Hotel Accommodations Deadline for Annual Meeting is Wednesday

OOIDA's Lawsuit Over FMCSA's DataQ Process Transferred to District Court

Saying it lacks jurisdiction, a federal appeals court has transferred a lawsuit about the Federal Motor Carrier Safety Administration's DataQ process to a district court.

  

The lawsuit filed by the Owner-Operator Independent Drivers Association centers on a refusal by the FMCSA to allow a DataQ challenge of a June 2011 misdemeanor citation against a truck driver issued by a Montana Department of Transportation officer for failure to stop at a weight station.

  

The charge was later dismissed by a Montana state court, but the FMCSA denied the driver's DataQ request to have the charge removed from the federal database.

FMCSA Alert on Fraudulent Letters

Another new round of fraudulent USDOT letters dated February 18, 2014, are starting to circulate among motor carriers.

 

The letters appear to be from the "U.S. Department of Transportation Procurement Office" and signed by a fictitious name of "Louis James -- Senior Procurement Officer."
 
The letters are attempting to obtain banking information from the targeted companies. Please advise your local carriers and law enforcement agencies of the possibility of this fraudulent financial data collection activity beginning again and to be suspicious when being asked for banking information from anyone.

TMHA Gains Two New Premier Sponsors

Deploying New Tactics for Finding and Keeping Drivers

Heightened concerns regarding the growing shortage of truck drivers is spurring carriers to investigate a series of new tactics to bolster their recruiting and retention efforts -- everything from boosting social media usage and deploying predictive analytics technology to opening their own driver training schools.

 

"The market for drivers is tight as the economy continues to improve, the situation will only get tougher. Competition is intense and drivers are at a premium and can easily move from one carrier to another to switch jobs," said Kent Ferguson, director of transportation solutions for global employment screening provider.

U.S. Factory, Spending Data Hint at Improving Economy

U.S. factory activity rebounded last month from an eight-month low and consumer spending increased more than expected in January, suggesting the economy was regaining some strength after abruptly slowing in recent months.

 

The signs of a comeback, which are also evident in a surprise gain in construction spending, should bolster the Federal Reserve's resolve to keep scaling back its massive monetary stimulus. Reports from automakers also showed sales edged up from January's weather-depressed levels.

 

"The economy is beginning the slow process of digging its way out of the weather-induced slowdown of recent months," said Millan Mulraine, deputy chief economist at TD Securities.
