R-21-15      Amending 2015 Dates of First Sundays Festivals - For the purpose of amending the dates on which the First Sundays Festivals are authorized to sell merchandise in the Historic District by adding the first Sunday in November and removing the first Sunday in December of year 2015.

Comment: The legislation changes the date of the last of these festivals for the year from December 6 to November 1. Pending consideration of issues you raise, I intend to vote for this legislation.

R-22-15      Street Rights-of-Way at the Enclave at Spa - For the purpose of
privatizing the street rights-of-way in the Enclave at Spa residential
planned development in accordance with Section 20.20.01.A of the Code
of the City of Annapolis.

Comment: The subject property is the old radiator shop on Spa Road near Hilltop Lane. It is surrounded by residential developments. The developer plans to do significant remediation of environmental hazards created by previous owners and reduce impervious surfaces and otherwise better control storm water. To accommodate those plans and to improve the aesthetics of the entrance, the developer has sought to build streets that don't confirm to City standards for width. I support that deviation because of the associated benefits with this redevelopment project.

My concern is whether the streets need to be private or can stay public to accomplish these goals, a point astutely raised by Alderman Budge. Other neighborhoods have struggled to maintain private roads, so I and other colleagues have been reluctant to permit additional streets to be privatized.  The City Attorney is now exploring options with the developer to see if the streets can stay public without disrupting the developer's plans. If the roads can stay public, and still be built as planned, then I'd prefer and support that result. Otherwise, I'd support the request to privatize the roads to avoid jeopardizing this project, which is the type of redevelopment that I believe the City should encourage and support.
