The City Council will meet on Monday, April 7, at 7 p.m. in City Council Chambers. 
 
The highlight of this Council session is the public hearing on the annual budget legislation. Your comments and thoughts are very important, and I encourage you to attend and provide your testimony.

 

News Since the Last Meeting 
The City held an emergency de-briefing Wednesday morning with the Public Safety Department Heads to discuss the City's response to the accident on Forest Drive that snarled traffic on Monday. The group will "devise a strategy that will improve decision making, improve coordination between agencies and improve communications with our residents, elected officials and our staff."

PUBLIC HEARINGS

 

O-8-14     Annual Operating Budget: Fiscal Year 2015 - For the purposes of adopting an operating budget for the City of Annapolis for Fiscal Year 2015; appropriating funds for expenditures for Fiscal Year 2015; defraying all expenses and liabilities of the City of Annapolis and levying same for the purposes specified; specifying certain duties of the Director of Finance; and specifying a rate of interest to be charged upon overdue property taxes.

O-9-14     Capital Budget Fiscal Year 2015 - For the purpose of adopting a capital budget for Fiscal Year 2015; and appropriating funds for expenditures for the Fiscal Year 2015 Capital budget.

 

R-12-14     Capital Improvement Program Fiscal Years 2015 - 2020 - For the purpose of adopting a capital improvement program for Fiscal Years 2015-2020 (July 1, 2014 - June 30, 2020). 

 

R-10-14    FY 2015 Fees Schedule Effective July 1, 2014 - For the purpose of

specifying fees that will be charged for the use of City services for FY 2015. 

 

R-11-14     Position Classifications and Pay Plan - For the purpose of approving the FY 2015 position classification and pay plan effective July 1, 2014.

 

My Comment to the Budget Legislation:  To see the proposed budget, go here, then click on "FY2015 Mayors Proforma.pdf". For a sense of significant differences from last year's budget, note the lines with changes in revenue and spending. 

 

The Finance Committee holds weekly meetings with various departments to discuss the budget and options. Nothing is final yet - your opinions matter. Please come to this public hearing to voice your preferences and suggestions.

 

O-1-14     Single-Family Attached Dwellings in C1A Special Conservation District - For the purpose of deeming conforming those single-family attached dwellings lawfully existing on June 20, 1994, in the C1A Special Conservation Residence District.

 

My Comment:  The ordinance is proposed in order to grant some relief to property owners of single-family attached structures that are seeking to expand their home. By deeming single-family attached structures conforming for the purposes of expansion, the City recognizes the legitimacy of existing single-family attached units while keeping historic densities by not allowing new housing other than single- and two-family structures. The right of expansion is already allowed for single- and two-family units, and the proposed ordinance would confer this right on townhouse and row house structures.

 

O-7-14     City Budget: Referrals to the Financial Advisory Commission and City Grants to Non-Profit Organizations - For the purpose of authorizing the
referral of the annual operating budget and capital budget with the capital
improvement program to the Financial Advisory Commission upon introduction
of the ordinances before the City Council; revising City standards for making
operating and/or capital grants to non-profit organizations; and the reporting
process for recipients of operating and/or capital grants. 

 

My Comment:  I requested this legislation to modify the City's Code to reflect actual practices (the referral of the budget to the FAC). This legislation also enhances the standards for grants the City gives. At this public hearing, past or potential recipients of City grants could offer valuable testimony on how the different standards could affect their organization.

 

O-11-14     Lease of Public Parking Lots to FRESHFARM Markets, Inc. - For the purpose of authorizing a lease of municipal property located at 110
Compromise Street from May 4, 2014 through November 23, 2014 (with the
exception of October 12, 2014 and October 19, 2014 for the Fall Boat Shows)
to FRESHFARM Markets, Inc.

 

My Comment:  This lease refers to the Farmer's Market held on Sundays at the above referenced property. Pursuant to the terms of the lease, the monthly rent would be $50. Last year when this lease was debated, some citizens suggested that rent is not sufficient. At this public hearing, I welcome the public's view of the market and rent collected. Separately, the lease provides for recycling collection, in addition to trash collection, like it was amended to last year.

 

  

LEGISLATIVE ACTIONS 

 

2ND READERS - RESOLUTION

 

R-14-14     Special Event Applications - For the purpose of authorizing City Council approval of selected special events per R-14-12, implementing a
moratorium on administrative approvals for events at City Dock; designating specific dates for the sale of merchandise in the Historic District in conjunction with only the approved special events; waiving City fees for the USNA Band Concert Series; and the reimbursement of full fees to the City for the cost associated with the other approved events.

My Comment: This legislation permits certain defined special events. By way of context, the City has been operating under a moratorium of special events, except as permitted by resolutions such as this pending one. Many interested parties have been spending countless hours crafting a new system for permitting special events, to balance the many competing demands and issues. Until that legislation is crafted and implemented, my inclination is to permit the events that have been held in recent years. Pending comments by you and Council colleagues that convince me otherwise, I intend to vote for this resolution.

 

1ST READERS - ORDINANCES

First Reader is a bill's formal introduction to the Council for consideration. Generally, I will vote in favor of a bill on First Reader, even if I disagree with it, so that the bill may be heard and discussed by the Council and the public.  The following bills are being introduced on First Reader:

 

O-2-14     Water Service to the Chesapeake Harbour Subdivision - For purpose of authorizing and approving an agreement regarding the provision of water service to the Chesapeake Harbour Subdivision.  

 

My Comment:  The proposed ordinance concerns the provision of water service by the City to the Chesapeake Harbour Subdivision, which is outside of City limits. The City provides water to Chesapeake Harbour pursuant to a Water Agreement signed in 1984. The Water Agreement states that the owners in Chesapeake Harbour are to pay the City two times the rate charged to similar City users of City water.

 

In 2006, the City Council amended the City Code to require water customers outside of the City to pay three times the rate charged to similar City users of City water, and the City implemented this higher rate to Chesapeake Harbour owners. Those owners have contested the City's right to charge them the higher rate. The proposed ordinance would authorize and approve an agreement with Chesapeake Harbour Subdivision that resolves this issue by reducing the water rate as provided under the initial agreement (the two times rate) and a negotiated settlement of the intervening years.

 

 

O-13-14     Repeal of Police Residency Requirement - For the purpose of repealing the requirement that sworn employees of the Police Department reside within a thirty-mile road radius from the City line.

My Comment: Generally, these types of residency requirements are intended to ensure a workforce that is invested in the community it is employed by. Critics argue that residency requirements encourage political rather than professional hires. Reportedly, this residency requirement has not be enforced in decades, and its elimination would aid in the recruitment and retention of a workforce.

    

BUSINESS AND MISCELLANEOUS

 
ID-13-108    Approval of Community Development Block Grant Allocations

My Comment: The U.S. Department of Housing and Urban Development (HUD) provides funds for the City's Community Development Block Grants. The FY 2015 total is $247,696, of which 15% ($37,154) must go to Public Services Projects, and 85% ($210,542) must go to Capital Projects. Applicants submitted and presented proposals for grants to the Housing and Community Development Committee, of which I am a member. The Committee unanimously recommended the allocation of funds as follows:

Center of Help: $11,000

OHLA: $1,000

OIC: $9,154

Restoration Community Dev. Corp.: $6,000

Volunteer Center: $10,000

 

CAPITAL PROJECTS

Arundel Lodge: $23,740

Housing Rehabilitation Rehab Units: $104,302

Housing Rehabilitation Administration: $30,000

Housing Authority: $27,500

Light House: $25,000

 

Pending the opinions of you and Council Colleagues, I will vote in favor of the Committee's recommendations. 


AP-02-14     Appointment to the board of Supervisors of Nominations 

 

AP-03-14     110 Compromise Street Committee (pursuant to R-3-14) 

 

My Comment: The Council previously passed a resolution establishing a committee to explore the purchase of the above-referenced property. At this meeting, the Council will name 2 members of the committee, a real estate attorney and a professional developer.
