Early in each Council Meeting there is an opportunity for comments by the General Public. The public may comment on any subject that is not on the agenda for a Public Hearing. Comments during this time are limited to five minutes per person.
 
BUSINESS AND MISCELLANEOUS 

Public Works/Water Supply - Transfer from Supplies - Transfer to Salaries and Benefits 
Comment: This is a request by the Director of DPW to reinstate the Instrumentation Technician position at the Water Treatment Plant (WTP). This work has recently been done by an outside contractor on an as-needed basis. However, the new state-of-the-art WTP under construction has advanced electronic equipment and systems that require the need for a full-time Instrumentation Technician. The Director proposes using the existing salary account for the WTP and savings from unpaid leave and temporary vacancies that he has managed during the year and a reallocation from the WTP supplies account. Pending consideration of issues to the contrary, I intend to support this transfer. 

PUBLIC HEARINGS

R-34-14    2014 West Annapolis Sector Study - For the purpose of adopting the West Annapolis Sector Study as an addendum to the 2009 Annapolis Comprehensive Plan.

O-36-15    Adequate Public Facilities - For the purpose of adding review criteria and certification for adequate school facilities to Title 22 of the Code of the City of Annapolis; and matters generally relating to the adequacy of school facilities.

Comment: When I joined the City Council and began to learn about various issues, I was shocked to learn that the existing approval process for residential developments never considered whether the public schools had the capacity to seat children from those developments. The City's approach was that it could not control the schools, so it should stay away from the issue. The school's view is that it has no jurisdiction over City developments.

Alderman Arnett and I attempted to address this issue in 2013 with legislation that would have required "consideration" of school capacity. The response from critics was that "consideration" was vague, that the process differed from the County process, and that there was not a sufficient ability for the developer to mitigate the issue. The pending Ordinance addresses those critiques, while addressing the underlying issue, in a balanced approach.

The pending legislation is based on the Anne Arundel County model, including the mitigation available to proposed developers. This ordinance proposes that school capacity become one of the public facilities that is tested at the time of Adequate Public Facility Review. The goal of the ordinance is to ensure that the capacity of the elementary, middle, and high schools can support additional students before an application for a residential subdivision of more that five dwelling units is approved. Non-residential, residential with no new dwelling units, institutions for the care of the aged, and age-restricted residential projects would be exempt from the requirements of this ordinance.

A conditional review process will allow projects in restricted areas to continue through the review process with an approval contingent upon capacity becoming available or after a six-year waiting period.

CA-1-15      Issuance of Revenue Bonds - For the purpose of authorizing and providing for the issuance of revenue bonds by the City of Annapolis.
Sponsor: Budge, Pantelides
Comment: The proposed legislation would allow the City to issue revenue bonds instead of general obligation bonds for enterprise fund needs. This is a practice that has been recommended by the City's Financial Advisory Commission, who also endorses this legislation. 

Payment of revenue bonds are secured by the corresponding revenues from the associated enterprise fund (i.e., water or sewer funds), whereas general obligation bonds are secured by taxes. The option of having revenue or general obligation bonds gives the City greater flexibility. 

I welcome input from you before reaching a final opinion on whether to support this legislation.
