The Commercial Vehicle Safety Alliance held its annual Conference & and Exhibition in Buffalo, N.Y., last week. The event was attended by almost 600 people.
 
The fall conference consists of meetings of the executive committee as well as all regulatory, training
and vehicle committees. It's important for members of the trucking industry to attend these meetings, so that our voice can be heard.

 

The committee that may be of most interest to TMHA is the Driver Traffic Committee, which deals with hours-of-service, driver qualification and other driver-related issues.
 
The first topic brought up in the Driver Traffic Committee was a motion by the FMCSA to place a carrier Out-of-Service, on a roadside inspection, for a suspended DOT number. The argument made was that even though the DOT number has been suspended and the carrier is not supposed to be operating trucks, there are numerous reasons why a truck could still be operating and they wanted to establish a policy that the truck should be placed out-of-service. After considerable discussion, the motion passed in the Driver Traffic Committee but failed to be approved by the CVSA Executive Committee, causing it to die.

 

Another topic of interest that came up was that of a violation being written up on multiple occasions. The example given was a driver written up and placed out-of-service for an 11-hour violation by Indiana enforcement and then three days later getting stopped in Kansas and written up again for the same 11-hour violation. It was determined that this happens too frequently.

 

A motion was made that if an officer has reasonable reason to know about the previous out-of-service, they should NOT write up the violation on the second inspection (this would include the driver being able to show the officer the first inspection). There was also a motion that if the second inspection DOES write up the same violation, the state MUST remove it from the carrier's and driver's records if the carrier files a DataQ request.

 

Both of these motions passed out of committee and were approved by the CVSA Executive Committee, which was a huge win for the transportation industry. It basically eliminates the chance for "double jeopardy" to the carrier and driver.

 

One of the most exciting things that came out of this meeting was the introduction of a new CVSA Driver Excellence Award that will recognize one driver each year for going above and beyond in their duty. This will be more than just a safety award.

Eligibility criteria for the award include 25 cumulative years of accident-free driving, three years without a driving violation (including hours-of-service)
, and no felonies in their lifetime. 
 
The award 
will be open to all CMV drivers (nominees do not need to work for a CVSA member company). CVSA is tentatively set to begin taking nominations January 5, 2015, with the deadline for submissions being February 27, 2015.

Darling Named Acting Administrator of FMCSA

U.S. Transportation Secretary Anthony Foxx named Scott Darling as acting administrator of the Federal Motor Carrier Safety Administration on August 22. He will succeed Anne Ferro, who left the agency to become president of the American Association of Motor Vehicle Administrators.

 

Before becoming the FMCSA's chief legal counsel, Darling served as deputy chief of staff and assistant general counsel to the Massachusetts Bay Transportation Authority. Darling has been the FMCSA's chief legal counsel since 2012. But, his selection dashed some expectations that the agency would tap William Bronrott, the deputy administrator.

 

President Barack Obama has not said whether Darling will be nominated as the permanent FMCSA administrator.

Some Disappointing August Data 

This week we received a couple of disappointing August economic indicators, including factory output and housing starts. In both cases, July's data was very robust and August may have represented a payback for that strength.

 
First, the Federal Reserve reported that factory production contracted 0.4 percent from July, which was the first month-to-month drop since January. In July production jumped 0.8 percent, and during the previous six months output increased a total of 4.2 percent.

Auto production was a large drag during August, contracting 7.6 percent after surging 9.3 percent in July. Total production of nondurable goods, which are products with a useable life of less than three years, increased 0.2 percent, the third straight gain.

Brad Bentley Named New TCA President

 
The Truckload Carriers Association announced that it has selected Brad Bentley as its new president. He will succeed Chris Burruss, who resigned on June 26 due to personal reasons.

 

The search was conducted by a special task force consisting of six TCA officers, two past chairmen and one member truckload carrier. The group, led by TCA Chairman Shepard Dunn, received more than 100 applications and spent the entire summer examining them. He will be relocating from Alabama to the Washington, D.C. area and will begin working for TCA full-time in mid-October.

 

A University of Alabama graduate with a degree in broadcast journalism, Bentley has worked in the trucking industry since 1988. He spent six years in driver recruitment advertising sales, followed by 15 years as a trucking publisher, before becoming the editorial director for Randall-Reilly recruiting in 2008.

 

Bentley has been active in TCA, most recently serving as co-chair of the Image and Communication Policy Committee. He is also a member of the Board of Directors as well as the Recruitment and Retention Human Resources Committee. Bentley has played a role in the behind-the-scenes development of several of TCA's signature activities, including helping to formalize TCA's partnership with Wreaths Across America, introducing TCA to organizers of the U.S. Capitol Christmas Tree project and promoting the Highway Angel program on a regular basis throughout the years.

 

Bentley is also active on the Commercial Vehicle Training Association's Marketing Committee and the American Trucking Associations' Communications and Image Policy Committee. While at Randall-Reilly, Bentley developed the Mike O'Connell Memorial Trucking's Top Rookie Program.

FMCSA Delays Expected Publication Dates for Minimum Insurance

Federal regulators have moved back by nearly a month their projected announcements of two proposed rules, one to raise the minimum insurance requirement for interstate motor carriers and the other requiring speed limiters on new heavy trucks, a new Department of Transportation.

 

The proposal to raise the insurance minimum, originally scheduled for publication later this month, has been delayed until October 22.

 

The proposed speed-limiter rule has been delayed several times, most recently projected for December 12, and now is not anticipated until January 12.

 

The anticipated Federal Register publication date for two other major regulations -- a proposed carrier safety fitness determination rule and a final drug and alcohol clearinghouse rule -- remained unchanged.

New ATRI Research 

The American Transportation Research Institute (ATRI) reported that the average marginal cost-per-mile last year was $1.68, an increase from the $1.63 in 2012.

 

The research provides motor carriers with a high-level benchmarking tool and government agencies with real world data for future infrastructure improvement analyses.

 

After the Great Recession and a sharp decline in fuel prices resulted in decreased industry costs between 2008 and 2009, costs steadily rose through 2010 and 2011, with a slight decline in 2012.

In addition to average costs per mile, ATRI's report documents average costs per hour and includes cost breakouts by industry sector.  Also new this year, ATRI is publishing a one-page fact sheet with the key findings of the report.
