This free CME activity sponsored by the American Psychiatric Association, will provide physicians and other clinicians involved in the treatment of opiate use disorder with an overview of the incidence of Neonatal Abstinence Syndrome, the clinical presentation of Neonatal Abstinence Syndrome, and treatment options for this syndrome. Short and long-term outcome data for infants who have undergone NAS will also be reviewed. Integration of this information into clinical practice will better prepare physicians and other clinicians to educate pregnant women on the expectant clinical course for their infants after delivery. MSNJ Urges CMS to Delay Rule Concerning Medical Staff Structure
MSNJ joined the AMA and virtually all of organized medicine in a letter to CMS urging it to delay the effective date of a recent final rule that would allow multi-hospital systems to integrate hospital medical staffs into a single, system-wide medical staff. This represents a sea change in the structure of medical staffs under Medicare's Conditions of Participation. Historically, each hospital's medical staff has been organized under its bylaws. The rule allows medical staffs to opt-in or opt-out of a multi-system medical staff. However, given the July 11, 2014 effective date medical staffs do not have adequate time to consider the advantages and disadvantages of a single, integrated multi-system medical staff. There are outstanding questions to CMS on issues of physician licensure for multi-state hospital systems and peer review in addition to the inadequate time frame for medical staffs to amend bylaws.  Read a summary of the change by medical staff attorney, Elizabeth A. Bill Introduced to Address Medicare Advantage Physician Terminations
The "Medicare Advantage Participant Bill of Rights" act has been introduced by Congresswoman DeLauro of Connecticut. If passed the bill would ban mid-year "without cause" terminations of Medicare Advantage network physicians; require plans to finalize their physician networks prior to open enrollment; and, require plans to provide adequate notice to seniors and ensure continuity of care.  MSNJ supports this bill.

MSNJ Expresses Concern Over ICD-10 Implementation

MSNJ Executive Committee member Marc Levine, MD, and CEO, Larry Downs, expressed reservations about the negative financial impact of ICD-10 implementation on medical practices without a benefit to patient care. Read more.

IRS Scam against Physicians

There have been multiple reports of an Internal Revenue Service (IRS) tax scam directed at physicians. According to the reports, someone is filing fraudulent federal income tax returns using physician names, addresses and Social Security numbers. From all appearances, the returns filed contain no personal income tax information other than the name, address and Social Security number of the involved physician. Physicians must begin using the new prescription blanks on August 18, 2014. An updated list of approved printer vendors has been posted to the BME website.

The Sentinel Project:  Are Health Plans Providing Essential Health Benefits? 

The Seton Hall University School of Law and the New Jersey Appleseed Public Interest Law Center started working on the Sentinel Project, a two-year effort to determine whether individual and small business health insurance plans in New Jersey are providing the "essential health benefits" required under the Affordable Care Act. This project will gather and analyze information on individuals who enroll in individual or small business health insurance plans but are not able to get the health care they need. Members are urged to read the Sentinel Project summary, post the flyer in their offices, and refer patients who have been denied medically necessary services to complete the project's intake form. Attend the PSP meeting on July 24 to learn more. 

Legislative Update

Fiscal Year Closes

There was a flurry of activity in the Legislature at the end of June, as the State's fiscal year drew to a close.  Here are the details of the Fiscal Year 2015:

Legislative action - The budget that the Democratic-controlled Legislature sent to the Governor was a $34.1 billion spending plan, 3.3 percent bigger than what Gov. Chris Christie signed last year. And it funds a number of Democratic priorities that Christie has cut in the last few years, such as women's health centers and a tax credit for the working poor.

The Democrats' budget also made a historic $2.25 billion payment for the cash-strapped pension system, imposed new taxes on personal income above $1 million and increased the corporate business tax. The electronic cigarette tax, proposed by the Governor to raise $35 million, was rejected by the Legislature and replaced with these wealth taxes.

Governor's action - The Governor reduced the budget to $32.5 million. He rejected the tax increases and reduced the pension payment to $680 million.  Though the funding is cut in half, one item that remained in the bill is funding for the Child Collaborative Mental Health Care Pilot Program. This program, which integrates primary care with mental health services, is supported by MSNJ, NJPA, AAPNJ and others.

Assisted Suicide

As a part of the flurry, the sponsor of A2270, a bill that would allow assisted suicide in New Jersey, scrambled to make amendments and get the bill passed by the full house.  As previously reported, the bill passed the Assembly Health Committee on June 5th. In an attempt to address some concerns about the bill (though not MSNJ's), the bill was amended on June 16th and again on June 23rd.  Assemblyman John Burzichelli, attempted to get the amended bill passed by the Assembly, but found that he did not have enough votes.  The Assemblyman will continue to work on the bill. MSNJ opposes the bill, as explained in our letter, which can be found here. Disability groups and religious groups also oppose the bill. CMS Registration Began June 1 for Physicians

As part of Open Payments, physicians should register with CMS, starting June 1, to review information about payments or other transfers of value given to them by the industry prior to public posting of the data. Physicians who participate will need to initially register in CMS' Enterprise Portal to access and review the information submitted about them by the industry. As a part of this overall process, registered users will be able to dispute information with industry that they believe to be inaccurate or incomplete.
