Seventy-two killed resisting gun confiscation in Boston!

Boston - National Guard units seeking to confiscate a cache of recently banned assault weapons were ambushed by elements of a Para-military extremist faction. Military and law enforcement sources estimate that 72 were killed and more than 200 injured before government forces were compelled to withdraw.

Speaking after the clash, Massachusetts Governor Thomas Gage declared that the extremist faction, which was made up of local citizens, has links to the radical right-wing tax protest movement.

Gage blamed the extremists for recent incidents of vandalism directed against internal revenue offices. The governor, who described the group's organizers as "criminals," issued an executive order authorizing the summary arrest of any individual who has interfered with the government's efforts to secure law and order.

The military raid on the extremist arsenal followed wide-spread refusal by the local citizenry to turn over recently outlawed assault weapons.

Gage issued a ban on military-style assault weapons and ammunition earlier in the week. This decision followed a meeting in early this month between government and military leaders at which the governor authorized the forcible confiscation of illegal arms.

One government official, speaking on condition of anonymity, pointed out that "none of these people would have been killed had the extremists obeyed the law and turned over their weapons voluntarily."

Government troops initially succeeded in confiscating a large supply of outlawed weapons and ammunition. However, troops attempting to seize arms and ammunition in Lexington met with resistance from heavily-armed extremists who had been tipped off regarding the government's plans.

During a tense standoff in the Lexington town park, National Guard Colonel Francis Smith, commander of the government operation, ordered the armed group to surrender and return to their homes. The impasse was broken by a single shot, which was reportedly fired by one of the right-wing extremists.

Eight civilians were killed in the ensuing exchange.

Ironically, the local citizenry blamed government forces rather than the extremists for the civilian deaths. Before order could be restored, armed citizens from surrounding areas had descended upon the guard units. Colonel Smith, finding his forces over matched by the armed mob, ordered a retreat.

Governor Gage has called upon citizens to support the state/national joint task force in its effort to restore law and order. The governor also demanded the surrender of those responsible for planning and leading the attack against the government troops.

Samuel Adams, Paul Revere, and John Hancock, who have been identified as "ringleaders" of the extremist faction, remain at large.

And this fellow Americans, is how the American Revolution began, April 20, 1775.

Many of them lost everything, including their families and their lives over the course of the next few years.

Palestinian jihadist group claims credit for Arizona wildfire



A Palestinian jihadist group, Masada al Mujahideen, recently claimed credit for ongoing wildfires in Arizona in a statement posted to jihadist forums today. The statement, titled "Masada al-Mujahideen Fulfilled its Promise and Attacked America Again After the Expiration of the Period with Fires that Achieved Historic Results," was obtained and translated by the SITE Intelligence Group.

"We had previously announced an unconventional war against the occupation state of Israel, and then we escalated this war to reach its main supporter, America, so that it receives a major share of it, which will destroy their flora and fauna, with permission from Allah and then with our hands," the group said.

The statement further said that the group targeted the United States "in order to make it clear and to make it know we can reach it when we warn it, and to make it certain that our hands don't just reach it but also strike it."

The group warned that the attacks "will not be the last...if America does not respond to our demands." The statement boasted that 19 firefighters had been killed in the fires.

Contrary to the claims of Masada al Mujahideen, authorities have said that they believe the fires were started as a result of lighting.

Today's statement was not the first highly dubious claim by the jihadist group related to fires in the US. In January 2012, the group claimed credit for wildfires in Nevada.

According to SITE, in addition to claiming responsibility for fires in the US, the jihadist group has claimed credit for more than a dozen fires in Israel since 2010.

Masada al Mujahideen 
Masada al Mujahideen announced its formation in April 2008 and said its leader is Abu Omar al Ansari, according to SITE. The terror group has claimed numerous attacks against Israel, including rocket and mortar attacks.

US Ambassador to Egypt Vows to Apply Pressure to Support Muslim Brotherhood

There are always two stories in America. There is the one that comes from Obama's mouth and then there is the truth. The truth of the matter is that this administration was "all in" on a Muslim Brotherhood controlled Egypt. You can't trust a word they say now that Morsi has been overthrown. Although I have little doubt that Obama would gladly throw Morsi, or anyone else, under the bus for his own benefit, we should not be so sure that this administration is done with The Muslim Brotherhood. There are reports coming from a very respected journalist in the Arab world that Anne Patterson is turning up the heat and vowing to apply pressure:

Evidence that the Obama administration is unhappy with the Egyptian people's liberation from Muslim Brotherhood rule continues to emerge.  As reported today by Youm 7, according to Muhammad Heikal - "the Arab world's most respected political commentator" and for some 50 years a political insider - soon after the overthrow of Morsi, U.S. ambassador Anne Patterson assured Hisham Qandil, who hours ago was Egypt's Prime Minister, that "there are many forms of pressure, and America holds the keys to the Gulf."

Such blatantly pro-Muslim Brotherhood assurances by Patterson are consistent with many of her other actions in Egypt, which have led most Egyptians, including politicians and activists, to refer to her as a Brotherhood stooge.  Among other things, in the days leading to June 30, she called on Egyptians not to protest - including by meeting with the Coptic Pope and asking him to urge the nation's Christian minority not to oppose the Brotherhood, even though Christians have naturally been the most to suffer under Morsi, especially in the context of "blasphemy" accusations.

Thus, and once again, the Obama administration makes indubitably clear that its primary interest in Egypt is to see the Muslim Brotherhood stay in power, the Egyptian people's will - the will of tens of millions of secularists, liberals, moderates, and Christians - be damned.

News from the Arab world last week was that Anne Patterson was accused of being part of a Muslim Brotherhood "sleeper cell."

If we are more organized and collaborate, we will be stronger in our battle to defend and preserve our RKBA in Pennsylvania and across America.
 
We have little time to waste in pulling together our resources to preserve and expand our RKBA in Pennsylvania.  Recently we have had our AG Kane revoke the reciprocity with FL permits, seen the stalling of HB357 Federal Nullification bill, and various attacks by Bloomberg financed anti-gun groups pushing for gun control legislation.  There is an alarming prospect of having a liberal anti-gun Governor for the next term.  We need to join forces now!
 
This will be a fun event for the family.  Gifford Pinchot State Park is located centrally and is just south of Harrisburg with easy access from the PA Turnpike.   Two pavilions are reserved and there will be horseshoes and baseball (bring your own equipment).  We will have hamburgers, hot dogs and drinks for those who sign up.  Feel free to bring along your own sides (e.g. chips, pretzels).

Concerned Gun Owners of Bucks Co (CGOBC) was a grassroots group quickly formed in the wake of renewed calls for infringement on our guaranteed Civil Liberty to bear arms in defense of our persons under the PA and Federal Constitutions.  There was such intense response and passion from all walks of 

life and we found the growing pains rapid.  

 

In the face of very well funded and organized opposition from out of state anti-liberty groups we ultimately decided together that the best course of action was going around that wall instead of over it, and to that end we decided to morph into 2 specialized groups with the same end goal of preserving our inherent rights.  One would focus solely on legislative action tactics and outreach aimed at a target audience (PA4SP) and the other on public awareness events and energizing the core (CGOPA), and they would both work together as one towards the ultimate goal of stopping statist infringement on our rights.  

 

While CGOBC was always neutral on open carry at events, PA4SP feels that it is not the best tool for their approach.  CGOPA on the other hand will utilize it at public events to demonstrate to the public that firearms are merely inanimate tools and are more often used to deter crime merely by their presence.

 

Our rallies are held to gather the support of local gun owners to strengthen our cause. Pennsylvanian's right to open carry is recognized by our state government and our state constitution. It is not our prerogative to dictate law, or tell Pennsylvanians they cannot exercise their rights. We are a firearms rights organization; we support not some of those rights, but all of them.

 

I want to remind all of you that our PA Unite The Fight Event at Gifford Pinchot State Park(click on the events tab above) is just 14 days away. We are looking for a little help to pull this off from our members. We are looking for any groups or individuals who can assist with the necessary provisions (for a couple hundred people) for the event. For instance Concerned Gun Owners of Pennsylvania will be providing Hot Dogs and Hamburgers for that day.

We will still need some help with the list below.

  • Ice and coolers
  • Charcoal and lighter fluid
  • A couple of larger portable grills to supplement the ones provided
  • Soda
  • Water
  • Paper Goods (plates, napkins, utensils, tablecloths)

Our vision for future Founder's Dinners is to inspire and inform not only our alumni and current CCS families but to inspire and inform the Tri-County Area and even our region by hosting speakers and artists who can uniquely assist us in celebrating the heritage, core values, and mission of CCS while also lifting our vision for an even greater future built upon the foundation of our past. The caliber of our speakers and guest artists should provide us with wonderful opportunities to share our CCS story with new partners in Christian education. Common Core State Standards

WHAT IS COMMON CORE?

Common Core, or the Common Core State Standards Initative (CCSSI), as it is known at the State and Federal level, is a set of national education standards that will fulfill the No Child Left Behind (NCLB) Act, through a waiver system. (The NCLB Act was put into place by Congress in 2001 and signed into law by President George W. Bush). Many states were failing to meet the NCLB Act requirements and, therefore, wanted something to replace NCLB.Common Core is part of the UN's plan for complete federal control over our education systems and the "Dumbing-down" of America.

 

Common Core State Standards Initiative (CCSSI) are not state standards in the first place, and are nothing more then further federalization of our state education systems.

 

COMMON CORE IS A TROJAN HORSE AND TIED TO THE UNITED NATIONS (UN)

If you cannot see that Common Core is tied to the United Nations you have not done your homework! The major funder of the Common Core Movement is the Bill and Melinda Gates Foundation which has pledged $60 million dollars to this effort. Bill and Melinda Gates are tied to UN through-and-through and have spent money in America and overseas for UN programs in Africa and all over the world for decades.


From the Conservative Teachers of American organization, they wrote an article entitled: "Common Core Standards and the Federalization of Education." In this article we read: "Many are concerned that the Common Core Standards, once successfully implemented, will provide unfettered access of our educational system by the United Nations. Some textbooks and curricula for our public schools have already been written by the [United Nations Educational, Scientific, and Cultural Organization] UNESCO and the International Baccalaureate program, that is currently in many school districts, across the United States. Grabbing additional access is a natural next step. Once they write the curricula, they must have authority to develop all testing tools."

 

The UN involvement in the American educational system has already been facilitated by treaties signed by American presidents from both parties. Those documents include but are not limited to: Universal Declaration of Human Rights, Treaty on the Rights of the Child, Civic Education: Classroom Connections, and Agenda 21.

 

The  US Partnership for Education for Sustainable Development (since 2003), is the nexus of the UNA-USA and Global Leadership Coalition at the Department of Education, which altogether leverages the UN Decade on Education for Sustainable Development 2005-2014.  UNESCO, the lead agency of the Decade, defines Education for Sustainable Development as "education for everyone everywhere" for the "lifelong learning" of "present and future generations".  

 

The UNA-USA sponsors Model UN across America and tailors its Global Classrooms curricula to whichever setting the kids happen to be participating.  Children are unknowingly trained to respond with prescribed consensus to the situations, simulations and stimulation's of the particular activity (Delphi Technique).  Global Kids is the CFR arm of Connect All Schools Consortium, a new Department of Education network, led by Independent Sector and The White House via United Planet Partners.  Global Kids is preparing children for Agenda 21.  

 

The White HouseNSA and CIA now have website divisions aimed at kids.  The Public Education Network is a national association funded by Independent Sector donors: plus Goldman Sachs, JP Morgan, the Carnegie Corporation of New York and the Department of Education

 

"Funders" of the Rockefeller Foundation-backed International Council for Local Environmental Initiatives (ICLEI), "Members" of the the Sustainability Consortium, backed by the EPA and BSR (Rockefeller Foundation, Rockefeller Brothers Fund, State Department) and the Bill and Melinda Gates Foundation-backed International City/County Management Association (ICMA): Center for Sustainable Communities (an ICLEI "Partner") are "partnered" with local schools and governments.  

 

From the Partnership for 21st Century Skills aligning the Common Core State Standards with "professional development" content for teachers and principals and Lego Robotics curricula for students (Carnegie Mellon/Lego Education); to software curricula through websites like: cyberschoolbus.un.org, icivics.org, atomiclearning.com, renlearn.org, brainpop.com and ttl4.sunburst.com; to the weekly deliveries of Time for Kids magazine and textbook curricula into classrooms; kids are programmed with UN-defined values.  State Governors administer Federal funds to "Community-Oriented Policing" systems like Crime Stoppers (The UN, FBI and other law enforcement and corporate partners administer Crime Stoppers International), the local student-equivalent of the Department of Homeland Security's' "See Something, Say Something" campaign; whereby children see hand-drawn posters of child characters on school walls displaying "Eyes Looking", "Ears Listening", "Mouth Reporting" with a hotline to call.  Presidents Bush and Obama have personally followed the George H. W. Bush/Clinton trail of the Agenda 21/ Sustainable America megabanks-maze in "bipartisan" fashion. 

 

UNESCO PLEDGES SUPPORT OF COMMON CORE

From UNESCO's document "The Vision of Education Reform in the United States" it states: "My department has been pleased to partner with the US Agency for International Development to help ensure that our best domestic practices are shared world-wide. The United States provides over a billion dollars annually to partner countries working on educational reform. Our goal for the coming year will be to work closely with global partners, including UNESCO, to promote qualitative improvements and system strengthening....Ultimately, education is the great equalizer. It is the one force that can consistently overcome differences in background, culture, and privilege."

 

THE UN'S AGENDA 21- COMMON CORE IMPLEMENTER!

In the United Nations Agenda 21 (Guide for the 21st Century), Chapters #25 and #36 specifically talk about education of our children:

 

Principle #25- "Children and Youth in Sustainable Development." In the "Activites 25.9.d" it states: "Ensure access for all youth to all types of education, wherever appropriate, providing alternative learning structures, ensure that education reflects the economic and social needs of youth and incorporates the concepts of environmental training, implementing innovative methods aimed at increasing practical skills, such as environmental scouting."

 

Principle #36- "Promoting Education, Public Awareness and Training." In the Activities Section of this document in "36.5.g" we read: "Within two years the United Nations system should undertake a comprehensive review of its educational programmes, encompassing training and public awareness, to reassess priorites and reallocae resources. The UNESCO/UNEP International Environmental Education Programme should, in cooperation with the appropriate bodies of the United Nations system, Governments, non-governmental organizations and others, establish a porgramme within two years to integrate the decisions of the Conference into the existing United Nations framework adapted to the need of the educators at different levels and circumstances. Regional organizations and national authorities should be encouraged to elaborate similar parallel programmes and opportunies by conducting an analysis of how to mobilize different sectors of the population in order to assess and address their environmental and development education needs."

 

In the Activities Section of this document in "36.5 h" we read: "There is a need to strengthen, within five years, information exchange by enhancing technologies and capacities necessary to promote environment and development education and public awareness. Countries should cooperate with each other and with the various social sectors and population groups to prepare educational tools that include regional environment and development issues and initiatives, using learning materials and resources suited to their own requirements." Sounds just like PARCC and SLDS. ASU's Institute for Global Sustainability and their "Sustainable Cities Network" is doing a fine job "brain-washing" our students in our high schools on sustainability, global warming (aka climate change), etc. Go here to meet the ASU sustainability schools!

The proponents of Common Core say that the standards ARE state led because they were developed by The National Governors' Association.

A group that allowed this kind of rhetoric to be said at their meeting? I don't think I want them developingeducational standards!  Please read to the bottom for transcripts from the 1987 NGA meetings chaired by Bill Clinton.  These transcripts are eye-opening.  They are clearly more concerned with workers for the manufacturing.  They seem to have concerns that we have students who can't read well enough (non-English speaking especially) to function in the manufacturing plants, and then on the other end of the spectrum... too many with higher ed degrees who don't WANT to work in the manufacturing.  So... what to do about all this?  Hummm.... standards!  Make sure they read well enough to function as the industrial workers, but not so well that they don't want to!!!   This is the John D. Rockefeller goal of the early 20th century when he started pushing for compulsory government schooling and funding the building of government schools.

June 11, 2013: Sen. Tom Harkin (D-IA) leads the Senate Health, Education, Labor and Pensions (HELP) Committee in a markup of the Strengthening America's Schools Act of 2013, an education initiative to replace No Child Left Behind.  http://www.c-spanvideo.org/event/220036

At the June 10 Common Core forum in Fayette County, Superintendent Barge stated over and over again that if Georgia wants to change these standards at any time, we have the ability to do so.   The testimony below contradicts this belief by Superintendent Barge and confirms that states who adopted the Common Core standards DO NOT have the ability to change the standards in any way on their own.

2:23:00 - Rep. Tim Scott discusses his amendment to Harkin's bill.  Instead of states being forced to adopt blanket standards like Common Core as a prerequisite for funding, let's put decision-making back in the hands of parents and teachers in our communities."

2:31:00 - It is admitted that states who want to change the CC standards,the Secretary of Education would have to approve it.  States DO NOT have the ultimate decision making abilities!

2:39:00 - Alexander reads page 89 of the bill stating that any changes to standards MUST go through the Secretary of Education for approval.

As are most of the amendments offered by Republicans to this education bill, the Scott Amendment is defeated 12-10.


DATA COLLECTING: Senator Burr at the 1:00:00 mark reveals information about ADDITIONAL data points that this legislation will add to the data mining.  He says that his count is now 500 data points.  

TEACHER EVALUATIONS: Senator Alexander at 2:00:00 mark discusses his amendment to end federally mandated school and teacher evaluations.  He says states had a "gun to their head" to adopt the teacher evaluations because they were desperate for NCLB waivers.   He makes the charge that the Harkin bill creates a "NATIONAL SCHOOL BOARD. The Gates Foundation involvement is mentioned frequently.  

Harkin says over and over "this is voluntary."  If states don't want to implement the programs in the bill we just don't accept the money!"    More strong evidence that our states need to "just say no" to all federal education dollars.   As is pointed out in this debate: Any private business that entered into a partnership where the partner who contributed 10% funding got 80-90% of the control (as is the case with education funding under NCLB and Common Core) the partnership is DOOMED TO FAIL!

The Growing Threat of Smart Meters

Sustainable Development is code for a policy designed to transform human society, essentially eliminating individual life decisions and replacing them with top - down, one-size-fits-all government control. In steady fashion, the agenda for this new policy, designed at the international level, is put into place piece by piece with a new government council here, and new regulation there, each designed to appear as a "local" development program. Like the proverbial frog in the slowly boiling pot, many Americans fail to notice the rise in government heat. 

The main course of action to impose the new agenda is through the pretense of environmental protection; "Sorry about your rights, but if we don't save the planet, then we will all perish!" And so with the devastation of a thousand pin pricks, America and its form or government is being changed through the creation of non-elected boards, councils and regional governments, designed to enforce the new regulations and "assure that we protect the environment."

The pin pricks come disguised as such issues as controls on community development; controls on use of private property; controls on use of open space; creation of development areas, many times under the excuse of historic preservation; communities designed on the blue print of pack and stack housing; making it harder to drive as roads are narrowed, even forcing cars to share the road with bicycles; the enforcement of expensive mass transit boondoggle projects; and the never ending spending spree on inefficient, unworkable alternative energy, such as wind and solar power.

In fact, control of energy and water are the two most effective tools in the enforcement of the Sustainable Development agenda. Without energy and water, human society stops. Using strict controls on how, or even if, energy and water can be used provides government with the power to dictate every aspect of society.

Mandatory Biometric Enrollment
Lawsuit - UPDATE

If you value liberty and understand how dangerous government mandated biometric ID is to our freedom, you need to read and understand every word of what I am writing about today. Something very important is happening so stay with me.
 
Over the years, the Constitutional Alliance has consistently fought against mandatory biometric ID and for the right of all citizens to be free of it.  Government mandated biometric ID is the lynchpin of the modern surveillance society.  The amount of control this system gives government over individuals is an anathema to a free society and we oppose it being imposed on anyone - period.  You cannot reconcile a free society with a surveillance society.
 
The founders of this country called religious freedom "the first freedom" because it is a precondition for other important rights..  Try to imagine the value of freedom of speech, or freedom of association without religious freedom and you will quickly see why religious freedom, also referred to as 'freedom of conscience' is so important.
 
Here is the Big News
 
This past week, 19 June 2013, a Motion for Summary Judgment was filed in Kaye Beach's lawsuit in the state of Oklahoma (You can read it here).  This is a pre-trial motion that presents the undisputed facts of her case and makes the strongest assertion based on those facts, that her rights are being violated.  The Motion for Summary Judgment asks the Judge, based on these undisputed facts, to rule in her favor.  Kaye fully expects a favorable ruling on this Motion but in the event that this doesn't happen, her lawsuit will continue on. You need only to read the first 30 pages of the Motion to understand the arguments Kaye and her attorneys have made.  If you choose to read further you can read about the answers the Department of Public Safety (the department that oversees the issuance of driver's licenses) gave to Kaye's "Discovery Motion". 
 
Kaye Beach's lawsuit, is the only substantial challenge to government mandated biometric ID, to my knowledge, that exists anywhere in our country.
 
Here is a brief recap of the issue and basis for Kaye's legal challenge;
 
Kaye is opposed to mandatory biometric identification which is required of her if she wishes to have a state issued driver's license or ID card.  As we know, the ability to drive a vehicle and also banking, many financial transactions, as well as a host of other necessary daily activities are dependent upon having a government issued photo ID most commonly presented in the form of state driver's license or ID card. Try to go without one and you will soon find (like Kaye has!) that not having a valid ID is no small matter.
 
In September, 2011 Kaye filed a lawsuit against the state of Oklahoma for the unwarranted collection of her biometrics and for violating her religious freedom, both of which are protected under Oklahoma law.  Kaye is a born again Christian.

We must stop the call for a  Constitutional Convention! 

 

Article V of the Constitution:

  1. Gives NO guidelines for how to conduct a Con Con. 
  2. NO rules on how delegates will be eligible or selected
  3. States have NO Guarantees they will even be represented
  4. Con Con could result in a COMPLETE CHANGE of our way of government
  5. There simply are NO controls over the delegates once selected.             
 
We must stop the call for a
Constitutional Convention!

Those pushing the idea are powerful and well funded. Every single state government and all state legislators in the nation have received very expensive, professionally-produced packages detailing how a Con Con could be called and controlled for a Conservative agenda.
 
This is an outright lie. A Con Con can not be controlled and there can be no guarantee that delegates will do anything they are instructed to do.
 
By calling a Con Con our precious Constitution will be placed on an operating table and cut to ribbons. Nothing is more dangerous to our Republic.
 
But the movement for a Constitutional Convention is gaining strength. Conservatives are being targeted because of our love of the Constitution and our frustration over how it is being ignored by those leading our government.
 
The effort is misguided, dangerous and just plan wrong.    
 
We must stop this movement now.
 
Urgent: I have enclosed a petition to your state's Governor asking him/her not to sign on to the Con Con movement.
 
You and I must deliver thousands of these petitions to every single Governor as fast as we can. They must know that Americans across the nation do not support this certain destruction of our Constitution.  
 
Please sign your petition and we will email it immediately to your state governor.
 
This new Con Con effort is very serious. The organizers are misguided in thinking they can control a Con Con once it has been called.
 
But that's what they are telling state legislators and Governors. And many who truly want to fix our problems are starting to believe it.

We must also address the fact that we're soft on criminals caught in crimes and aren't deported. No other country would allow this to continue. 40% of them entered the country legally and overstayed their visas. Yet there's still no reliable method to verify if Visa overstays have left the country. Another incentive that must be addressed is the birthright citizenship program that has resulted in millions of children and parents receiving instant rights and benefits. Some have called them "GPS babies" and this certainly cannot be what the authors of the 14th Amendment intended to occur. Public housing and other benefits are provided for the illegal parents through their 'anchor children' while citizens are turned away because of limited resources. This antiquated program must end. Government agencies and officials at all levels must address the costs associated with this kind of abuse. Past mistakes have been made in attempts to fix illegal immigration and our communities can no longer afford these kinds of mistakes.

When it comes to ObamaCare, Nancy Pelosi has a way of putting things that, in a roundabout and unintended way, sheds light on reality. For instance, before the law passed, she told us, "We have to pass the bill so that you can find out what is in it." Then last week, she declared, "[W]hen we celebrate Independence Day we'll also be observing health independence. ... It captures the spirit of our Founders."

Memo to Nancy: There's a difference between dependence and independence.

Just in time for Independence Day, Barack Obama announced that he would use his despot-like executive power to delay for one year the employer mandate until 2015. That, of course, just happens to be after the 2014 elections, thereby sparing Democrats much inconvenience. So much for their month-old 2014 strategy to "own ObamaCare."

The mandate requires that businesses with 50 or more employees provide government-approved health insurance for their employees or pay a penalty of $2,000 per employee. The requirement is already costing businesses and thereby creating unemployment. On the other hand, the individualmandate, which the Supreme Court upheld as a "tax," remains in effect for 2014. The mandates are the heart of the law -- the reason Obama can claim "universal coverage." How can one work without the other?

In short, the law isn't even fully in effect but has become exactly what one of its authors, Sen. Max Baucus (D-MT), labeled it earlier this year: "a huge train wreck." Or as Chris Jacobs of the Heritage Foundation put it, "It is hard to understate the impact of today's devastating admission from the Administration that, after three years, it still cannot implement Obamacare without strangling businesses in red tape and destroying American jobs."

In related news, the Tenth Circuit Court of Appeals ruled last week that the federal government infringed on the religious liberties of the Green family of Oklahoma by forcing their company, Hobby Lobby, to comply with ObamaCare's contraception mandate. The Obama Department of Health and Human Services (HHS), unmoved by such trivial things as the constitutionality of its actions, finalized the mandate the same day the ruling was handed down, compelling the Tenth Circuit to issue a restraining order preventing the government from enforcing its mandate against Hobby Lobby.

The HHS mandate, supposedly rewritten to provide broader religious exemptions, was finalized in almost the same form in which it was originally presented two years ago. There are currently 60 lawsuits that challenge the mandate, and 21 temporary halts to its enforcement have been granted.

None of this, however, stopped the American Library Association from willingly becoming a mouthpiece for ObamaCare, agreeing to use 17,000 public libraries as information centers and way stations for uninsured individuals to sign up for the program. This tragic conversion of America's public library system into a political tool to promote an unpopular government program shatters the concept of an institution dedicated to the free and open dissemination of knowledge. Further demonstrating that their shamelessness knows no bounds, Team Obama also attempted to recruit several professional sports organizations as ObamaCare propagandists. The NFL has, wisely, refused to sully its brand.

And, finally, in case you forgot just how expensive ObamaCare will actually be, a recent analysisconducted by The Wall Street Journal of insurance coverage to be sold in the law's new exchanges revealed that few low-rate policies currently available for healthy people will still be available once the law is fully implemented, thus forcing individuals to pay more for their health insurance.

It would seem Nancy Pelosi's idea of celebrating ObamaCare dependency couldn't be more wrong.

Pennsylvanians Against Common Core is committed to providing improved communication with members and regular updates concerning the fight against this one-size-fits-all national education standard. Leadership of PACC has been busy behind the scenes orchestrating opposition and working in Harrisburg to lobby legislators and make them aware of the negative consequences of Common Core to great effect. We continue to rely on the power of the grass roots opposition (you) that we have seen can mobilize when necessary to significantly impact legislators. 

As reported last week, due to input from citizens across the Commonwealth, there has been significant movement in Harrisburg towards stopping Common Core. We strongly recommend that you click here to view the press conference on June 28th held by four education Patriots; Representatives Bloom, Tallman, Kauffman and Lawrence. These guys really "get it" and we should back them and all other opponents of Common Core.

 HB 1551 - Legislation to repeal the State Board of Education Pennsylvania Common Core Standards. 
HB 1552 - Exempting private, religious and home-schools from Common Core Standards 
HB 1553 - National Standardized Assessments and Surveys 
HB 1554 - Prohibition of individual student data transfer to the Federal Government 
HB 1555 - Advisory Committee to conduct a study of Common Core Standards prior to any implementation

Democrats are hopeful that a nagging mother will be hard to say no to.

4.  Lamar Alexander Fishing for Distraction from Amnesty Vote

What happens when you bring a Lamar Alexander to a Chuck Schumer fight?  He turns around and becomes a weapon for Chuck Schumer and his allies, albeit an ineffective one.

 

In 2007, before running for a second term, Alexander rightfully noted that "to regain the public's confidence, we ought to scale it back and fix the problem step-by-step by absolutely securing our borders first, then enforcing our laws without amnesty."  Now, after years of voting for more spending, higher taxes, more debt, expanded government healthcare, massive energy regulations and subsidies, and liberal judicial nominees, the former third ranking Senate Republican has become a Chuck Schumer Republican.  He led the fight, along with Bob Corker, to push a fledgling amnesty-first bill across the finish line. . . . please click here for the rest of the post

 

5.  Dear GOP: Don't Get Cute With This

The President has decided to scrap the employer mandate in Obamacare. It is questionable if he actually can do this without Congress okaying it. But no one will challenge him. The scrapping is really a delaying until after the election.

 

Republican strategists are already opining that we should fight to repeal the individual mandate too. What's good for employers should be good for people after all.

 

Republicans, please take note - that's stupid. It won't stop Obamacare. It simply gives the Democrats an out that will make the overall law both more expensive and less onerous to the American public. Do not get cute here. . . . please click here for the rest of the post

Obamacare's Dirty Dozen Implementation Failures

Last week, the Obama Administration attempted to spin its announcement of a one-year delay in Obamacare's employer mandate as an effort to implement the law "in a careful, thoughtful manner." Don't be fooled. Even Democrats have admitted the law has turned into a massive "train wreck," with delays, glitches, and problems aplenty. Here are a dozen more Obamacare implementation failures.

1. The CLASS Act: ABANDONED, THEN REPEALED

One Democrat famously called this new long-term care entitlement "a Ponzi scheme of the first order, the kind of thing that Bernie Madoff would have been proud of"-and so it proved. In the fall of 2011, the Department of Health and Human Services (HHS) admitted CLASS could not be implemented in a fiscally sound manner-and Congress eventually repealed the program outright.

2. Exchanges: MISSED DEADLINES

Most states resisted Obamacare's call to create insurance exchanges, choosing to let Washington create a federally run exchange instead. However, a Government Accountability Office report released last month noted that "critical" activities to create a federal exchange have not been completed, and the missed deadlines "suggest a potential for challenges going forward."

3. HHS mandate: DELAYED; UNDER LEGAL CHALLENGE

Last year, the Administration announced a partial delay for Obamacare's anti-conscience mandate. However, many employers have filed legal actions against the mandate, which forces them to fund products they find morally objectionable or pay massive fines.

4. Small business plan choice: DELAYED

The Administration announced in April that workers will not be able to choose plans from different health insurers in the small business exchanges next year-a delay that liberal blogger Joe Klein called "a really bad sign" of "Obamacare incompetence."

5. Child-only plans: UNINTENDED CONSEQUENCES

A drafting error in Obamacare has actually led to less access to care for children with pre-existing conditions. A 2011 report found that in 17 states, insurers are no longer selling child-only health insurance plans, because they fear that individuals will apply for coverage only after being diagnosed with a costly illness.

6. Basic health plan: DELAYED

This government-run plan for states, created as part of Obamacare, has also been delayed, prompting one Democrat to criticize the Administration for failing to "live up" to the law and implement it as written.

7. High-risk pools: UNDERPERFORMING; FUNDING LOW

This program for individuals with pre-existing conditions faced higher costs and lower enrollment than advertised. Though it was originally projected to cover up to 700,000 individuals, only about 110,000 have enrolled-yet the Administration had to halt new enrollment and take other radical measures to prevent the $5 billion program from running out of money.

8. Early retiree reinsurance: BROKE

The $5 billion in funding for this program was intended to last until 2014-but the program's money ran out in 2011, two years ahead of schedule.

9. Waivers: UNINTENDED CONSEQUENCES

After the law passed, HHS discovered that some of its new mandates would raise costs so much that employers would drop coverage rather than face skyrocketing premiums. Instead, the Administration announced a series of temporary waivers-and more than half the recipients of those waivers were members of union health insurance plans.

10. Co-ops: DEFUNDED

Congress blocked additional funding to this Obamacare program in January, and with good reason: In one case, a new health insurance co-op was called "fatally flawed" by Vermont's state insurance commissioner.

11. "Employee free choice": REPEALED

This provision, which would have allowed certain workers to use contributions from their employers to buy exchange health plans, was repealed in April 2011, as businesses considered it too complex and unworkable.

12. Medicaid expansion: REJECTED BY MANY STATES

Last year, the Supreme Court made Obamacare's Medicaid expansion optional for states, ruling that Obamacare as written engaged in "economic dragooning" that puts "a gun to the head of states." Many states are resisting Obamacare's call to expand Medicaid, knowing that expansion will saddle them with additional, unsustainable costs.

As these examples demonstrate, it's not just the employer mandate that's flawed-it's the entire law. Recognizing these myriad, massive failures, Congress should hold the line and refuse to spend a single dime on Obamacare implementation.

Friday Afternoon Roundup - Brief Briefs



PERSONAL UPDATE

It's been a very long month. Thank G-d things are better now and there are some days when I even feel halfway human. And one day I may even be able to get a full night's sleep. It's a nice dream to have at any rate.

I appreciate all the support, especially from those who have come forward to help, more than I can say.

There weren't that many articles this week. But 3 out of 4 of them were newly written articles.




EGYPTLAND 

On to current events, I predicted a counterrevolution last year in Egypt and Tunisia. And those seem to have materialized. But predicting revolutions in unstable societies is not that great a leap.

In Egypt, the Muslim Brotherhood has resorted to Mubarak's old tactics of using violent attacks against protesters, particularly female protesters. Unlike Mubarak, the Muslim Brotherhood doesn't care what anyone thinks of it, but the escalation of that violence may lead somewhere they don't expect.

Tahrir Square is once again turning into a protest ground, this time for Anti-Brotherhood activists who were the players in the original revolution. The confrontations between liberal protesters and government thugs is playing out a lot like the way the old revolution did. And while the Muslim Brotherhood reaped the rewards of that revolution, Mubarak was not removed by an election and there's no reason to think that the same thing cannot also happen to Morsi.

And it did. But it's not the end of the game.

Morsi's big mistake was in alienating too many groups at the same time. He alienated the military by making too many sudden moves against it and alienated the liberal opposition by breaking all his promises to them.

He didn't expect that the military and the liberal opposition would join forces against him. He was wrong. The Egyptian military has bypassed him assembling a coalition of religious and political leaders to sideline the Brotherhood.

And even if the military and the liberal opposition succeeds in their political judo move, they inherit a disastrous economy and a wave of popular anger over it. The Brotherhood can stage another revolution or a counter-revolution or a counter-counter-revolution after a few months of El Baradei running Egypt into the ground. If the military doesn't remove him first.

A Nation of Living Constitutions

"Today, people are more persuaded than ever that they have perfect freedom, yet they have brought their freedom to us and laid it humbly at our feet."

Freedom exists by virtue of an independence from the powers that might take that freedom away. Rights exist to fence out authority from the space allotted to freedom.  The more leverage the citizens have over the authorities, the more they can prevent those rights from being trampled upon. 

The problem begins when people begin to assume that the rights they enjoy are inherent to the system, so that they don't have to worry about them. As long as the system exists, so do their rights. 

Many Americans assume that as long as the flag waves and everyone celebrates the 4th of July, then their rights are safe. But it is entirely possible to have an America in which the flag still waves and people still go to see fireworks on the 4th of July, and in which there are no more rights or freedoms left. This can happen when people forget what the flag means and what the 4th of July means; the symbolism of a flag composed of individual states, and a holiday celebrating the Declaration of Independence, which holds that a people may overthrow a government when it violates their rights.

It is dangerous to celebrate symbols while forgetting what they mean. Because a nation's fundamental symbols are the keys to its power. They are its scepters and thrones. And when people forget what the symbols mean and begin bowing to the symbols themselves-- a tyrant can take the symbols and have people bow to him, even as he desecrates what those symbols actually stand for. 

Obama's rise to power could not have taken place except through a forgetfulness that has been with us for some time now. And Obama has been quite talented at manipulating symbols, posing in front of half a dozen flags, a Superman statue, glowing halos, historic sites and documents. That these symbols have no meaning to him except as tokens of power, that his very presence next to them or adjacent to them, should be anathema because of the profound gap between the ideals they represent, and the agenda he represents, is obvious to those who remember that symbols also have meanings. 

But Obama's success is due to those who do not remember. To whom the flag represents America, but who do not understand that it is not a random selection of shapes meant to look pretty against a blue sky. To whom the Constitution is a document that protects their freedoms, without understanding how it does that and what part their active participation must play for it to work.

Obama exploits symbols, while the media warns about the dangers of anyone literate enough to understand their meanings. In the kingdom of the blind, the one eyed man is a dangerous extremist. Because he can see what those in power can't.

Egypt Awaits 'Friday of Resistance,' Muslim Brotherhood Backlash

Egypt's Muslim Brotherhood, which governed the country through the Freedom and Justice Party until a coup July 3, called for nationwide protests and a "Friday of Resistance" following weekly prayers at the country's mosques.

In 2011, similar protests, then called "Day of Rage" demonstrations, helped topple then-president Hosni Mubarak's regime.

The Egyptian military has indicated it would tolerate peaceful protests.

Boeing 777 Crash Survivor Says Flight Crew 'Fell Out' Of Plane
A survivor of the Asiana Airlines plane crash at San Francisco International Airport said flight attendants "fell out" of the back of the plane after the tail section broke off. The survivor said he was able to evacuate safely because he was seated in the middle of the Boeing 777, but the flight attendants seated in the back "got hammered, because we landed short." He added, "And then they all fell out -- and it was just the most terrible thing I've seen." Get the rest of the account from this witness HERE.


Police say enraged spectators invaded a soccer field, stoned the referee to death, and quartered his body after he fatally stabbed a player. An official statement said that it all started when a referee expelled player Josenir Abreu from a game. The two got into a fistfight, then the ref took out a knife and stabbed Abreu, who died on his way to the hospital. Egyptian activists posted video on YouTube Saturday purporting to show Egyptian youths being thrown off a high wall situated on the roof of a building then being beaten in the head with sticks. Gergen said the State Department "blew it" by first denying a CBS report that Kerry was on his boat, only to have to turn around and admit otherwise. "It was not right to do it that way, but to be fair to Secretary Kerry, he has been going through a grueling time," Gergen said. "He just came back from a 15-day trip to the Middle East," he added. San Francisco police are asking for the public's help in identifying a robbery suspect caught on video kicking a woman in the face so hard she was knocked unconscious. The attack took place around 2 a.m. Sunday, June 30. A female victim was robbed by a group of suspects. The eight-second surveillance footage shows the woman on the ground, struggling to get up before a male suspect brutally kicks her directly in the face, knocking her motionless. Liz Cheney For Senate?

I admire Liz Cheney as much as anyone, but I can't claim to be pleased to learn that she has moved from Washington to Jackson Hole, Wyoming, and has told Senator Mike Enzi that she may run against him in next year's GOP primary. In my view, Republicans (and conservatives) spend much too much time and energy attacking each other, rather than going after the Democrats. That doesn't mean, of course, that Republicans should never mount primary challenges.

But when do such challenges make sense? If an incumbent Republican is not a conservative (Susan Collins, say) and a more conservative challenger has a good chance of winning the general election, then a primary challenge is in order. But that isn't the case here: Enzi is a solid conservative with a 93% lifetime American Conservative Union rating (92% in 2012). He recently voted against the Gang of Eight's immigration bill. Cheney may well be a little more conservative than Enzi, but going after a 90+% conservative is fratricide.

Another situation where a primary challenge makes sense is when the incumbent Republican is a solid conservative, but for whatever reason, not a strong politician, and is likely to lose the general election. In that scenario, a primary challenge by an equally sound conservative with better general election prospects is also appropriate. But that scenario doesn't apply here, either. Wyoming is a solidly Republican state, and either Enzi or Cheney would be the overwhelming favorite to win the seat next year.

A third possibility should also be considered: there may be situations where the incumbent is a good conservative as well as a good bet for re-election, but due to advancing years or ill health may no longer be an effective senator. (Think, on the other side of the aisle, Tim Johnson.) In that situation, it may make sense to try to nudge the incumbent off the stage and get the seat into the hands of someone younger and more vigorous. But that situation doesn't obtain in Wyoming, either. Enzi is 69, by no means elderly for a senator, and to my knowledge his health is fine.

Perhaps, if Ms. Cheney decides to seek the Wyoming seat, she will be able to articulate a compelling rationale for her candidacy. But for now, this looks like exactly the kind of primary challenge that conservative Republicans should not be mounting. Cheney is neither significantly more conservative than Enzi nor significantly more electable; her real advantage as a primary candidate is that she is significantly more glamorous. That isn't enough.

Most interesting man in the world accused of sex harassment

No, I'm not talking about the guy who plays the most interesting man in the world on television in beer commercials. I'm talking about Colin McGinn.

He's a philosopher (he thinks, therefore we are), surfer (when he catches a wave, the wave is sitting on top of the world), and tennis enthusiast (the net exists, but only for others, not for him). And, of course, the most interesting man in the world blogs.

McGinn doesn't shrink from his status as the world's most interesting man. He described himself to the Chronicle of Higher Education (subscription required) as "the most enlightened person in the world" and not necessarily arrogant, but "superior." He added that he's a "ladies' man."

It is this self-image, perhaps, that led McGinn into his current difficulties. A graduate student at the University of Miami, where McGinn taught until recently, has accused him of sending her sexually explicit and other inappropriate emails and text messages.

Although there no claim of any physical relationship, the student's allegations, if true, would raise a colorable claim of sex harassment, and certainly describe a course of inappropriate conduct.

The student was McGinn's paid research assistant on a project relating to the evolution of the human hand. McGinn, who is 63, admits to engaging in sexual banter with his assistant. He notes, however, that the subject of his study, the human hand, tempted such banter. Maybe so, but it's a temptation that "the most enlightened person in the world" would want to resist.

McGinn describes his relationship with the student as an "intellectual romance." But the student says she received an email from him saying that the two should have sex in his office during the summer when no one else is around.

McGinn denies sending such an email. However, he admits sending an email that said "had a hand job imagining you giving me a hand job." (This was, after all, an "intellectual romance"). According to McGinn, though, he was referring to a manicure.

The Chronicle suggests that the McGinn affair is emblematic of a larger tale in the world of academic philosophy. It claims that stories of sex harassment "have long plagued the discipline in which fewer than one in five full-time professors are female." Indeed, the American Philosophical Association has established an ad hoc committee on sexual harassment.

Having litigated sex harassment cases, and read the case law, I understand that this form of discrimination can be a particularly big problem in certain traditionally male jobs where female employees are essentially pioneers. Examples include police officer (at one time) and coal miner.

I wouldn't have thought to add philosophy professor to the list, but why not?

The Chronicle says that a sex harassment charge against a tenured professor, whatever the department, almost never results in the accused's departure. But it did in McGinn's case. He resigned from the University of Miami faculty because, he says, it became apparent to him that the University's president, Donna Shalala, was determined to drive him out.

McGinn modestly predicts that his departure will lead to the demise of the U's philosophy department within three years.

Should McGinn have been driven out, assuming that's what happened? His admission of engaging in sexual banter with a student, coupled with the "hand job" email, are enough to show inappropriate conduct that justifies discipline. And if McGinn suggested having sex with a graduate student in his office, the discipline should be severe.

But whether McGinn deserved to be sacked (assuming this is what Shalala wanted) is less clear. Steven Pinker, a professor at Harvard, contends that "the punishment is ludicrously disproportionate to the alleged offense."

I'd feel a bit sorry for McGinn, but how can you feel sorry for the most interesting man in the world?

Too Many Notes?

Moviegoers may recall the absurd scene near the beginning of Amadeus where Emperor Joseph II (played exquisitely by Jeffrey Jones, perhaps better known as the principal in Ferris Bueller's Day Off) tells Mozart that one of his compositions contains "too many notes."  Who knew that the Emperor would be on to a tic of modern liberalism.

When the Reagan Administration arrived in Washington DC in 1981, they found an ongoing Federal Trade Commission antitrust action against the major breakfast cereal companies for the alleged sin of offering . . . too many choices.  Reagan's appointees to the FTC took one look at this, said "This is stupid," and dropped the case immediately.  The theory behind the case was that the big three cereal companies (Kellogg, General Mills, and Post) constituted an oligopoly that prevented new entrants to the consumer market through the simple expedient of crowding shelf space with endless permutations of Cap'n Crunch.  Today, of course, you can find any weird cardboard-and-kitty-litter based cereal you want-and even blend your own-at both regular and at health food stores.

But that's exactly the problem now for the always-dyspeptic Left, which increasingly appears to be "pro-choice" about one thing only.  The complaint now is that consumers are offered "too many choices." Matt Ridley points to this TED talk where some nitwit I've never heard of says our surfeit of choices is causing us "anxiety":

In our post-industrial capitalist age, says Salecl, choice, freedom and self have been elevated into an ideal - the ideal. But the flip side are increased feelings of anxiety, guilt and inadequacy at facing the possibility of not "making it" - that is, not reaching the ideal. What's strange, says Salecl, is that increasingly people turn this anxiety inward, indulging in self-critique, rather than social critique. Ultimately this has made us unable to move toward social change; our abundance of choices has made us politically passive.

To paraphrase the old Marxian saw, who knew that existentialism would repeat itself first as a Woody Allen film, and then as postmodern babble.  Or, to paraphrase Gabby Johnson from Blazing Saddles, this is some authentic postmodern gibberish.  (The phrase "post-industrial capitalist age" is a dead giveaway, isn't it?  It's getting so "late" for capitalism that one expects Yogi Berra's old line about it "gets late early" out in left field to be of use in this domain instead of Yankee Stadium.)

Or you can just take in Matt Ridley, who dispatches this nonsense with his usual clarity and directness:

Now, I don't know about you, but last time I was offered blue-cheese, Ranch, French or thousand-island dressing for my salad, I don't remember having a panic attack, or even needing therapy at all. I don't generally find my heartbeat racing or my palms sweating as I contemplate the rows of different brands of toothpaste on the shelves. And I am rather relieved at having been allowed the choice of whom to marry. There are poor teenagers in Indian villages who have none of these choices: I do not envy them.

TED, by the way, stands for "Technology, Entertainment, Design."  I think it's time for someone-perhaps Power Line at our long threatened first annual Wine Summit-will innovate with TADD talks: "Totally Awesome Departures from Dimwittery."  It's about time.

Meanwhile, Matt Ridley is giving up his Saturday Wall Street Journal column, which was always the first thing I turned to on Saturday mornings.  (I was always glad it didn't run Friday, since it would present a dilemma, as Friday's WSJ means one thing: getting my real estate porn fix with their "Mansion" section.")  Anyway, Matt's signoff article yesterday lays down a nice hit on "consensus" science, and why it is a corrupt idea.  He explains in just a few paragraphs how he went from being a convinced global warming believer to a skeptic.  Worth reading the whole thing, but this graph conveys the essence of the problem of appeals to scientific "consensus":

[S]cience does not respect consensus. There was once widespread agreement about phlogiston (a nonexistent element said to be a crucial part of combustion), eugenics, the impossibility of continental drift, the idea that genes were made of protein (not DNA) and stomach ulcers were caused by stress, and so forth-all of which proved false. Science, Richard Feyman once said, is "the belief in the ignorance of experts."

Solomon Burke - "the King of Rock 'n Soul" - was one of the last great exponents of the pinnacle of Western civilization known as soul music. Burke died in an Amsterdam airport in 2010 at the age of 70.

Burke was the surprise hero of Peter Guralnick's Sweet Soul Music and the subject of a brilliant chapter of the book. (Guralnick named songwriter Dan Penn the "secret hero" of the book. Why? As KFAI's Pete Lee patiently explained to me: "Because he wrote the songs.")

Guralnick quoted the judgment of Atlantic Records mogul Jerry Wexler - a man who worked with Ray Charles, Aretha Franklin, Otis Redding and others - when asked to name the greatest of the great soul singers: "Solomon Burke with a borrowed band." John Hinderaker and I saw Burke perform at a fundraising concert at the Fine Line club one evening in downtown Minneapolis in 1990 or so. Burke had a borrowed band that night; I thought we had the privilege of hearing Wexler's judgment vindicated.

Burke's aptly named Soul Alive! recording of 1984 (remastered and reissued in expanded form in 2002) displayed him in his element while providing a moving overview of his career. In one of his latter-day recordings - Nashville, produced by instrumental virtuoso Buddy Miller - Burke recalled the beginning of his career with a return to the country music scene. He was joined by such appreciative artists as Dolly Parton, Emmylou Harris, and Patty Griffin in a memorable outing.

Early in his career, in "Everybody Needs Somebody To Love," Burke preached: "There's a song that I sing, and I believe that if everybody was to sing this song, it would save the whole world." It's the spirit that informs most of his work. In the video below Burke is backed by a church-inflected organ while he sings the title song Dan Penn contributed to 2002's Don't Give Up On Me.

An invitation to fraud

Over at NRO, Yuval Levin pursues a basic issue raised by the Obama administration's delay of Obamacare's employer mandate, announced this past Tuesday. Following up on the final version of a 600-page regulation released on Friday, Levin observes:

In 2014, applicants can more or less be deemed eligible for subsidies in the state-run exchanges if they say they are eligible. If it has no external sources of information regarding what insurance employers offer, the rule states, "the exchange may accept the applicant's attestation regarding enrollment in an eligible employer-sponsored plan and eligibility for qualifying coverage in an employer-sponsored plan for the benefit year for which coverage is requested without further verification." In fact, the exchanges are not only released from the obligation to verify whether applicants are eligible for employer coverage, they are also released from the obligation to confirm applicants' statements regarding their household incomes before providing them with what is supposed to be an income-based benefit.

Levin adds:

[A]s with the employer-mandate delay, the suspension of verification requirements was justified in the administration's announcement by pointing to the administration's inability to pull off what the law requires. Doing so, the rule states, "would involve a large amount of systems development on both the state and federal side, which cannot occur in time for October 1, 2013." I suspect we'll be hearing more of that in the coming weeks and months.

Levin draws inferences regarding what is happening outside of public view:

The administration's contortions in implementing Obamacare have to be understood in light of the fact that only the administration itself really knows how implementation is going. No one else has anything approaching a complete picture, and particularly not regarding the development of the exchanges. The status of the federally-run exchanges, even more than those to be run by the states, remains simply a mystery. The administration has shared scant little information with the public, and even an investigation by the Government Accountability Office (an arm of the Congress) concluded last month that the likelihood that the exchanges will be ready to launch in October as required by law "cannot yet be determined." The various delays and rule changes announced by the administration are responses to problems they are finding in the process of implementation, and the shape of those responses is among the only clues we have to the shape of the problems they see.

The delay of the individual mandate announced on Tuesday and the delay of the verification requirements for eligibility announced on Friday both suggest the same two kinds of problems: logistical difficulties with getting complex systems into place, and the fear of ending up with too few people in the exchanges.

Thus the invitation to fraud:

Opening the door wide open to fraud could well increase the number of people in the exchanges, but it will also make that number far less meaningful-casting a shadow over whatever is achieved by the enrollment effort set to launch in the fall. It will also, needless to say, increase the cost of the exchange subsidies. The administration is clearly worried enough about enrollment to take that risk and bear that cost. It seems to be operating under the assumption that the way to secure Obamacare's future is to get as many people as possible into the system and receiving subsidies. Maybe they're right, and maybe they're wrong, but they certainly seem increasingly desperate.

Whether Levin's speculation is correct or not, his understanding of the invitation to fraud extended by the Obama administration appears, as they say, to be on the money.

In place of the traditional Churchill meditation that usually appears in this space on the weekends, let's take a detour to one of the areas which contemporary liberals hold against Churchill: the British Empire.  For a long time I've been predicting that sooner or later revisionist scholarship would be begin to contest and eventually reverse much of the cliché-ridden leftist line that "colonialism" should be summed up purely as racism, conquest, and exploitation.  Here and there revisionist books have appeared, and then there's Harry Crocker's splendid Politically Incorrect Guide to the British Empire, and also Kirk Emmert's fine but out-of-print and hard to find defense of Churchill's humane imperial views, Churchill on Empire.

Bill Kristol writes in to direct our attention to a story appearing in The Express by an Indian author on "The Remarkable Raj: Why Britain Should Be Proud of Its Rule in India."

The period of colonial rule, spanning some 200 years, is routinely depicted as the systematic plundering of a nation. The popular view is that the Empire stripped India of its natural resources and gave little in return, leaving the place all but destitute when independence was finally granted in 1947.

Now, however, a new book written by an Anglo-Indian challenges this notion. It asserts that in fact Britain laid the foundations for modern-day India and the prosperity that it enjoys today.

The girders for every bridge, the track for every mile of railway and the vast array of machinery required for India's infrastructure were all carried there by the same ships that helped exploit a land thousands of miles away. The engineers who laid the cornerstones for India's development from Third World nation to burgeoning industrial superpower were British.

"The indisputable fact is that India as a nation as it stands today was originally put together and created by a small, distant island country," says Dr Kartar Lalvani, founder of the vitamins company Vitabiotics and a former Ernst and Young Entrepreneur of the Year, in the book he has spent the past eight years writing, The Making Of India: A Story Of British Enterprise. It comes out later this year.

He adds: "The 'sins' of the Empire have been widely and frequently written about while the other positive side of the imperial coin, of which Britain can be proud and which laid the foundations for modern-day India, has always been overlooked. This is the first book of its kind to recognise Britain's vast contribution to India's social, civil and physical infrastructure provided during two centuries of colonial rule."

If Dr. Lalvani keeps this up, he won't be able to get tenure at an American university.

The road to Obamacare, cont'd

This week the Obama administration announced that it is delaying the implementation of Obamacare's employer responsibility provision. Now employers won't have to worry about compliance with the provision until 2015, after the midterm elections.

The announcement followed best scandal management practices. It was posted without fanfare on the Treasury Department Web site. It was released on the eve of a long holiday weekend. The story was designed to escape the attention of all but those with a legal need to know, almost as though it was something to be ashamed of.

The Wall Street Journal explains the delay in a knowledgeable editorial: "This is probably an admission that Treasury's information technology isn't ready to process and cross-check paperwork across the 5.7 million businesses in America, especially the pass-through S-corps and partnerships that file under the individual tax code. This is more than a typical government snafu. It relates directly to the design of the law, which was thoughtlessly written and rammed through Congress with instructions for the bureaucracy to figure it all out."

There is a larger point to the announcement, referred to in the Journal editorial as its "dubious legality." The road to Obamacare is the road to serfdom.

The announcement fits into the larger pattern of lawlessness with which we have become familiar in the Age of Obama. It has become something of a defining characteristic, an aspect of what Michael Barone first identified as "gangster government" in a May 2009 column on the Chrysler bankruptcy. Mario Loyola observes:

During the presidency of Barack Obama, we've learned something about our Constitution that we did not know: The president can simply refuse to enforce whatever laws he doesn't like. Not as a matter of prosecutorial discretion, mind you, but in general, as to whole categories of people.

First it was DOMA, in a sop to the gay lobby. Then it was the immigration laws, which the president has decided not to enforce against young illegal immigrants. Now it's the crucial employer-insurance mandate in Obamacare, which is "suspended" for a year, because the president feels like it. I say "crucial" because, absent the employer mandate, the official estimate of how much Obamacare is going to cost, and how it's going to affect the number of uninsured, is no longer valid.

George Will puts it this way:

Although the Constitution has no Article VIII, the administration acts as though there is one that reads: "Notwithstanding all that stuff in other articles about how laws are made, if a president finds a law politically inconvenient, he can simply post on the White House Web site a notice saying: Never mind."

Loyola elaborates on the point:

The Constitution states that the president "shall take care that the laws be faithfully executed." Not "shall take care that the laws be faithfully executed if he feels like it," which is how the Obama administration apparently reads the provision. Rather, he must see that the laws are faithfully executed, period. Otherwise, there's no point to the veto power. The president can simply decide, by his sole imprimatur, to nullify any law he doesn't like.

Alas, there is no way to enforce the president's obligation to see that the laws are faithfully executed. The courts will not issue a mandamus - it is a "political question." It's probably not a "crime or misdemeanor" for him to fail to enforce a law, so he probably can't be impeached for it. The reason presidents have enforced the rule of law is, generally, the people's expectation that they will. But if the president simply ignores the Constitution, and the people cheer him on (as happened during the administration of Franklin D. Roosevelt), then where does that leave us?

In the middle of a wide-open Pandora's box, that's where.

This is is a point to which we will undoubtedly have occasion to return in coming days.

Reading Obama

ON Wednesday night the White House issued President Obama's statement on events in Egypt including the removal of President Morsi from power. The statement is posted here. Please check it out.

As we have been noting, President Obama early on staked his claim to support of the Muslim Brotherhood as the wave of the future in Egypt. He is therefore disappointed in Morsi's removal and vaguely threatening about the consequences. Here is the operative passage:

[W]e are deeply concerned by the decision of the Egyptian Armed Forces to remove President Morsy and suspend the Egyptian constitution. I now call on the Egyptian military to move quickly and responsibly to return full authority back to a democratically elected civilian government as soon as possible through an inclusive and transparent process, and to avoid any arbitrary arrests of President Morsy and his supporters. Given today's developments, I have also directed the relevant departments and agencies to review the implications under U.S. law for our assistance to the Government of Egypt.

As for the rest, Obama comes across as something of a prim schoolmarm of the kind you loved to hate in grade school. He is long on advice but utterly clueless. It is no accident, as they say, that Obama has made the United States an object of contempt and derision on all sides. Among those who agree on nothing else, this is common ground.

In his weekly column, Mark Steyn takes the long view, going back, as is Mark's wont, to the CIA's Project Fat F***er. Quotable quote: "Morsi is a good example of what happens when full-blown Islamic rule is put into effect in a country without the benefit of oil. He's your go-to guy when it comes to ramping up the clitoridectomy rate, but he's not so effective when it comes to jump-starting the economy."


The Times Does Geography

A map on June 22 with the Mount Airy Journal article, about efforts in that North Carolina town to transform it into Mayberry, the fictional town created by Mount Airy's native son, Andy Griffith, labeled incorrectly the state to the immediate west of Virginia. It is Kentucky, not West Virginia.

The map is now gone from the corrected article, but via the Wayback Machine we can recover it. Here it is:

Heh. You can imagine the Times guy: "Hmm, there's Virginia. North is at the top, that means west is to the left, right? Must be West Virginia!" Sure, what we see on the map is just a part of the long West Virginia-Tennessee border.

Always remember: you are smarter than they are.

State Department denies that Kerry was on yacht during Morsi's ouster

Mosheh Oinounou of CBS has tweeted a photo of John Kerry's yacht, the "Isabel," and claimed that a CBS producer spotted Kerry on board Wednesday, the day of Mohammed Morsi's ouster. According to Oinounou, when the producer shouted "Morsi," she received no response.

However, the State Department denies that Kerry was on his yacht during the crisis. And it insists that, although he wasn't in Washington at the national security team meetings on Egypt, he participated "by secure phone and was and is in non-stop contact with foreign leaders, and his senior team in Washington and Cairo."

Such participation is not inconsistent with yachting. Thus, it doesn't matter if Kerry was on the "Isabel," though the idea is amusing.

Indeed, it doesn't really matter whether Kerry participated in the Washington meetings. We're not talking about William Seward, John Hay, or Dean Acheson here.

Nor is it likely that even these giants could have contributed anything of consequence. By Wednesday, the U.S. had already sidelined itself due to the previous poor decisions of the Obama administration.

The end of Obama's Egypt amateur hour

David Goldman shows, among other things, that the Egyptian coup signals that Saudi Arabia, not the U.S., will have the leading foreign role in Egypt's affairs going forward. At the risk of sounding unpatriotic, that's probably a good thing for Egypt under the present circumstances.

I have suggested, and Goldman goes a long way toward demonstrating, that the Egyptian turmoil is more about economics than politics. The Saudis might just be able to keep Egypt financially afloat and better fed.

Moreover, even from a political point of view, Egypt is probably better off taking its cues from the Saudis than from President Obama. As Goldman says: "The notion that [the Muslim Brotherhood's] band of Jew-hating jihadi thugs might become the vehicle for a transition to a functioning Muslim democracy was perhaps the stupidest notion to circulate in Washington in living memory."

But military control propped up by Saudi economic support is not a long-term answer. For one thing, it's far from clear that the Saudi regime will remain in power over that term.

In my opinion, the long-term answer, if Egypt has one, resides in the rise of freedom and democracy as Islamism recedes (waves of that sort of religious fanaticism tend to). Unfortunately, with the Saudis behind them, it's far from clear that the Egyptian military will take even baby steps in the direction of freedom and democracy.

We see here another significant failure of the Obama administration. Instead of trying to work with the military - the only force capable of countering the Muslim Brotherhood - to ease Egypt down the road to freedom and democracy, Obama bet on the Brotherhood, a losing horse and an evil one.

Presumably, he thereby earned the contempt of the military, which is now in charge. At a minimum, he ensured that the military will take its cues from the anti-democracy Saudis.

But as I said, this may be better, all things considered, than the alternative right now. It's not easy to disagree with Goldman's assessment that the judgment of Prince Bandar is preferable to that of John Kerry, Susan Rice, or John McCain.

What patriotism is not

Dana Milbank defends the patriotism of Samantha Power which, he says, was publicly questioned the other day by Frank Gaffney, Allen West, and others. The quotations Milbank cites do not use the word "patriotism," but they scathingly imply that Power lacks that attribute.

Milbank assures us, however, that he knew Power in college and "was unaware that she was un-American." I wouldn't put much stock in this, though. John Hinderaker was my best friend in college during the late 1960s-early 1970s, and I was unaware, back then, that he was pro-American (and he certainly could say the same thing about me).

On a more serious note, Milbank claims that Gaffney and the others are conflating the advocacy of policies one opposes with lack of patriotism. But Milbank's analysis is too facile.

There are some policy disagreements that bear on one's patriotism. If one were to argue that the U.S. should give up its independence to a foreign power, that position would be unpatriotic.

There might, in the future, be defensible policy reasons for such a move (we might be financially broke and the foreign power might offer us a great deal; see the former East Germany), just as there seemed to be defensible policy reasons for disagreeing with the first American patriots when they fought for independence from Great Britain.

But it would still be unpatriotic to want to cede control over our lives and national destiny to foreigners.

Samantha Power hasn't called for the U.S. to become subordinate to another nation. But to the extent that she wants the U.S. to cede to an international body the right to decide (not to influence, but to decide) matters that Americans now decide, she is - other things being even close to equal - considerably less patriotic than those who want Americans to make their own decisions.

And the same would be true of President Obama, who plucked Power from academic obscurity.

Mr. Solomon's wisdom

Attending the Upper Midwest Employment Law Institute in St. Paul this past May, I was only seeking to fulfill my continuing legal education requirement. I wasn't looking for politics, but at the institute's plenary morning session I found myself listening to NLRB acting general counsel Lafe Solomon. Solomon is a newsmaker worthy of general attention, a perfect representative of the lawlessness at the heart of the Obama administration.

Representing an agency that is in legal limbo as a result of Obama's putatively unconstitutional appointments to it, Solomon is carrying a heavy load. In his remarks before the employment law institute in May, Solomon conveyed a mournful angst and subliminal anger about the situation in which the board finds itself. I failed to capture that spirit in the photograph Solomon let me snap before his remarks at the breakout session.

In her weekly Wall Street Journal column Kim Strassel now finds Solomon to be "The lord of U.S. labor policy." Strassel explores the deepening legal limbo of the board and the shenanigans of its combative acting general counsel. Solomon is flailing manfully in a bad cause:

Right now, the NLRB is the only weapon the administration can wield on behalf of Big Labor. The need to placate that most powerful special interest was behind Mr. Obama's decision to install his illegal recess appointments in the first place, and it explains the NLRB's continuing defiance of courts and Congress. Mr. Solomon's wisdom is the Obama philosophy of raw power, in all its twisted glory.


Obama's tax holiday for employers

A friend offers the following observations about President Obama's decision to delay the implementation of Obamacare's employer responsibility provision:

The "delay" in Obamacare doesn't amount to anything that one can take legal cognizance of.

PPACA provides that, beginning in 2014, employers with more than 50 full-time employees must provide them health insurance or else the employer is subject to a penalty (really a tax per the Roberts court). What came out [on Tuesday] was a statement by the Administration that we're not planning to "enforce" this statutory requirement - that is, we're not going to "collect" that tax - until 2015. But what does this "representation" by the government actually amount to? Nothing, it seems to me.

If, at the end of 2014, the feds turned around and told all the big companies to "pay up, you didn't provide X number of your employees with health insurance in 2014," what relief would the employers have? None, it seems to me. Estoppel doesn't run against the government. [The] announcement doesn't constitute anything, really.

I take this a step further. How can Obama decide for the "independent" IRS what tax laws it will and will not enforce?

Hasn't he just thrown a lot of gasoline on the fire that is his administration's politicization of the IRS?

Reporting From the Land of the Free [UPDATED With Firearms and Fireworks]

Power Line has a 4th of July tradition: Scott writes moving and profound meditations on the Declaration and the Founding, while I go to South Dakota and blow things up. Today finds me, once again, in my home town. This year we have firearms as well as fireworks on the agenda, so we will enjoy gunpowder in its manifold forms. I will update this post, or add new ones, over the course of the day. Happy Independence Day!

UPDATE: We began the morning at Lew's, a fireworks emporium on the outskirts of town. You can buy pretty much anything there. Here are two of my daughters with our shopping cart, about to check out:

One innovation this year is a line of fireworks honoring the local high school sports teams, the Arrows. Their colors are purple and gold:

 

As in prior years, the centerpiece of our fireworks purchases was a large box that contains a reloadable mortar and 24 shells. As we were checking out, we chatted with the people behind us in line. We mentioned that we were going to shoot this afternoon, and set off fireworks tonight. They thought that sounded like an excellent plan. The girl who was ringing up our fireworks volunteered that her family had done its shooting last night: long guns and handguns, the calibers of which she rattled off. Sadly, the odds would be against this kind of conversation where we live in the Minneapolis suburbs.

So we picked up my brother and one of his .22 rifles and headed for the outdoor public range where we shot last December. Unfortunately, it was closed from July 1 through July 15, so we went with Plan B: a wood pile in a meadow near where my brother lives. We started with the rifle:

The eternal meaning of Independence Day

On July 9, 1858, Illinois Senator Stephen Douglas gave a campaign speech to a raucous throng from the balcony of the Tremont Hotel in Chicago. Abraham Lincoln was in the audience when Douglas prepared to speak. Douglas invited Lincoln to come join him on the balcony to watch the speech. In his speech Douglas sounded the themes of the momentous campaign that Lincoln and Douglas waged that summer and fall for Douglas's Senate seat.

Douglas paid tribute to Lincoln as a "kind, amiable, and intelligent gentleman, a good citizen and an honorable opponent," but took issue with Lincoln's June 16 speech to the Illinois Republican convention that had named him its candidate for Douglas's seat. In that speech Lincoln had famously asserted that the nation could not exist "half slave and half free." According to Douglas, Lincoln's assertion was inconsistent with the "diversity" in domestic institutions that was "the great safeguard of our liberties." Then as now, "diversity" was a shibboleth hiding an evil institution that could not be defended on its own terms.

Douglas responded to Lincoln's condemnation of the Supreme Court's Dred Scott decision - a condemnation that was the centerpiece of Lincoln's convention speech. "I am free to say to you," Douglas said, "that in my opinion this government of ours is founded on the white basis. It was made by the white man, for the benefit of the white man, to be administered by white men, in such manner as they should determine."

Lincoln invited Douglas's audience to return the next evening for his reply to Douglas's speech. Lincoln's speech of July 10, 1858, is one of his many great speeches, but in one respect it is uniquely great. It concludes with an explanation of the meaning of this day to Americans with matchless eloquence and insight in words that remain as relevant now as then.

Now, it happens that we meet together once every year, sometime about the 4th of July, for some reason or other. These 4th of July gatherings I suppose have their uses. If you will indulge me, I will state what I suppose to be some of them.

We are now a mighty nation, we are thirty-or about thirty millions of people, and we own and inhabit about one-fifteenth part of the dry land of the whole earth. We run our memory back over the pages of history for about eighty-two years and we discover that we were then a very small people in point of numbers, vastly inferior to what we are now, with a vastly less extent of country,-with vastly less of everything we deem desirable among men,-we look upon the change as exceedingly advantageous to us and to our posterity, and we fix upon something that happened away back, as in some way or other being connected with this rise of prosperity. We find a race of men living in that day whom we claim as our fathers and grandfathers; they were iron men, they fought for the principle that they were contending for; and we understood that by what they then did it has followed that the degree of prosperity that we now enjoy has come to us. We hold this annual celebration to remind ourselves of all the good done in this process of time of how it was done and who did it, and how we are historically connected with it; and we go from these meetings in better humor with ourselves-we feel more attached the one to the other, and more firmly bound to the country we inhabit. In every way we are better men in the age, and race, and country in which we live for these celebrations. But after we have done all this we have not yet reached the whole. There is something else connected with it. We have besides these men-descended by blood from our ancestors-among us perhaps half our people who are not descendants at all of these men, they are men who have come from Europe-German, Irish, French and Scandinavian-men that have come from Europe themselves, or whose ancestors have come hither and settled here, finding themselves our equals in all things. If they look back through this history to trace their connection with those days by blood, they find they have none, they cannot carry themselves back into that glorious epoch and make themselves feel that they are part of us, but when they look through that old Declaration of Independence they find that those old men say that "We hold these truths to be self-evident, that all men are created equal," and then they feel that that moral sentiment taught in that day evidences their relation to those men, that it is the father of all moral principle in them, and that they have a right to claim it as though they were blood of the blood, and flesh of the flesh of the men who wrote that Declaration [loud and long continued applause], and so they are. That is the electric cord in that Declaration that links the hearts of patriotic and liberty-loving men together, that will link those patriotic hearts as long as the love of freedom exists in the minds of men throughout the world. [Applause.]

Now, sirs, for the purpose of squaring things with this idea of "don't care if slavery is voted up or voted down" [Douglas's "popular sovereignty" position on the extension of slavery to the territories], for sustaining the Dred Scott decision [A voice---"Hit him again"], for holding that the Declaration of Independence did not mean anything at all, we have Judge Douglas giving his exposition of what the Declaration of Independence means, and we have him saying that the people of America are equal to the people of England. According to his construction, you Germans are not connected with it. Now I ask you in all soberness, if all these things, if indulged in, if ratified, if confirmed and endorsed, if taught to our children, and repeated to them, do not tend to rub out the sentiment of liberty in the country, and to transform this Government into a government of some other form. Those arguments that are made, that the inferior race are to be treated with as much allowance as they are capable of enjoying; that as much is to be done for them as their condition will allow. What are these arguments? They are the arguments that kings have made for enslaving the people in all ages of the world. You will find that all the arguments in favor of king-craft were of this class; they always bestrode the necks of the people, not that they wanted to do it, but because the people were better off for being ridden. That is their argument, and this argument of the Judge is the same old serpent that says you work and I eat, you toil and I will enjoy the fruits of it. Turn in whatever way you will-whether it come from the mouth of a King, an excuse for enslaving the people of his country, or from the mouth of men of one race as a reason for enslaving the men of another race, it is all the same old serpent, and I hold if that course of argumentation that is made for the purpose of convincing the public mind that we should not care about this, should be granted, it does not stop with the negro. I should like to know if taking this old Declaration of Independence, which declares that all men are equal upon principle and making exceptions to it where will it stop. If one man says it does not mean a negro, why not another say it does not mean some other man? If that declaration is not the truth, let us get the Statute book, in which we find it and tear it out! Who is so bold as to do it! [Voices---"me" "no one," &c.] If it is not true let us tear it out! [cries of "no, no,"] let us stick to it then [cheers], let us stand firmly by it then. [Applause.]

In 2009, Manuel Zelaya, a leftist thug, thief and "business partner" of Cesar Chavez was president of Honduras. He had long been mismanaging the nation via payoffs to supportive unions (sound familiar?), and was planning an illegal election to cement his power.

There being no Constitutional method to remove him, both the Congress and the Judiciary asked the Military to assist in said removal. This they did and Vice President Roberto Micheletti took power as required by their Constitution. At no time did the military have power...not one second.

The craven Obamites and all allies, SEIU, etc. demanded that the odious Zelaya be returned to power or they would starve the country, which is rarely very far from starvation in normal times. Along with their buddy Cesar and other "democrats", the Obama/Clinton regime had no difficulty calling it a coup. The removal of "duly elected" Muslim Brotherhood President Mohammed Morsi represents an instance of the Egyptian Military supporting the will of the people. (1) The military suspended the constitution and appointed the Supreme Justice of Egypt's Supreme Constitutional Court, Adly Mansour, interim president until the next presidential election. And in view of the western media predictably screaming "Coup d'état" because a Democrat favored dictator was forcibly removed, the military showed a lot of restraint. The facts were clear: Morsi failed, a lousy economy was growing worse and the implementation of Sharia law didn't sit well with the pro-democracy movement. The Egyptian military has evolved from its pro-dictator roots to become the guardian of the people. How disappointed Mr. Obama must be that his favorite Islamic dictator was removed and arrested.

Election years that have no incumbent president make for crowded Democrat and Republican primaries. Consequently, the quicker a Party settles on a nominee the quicker it can start to coalesce behind the person they want to put in the White House. When a potential candidate disqualifies himself early on, it is very helpful. Jeb Bush the former Governor of Florida has disqualified himself and therefore has become helpful to the Republican selection process.

Bush has co-authored an opinion piece urging House Republicans to do Chuck Schumer's bidding and pass an amnesty bill. Making baseless claims that adding as many as 40 million unskilled and disinterested people will somehow make America better and stronger, Bush reminds us of why he should never be president.

Following the RINO/Democrat mantra of blame America first Bush makes the totally illogical assertion that, "Illegal immigration results now because there are too few lawful low-skill job opportunities for immigrants."
