The City Council will meet tonight at 7 p.m. in City Council Chambers. My analysis of the agenda is below.

Forest Conservation Act
On the agenda is the introduction of a new version of the Forest Conservation Act and corresponding fine and fee legislation. This version is the result of many months of work by the 4 sponsors of the legislation and others. It represents a compromise version that is meant to replace the pending version sponsored by Alderman Arnett and me, and the version sponsored by Alderwoman Finlayson. Assuming introduction of the new legislation, the older versions will be withdrawn. I'd also like to call out in appreciation the work of Alderman Budge to guide these negotiations and for preparing a chart that compares the FCA Model Act, the 2 previously sponsored versions, and the newly introduced version (O-22-16 FCA Side by Side). For anyone interested in following what changes are made, this document is very helpful and is available on the City website under City legislation.

Assuming introduction, the next step will be a referral to the Planning Commission, which will likely hold a public hearing. Thereafter, it will return to the Council for its own public hearing, then assignment to Council Committees.

Comment: The Consent Calendar is used to quickly get through items that have unanimous support from Council in order to reduce unnecessary time on procedure. 0-16-16         Title 12 Updates and Amendments - For the purpose of updating and amending Chapters 12.04, 12.20, 12.24, 12.28 and 12.32 of the Annapolis City Code to permit an authorized agent of the City to exercise limited authority related to parking enforcement, residential parking permits, towing and other parking matters; to permit the use of modern technology related to parking meters, parking permits and other parking matters; and matters generally relating to Chapters 12.04, 12.20, 12.24, 12.28 and 12.32.

Comment: Currently, only City employees can enforce parking regulations. Recently, the City signed a contract to outsource parking services to SP+. This legislation would allow SP+ to enforce parking regulations. Before approving this legislation, I'd like to ensure that the SP+ employees can't be counted as a police officer for purposes of APF. Other than that issue, I support this legislation.
 
R-15-16         Annapolis Business Academy - For the purpose of approving a project to establish the Annapolis Business Academy that will focus on building better business and creating more sustained economic vitality.

Comment: In October of 2015, the Annapolis Partnership applied for a grant from the State of Maryland for a marketing, merchandising and social media program. They have been awarded a $20k grant and this Resolution will complete the application. The Annapolis Partnership will undertake the project. I will support this legislation.

O-21-16         Title 4 - Elections - For the purpose of amending and updating Chapters 4.28 and 4.44 of the Code of the City of Annapolis concerning absentee voting and fair election practices; and matters generally relating to absentee voting and fair election practices.

Comment: In June of 2014, the City Council created an Ad Hoc Committee to study the 2013 City election and make recommendations regarding changes. Last month, that committee reported to the City Council with its recommendations. This legislation proposes to effectuate those recommendations.
 
O-22-16         City of Annapolis Forest Conservation Act - For the purpose of prohibiting certain development projects from cutting or clearing certain forests within the City of Annapolis (the "City") unless a forest stand delineation and a forest conservation plan associated with such projects are in effect.

Comment: The State passed a Forest Conservation Act in the early 1990s, which the City adopted. That version of the FCA has been disputed for numerous reasons. Previous versions of an FCA have been introduced by the Council without resolution. This version of the FCA seeks to strike a compromise between those previous versions. 
 
O-23-16         Grading Permits for Tree Removal - For the purpose of requiring a Grading Permit when trees having a combined diameter of 60 inches are to be removed from lots 40,000 square feet or greater.

Comment: This legislation seeks to close a loophole for when tree removal is allowed without a permit. 
 
R-17-16          Emergency Meeting Memorandum of Understanding - For the purpose of approving an Emergency Meeting Memorandum of Understanding between the City of Annapolis and Anne Arundel County Public Schools for use of certain County property in the event of an emergency.

Comment: The City of Annapolis Continuity of Government (COG) Plan outlines the functions that the Mayor and City Council aim to perform in the wake of a disaster and in situations that inhibit their ability to carry out normal business. To prepare for the potential loss of access to City Hall, the COG plan identifies alternate facilities for their use. This resolution memorializes an agreement with the AA County Public Schools to use their administration building if necessary.
 
R-18-16          Forest Conservation Act Fees and Fines - For the purpose of setting fees and fines associated with the City's Forest Conservation Act set forth in Chapter 21.71 of the City Code.

Comment: This resolution adds fees associated with reviews of Forest Conservation Plans. Currently, no fees are collected for those reviews despite the hundreds of hours spent on them by staff.

O-13-16         Annual Operating Budget: Fiscal Year 2017 - For the purposes of adopting an operating budget for the City of Annapolis for Fiscal Year 2017; appropriating funds for expenditures for Fiscal Year 2017; defraying all expenses and liabilities of the City of Annapolis and levying same for the purposes specified; specifying certain duties of the Director of Finance; and specifying a rate of interest to be charged upon overdue property taxes.

R-14-16          Major City Dock Special Event Parking Rules - For the purpose of establishing parking rules to be effective during Major City Dock Special Events.

Comment: This resolution will establish parking rules to be effective during major City Dock special events, primarily the fall Boat Show and July 4th celebrations. This resolution creates resident-only parking on Randall Street, East Street, and part of Prince George street during those events. Pending consideration of issues that you raise, I will support this legislation.
 
O-09-16         Removing Members of Boards and Commissions - For the purpose of providing a formal process for the removal of appointed members of City boards and commissions for cause.
Sponsors: Budge and Arnett
Comment: This Ordinance specifies, for the first time, when and how someone can be removed from a City board or commission. While our many volunteers should be thanked and celebrated for their service, it also makes sense to have a formal process for removal, when and if necessary. There are a few amendments to go through tonight but, in general, I support this effort to avoid the confusion created by a removal without a formal process.
 
CA-1-16          Departmental Reorganization - For the purpose of amending the Annapolis Charter concerning: dissolving the Department of Human Resources and the Department of Neighborhood and Environmental Programs; and reassigning certain duties and granting certain authority to the Department of Finance, the Department of Planning and Zoning, the Department of Public Works and the City Manager.

Comment: This Charter Amendment is 1 of 2 pieces of legislation related to a reorganization plan put together by the City Manager, Tom Andrews. The goal is to better group activities so that the process for permit reviews, for instance, is more efficient and smoother for the customer. There aren't large financial savings associated with these plans initially, at least. Of note, the Department of Neighborhoods and Environmental Programs will be split up. I am satisfied that the intent of the reorganization is positive and that the commitment to high environmental standards will be maintained. I have a high degree of confidence in the City Manager and, as the person at the head of the organization of all of the departments and inner workings with staff, am comfortable largely deferring to his recommendations for the organization of those departments and staff. Pending further consideration of issues you raise, I intend to support this legislation.
