The City Council will meet Monday night at 7 p.m. in City Council Chambers. Of particular note is the public hearing on Ordinance 36-15, Adequate Public Facilities which would add school capacity to the review criteria for proposed residential developments. More information is below.

BUSINESS AND MISCELLANEOUS 

GT-06-16         Transfer from Contract Services/Benefits Transfer to Salaries - Planning & Zoning
Comment: This transfer would fund the new position, "Economic Development Manager" from other accounts in the Planning & Zoning budget. Pending consideration of concerns you raise, I intend to vote in favor of this transfer.
 
PUBLIC HEARINGS

O-40-15          Waterfront Maritime Conservation District - For the purpose of amending  Retail Use, the Standards for Uses Subject to Standards and Parking Requirements in the WMC Zoning District.

O-47-15          Moderately Priced Dwelling Units - For the purpose of amending the eligibility requirements for access to moderately priced dwelling units to include individuals working within the United States Naval Academy grounds.

O-48-15          Agreement of Purchase and Sale - For the purpose of approving the purchase and sale of property located at 9 St. Mary's Street, Annapolis, Maryland 21401; and matters generally relating to said sale.

Comment: This Ordinance would effectuate the Council's decision to sell the Old Rec Center to a private builder for $1.5M.

CA-2-15          Charter Amendment, Board of Supervisors of Elections - For the purpose of changing the deadlines for designating and appointing members to the Board of Supervisors of Elections.

R-34-14          2014 West Annapolis Sector Study - For the purpose of adopting the West Annapolis Sector Study as an addendum to the 2009 Annapolis Comprehensive Plan.

O-36-15          Adequate Public Facilities - For the purpose of adding review criteria and certification for adequate school facilities to Title 22 of the Code of the City of Annapolis; and matters generally relating to the adequacy of school facilities.

Comment: This public hearing on this legislation began at the last council session where a number of developers spoke against this bill. Thereafter, I received a number of letters of support, including this very well written one .

This ordinance would add school capacity (the available space at a school for additional students) to the existing list of public facilities, like water supply, police and fire availability, etc., that must be deemed to be in adequate supply before a residential development is approved. Currently, the City does not evaluate school capacity before considering whether to approve a new residential development. The county, on the other hand, does make this evaluation, and their system has been working to balance development and school capacity.

The pending legislation is based on the Anne Arundel County model, including the mitigation available to proposed developers. Non-residential, residential with no new dwelling units, institutions for the care of the aged, and age-restricted residential projects would be exempt from the requirements of this ordinance.

LEGISLATIVE ACTION

For the purpose of City Council Action pursuant to 2.16.090.B: Motion to postpone to date certain not to exceed 90 days, or vote to adopt or defeat O-32-14 and R-38-14

O-32-14          Forest Conservation Requirements and Standards in the City of Annapolis - For the purpose of adopting requirements and standards for forest conservation in the City of Annapolis; providing forest stand delineation and forest conservation plan requirements; providing exceptions to Chapter 17.13 of the City Code; providing for variance procedures; and all other matters generally relating to forest conservation in the City of Annapolis.

R-38-14          Forest Conservation Act Fees and Fines - For the purpose of setting fees and fines associated with the City's Forest Conservation Act set forth in Chapter 17.13 of the City Code.

Comment: Because this legislation has not been voted on yet, it must come back to the Council. A subgroup of the Council, including me, has been working diligently on reconciling various versions of this legislation. I intend to vote to continue these 2 bills to give that subgroup additional time to work towards a resolution.

O-39-15          Towing Company Facility Location - For the purpose of specifying that towing companies licensed by the City of Annapolis may locate their facilities in proximity to the City border.
Sponsor: Finlayson
Comment: Existing law requires that towing companies used by the City are located in the City so that if residents cars are towed, there cars would be relatively nearby. One of the towing companies that the City relies upon moved just outside of City limits on West street. Because their new location would violate the letter but not the spirit of the existing law, this Ordinance loosens the standards slightly to allow the City to use towing companies located within 1 mile of City limits.

O-44-15          Lease of City Property: Fall 2019 Boat Shows - For the purpose of authorizing a lease of certain municipal property located in the general harbor, Dock Street and Edgewood Road areas to United States Sailboat Shows, Inc. and United States Powerboat Shows, Inc., for a certain period of time in October 2019 to conduct boat shows.
Sponsors: Pantelides, Budge, Littmann and Finlayson
Comment: This legislation leases space around City Dock in October 2019 to the Boat Shows in exchange for 50% of their gross receipts, plus $38k for cost reimbursement.
Pending consideration of issues you raise, I intend to vote in favor of this legislation.

O-45-15          Lease of City Property: Spring 2016 Boat Shows - For the purpose of authorizing a lease of certain municipal property located in the areas of Susan Campbell Park, Annapolis City Donner Parking Lot, Ego Alley Water Space, and Old City Recreation Center and other property and water locations as described in the lease to Cruisers University, Inc., t/a Annapolis Spring Sailboat Show, in April 2016, to conduct boat shows.
Sponsors: Pantelides, Littmann, Paone, Budge and Finlayson
Comment: This legislation leases space around City Dock in April 2016 to the Boat Shows in exchange for 35% of their gross receipts. This is the smaller of their shows, and they do not have costs to reimburse because they obtain services from private contractors.
Pending consideration of issues you raise, I intend to vote in favor of this legislation.

R-23-15          Street Rights-of-Way in the Thomas Woods Planned Development - For the purpose of privatizing the street rights-of-way in the Thomas Woods Planned Development in accordance with Section 20.20.01.A of the Code of the City of Annapolis.

Comment: This is a small pending residential development in a forested area. In order to minimize the impact on the environment, the developer and City planners propose that the streets be narrower than as required of public streets.
Pending consideration of issues you raise, I intend to vote in favor of this legislation.

R-24-15          Street Rights-of-Way in the Primrose Hill Planned Development - For the purpose of privatizing the street rights-of-way in the Primrose Hill Planned Development in accordance with Section 20.20.01.A of the Code of the City of Annapolis.

Comment: This is a pending development off of Milkshake Lane. Because Milkshake Lane is private, the developer and City planners propose to make roads in this development private as well. In addition, privatizing these streets gave the City planners additional flexibility in the design of the development to preserve additional trees.

Comment: Because of the short time from of the subject events, Alderman Budge intends to ask the Council to suspend the rules so that we can vote on the resolution on 2nd Reader as well.
