R-21-16          Katherine Properties Annexation and Public Facilities Agreement Status - For the purpose of examining the implementation of requirements specified in Resolution R-12-05 Revised and the associated Public Facilities Agreement in light of the annexation standards specified in Section 2.52.070 of the Code of the City of Annapolis, the Planning Commission Analysis of October 20, 2005, the City Comprehensive Plan adopted on October 5, 2009 by City Council Resolution R-32-09 and development activity within the Forest Drive corridor subsequent to the effectiveness of Resolution R-12-05 Revised on March 14, 2006.

Comment: This and the following 3 resolutions all address similar issues. Specifically, the annexations were all done with certain requirements, namely connecting existing residences with water and sewer service from the City. As the title of this resolution suggests, these requirements were restated in each piece of legislation pertaining to the annexation and agreements, which indicates to me that they were important to the drafters and signers of those agreements.

This requirement even impacts each City homeowner, monetarily. That is because the City's fire department's rating by insurance companies, while very good at a "2", would be excellent at a "1" but for these residences getting connected to the City's water and sewer. If the City had a "1" rating, then every resident would pay a lower premium for homeowner's insurance. 

This resolution would ask the City's Planning Commission to examine the Annexation agreements and advise the Council if and how these annexation agreements should be revisited. If the failure to achieve the stated conditions for annexation merits new annexation agreements, then what impact should the subsequently enacted 2009 Annapolis Comprehensive Plan have, and the lack of action on a Forest Drive relief road (which was addressed in the annexation document and required a significant contribution for construction by the developer)?
