CMS Adopts Final Medicare Physician Fee Rule
On October 30, 2015 CMS finalized the Medicare Physician Fee Rule. Among the items for which MSNJ advocated:
  • Physicians who opt-out will not need to renew this status every two years; instead, they may cancel their renewal 30 days prior to the next two-year period.
  • Physicians may be paid for two advanced care planning services.
The rule requires further analysis which will be forthcoming. There are significant concerns that provisions on mis-valued codes may cut into the .5% fee update.  Read the CMS fact sheet and the rule for more details.
Meaningful Use Stage 3 - Call to Action
MSNJ, along with the AMA and nearly all of organized medicine, signed on to a letter to the House and Senate highlighting our frustration with CMS' choice to move forward with Stage 3 of Meaningful Use. Visit AMA's web site for an analysis of issues and a list of things that physicians can do to convey their issues to Congress. Participate in a call to action. 
New Jersey Council on Physical Fitness and Sports

Resolutions Due November 10
The next meeting of the Revolving Reference Committee is Monday, November 23 at 7:00 pm via webinar. All resolutions need to be vetted by your County Medical Society prior to submission to MSNJ. Resolutions are due from the County Medical Societies by November 10. Read the instructions on writing a resolution.

Election Results
The election for the New Jersey General Assembly and local positions was on Tuesday, November 3rd. There were a few upsets with incumbents losing seats and the Democrats gaining a larger majority. See results. Read more.
NJ Board of Medical Examiners Appointments
Two MSNJ member physicians from Union County have been appointed to the NJ BME. We congratulate Dr. Paul Carniol, immediate past President of MSNJ, and Dr. Nazar Haidri.

Physician Discipline
A California doctor was convicted of second-degree murder in connection with the overdose deaths of three patients. This is a major decision regarding physician liability for prescribing. Read more.

As a reminder, the PMP law goes into effect on November 1st (but delegation is not allowed until regulations are finalized). Read our guidance document.

ICD-10: One Month In
It has been one month since the October 1 start date for ICD-10 and we would like to hear about your experience. While we encourage members to report claims payment and processing issues related to ICD-10, we also want to hear about transitions that went well. Updated CMS Guidance on Meaningful Use Public Health Reporting Measure
Eligible Professionals (EPs) in Stage 1 must attest to 1 public health measure.
  • EPs may claim an alternate exclusion for up to 2 measures, if they were not planning to attest to the public health measure prior to the final rule being published.
  • For the remaining measure, EPs must attest OR meet the exclusion requirement.
Eligible Professionals (EPs) in Stage 2 must attest to 2 public health measures.
  • EPs may claim an alternate exclusion for the Syndromic Surveillance OR the Specialized Registry reporting measure, if they were not planning to attest to the public health measure prior to the final rule being published.
  • For the remaining two measures, EPs must attest OR meet the exclusion requirements.

The New Jersey Department of Health website includes information on immunizationand syndromic surveillance reporting options through the state. Read the CMS Frequently Asked Question for more information.

PQRS Informal Review Period Extended
CMS has extended the 2014 Informal Review period to November 23, 2015 for Individual eligible professionals, Comprehensive Primary Care practice sites, PQRS group practices, and Accountable Care Organizations (ACOs) that believe they have been incorrectly assessed for the 2016 PQRS negative payment adjustment. All informal review requests must be submitted electronically via the Quality Reporting Communication Support Page.

Value Modifier Informal Review Deadline Extended
CMS has extended the informal review period for the 2016 Value Modifier to November 23, 2015. The informal review process allows groups with 10 or more eligible professionals, as identified by their taxpayer identification number, that are subject to the 2016 Value Modifier to request a correction of a perceived error in their Value Modifier calculations.

Provider Enrollment Requirements for Writing Prescriptions for Medicare Part D Drugs
CMS has revised their article on Provider Enrollment Requirements for Writing Prescriptions for Medicare Part D Drugs to reflect the delayed enforcement of the Part D prescriber enrollment requirement until June 1, 2016.
