Physician Alert! Medicare's Proposed Payment Rule
The Medicare Access and CHIP Reauthorization Act of 2015 (MACRA) changes the way Medicare rewards clinicians for providing quality care by streamlining multiple quality programs into a new Quality Payment Program tied to Part B Fee-For-Service payments. With the implementation of MACRA and the replacement of the Sustainable Growth Rate, Medicare will pay clinicians participating in the Merit-based Incentive Payment System or Advanced Alternative Payment Models of the Quality Payment Program beginning in 2019. CMS Face to Face Requirement Update
As previously reported and discussed at last year's PSP, we have been working to reduce the administrative burden of this requirement for home health referrals. The NJ Hospital Association and National Government Services are hosting a webinar on Friday, May 20 at 2:30 p.m. that will focus on the early lessons learned and trends from the audits of face-to-face encounter documentation. FSMB Does Not Adopt Policy Statement on Compounding The Federation of State Medical Boards conducted its annual meeting the last weekend in April and considered a statement on compounding by physicians. Some member allergists and immunologists objected to the policy and provided information to MSNJ that we shared with our Board of Medical Examiners before the FSMB annual meeting. We appreciate our state board's consideration of our members' concerns. The FSMB declined to adopt the policy statement. Read more.

DOJ Objects to Dismissal of Deaf Litigant's Law Suit against Newark Physicians are urged to take heed of the Federal Government's position in a case concerning the requirement to provide sign language interpreters. A deaf individual sued the Newark Municipal Court for failing to provide him with a sign language interpreter during a court proceeding. Newark subsequently moved to dismiss the complaint. The U.S. Department of Justice filed a statement of interest objecting to a dismissal and asserting that the litigant has stated a valid claim under the Americans with Disabilities Act because he was excluded from full participation in the proceedings. Ex-Horizon Employee Alleges that Company Systematically Underpaid Claims An ex-employee of Horizon, who is engaged in litigation over wage discrimination, is also alleging that the company systematically underpaid claims. She alleges that underpayments were the result of a computer programming error and involved emergency care and pre-existing conditions. Horizon denies the allegations. Read more.

WEDI Prior Authorization Survey
The Workgroup for Electronic Data Interchange is conducting a survey of industry stakeholders on usage of the standard electronic transaction for prior authorization. The survey is specifically looking to collect information on the current usage and barriers to widespread implementation of the 278 standard electronic transaction for medical services prior authorization. Please take this survey by May 13.

Open Payments Review and Dispute Period- Closes May 15
Physicians and teaching hospitals have until May 15 to review payments attributed to them. Drug and medical device makers are required to report certain payments made to physicians and teaching hospitals on an annual basis. Participation in the program is voluntary, but encouraged so that physicians and teaching hospitals can review and, if necessary, dispute payments before the information is made public on June 30, 2016. To review the data by May 15, you must register in both the CMS Enterprise Portal and the Open Payments system. If you registered last year, you do not need to register again in both systems.
