Out of Network Legislation
The Assembly Financial Institutions and Insurance Committee released A.4444, the "Out-of-network Consumer Protection, Transparency, Cost Containment and Accountability Act." MSNJ continues to oppose this legislation. See press coverage and our recent quote.

OMNIA Tiered Network
Mercer County Medical Society President, Dr. Steven Orland, and MSNJ lobbyist, Mishael Azam, testified about concerns regarding physician contracts and network adequacy at a joint committee hearing on tiered networks this week. See press coverage. More press coverage.
On Monday, DOBI Acting Commissioner Richard J. Badolato issued a 40-page order denying a request by the Tier 2 hospitals to delay OMNIA's implementation.

Drug Abuse
Abuse Deterrent Drugs MSNJ member, Dr. Peter Staats, has published an opinion piece in favor of abuse deterrent drugs. MSNJ supports A.4271.
Physician Mandates MSNJ continues to help physicians with the implementation of the PMP law. See our guidance. We are also opposing further physician mandates in the form of statutory requirements for uniform and documented informed consent. See our press statement.

Federal Legislation - Promoting Access, Competition, and Equity Act of 2015 or the PACE Act of 2015
MSNJ has signed on to a letter supporting this bill, which would partially lift the ban on new physician-owned hospitals and also address limitations on the growth of existing facilities. Under current law, expansion of physician-owned hospitals is subject to certain limitations, such as those regarding the extent and frequency of expansion and requiring community output. The bill suspends these limitations with respect to applications for expansion filed before October 1, 2019. Read more.

December 16 Deadline to Request PQRS and Value Modifier Informal Review
Time is running out to file an informal review, if you think your practice has been incorrectly assessed for the 2016 PQRS and/or Value Modifier negative payment adjustments. Your practice could face a Medicare payment cut of up to 2-4%, if you do not successfully participate in these programs. Submit your request for PQRS and/or Value Modifier informal review online through the Quality Reporting Communication Support Page. Read the CMS tipsheet for more information. Please note, the informal review system will be periodically down for maintenance from December 3-7.

Philadelphia Medical School to Open Branch Campus at Two Atlantic Health Hospitals
Atlantic Health System and the Sidney Kimmel Medical College at Thomas Jefferson University have signed an agreement establishing a branch campus of the medical school at Atlantic's hospitals in Morristown and Summit. Read more.

Lahey Hospital and Medical Center HIPAA Settlement over Stolen Laptop
Lahey Hospital and Medical Center has agreed to pay $850,000 for potential violations of the HIPAA Privacy and Security Rules with the Department of Health and Human Services, Office for Civil Rights.
Lahey Hospital reported a stolen laptop from an unlocked treatment room during overnight hours on August 11, 2011. Along with the settlement, they will have to adopt a robust corrective action plan to correct deficiencies in their HIPAA compliance program. Read the resolution agreement and corrective action plan.

PIP and ICD-10
PIP carriers are not considered covered entities under HIPAA and therefore are not obligated to transition to ICD-10. However, it is our understanding that many PIP carriers in NJ are already accepting claims with ICD-10 codes. The Department of Banking and Insurance recently updated its ICD-10 transition guidance regarding PIP Attending Provider Treatment Plans. Read DOBI's FAQ for more information.
