Congress to Hold a Hearing on SGR Replacement

This week the Chair of the House Ways & Means Health Subcommittee announced that it will hold a hearing on May 7 to study options for repealing the Medicare SGR and reforming the physician payment system. He stated that:

 

Reforming Medicare and eliminating the unworkable SGR formula is necessary to ensure our seniors have access to a strong Medicare program.  This year we have an opportunity to repeal the SGR, provide predictability for physicians and ensure seniors can see their local doctors.  While the timing is ripe for action, we need to be sure we get the policy right. My hope is that we can put the days of kicking the SGR can down the road behind us.  This hearing will enable the Subcommittee to hear from stakeholders with experience and ideas on how to craft a policy that is fair, reliable and fiscally responsible.

 

Oral testimony will be taken from invited guests, but all written comments will be considered. MSNJ will comment on the Committees' proposal before the May 21 due date. Write to info@msnj.org and put "SGR Replacement" in the subject line with comments on the Committees' proposal.

 

The House Ways & Means and Energy and Commerce Committees' effort to repeal the SGR and to reform Medicare's payment model to make it more sustainable is the most serious effort from Congress to date. The concept is consistent with the SGR Transition Principles developed by the AMA and adopted by MSNJ.

MSNJ Urges Revisions to NJ Rules of Evidence on Expert Testimony

Following on the heels of the New Jersey Supreme Court decision that will require same specialty and board certification of the defendant in a medical malpractice law suit, MSNJ continues our efforts to ensure the reliability of expert testimony. In a letter to the Committee on the Rules of Evidence we urged that the high court adopt rules that will allow a pretrial hearing on the qualifications of expert witnesses and establish three reliability factors that must be considered before admitting testimony.

The Physicians Foundation announced a grant in the amount of $350,000 each to the Medical Society of New Jersey and the Medical Society of the State of New York. Grantees do not have to be MSNJ Members. Download the application today.

 

Affordable Care Act Conference - May 8, 2013 

The Region II Centers for Medicare & Medicaid Services (CMS) and ShapingNJ, the Office of Nutrition & Fitness, New Jersey Department of Health & Senior Services will host a free conference, "Bringing the Affordable Care Act Home" on Wednesday, May 8, 2013 from 8:00 A.M. to 5:00 P.M., at the Rutgers University Busch Campus Center. Come learn and network with other organizations working to implement health reform in New Jersey. More information and registration. Legislative Updates 

Bill that would allow Psychologists to Prescribe Drugs

The Assembly passed a bill allowing psychologists to prescribe drugs this week. On Monday, A. 2419 cleared the house by one vote. MSNJ and NJPA fought hard against this scope of practice bill.  In good news, the Senate has not acted on the bill. We will continue to fight the bill.

 

Opioid Overdose Bill is enacted into Law

On Monday, both houses passed a final version of an opioid overdose bill. S. 2082 provides immunity for physicians and lay persons who administer naloxone. Incorporating the Governor's conditional veto, the bill now also includes a Good Samaritan provision providing immunity for those who report an overdose. MSNJ supported the bill. On Thursday, the Governor signed the "Opioid Antidote and Overdose Prevention Act" into law.

 

Bill Concerning Medical Standards for Declaration of Death

The Assembly also passed A. 3586, which removes the statutory authority of the Department of Health and Board of Medical Examiners over medical standards governing declarations of death upon the basis of neurological criteria.  MSNJ supports this bill.  No action has been taken in the Senate.

 

Bill concerning Federal Health Insurance Exchange

The Assembly also passed, along party lines, A. 3878, a bill that requires the  Commissioner of Banking and Insurance to establish a public awareness campaign about new federally required health insurance exchange. The Senate bill has not yet moved.


Practice Management

MSNJ Practice Management Community

A community has been created on MSNJ's website for all Medical Practice Manager Section (MPMS) members. Here you will find blogs, forums, events, polls and links to important information regarding practice management. All MPMS members are automatically subscribed to the community and forum as part of membership. An email will be sent when a forum is created. You may unsubscribe at any time, using the unsubscribe link at the bottom of the email or through the community website.

Delay in Medicare Ordering & Referring Denial Edits

CMS has delayed implementation of the Phase 2 ordering and referring denial edits due to technical issues. The original implementation date was scheduled for May 1, 2013. CMS claims the delay is temporary, but has not announced the new date. We will post information, as it becomes available, in e-News and on the MSNJ website.  

 

MSNJ worked with AMA to secure delays of the compliance date to allow a sufficient period of time for physician outreach and education. Billing physicians will not be paid for services if the ordering/referring physician is not enrolled or if ordering/referring information is complete. Physicians must list on a claim the name and NPI of the ordering/referring physician or provider. Paper filers are reminded that only the first and last name of the ordering/referring physician should be included on the claim; nicknames, middle initials, and/or credentials should not be included, as the claim will be denied.   

 

Physicians who need to enroll are urged to do so now through Medicare's online PECOS websiteThe Texas Medical Association created a very helpful National PECOS Lookup ToolUse this free tool to verify your Medicare ordering/referring enrollment status. CMS Transition to HETS

CMS will implement changes to Medicare beneficiary health insurance eligibility inquiry services. In April 2013, access to Common Working File (CWF) eligibility query was terminated. If you currently use CWF queries to obtain Medicare health insurance eligibility information for Medicare fee-for service patients, you should immediately begin transitioning to the Medicare Health Insurance Portability and Accountability Act (HIPAA) Eligibility Transaction System (HETS). NJ-HITEC Offers Meaningful Minutes

NJ-HITEC has changed their Meaningful Use hour-long webinars into Meaningful Minutes so they can still continue to provide updates, but in a more concise and shorter format. At the conclusion of each Webcast, participants will receive a one-page summary of the most important topics covered to share with the rest of their team. The "Meaningful Minutes" will be offered every Wednesday from noon to 12:30 p.m. beginning on May 1 and will continue to help physicians, nurses, and practice managers stay up-to-date on the important changes in Meaningful Use, CMS incentive programs, and related Health IT issues.
