Data Breach Results in $4.8 Million in HIPAA Settlements

Two health care organizations have agreed to settle charges that they potentially violated the HIPAA Privacy and Security Rules by not securing thousands of patients' electronic protected health information (ePHI) held on their network. The combined monetary settlement totals $4.8 million and is the largest HIPAA settlement to date. The U.S. Department of Health and Human Services (HHS) Office for Civil Rights (OCR) investigated New York and Presbyterian Hospital (NYP) and Columbia University (CU) after they submitted a joint breach report on September 27, 2010, regarding the disclosure of the ePHI of nearly 7,000 individuals. NYP and CU are separate covered entities, but operate a shared data network and a shared network firewall that is administered by employees of both entities. Read more.  

BME Issues Certificate of Waiver to Carry Out Overdose Prevention Act

The Overdose Prevention Act, which is meant to reduce overdose related deaths by encouraging victims and witnesses of overdose to obtain medical care without criminal or civil liability, supports distribution of Naloxone to those considered at risk for opioid overdose, as well as to their friends, family, or first responders. The Act allows physicians to prescribe Naloxone with civil, criminal, and professional disciplinary immunity.  

 

The NJ Board of Medical Examiners (BME) recently approved a regulatory proposal that explains physician rights and responsibilities under the Act. The BME issued a Certificate of Waiver to all licensed physicians in order to expedite operation of the Act, while the proposed rules are promulgated. The waiver explains that physicians may issue Naloxone prescriptions to family, friends, or first responders without requiring examination or follow-up of the at risk individual.

Physician Risk based on Medicare Utilization Data

Frank Cohen, from the Frank Cohen Group, has been working with the CMS physician payment data that was recently released to come up with a way that physicians can use the data to both defend themselves against unwarranted attacks and to better understand their utilization patterns. He created a proportional distribution model that resulted in a more realistic view of utilization and payment patterns that are agnostic to payer mix and other missing critical data points. New Prescription Blanks Effective August 18, 2014

The NJ Division of Consumer Affairs finalized  regulations that update the security of NJ Prescription Blanks. These rules were originally proposed in November 2012 and became effective February 18, 2014. MSNJ filed comments on the original proposal in January 2013. Some changes to the blanks include: a unique 15 digit identifier and barcode for each blank; thermal activated ink in the Rx logo; microprint viewable at 5 times magnification or greater that is illegible upon photocopying; and the word "VOID" that is only visible upon photocopying or scanning of the blank. Blank vendors must sell only the new version of the blanks by May 18, 2014. Physicians must begin using the new blanks on August 18, 2014. The BME is still in the process of certifying vendors and has not yet posted the revised vendor list. Stay tuned to e-News for more information as it becomes available.

End-of-Life CME

The POLST law requires physicians to obtain 2 AMA PRA Category 1 Credits™ of continuing medical education in topics related to end-of-life care for license renewal starting in 2015 and every renewal thereafter.


These 2 Category 1 credits will be considered part of the 40 Category 1 Credits that are required each renewal. Physicians, who feel this education does not pertain to their practice, can write to the BME to request a waiver each renewal

Endocrinologists Alert! May 31 Deadline for Certification Application

Endocrinologists who perform thyroid ultrasound and ultrasonic guidance for biopsy and are Horizon participating physicians will be required by Horizon to earn an Endocrine Certification In Neck Ultrasound (ECNU) by June 1, 2015. In order to continue to be paid for these services beyond May 31, 2014, physicians must have submitted an ECNU Program Application to the AACE. Read Horizon's payment notification. Originally, Horizon required that endocrinologists performing these services be certified by January 1, 2014. MSNJ, together with your state and national specialty society, urged Horizon to delay the certification requirement because many physicians were not aware of the requirement and would not be able to become certified before the January 1, 2014 effective date. The year and a half delay was granted in response to those concerns.

Legislative Update 

Tobacco Taxation and Limitations

The Senate Health Committee approved a bill that would increase taxes on certain tobacco products (cigarellos, moist snuff, little cigars and cigars). This bill would implement the Governor's recommendation to tax e-cigarettes, but adds other products and sends some revenue to cancer treatment, drug treatment and tobacco prevention and cessation programs (revenue under the Governor's tax proposal would go to the State's general fund).

 

The Senate Health Committee passed S321, which permits municipalities to establish civil penalty for smoking in public places.

 

The Senate Health Committee passed S1772/A1080, which prohibits smoking at public parks and beaches.


Opioids

Despite opposition from the physician and pharmacy communities, the Assembly Judiciary Committee passed a bill that would improve the state prescription drug monitoring program by allowing access by designees, increasing pharmacy data input and allowing more reports to be sent to prescribers and dispensers. The bill also requires physicians to register for the program.  MSNJ supports these provisions. However, the bill would also do the following, which the physician and pharmacy communities oppose:

  • Provide that, in addition to any other penalty provided by law, a health care professional who engages in improper prescribing is liable to a civil penalty of not less than $10,000 for the first violation and not less than $20,000 for the second and each subsequent violation. Current law provides a maximum fine of $10,000 for the first violation and $20,000 for a second or subsequent violation;
  • Provide law enforcement agencies greater access to prescription monitoring information;
  • Require health care practitioners who prescribe, and pharmacists who dispense, Schedule II drugs to check the information available through the prescription monitoring program prior to prescribing in order to determine if the patient has received other prescriptions that indicate prescription abuse or diversion; and
  • Grant the Division of Consumer Affairs authority to gather information on any significant business relationships involving the medical practice of a licensee of the State Board of Medical Examiners.

This is a "competing" bill to A3129, which, as reported last week, passed the Assembly Health Committee with full support from the physician and pharmacy communities.  The bills will be reconciled in the Assembly Appropriations Committee. MSNJ will continue its advocacy on this issue.
Practice Management

Virtual Credit Card Payments

If your practice accepts virtual credit card (VCC) payments from health plans, you may be losing a significant amount of your contractual payments to high interchange fees. There are three steps you can take to make sure you aren't paying unnecessary charges.

  1. Register for electronic funds transfer (EFT) payments. HIPAA requires all health plans to offer standardized EFT using the Automated Clearinghouse (ACH) Network. Similar to direct deposit, ACH EFT allows health plan payments to be directly paid into a physician's designated bank account. Each ACH EFT transaction carries only one fee of about 34 cents, far less than the potential 5 percent fee charged to VCC transactions. In order to receive ACH EFT, physicians should request and register for this payment method. View AMA's EFT toolkit.
  2. Be aware of restrictions in payment methods when contracting with health plans. Even though HIPAA requires health plans to make EFT payments available upon request, health plans may try to require other payment methods, such as VCC, within their contracts with physicians. Be cognizant of any restrictions and avoid signing contracts with inflexible payment terms.
  3. Educate your practice staff. If your practice staff processes both patient and health plan payments, make sure they know how to differentiate between patient and health plan credit card payments to avoid authorization of VCC payments from health plans. Read more.  

Accredited Standards Committee Transaction Survey

The Accredited Standards Committee (ASC) X12 is asking for provider feedback regarding the ASC X12 274 Healthcare Provider Information transaction set. These transactions offer a standardized way to transfer and maintain accurate provider directory information. Read a letter that includes a link to a survey about the ASC X12 274 transactions, as well as a reference document describing high-level data elements being considered for inclusion in the next version of the transactions. Members are encouraged to participate. The survey will close on May 30.

CDC Vaccine Schedules App

Immediately access all CDC recommended immunization schedules and footnotes using the free CDC Vaccine Schedules app available for tablets and smartphones. The app features color coding coordinates with printed schedules; hyperlinked vaccine name opens as a pop-up with dose specifics; catch-up schedule for children shows minimum dosing intervals; related vaccine resources and websites are included; and any changes in the schedules will be released through app updates. Important EHR Incentive Program Deadlines

This is the last year (2014) that Eligible Professionals (EPs) can start participating in the Medicare EHR Incentive Program to receive incentive payments. EPs who begin participation in the Medicare EHR Incentive Program after 2014, will not be able to earn an incentive payment for that year or any subsequent year of participation. If you choose to participate in the program for the first time in 2014, you should begin your 90-day reporting period no later than July 1, 2014 and submit attestation by October 1, 2014 to avoid the payment adjustment in 2015. If you were unable to successfully demonstrate meaningful use for 2013 due to circumstances beyond your control, CMS is accepting applications for hardship exceptions to avoid the penalty for the 2013 reporting year. Applications for individual eligible professionals and eligible professionals submitting multiple NPIs are available. CMS will review the application to determine whether or not you are granted a hardship exception. Applications for the 2015 penalty are due July 1, 2014. If approved, the exception is valid for one year. Tipsheets are available on the CMS website. Use this timeline  to determine which year you will demonstrate Stage 1, Stage 2 and Stage 3 of meaningful use.

 

CMS and the ONC released a Notice of Proposed Rulemaking (NPRM) allowing providers participating in the EHR Incentive Programs to use the 2011 Edition of certified electronic health record technology (CEHRT) for calendar and fiscal year 2014 and extending Stage 2. Read more.

Avoid the 2016 PQRS Penalty

Eligible professionals and group practices that fail to successfully report data on quality measures during 2014 will be subject to a two percent reduction on Medicare Fee Schedule amounts for services furnished by the eligible professional or group practice between January 1, 2016 and December 31, 2016. CMS Registration Begins June 1 for Physicians

As part of Open Payments, physicians should register with CMS, starting June 1, to review information about payments or other transfers of value given to them by the industry prior to public posting of the data. Physicians who participate will need to initially register in CMS' Enterprise Portal to access and review the information submitted about them by the industry. As a part of this overall process, registered users will be able to dispute information with industry that they believe to be inaccurate or incomplete. Read more.
