The Sentinel Project: Are Health Plans Providing Essential Health Benefits?
The Seton Hall University School of Law and the New Jersey Appleseed Public Interest Law Center started working on the Sentinel Project, a two-year effort to determine whether individual and small business health insurance plans in New Jersey are providing the "essential health benefits" required under the Affordable Care Act. This project will gather and analyze information on individuals who enroll in individual or small business health insurance plans but are not able to get the health care they need. Members are urged to read the Sentinel Project summary, post the flyer in their offices, and refer patients who have been denied medically necessary services to complete the project's intake form. MSNJ Seeks Clarity on Use of Gift Cards and Virtual Credit Cards as Payment by Insurers
On June 20, MSNJ filed comments that generally support a regulatory proposal by the Department of Banking & Insurance that would regulate how insurers use gift cards and virtual credit cards (alternate payment methods) to pay for medical services. While the proposal requires insurers to gain permission from physicians to use these alternate payment methods, it did not require that the permission be granted in writing. We have asked that any permission be in writing and that physicians have the further right to revoke the permission at any time, which should be effective upon receipt by the insurer. We also recommended that the rule state the physician's right to seek payment via automated clearing house electronic funds transfer (ACH EFT) under HIPAA. Transaction fees are less with ACH EFT than other electronic alternative payment methods. Virtual credit card payments have been a significant issue for some of our members. We have assisted and been able to require the insurer to issue a check instead of a gift card when requested. Physicians presented with these one -time cards or virtual credit cards are advised to just say "no' and request a check or that payment be made via ACH EFT. Members are urged to read more about ACH EFT and to access the AMA's toolkit.

New Jersey Family Care Alternative Benefit Plan Medically Exempt Beneficiaries
The New Jersey Family Care Alternative Benefit Plan (ABP) was created to cover the expanded Medicaid population. The ABP does not include some benefits offered under traditional Medicaid, including long term care. Some beneficiaries may be considered "medically exempt" from participating in the ABP, under federal regulations. Medical exemptions include patients with: disabling mental disorders; chronic substance use disorders; serious and complex medical conditions; physical, intellectual or developmental disabilities that impair activities of daily living; and/or disability based on social security criteria. If deemed exempt, NJ Medicaid must give the beneficiary the option to choose between the ABP or another Medicaid plan that includes all Medicaid covered benefits.
Physicians, who treat ABP patients and believe they meet the medically exempt criteria are urged to complete the Medically Exempt Attestation Form and submit it to the Medical Assistance Customer Center (MACC) office for the county in which the patient resides. The MACC will counsel and assist the patient on coverage options. Please see the Division newsletter and attestation form for details.

$800,000 HIPAA Settlement - Medical Records Dumping Case
Parkview Health System, Inc. has agreed to settle potential HIPAA violations with the U.S. Department of Health and Human Services Office for Civil Rights (OCR). OCR opened an investigation after receiving a complaint from a retiring physician alleging that Parkview had violated the HIPAA Privacy Rule. In September 2008, Parkview took custody of medical records pertaining to approximately 5,000 to 8,000 patients while assisting the retiring physician to transition her patients to new providers, and considering the possibility of purchasing some of the physician's practice. On June 4, 2009, Parkview employees, with notice that the physician was not at home, left 71 cardboard boxes of these medical records unattended and accessible to unauthorized persons on the driveway of the physician's home, within 20 feet of the public road and a short distance away from a heavily trafficked public shopping venue. Parkview will pay $800,000 and adopt a corrective action plan to address deficiencies in its HIPAA compliance program. The resolution agreement can be found here.

APN Scope of Practice
The Senate unanimously passed a bill that permits attending advanced practice nurses to determine cause of death and execute death certification of a patient, if the nurse is the patient's primary caregiver. Unfortunately, there was a general perception that the bill was NOT a scope expansion, but rather a small correction to a day-to-day problem. MSNJ will continue to oppose this bill, along with other physician societies, and hopes to prevent action in the Assembly. Our opposition memo from Monday's Senate voting session can be found here.

Important EHR Incentive Program Deadline: July 1
This is the last year (2014) that Eligible Professionals (EPs) can start participating in the Medicare EHR Incentive Program to receive incentive payments. EPs who begin participation in the Medicare EHR Incentive Program after 2014, will not be able to earn an incentive payment for that year or any subsequent year of participation. If you choose to participate in the program for the first time in 2014, you should begin your 90-day reporting period no later than July 1, 2014 and submit attestation by October 1, 2014 to avoid the payment adjustment in 2015. If you were unable to successfully demonstrate meaningful use for 2013 due to circumstances beyond your control, CMS is accepting applications for hardship exceptions to avoid the penalty for the 2013 reporting year. Applications for individual eligible professionals and eligible professionals submitting multiple NPIs are available. CMS will review the application to determine whether or not you are granted a hardship exception. Applications for the 2015 penalty exception are due July 1, 2014. If approved, the exception is valid for one year. Use CMS' new interactive tool for eligible professionals to help determine if you will avoid the penalty by demonstrating meaningful use. Tipsheets are available on the CMS website. Use this timeline to determine which year you will demonstrate Stage 1, Stage 2 and Stage 3 of meaningful use.
CMS and the ONC released a Notice of Proposed Rulemaking (NPRM) allowing providers participating in the EHR Incentive Programs to use the 2011 Edition of certified electronic health record technology (CEHRT) for calendar and fiscal year 2014 and extending Stage 2. Read more. |

Paper Billers Submitting CMS 1500 Claim Forms
The following two items continue to be billed to Novitas Solutions incorrectly:
- Legacy Provider Identifier- Novitas continues to receive CMS 1500 claim forms that are reporting Legacy numbers including PIN, UPIN or National Clearinghouse Numbers in items: 17A (red shaded area) for the UPIN physician, 24J (red shaded area) for Rendering physician, and 33B for Billing or Group physician. These areas are to be left blank as of May 23, 2008. The NPI should be reported in the appropriate blocks that have been designated for referring, rendering and billing. Continued reporting in these fields will result in claims being returned.
- Diagnosis Codes reported in Item 21 and 24E- These are required fields
- Item 21 - Enter the patient's diagnosis/condition. All physician and non-physician specialties should use diagnosis codes to the highest level of specificity for the date of service and enter the diagnoses in priority order.
- Item 24E/Line Diagnosis - Enter the diagnosis code reference letter as shown in item 21 to relate the date of service and the procedures performed to the primary diagnosis. Enter the corresponding alpha diagnosis code pointer at the service line level. Enter only one reference letter per line item. When multiple services are performed, enter the primary reference letter for each service. If a situation arises where two or more diagnoses are required for a procedure code, the provider shall reference only one of the diagnoses in item 21.

CMS Registration Began June 1 for Physicians
As part of Open Payments, physicians should register with CMS, starting June 1, to review information about payments or other transfers of value given to them by the industry prior to public posting of the data. Physicians who participate will need to initially register in CMS' Enterprise Portal to access and review the information submitted about them by the industry. As a part of this overall process, registered users will be able to dispute information with industry that they believe to be inaccurate or incomplete.
