Further, "If a licensee believes that this mandate has little applicability to his/her practice area, waivers or extensions can be requested. The licensee, within 60 days of the expiration of the biennial renewal period, (i.e., by April 30, 2015) needs to send to the Board office, by certified mail, return receipt requested, or other proof of delivery, a letter explaining why such waiver/exemption is applicable. If granted, the extension or waiver is effective for the biennial licensure period in which the extension and/or waiver is granted. If the reason(s) which necessitated the extension and/or waiver continues into the next biennial period, the licensee shall apply to the Board for the renewal of such extension and/or waiver for the new biennial period."

The American Academy of Addiction Psychiatry, in collaboration with Providers' Clinical Support System for Medication Assisted Treatment, recently released a free 1-hour review course for physicians, who have completed the 8 hour required training to obtain a waiver to prescribe buprenorphine and would like an update. Free PCSS-MAT Online Module - Patient-Centered Urine Drug Testing: Facts you should know!

This module will provide the clinician with the "best clinical practices" to utilize patient-centered urine drug testing (UDT) as an important tool in the management of all patients, who are being treated for substance use disorder (SUD) and/or chronic pain with opioids. This module will discuss testing methodology in UDT, review the difference between qualitative vs. quantitative testing, review drug metabolism (which is essential to interpret test results) and finally discuss sample integrity check (SIC). Legislative Update

Hospital Reporting

As previously reported, concerns about the growth of for-profit hospitals -- and the lower financial reporting standards that they are subjected to -- prompted the Legislature to pass a bill last year that created new reporting requirements.  The Governor conditionally vetoed the bill, asking the Department of Health (DOH) to study the issue instead. DOH has released its report and recommendations. The report recommends submission of the following (some of which is already submitted): audited and unaudited financial reports, "self dealing" contracts and sale-leaseback contracts, board and officer names, hospital charges (via CMS) and network coverage and out of network services.  To the dismay of the bill's supporters, the report does not recommend reporting of compensation to executives or contractors or all financial information of "other entities" (owners, etc).

Medicaid Transitions More Coverage to MCOs

On July 1, 2014, the Department of Human Services (DHS) launched the Managed Long-Term Services and Supports (MLTSS) program, which drives more Medicaid services through the Managed Care Organizations (MCOs). MLTSS will effectively transition coverage for specified long term services (such as: personal care, respite, home and vehicle modifications, home delivered meals, and mental health and addiction services) from Medicaid fee for service to the MCOs. In addition, participants in the following Medicaid Waiver programs will be automatically enrolled in MLTSS through their current MCO: AIDS Community Care Alternatives Program (ACCAP); Community Resources for People with Disabilities (CRPD); Traumatic Brain Injury (TBI) Waiver; and Global Options for Long-Term Care (GO). The DHS will provide regional provider educational sessions on MLTSS. Read more from DHS about the program. Sunshine Act Update: Open Payments Registration and Review/Dispute Process Began July 14  

Registering in the Open Payments system is voluntary, however, it is a mandatory process if physicians want to review and dispute the data submitted by manufacturers and group purchasing organizations (the Industry) before the data is posted to the public on September 30, 2014. Any data disputes must be filed on or before August 27, 2014, in order to be reviewed and possibly corrected by the Industry, which will be able to submit dispute corrections beginning August 28 through September 11. Please Note: Registration is a two-step process. Physicians must first register for the Enterprise Portal before registering for the Open Payments System. IHCAP Notice Requirement for Physician Offices

The New Jersey Department of Banking and Insurance (DOBI) recently adopted regulations requiring physician offices to post notice regarding patient rights under the Independent Health Care Appeals Program (IHCAP). MSNJ provided comments to DOBI on the proposed regulations requesting that the notice include language that clarifies that IHCAP may not apply to all patient plans. We thank DOBI for honoring our request. Note that IHCAP does not apply to most government-sponsored coverage, such as Medicare, the Federal Employee Health Benefits Program, the New Jersey State Health Benefits Program and self-funded plans according to DOBI.  The notice language may be downloaded from DOBI's website. The notice must be posted by August 3, 2014, include the specific content from DOBI's website, and be printed on at least 8 ˝" by 11" paper with 12-point type or larger. Physicians may choose to print it on larger paper, in order to incorporate all the information on one sheet; in this case the text must also be at least 12-point type. MSNJ created a one page sample notice, for member use. Please feel free to download, print, and post this legal sized (8 ˝" by 14") poster in your office.

We also recommend that practice's also have available, the plans that DOBI has excluded from the IHCAP appeal process. This information can be found on the DOBI website FAQ number 25 or downloaded here.

New Prescription Blanks - Certificate of Destruction Requirement

Under the Uniform Prescription Act, physicians destroying old unused prescription blanks must notify the NJ Drug Control Unit (DCU) of the destruction by completing a certification of destruction. The certification of destruction is meant to be a provider protection that helps prevent stolen, forged, altered or counterfeited prescriptions. The witness of the destruction of the blanks must complete the form; the witness may not destroy the blanks him/herself. The DCU requires a different certification form to be submitted for each unique batch number or order month. A copy of the first and last serial numbers in the batch must also be submitted. Blanks may be destroyed by shredding, burning, pulping or pulverizing, so long as they are rendered unreadable. Questions should be addressed with the DCU at 973.504.6200 or NJPB@dca.lps.state.nj.us.
