The New Jersey State Bar Association and HRET will host the "2015 First Annual End of Life Conference: Legal and Practical Issues and Advance Care Planning" on Monday, October 5 from 9:00am to 1:00pm at NJ Law Center. Hear from experts as they examine various scenarios and offer an assessment from points of view of the individual and the health care provider. This will be followed by a discussion of the legal tools presently available in New Jersey to accomplish these efforts including the advanced health care directive, the durable power of attorney, physician orders for life sustaining treatment, and do not resuscitate orders. This activity has been approved for 3.75 AMA PRA Category 1 Credit(s)™. More information and registration. 

Ready Set Code! ICD-10 Webinar Workshops

The compliance date for implementation of ICD-10 is October 1, 2015. Will you be ready? MSNJ and the New Jersey Hospital Association will host a series of specialty specific webinar workshops on ICD-10. These hands-on coding workshops will help you master ICD-10-CM and the documentation requirements associated with coding for your specialty-specific practice. Participants will gain an understanding of the code format and structure of ICD-10 and the ability to successfully assign diagnosis codes using ICD-10. Choose one workshop that best describes your practice. Each 2-hour Specialty Workshop will be repeated on two different dates/times for your convenience. All workshops are approved for 2 AAPC CEUs. CMS will host a series of one-hour webinars explaining the reporting and the Physician Compare website. The webinars will be offered multiple times with the same information. AMA's Competition Analysis of Proposed Mergers Health Insurer Mergers
On September 8 the AMA announced its release of the annual update to its competition study of the health insurance industry. It also analyzed the impact of the proposed Anthem-Cigna and Aetna-Humana mergers. It finds that the combined impact of the proposed mergers would exceed federal antitrust guidelines in 17 states and urges regulators in those states to carefully review the mergers. While New Jersey is not among those states, the competition study finds that it is among ten states that have experienced the biggest drop in competition between 2010 and 2013.
BME Requires Two CME Credits on End of Life for Each License Cycle
On September 8 the NJ Board of Medical Examiners released its final rule requiring that physicians take two credits of Category 1 continuing medical education on end-of-life topics every biennial license cycle. MSNJ opposes topic specific mandates of CME. The statute requires two credits of CME in each license cycle and is silent on the Category. In our comments we urged the BME to exercise its discretion and only require Category 1 credits in the first license cycle and to allow Category 2 credits in subsequent license cycles.  The BME recognized that the Category was not mandated by statute, but decided that the rigor of Category 1 CME would ensure that physicians receive the best possible review of end-of-life issues.

PQRS Informal Review Process
Next year, CMS will apply a penalty to individual eligible professionals, Comprehensive Primary Care practice sites, and group practices participating in the PQRS group practice reporting option for not successfully reporting PQRS in 2014. If any of the above believe they have been incorrectly assessed the 2016 penalty, you may submit an electronic informal review request between September 9, 2015 and November 9, 2015. All informal review requestors will be contacted by CMS via email with a final decision within 90 days of the original request. All decisions will be final and there will be no further review or appeal. Read more.

Medicaid Credit Balances
The Office of Inspector General (OIG) reviewed Medicaid credit balances for acute care hospitals, nursing facilities, or certain non-institutional providers in eight states with eight providers in each state. Of the 1,102 patient records with credit balances reviewed, 538 did not contain Medicaid overpayments; however, 564 patient records contained Medicaid overpayments totaling $264,000. Based on the results, the OIG estimated that the eight states could realize an additional recovery of $25 million from their audit period and could obtain future savings if they enhanced their efforts to recover overpayments in provider accounts.
