Physician Alert! Open Payments Review and Dispute Period- Closes May 15
Physicians and teaching hospitals have until May 15 to review payments attributed to them. Drug and medical device makers are required to report certain payments made to physicians and teaching hospitals on an annual basis. Participation in the program is voluntary, but encouraged so that physicians and teaching hospitals can review and, if necessary, dispute payments before the information is made public on June 30, 2016. To review the data by May 15, you must register in both the CMS Enterprise Portal and the Open Payments system. If you registered last year, you do not need to register again in both systems.

Physician Alert! Medicare's Proposed Payment Rule
The Medicare Access and CHIP Reauthorization Act of 2015 (MACRA) changes the way Medicare rewards clinicians for providing quality care by streamlining multiple quality programs into a new Quality Payment Program tied to Part B Fee-For-Service payments. With the implementation of MACRA and the replacement of the Sustainable Growth Rate, Medicare will pay clinicians participating in the Merit-based Incentive Payment System or Advanced Alternative Payment Models of the Quality Payment Program beginning in 2019. OMNIA Litigation Update:
MSNJ's Amicus Brief:
We previously reported that Horizon and the New Jersey Department of Banking & Insurance (DOBI) opposed our motion for permission to file an amicus brief in the case challenging DOBI's approval of the OMNIA program. The appellate division denied those motions and allowed our brief to be filed. Subsequently, both parties sought permission from the court to respond to our amicus brief. Those motions were granted. The case is scheduled for a hearing on May 25.
St. Peter's Case against Horizon: The trial court ruled in the St. Peter's case against Horizon concerning the OMNIA program. St. Peter's brought claims for breach of contract and sought to be designated as a Tier 1 hospital. While the trial court dismissed some causes of action, including allegations of unfair competition and defamation, it found that the contract causes of action, including implied covenant of good faith and fair dealing and tortious interference with prospective economic advantage, may proceed. The dismissed causes of action were without prejudice so St. Peter's may seek relief on those causes of action in the future. Read more.
Tier 2 Hospitals Case Against Horizon:
One of seven Tier 2 hospitals that filed suit against Horizon over the OMNIA program has taken a voluntary dismissal. Read more. The voluntary dismissal does not affect the status of the case. Both cases against Horizon have been slowed by a discovery dispute which Horizon has raised to the appellate division.

The Workgroup for Electronic Data Interchange is conducting a survey of industry stakeholders on usage of the standard electronic transaction for prior authorization. The survey is specifically looking to collect information on the current usage and barriers to widespread implementation of the 278 standard electronic transaction for medical services prior authorization.
