MSNJ Defends Constitutionality of Affidavit of Merit Statute
The New Jersey Supreme Court previously granted MSNJ leave to file an amicus brief in the case of Meehan v. Antonelllis on the issue of the constitutionality of the affidavit of merit statute. Later, the court granted permission on our request for oral argument on this important issue. The oral argument is now scheduled for the week of March 14. The affidavit of merit requirement in a medical malpractice case is an important element of tort reform, advocated and achieved by MSNJ. It has curtailed the filing of claims that are without merit. We will keep members apprised of the date for oral argument and developments on this case. |
