Legislative Update
Tort Reform
Assemblywoman Nancy Pinkin introduced legislation to improve the affidavit of merit process. The bill would raise the bar for courts to waive the same-specialty affidavit of merit requirement for cases against physicians.

MSNJ, specialty societies and the NJ Civil Justice Institute support this bill, which will help many professionals against frivolous litigation, not just physicians. Stay tuned for action on this bill. 
Drug Abuse
The New Jersey Prescription Monitoring Program is being improved. We will now have interoperability with New York so physicians can see patient information from both states. Read more.

Tiered Networks
MSNJ is raising concerns with the state Department of Banking and Insurance about notice required of physicians participating in OMNIA. The policy, which comes with a record-keeping requirement and penalty, states that "participating physicians and other health care professionals who are treating/coordinating the care of members and/or dependents enrolled in an OMNIA Health Plan are required to discuss the cost sharing implications of using physicians, other health care professionals and facilities designated as OMNIA Tier 1 or Tier 2 with their patients or the parents, guardians or designated personal representatives of patients enrolled in an OMNIA Health Plan." CMS Releases Proposed Medicare Payment Rule to Implement MACRA
The historic Medicare Access and CHIP Reauthorization Act (MACRA) repealed Medicare's flawed payment formula and replaced it with new physician payment policy that will allow new payment models. This week CMS released its proposed rules to implement those changes. AMA's President Steven J. Stack, MD, issued a statement that:
Our initial review suggests that CMS has been listening to physicians' concerns...In particular, it appears that CMS has made significant improvements by recasting the electronic health record (EHR) meaningful use program and by reducing quality reporting burdens.
The 962-page proposed rule appears to: reduce quality reporting measures; not require all-or-nothing EHR measurement or redundant quality reporting; and, reward physicians for clinical practice improvements based on care coordination, patient engagement and patient safety. "This proposed rule gives us an opportunity to provide thoughtful feedback to CMS in order to secure further improvements in the final regulations," Dr. Stack said. Read more.
Settlement Illustrates Need for HIPAA Business Associate Agreements
Raleigh Orthopaedic Clinic, P.A. of North Carolina has agreed to pay $750,000 to settle charges that it potentially violated the HIPAA Privacy Rule by handing over protected health information for approximately 17,300 patients to a potential business partner without first executing a business associate agreement. Read the resolution agreement and corrective action plan. 
New Jersey Orthotics and Prosthetics Board of Examiners Vacancy
The Governor's Office of Appointments is looking for medical/surgical physician candidates to nominate to the New Jersey Orthotics and Prosthetics Board of Examiners. They are also in need of recommendations for prosthetic users who are unaffiliated with the industry and would be interested in serving on the Board. This board is responsible for regulating the sale of orthotic and prosthetic devices, which are devices used to enable the disabled to function better and increase their mobility. The board licenses orthotists and prosthetists. This position is a three year term. More information. 
De Groote Award Nominations
MSNJ is accepting nominations for the De Groote Award which will be conferred at the MSNJ Inaugural Gala of the incoming 224th President, Joseph Costabile, MD on July 23, 2016. The De Groote Award was established by resolution to honor the selfless work of Dr. Robert De Groote in service to the medical profession. The De Groote Award will be given to the individual whose selfless and idealistic work benefits humankind and not him or herself.

Nominations should be made by submitting a
brief narrative to info@msnj.org by the close of business on Friday, May 6, 2016.
Lifetime Achievement Award
MSNJ is accepting nominations for the Lifetime Achievement Award, which will be presented at the Inaugural Gala of the incoming 224th President, Dr. Joseph Costabile, on July 23, 2016. Submit a short paragraph to info@msnj.org describing their commitment to the Medical Society.

CMS Delays Enforcement of the Medicare Part D Prescriber Enrollment Requirements to February 1, 2017
CMS is now recommending that physicians, who write prescriptions for covered Part D drugs and are not currently enrolled in or opted out of the Medicare Program, to submit an enrollment application or an opt-out affidavit to Novitas by August 1, 2016. Read more. You may submit your enrollment application electronically using the Internet-based  Provider Enrollment, Chain, and Ownership System (PECOS) or by completing the paper CMS-855I or CMS-855O application. Due to member concerns, MSNJ has asked for guidance from Novitas on how this requirement affects physicians with retired active (reduced fee) license status. Novitas has confirmed that retired active licensees may file an opt-out affidavit, or the CMS-855O
 application as an alternative to opting out, in order to continue prescribing for Part D beneficiaries. More information
