June 16, 2015: Your opt-out status will expire 2 years after the effective date. If you wish to remain opted-out, a renewal affidavit must be filed within 30 days of the expiration of the current opt-out period.
- If your opt-out affidavit was signed AFTER June 16, 2015: Your opt-out status will automatically renew every two years. If you no longer wish to be opted-out, you will need to cancel the renewal at least 30 days prior to the start of the next opt-out period.
