ERISA Plan Must Advise Physicians of Right and Time Limit to Sue for Denied Benefits The 3d Circuit Court of Appeals has found that there is an obligation on behalf of ERISA plan administrators to provide information in the notice denying benefits of the right to sue and any time limitation. In Mizra v. Insurance Administration of America, Dr. Mizra obtained an assignment of benefits which the parties agreed allowed him to step into the shoes of the patient to sue. The plan did not advise that there was a one year time limit to file and argued, unsuccessfully, that the suit was time-barred.
This case follows on another recent 3d Circuit Court of Appeals decision, North Jersey Spine & Brain v. Aetna, in which the court found that no particular "magic words" were required for the assignment of benefits to be effective; an assignment of the right to payment is sufficient to confer standing to sue. MSNJ, together with the AMA, filed an amicus brief in that successful case which is part of our legal advocacy on behalf of our members.

Comment Period Extension
CMS has announced that they will extend the comment period for the Request for Information for the Medicare Access and CHIP Reauthorization Act of 2015 (MACRA). The comment period will now close on November 17, 2015.

New Jersey Awarded Grant for Certified Community Behavioral Health Clinics
The Substance Abuse and Mental Health Services Administration (SAMHSA), as well as CMS and the Assistant Secretary of Planning and Evaluation (ASPE), awarded $22.9 million to support states throughout the nation, including New Jersey, in improving behavioral health of their citizens by providing community-based mental and substance use disorder treatment. Drug Abuse
As a reminder, the PMP law goes into effect on November 1st (but delegation is not allowed until regulations are finalized). See our guidance document. In addition, the CDC has released draft guidelines on opioid prescribing. Read AMA's response, which we support. President Obama has also issued guidance on prescriber education. Further AMA resources on drug abuse can be found on their website.

Epinephrine
The Senate Health Committee has passed S.2884, which would permit administration of epinephrine auto-injector device by persons who complete approved educational program. The bill would allow standing orders and prescriptions to family members and other non-end users, after certain training, and with immunity. The bill passed the Assembly Health Committee in March, 2015.
