I am not sure when the people of Egypt became more worldly than the people here in America but it would seem they have it figured out. Betsy Hiel tweeted a picture of a banner that has been hoisted in Tahrir Square that reads "Obama Supports Terrorism" in both English and Arabic. The banner has been placed in preparation for Sunday's scheduled protests against Mohamed Morsi and The Muslim Brotherhood.

Hello Members and Friends,
I just wanted to share with you a bunch of upcoming political events, meetings, and rallies in the Greater Philadelphia Area. Some of these include Citizens for Liberty events, and other groups. I have them listed in order of upcoming dates. I hope that you can make it out to some of these, especially our Independence Day Parade March. We need volunteers to walk with us! We'll be marching in the Skippack PA parade with Gadsden flags, Banners, appropriate pre-determined signs, we'll be passing out pocket Constitutions, contact info, and important literature to help wake more people up. Bring your rifles too, lets show the community our support for the 2nd Amendment and that we aren't going nowhere! Keep them unloaded and slung around your back for safety reasons. We are seeking 2 soldiers to walk with us. One will dress like a Revolutionary Soldier, and the 2nd will dress as a modern day soldier. We are hoping to get each soldier to carry an AR-15. Also, if anyone has a horse that they can ride in the parade that would be a bonus.

Dr. Carson is a highly regarded neurosurgeon and motivational speaker who has addressed various audiences across the country. He is a recipient of the Presidential Medal of Freedom, the highest civilian honor in the United States. He is the author of five books and is the founder of the Carson Scholars Fund. The 2013 Founder's Dinner, which will once again be a part of our Homecoming festivities, will be held at the historic Sunnybrook Ballroom in Pottstown on Sunday, October 13th, 2013. Doors will open at 4:30pm, followed by dinner at 5:15. Dress will be business/professional. Tickets will be priced at $100 until May 15th, then will be $125, so reserve your tickets for the reduced price.
Due to Dr. Carson's international reputation and recent prominence in the media, including his recent speech at the 2013 National Prayer Breakfast, we fully anticipate that this event will sell out quickly once advertised to the public. WHAT IS COMMON CORE?Common Core, or the Common Core State Standards Initative (CCSSI), as it is known at the State and Federal level, is a set of national education standards that will fulfill the No Child Left Behind (NCLB) Act, through a waiver system. (The NCLB Act was put into place by Congress in 2001 and signed into law by President George W. Bush). Many states were failing to meet the NCLB Act requirements and, therefore, wanted something to replace NCLB.Common Core is part of the UN's plan for complete federal control over our education systems and the "Dumbing-down" of America. Common Core State Standards Initiative (CCSSI) are not state standards in the first place, and are nothing more then further federalization of our state education systems. COMMON CORE IS A TROJAN HORSE AND TIED TO THE UNITED NATIONS (UN)If you cannot see that Common Core is tied to the United Nations you have not done your homework! The major funder of the Common Core Movement is the Bill and Melinda Gates Foundation which has pledged $60 million dollars to this effort. Bill and Melinda Gates are tied to UN through-and-through and have spent money in America and overseas for UN programs in Africa and all over the world for decades. From the Conservative Teachers of American organization, they wrote an article entitled: "Common Core Standards and the Federalization of Education." In this article we read: "Many are concerned that the Common Core Standards, once successfully implemented, will provide unfettered access of our educational system by the United Nations. Some textbooks and curricula for our public schools have already been written by the [United Nations Educational, Scientific, and Cultural Organization] UNESCO and the International Baccalaureate program, that is currently in many school districts, across the United States. Grabbing additional access is a natural next step. Once they write the curricula, they must have authority to develop all testing tools."
The UN involvement in the American educational system has already been facilitated by treaties signed by American presidents from both parties. Those documents include but are not limited to: Universal Declaration of Human Rights, Treaty on the Rights of the Child, Civic Education: Classroom Connections, and Agenda 21. The US Partnership for Education for Sustainable Development (since 2003), is the nexus of the UNA-USA and Global Leadership Coalition at the Department of Education, which altogether leverages the UN Decade on Education for Sustainable Development 2005-2014. UNESCO, the lead agency of the Decade, defines Education for Sustainable Development as "education for everyone everywhere" for the "lifelong learning" of "present and future generations". The UNA-USA sponsors Model UN across America and tailors its Global Classrooms curricula to whichever setting the kids happen to be participating. Children are unknowingly trained to respond with prescribed consensus to the situations, simulations and stimulation's of the particular activity (Delphi Technique). Global Kids is the CFR arm of Connect All Schools Consortium, a new Department of Education network, led by Independent Sector and The White House via United Planet Partners. Global Kids is preparing children for Agenda 21. The White House, NSA and CIA now have website divisions aimed at kids. The Public Education Network is a national association funded by Independent Sector donors: plus Goldman Sachs, JP Morgan, the Carnegie Corporation of New York and the Department of Education "Funders" of the Rockefeller Foundation-backed International Council for Local Environmental Initiatives (ICLEI), "Members" of the the Sustainability Consortium, backed by the EPA and BSR (Rockefeller Foundation, Rockefeller Brothers Fund, State Department) and the Bill and Melinda Gates Foundation-backed International City/County Management Association (ICMA): Center for Sustainable Communities (an ICLEI "Partner") are "partnered" with local schools and governments. From the Partnership for 21st Century Skills aligning the Common Core State Standards with "professional development" content for teachers and principals and Lego Robotics curricula for students (Carnegie Mellon/Lego Education); to software curricula through websites like: cyberschoolbus.un.org, icivics.org, atomiclearning.com, renlearn.org, brainpop.com and ttl4.sunburst.com; to the weekly deliveries of Time for Kids magazine and textbook curricula into classrooms; kids are programmed with UN-defined values. State Governors administer Federal funds to "Community-Oriented Policing" systems like Crime Stoppers (The UN, FBI and other law enforcement and corporate partners administer Crime Stoppers International), the local student-equivalent of the Department of Homeland Security's' "See Something, Say Something" campaign; whereby children see hand-drawn posters of child characters on school walls displaying "Eyes Looking", "Ears Listening", "Mouth Reporting" with a hotline to call. Presidents Bush and Obama have personally followed the George H. W. Bush/Clinton trail of the Agenda 21/ Sustainable America megabanks-maze in "bipartisan" fashion. UNESCO PLEDGES SUPPORT OF COMMON COREFrom UNESCO's document "The Vision of Education Reform in the United States" it states: "My department has been pleased to partner with the US Agency for International Development to help ensure that our best domestic practices are shared world-wide. The United States provides over a billion dollars annually to partner countries working on educational reform. Our goal for the coming year will be to work closely with global partners, including UNESCO, to promote qualitative improvements and system strengthening....Ultimately, education is the great equalizer. It is the one force that can consistently overcome differences in background, culture, and privilege." THE UN'S AGENDA 21- COMMON CORE IMPLEMENTER!In the United Nations Agenda 21 (Guide for the 21st Century), Chapters #25 and #36 specifically talk about education of our children: Principle #25- "Children and Youth in Sustainable Development." In the "Activites 25.9.d" it states: "Ensure access for all youth to all types of education, wherever appropriate, providing alternative learning structures, ensure that education reflects the economic and social needs of youth and incorporates the concepts of environmental training, implementing innovative methods aimed at increasing practical skills, such as environmental scouting." Principle #36- "Promoting Education, Public Awareness and Training." In the Activities Section of this document in "36.5.g" we read: "Within two years the United Nations system should undertake a comprehensive review of its educational programmes, encompassing training and public awareness, to reassess priorites and reallocae resources. The UNESCO/UNEP International Environmental Education Programme should, in cooperation with the appropriate bodies of the United Nations system, Governments, non-governmental organizations and others, establish a porgramme within two years to integrate the decisions of the Conference into the existing United Nations framework adapted to the need of the educators at different levels and circumstances. Regional organizations and national authorities should be encouraged to elaborate similar parallel programmes and opportunies by conducting an analysis of how to mobilize different sectors of the population in order to assess and address their environmental and development education needs." In the Activities Section of this document in "36.5 h" we read: "There is a need to strengthen, within five years, information exchange by enhancing technologies and capacities necessary to promote environment and development education and public awareness. Countries should cooperate with each other and with the various social sectors and population groups to prepare educational tools that include regional environment and development issues and initiatives, using learning materials and resources suited to their own requirements." Sounds just like PARCC and SLDS. ASU's Institute for Global Sustainability and their "Sustainable Cities Network" is doing a fine job "brain-washing" our students in our high schools on sustainability, global warming (aka climate change), etc. Go here to meet the ASU sustainability schools! The video says this is a clip from the 1989 National Governors'Assoc conference on Education: Sr. Director of Mid-Continental Regional Education Laboratory, Dr. Shirley McCune She says about education: #1) Total transformation of our society #2) Teaching of facts and information (knowledge) is no longer the primary purpose of education #3) Close connection between economic (sustainable) development and human capitol (human resource labor for a planned economy) A group that allowed this kind of rhetoric to be said at their meeting? I don't think I want them developingeducational standards! Please read to the bottom for transcripts from the 1987 NGA meetings chaired by Bill Clinton. These transcripts are eye-opening. They are clearly more concerned with workers for the manufacturing. They seem to have concerns that we have students who can't read well enough (non-English speaking especially) to function in the manufacturing plants, and then on the other end of the spectrum... too many with higher ed degrees who don't WANT to work in the manufacturing. So... what to do about all this? Hummm.... standards! Make sure they read well enough to function as the industrial workers, but not so well that they don't want to!!! This is the John D. Rockefeller goal of the early 20th century when he started pushing for compulsory government schooling and funding the building of government schools.

States DO NOT have the ultimate decision making abilities! 2:39:00 - Alexander reads page 89 of the bill stating that any changes to standards MUST go through the Secretary of Education for approval. As are most of the amendments offered by Republicans to this education bill, the Scott Amendment is defeated 12-10. DATA COLLECTING: Senator Burr at the 1:00:00 mark reveals information about ADDITIONAL data points that this legislation will add to the data mining. He says that his count is now 500 data points. TEACHER EVALUATIONS: Senator Alexander at 2:00:00 mark discusses his amendment to end federally mandated school and teacher evaluations. He says states had a "gun to their head" to adopt the teacher evaluations because they were desperate for NCLB waivers. He makes the charge that the Harkin bill creates a "NATIONAL SCHOOL BOARD." The Gates Foundation involvement is mentioned frequently. Harkin says over and over "this is voluntary." If states don't want to implement the programs in the bill we just don't accept the money!" Sustainable Development is code for a policy designed to transform human society, essentially eliminating individual life decisions and replacing them with top - down, one-size-fits-all government control. In steady fashion, the agenda for this new policy, designed at the international level, is put into place piece by piece with a new government council here, and new regulation there, each designed to appear as a "local" development program. Like the proverbial frog in the slowly boiling pot, many Americans fail to notice the rise in government heat. The main course of action to impose the new agenda is through the pretense of environmental protection; "Sorry about your rights, but if we don't save the planet, then we will all perish!" And so with the devastation of a thousand pin pricks, America and its form or government is being changed through the creation of non-elected boards, councils and regional governments, designed to enforce the new regulations and "assure that we protect the environment."
The pin pricks come disguised as such issues as controls on community development; controls on use of private property; controls on use of open space; creation of development areas, many times under the excuse of historic preservation; communities designed on the blue print of pack and stack housing; making it harder to drive as roads are narrowed, even forcing cars to share the road with bicycles; the enforcement of expensive mass transit boondoggle projects; and the never ending spending spree on inefficient, unworkable alternative energy, such as wind and solar power.
In fact, control of energy and water are the two most effective tools in the enforcement of the Sustainable Development agenda. Without energy and water, human society stops. Using strict controls on how, or even if, energy and water can be used provides government with the power to dictate every aspect of society.

Mandatory Biometric Enrollment Lawsuit - UPDATE (fingerprinting, facial recognition, iris scan, DNA, etc.) By Mark Lerner: Co-Founder Constitutional Alliance
If you value liberty and understand how dangerous government mandated biometric ID is to our freedom, you need to read and understand every word of what I am writing about today. Something very important is happening so stay with me. Over the years, the Constitutional Alliance has consistently fought against mandatory biometric ID and for the right of all citizens to be free of it. Government mandated biometric ID is the lynchpin of the modern surveillance society. The amount of control this system gives government over individuals is an anathema to a free society and we oppose it being imposed on anyone - period. You cannot reconcile a free society with a surveillance society. The founders of this country called religious freedom "the first freedom" because it is a precondition for other important rights.. Try to imagine the value of freedom of speech, or freedom of association without religious freedom and you will quickly see why religious freedom, also referred to as 'freedom of conscience' is so important. Here is the Big News This past week, 19 June 2013, a Motion for Summary Judgment was filed in Kaye Beach's lawsuit in the state of Oklahoma (You can read it here). This is a pre-trial motion that presents the undisputed facts of her case and makes the strongest assertion based on those facts, that her rights are being violated. The Motion for Summary Judgment asks the Judge, based on these undisputed facts, to rule in her favor. Kaye fully expects a favorable ruling on this Motion but in the event that this doesn't happen, her lawsuit will continue on. You need only to read the first 30 pages of the Motion to understand the arguments Kaye and her attorneys have made. If you choose to read further you can read about the answers the Department of Public Safety (the department that oversees the issuance of driver's licenses) gave to Kaye's "Discovery Motion". Kaye Beach's lawsuit, is the only substantial challenge to government mandated biometric ID, to my knowledge, that exists anywhere in our country. Here is a brief recap of the issue and basis for Kaye's legal challenge; Kaye is opposed to mandatory biometric identification which is required of her if she wishes to have a state issued driver's license or ID card. As we know, the ability to drive a vehicle and also banking, many financial transactions, as well as a host of other necessary daily activities are dependent upon having a government issued photo ID most commonly presented in the form of state driver's license or ID card. Try to go without one and you will soon find (like Kaye has!) that not having a valid ID is no small matter. In September, 2011 Kaye filed a lawsuit against the state of Oklahoma for the unwarranted collection of her biometrics and for violating her religious freedom, both of which are protected under Oklahoma law. Article V of the Constitution:
- Gives NO guidelines for how to conduct a Con Con.
- NO rules on how delegates will be eligible or selected
- States have NO Guarantees they will even be represented
- Con Con could result in a COMPLETE CHANGE of our way of government
- There simply are NO controls over the delegates once selected.
We must stop the call for a Constitutional Convention!

But the movement for a Constitutional Convention is gaining strength. Conservatives are being targeted because of our love of the Constitution and our frustration over how it is being ignored by those leading our government. The effort is misguided, dangerous and just plan wrong. We must stop this movement now. We have good news to report as legislative sessions in Delaware and Pennsylvania come to a close--including passage of the PA Liquor Privatization Bill, which, in concept, is supported strongly by the Association.
In Dover, Governor Jack Markel's proposal for a $30 million tax increase (in a year in which the Delaware treasury reported a significant surplus) was 'dead on arrival' in both houses of the legislature. The Association strongly opposed Governor Markel's money grab.
We thank the Association's 2012 DE State Legislator of the Year, Senator Dave Lawson, for taking a lead role in stopping the Governor and his insatiable appetite for taxing and spending other people's money.
In Harrisburg, the news was twice as good as the Senate passed a Liquor Privatization bill and the House appears to have tabled a $2.1 billion tax increase aka SB1 Transportation Bill, insanely supported by Governor Tom Corbett.
Apparently, their has been a revolt against the bill by rank and file House Republicans led by State Representatives Stephen Barrar (R-Chester, Delaware County) and Daryl Metcalfe (R-Allegheny).
SB1 would increase the cost of gasoline by $.28 a gallon and is strongly opposed by the Association.
Kudos to Rep. Stephen Barrar and the Association's 2012 PA State Legislator of the Year, Rep. Metcalfe for taking on the tax collectivists in their own party.

As we reported Friday, the news in Trenton wasn't good as the Senate passed its most
sweeping piece of gun legislation, S2723. The bill now sits on Governor Chris Christie's Desk.
Here's how NJ.Com describes the legislation:
The State Senate today gave final legislative approval to the bills - the most notable of which, sponsored by Senate President Stephen Sweeney, would encode firearm purchase permits on a driver's license or a photo ID card and allow for instant background checks when buying guns. The state Attorney General will choose whether the license or ID card becomes the standard.
The measure (S2723) would also require gun buyers to prove they've completed a safety-training course and require dealers to log ammunition sales made on the Internet in real time.

The most disturbing part of this legislation is the encoding of "firearm purchase permits on a driver's license or a photo ID card..."

State House members introduce bills to derail Common Core
On June 28th, four PA State House representatives held a press conference to introduce five new pieces of legislation that directly affect the implementation of Common Core standards in Pennsylvania. Read about it here and here. While the necessary legislative and regulatory approval of these standards has been postponed, the possibility remains that implementation of these standards could take place in the 2013-14 school year. The following bills have been introduced: HB 1551 - Legislation to repeal the State Board of Education Pennsylvania Common Core Standards. (Rep. Tallman) HB 1552 - Exempting private, religious and home-schools from Common Core Standards (Rep. Bloom) HB 1553 - National Standardized Assessments and Surveys (Rep. Kauffman) HB 1554 - Prohibition of individual student data transfer to the Federal Government (Rep. Lawrence) HB 1555 - Advisory Committee to conduct a study of Common Core Standards prior to any implementation (Rep. Tallman)

1. The "Evolving" Energy Policies of President Bystander
In a "groundbreaking" speech Tuesday at Georgetown University, Barack Obama rehashed the same anti-Big Oil themes and half-baked energy policies that have marked his Administration since 2009. (See here and here for historical examples.)
One change: President Obama has decided he likes natural gas*, and credits "Federally supported technology", an implicit endorsement of fracking (its name is still as taboo as that other F-word). He's still not crazy about oil, but since we're producing more of it, he may as well claim credit. 4. Wind power kills birds. Birds that Greenies are supposedly FOND of.
Look, the news that the extinct-for-the-area white-throated needletail bird had been spotted in Scotland - only to be promptly sucked into a wind turbine, accompanied by the screams of horrified amateur ornithologists - should not be surprising. Wind farms are Giant Scythes Of Swinging Doom, when it comes to birds.
The American Bird Conservancy rather desperately wants to support wind power, which is why they're begging wind farms to somehow stop the darn things from being on track to kill a million birds a year in the USA by 2030.
Most of the articles that I've seen estimate that we're killing about 40% to 60% of that now, with the real problem being that endangered species and raptors are disproportionately represented:
- Wind farms kill golden eagles.
- Wind farms endanger bald eagles.
- Wind farms endanger whooping cranes.
- At least one wind farm has been given preemptive forgiveness to kill a California Condor, which news came perilously close to causing actual mass aneurysms among bird conservationists.
- The Obama administration has absolutely no plans to solve the problem. No interest, either. Birds don't make campaign contributions.
- Wind farms are killing birds in other countries, too.
Look, the bottom line is this: birds are, by and large, not the most intelligent animals on the planet*. Wind turbines are large spinning blades of metal designed to move as fast as possible without detaching, and then go spinning off into the countryside**. 5. We must promote marriage, not just defend it
The Defense of Marriage Act took a big hit at the Supreme Court this week. We really should be promoting marriage, not just defending it. But traditional marriage has been on the defensive for a long time, and it's not just because of the same-sex marriage crusade. Marriage began looking weak long before anyone thought gay marriage had a chance of obtaining widespread legal sanction. In fact, gay marriage supporters sometimes wonder why anyone bothers to fight for traditional marriage at all, given the divorce rates, and the growing indifference of young people toward the institution. Why make gay couples feel humiliated or excluded by denying them access to something straight people aren't taking seriously any more? 5 Immigration Questions for Members of Congress

It's July 4 week, which means Members of Congress are at home in their districts. As you head to your nearest town hall meeting, take these questions for your Representative. Below, we also provide the real answers you should be listening for. 1. Since the Senate-passed bill doesn't require the flow of illegal immigrants to stop, how can you say this approach secures the border? No one can make that promise. The Senate bill, S.744, throws tens of billions of dollars at the problem and calls for meeting arbitrary security standards, but it doesn't guarantee that illegal immigration will stop. Also, many of the bill's "requirements," such as 700 miles of border fencing and new border patrol agents, would not commence immediately but over time. As with current immigration laws, some provisions would end up being ignored or waived. S.744 contains no guarantee that the government would keep its promises of more security and enforcement. Even if it did, it wouldn't even come close to stopping illegal immigration. We'd revisit this debate again within 20 years. 2. The Senate-passed bill requires the U.S. government to manage many more visas, even though it doesn't do a good job with today's smaller work load. So how does this "fix" our legal immigration system? It doesn't. The bill makes some changes to various types of visas but does little to fix the broken bureaucracy in charge of the legal immigration system. Without significant changes, new requirements and more responsibilities would only make the system worse. S.744 does away with some flawed visa programs, such as the "diversity" lottery. It creates a merit-based program and adds work-based visas. Although these are steps in the right direction, the devil is in the details. For example, the bill would make the H-1B visa program unworkable by creating expensive restrictions and costs. In short, S.744 fails to make the legal immigration system better. 3. The Senate-passed bill puts the federal government in charge of enforcing immigration laws, even though state and local governments want to help and would be good partners. Is this federal focus the right approach? No, giving the federal government all the responsibility is the wrong approach. Immigration and Customs Enforcement has fewer than 6,000 agents, and S.744 does little to augment that. Putting all the authority in federal hands is a surefire way to hamstring enforcement, simply because the federal government can't do it all. A million local and state law enforcement officers are ready and willing to help enforce federal immigration law. These officers know their communities best and are already in place. By partnering through programs such as 287(g), state and local authorities can help. Sadly, S.744 ignores them. 4. Since the Senate-passed bill would add huge costs and likely depress wages for many current Americans, is it really good for the citizens you're supposed to represent? The fact is, this approach costs too much, and hurts current citizens. The bill is loaded with wasteful pork and kickbacks, such as $1.5 billion for a mini-stimulus "jobs for youth" program. What's more, the bill would harm the nation's long-term fiscal health. After amnesty, illegal immigrants on average would receive more in government benefits, such as welfare and entitlements, than they pay in taxes. The total cost of amnesty to taxpayers could be $6.3 trillion or more. Finally, the bill would lower the wages of current citizens as they compete for jobs with illegal immigrants who get amnesty. By introducing millions of newly legalized workers to the market, the bill would drive down wages. 5. In 1986, when Congress last passed amnesty, the sponsors said it was a "one-time" thing. The Senate-passed bill follows the same "amnesty first, security and enforcement later" approach. Why are we doing that again? There is no reason to make the same mistake twice. The U.S. government gave out amnesty and legal permanent residency to at least 2.7 million illegal immigrants as a result of the Immigration Reform and Control Act in 1986. That amnesty didn't stop illegal immigration, because the government didn't (and still doesn't) want to tackle border security or enforcement of immigration laws. In fact, amnesty only encourages more illegal immigration by sending the message that once enough illegal residents are here, the government will hand out amnesty again. Some have argued that S.744 is not amnesty, but this is simply double-talk. Senator Marco Rubio (R-FL), when running for office in 2010, said "an earned path to citizenship is basically code for amnesty." He was right. Muslim Brotherhood Headquarters Torched in Egypt Clashes
6/29/13 - Two people, one an American student, were killed when protesters stormed an office of Egypt's ruling Muslim Brotherhood in Alexandria, adding to growing tension ahead of mass rallies aimed at unseating the Islamist president. A third man was killed and 10 injured in an explosion during a protest in Port Said, at the mouth of the Suez Canal. Police on Saturday said the cause was unclear but protesters, believing it was a bomb, attacked an Islamist party office in the city.
Egypt's leading religious authority warned of "civil war" after violence in the past week that had already left several dead and hundreds injured. They backed President Mohammad Morsi's offer to talk to opposition groups ahead of Sunday's protests. The UN, European Union and United States have appealed for restraint and urged Egypt's deadlocked political leaders to step back from a confrontation threatening the new democracy that emerged from the Arab Spring revolution of 2011.
The US embassy said in a statement it was evacuating non-essential staff and family members and renewed a warning to Americans not to travel to Egypt unless they had to. The Muslim Brotherhood said eight of its offices had been attacked on Friday, including the one in Alexandria. Officials said more than 70 people had been injured in the clashes in the city. One was shot dead and a young American man who was using a small camera died after being stabbed in the chest.
He was identified as Andrew Pochter, a 21-year-old student from Chevy Chase, Maryland who had been studying at Ohio's Kenyon College. The college said he had been working as an intern for the US educational organisation AMIDEAST.

Reconfirming the Constitution

Section 2 of the Voting Rights Act bans any "standard, practice, or procedure" that "results in a denial or abridgement of the right of any citizen... to vote on account of race or color." After yesterday's Supreme Court decision in Shelby County v. Holder, that is still the law in America, in every state in the country.
What was struck down yesterday was another component of the Voting Rights Act, embodied in Sections 4 and 5. Those sections have always been such a broad, fundamental departure from the Constitution that they were barely constitutional when adopted in 1965. But they were justified then by the fundamentally immoral and uncivilized racial practices still going on in too much of America at the time.

PALIN FLOATS LEAVING GOP
Former Alaska Gov. Sarah Palin said on Saturday that if Republicans abandon conservatives, conservatives may have to consider leaving the Republican Party.
Palin was responding on Fox News to a question from a viewer, Josh Painter, who asked if she and conservative talk radio host Mark Levin would be willing to form a "Freedom Party" if the GOP continues to let down conservatives.
"I love the name of that party," Palin said on Fox News on Saturday. "If the GOP continues to back away from the planks in our platform, from the principles that built this party of Lincoln and of Reagan, then, yeah, more and more of us are going to start saying, 'You know, what's wrong with being independent?'"
Palin said that if Republicans vote for things like amnesty, "there will be a lot of us who start saying, 'GOP, if you abandon us, we have nowhere else to go except to become more independent and not enlisted in one or the other private majority parties that rule in our nation.'"
She said that both national parties are "private parties" and nobody forces Americans to be "enlisted in either party."
Palin's remarks represent the frustrations of conservatives who note Republicans lose when they nominate moderate candidates in national elections. Tea Partiers, in particular, emphasize that House Republicans have the majority because of their support in the previous two elections, and their concerns should be embraced instead of ignored.

The family member mentioned in previous roundups has come home from the hospital, but there is still a road ahead. It hasn't been an easy few weeks and I appreciate the understanding and support. While I was distracted, I was apparently attacked by Paul Krugman, of all people. Paul Krugman, who has done for economics what Erich Von Daniken did for space exploration, decided to attack me for the article while failing as badly at reading comprehension as he does at comprehending the existence of money.
Writing tongue-in-cheek, I mentioned that Bloomberg's transportation commissioner Janette Sadik-Khan, the granddaughter of a Muslim Imam who worked with Hitler's Mufti teaching SS men had, "In partial revenge... made many New York streets nearly as impassable as those of her grandfather's wartime Dresden."
You would have to be an idiot to take that at face value. Or Paul Krugman who headlined it as Nazi Islamic Bikes From Hell and called it "a wonderful window into the conservative psyche". When I was mentioned on Rush, I got emails telling me about it. But apparently no one around here reads Paul Krugman... which is a good thing. OBAMNESTY Is it really amnesty or Obamnesty? I have made the argument that it's really all about Obama.

The streets of Manhattan are full of smiling white yuppies riding their Citibank bikes, blue lights flashing as they sail through midtown traffic. But the great rack of bike share bikes planted next to a housing project is filled with its cargo of blue vehicles. No one is checking them out here. Instead black kids sit on the locked bikes, occasionally fitfully pedaling them, going nowhere.  The contrast is an apt metaphor for the city. The smiling kids who could just as easily be cashing checks from their parents and working at an ad agency while trying to pay off their student debts in Portland, San Francisco or Seattle. They happen to be doing it in New York City and they expect the same social amenities, the retro bars, the craft beers, the obscure bands and the bike lanes. The street ahead has been dug up and water has been turned off to half the block. The operation has no other purpose than to turn two lanes of traffic into some kind of complex curved sidewalk on a street where there is hardly any foot traffic and you can wait two minutes to see a single pedestrian during the daylight hours. Such street planning assaults are happening all over the city as traffic lanes are torn out and eliminated to make way for impromptu sidewalk cafes and expanded sidewalks that often no one needs or wants. And then there are the ubiquitous bike and bus lanes which see about 1 percent of the traffic of the street and the sidewalk, but are approaching equal billing in terms of space. When I wrote about Bloomberg's bike share program back a few months ago, I was attacked by the New York Times' Paul Krugman, Gawker, New York Mag and the New York Observer. It's easy to see what unites these outlets. They are the voices of the upscale city that doesn't drive to work, but is driven. The one that thinks the city is only a few bike lanes away from being properly European. Krugman and Co. assumed that I was against bike shares because conservatives hate sharing. I don't claim to speak for conservatives, but most of them, I suspect, like me, are concerned about the political hijacking of urban spaces by a small elite. They are concerned that the new technocracy that men like Krugman and Bloomberg embody, are destroying the country for shallow and silly reasons.

Syrian Catholic priest Francois Murad was killed last weekend by jihadi fighters. According to a report by Catholic Online, Murad was beheaded and is linking to video purportedly showing the brutal murder to prove it. Murad, 49, was setting up a monastery in Northern Syria. Canadians in the High River area of Alberta -- many already "irate" at not being able to return to their homes after massive flooding last week -- were shocked to learn late Thursday that the Royal Canadian Mounted Police have seized a "large quantity of firearms" from their evacuated houses. A police official said "Firearms that were unsafely stored in plain sight were seized for safekeeping." EJE: WAS SNOWDEN ALONE?
Our friend Edward Jay Epstein takes a look at the Snowden timeline and asks whether Snowden has been playing with others who remain unidentified:
My question: Was Snowden alone in this enterprise to publish COMINT? Prior to his taking the Booz Allen Hamilton job in Hawaii, he was in contact with other people who, five months later, helped arrange the publication of the COMINT. In January 2013, according to the Washington Post, Snowden requested that Laura Poitras get an encryption key for Skype so that they could have a secure channel to communicate. In February, he contacted Guardian columnist Glenn Greenwald and provided him with a step-by-step email and video to get an encryption key. So before Snowden proceeded with his penetration in March 23013 of Booz Allen Hamilton and the NSA he had arranged with two other people, who later participated in the publication, a secure channel of encrypted communications. The point of Snowden's penetration was to get classified data from the NSA. He subsequently stated: "My position with Booz Allen Hamilton granted me access to lists of machines all over the world the NSA hacked, that is why I accepted that position." Snowden's next move was to arrange to meet Greenwald in Hong Kong. On May 20, after falsely claiming he needed treatment for epilepsy, Snowden took the stolen data to Hong Kong on thumb drives and four laptops. The plan to get and publish COMINT thus appears to have extended over five months, It began well before Snowden sought the job at Booz Allen that would give him access to the COMINT. The Guardian article by Greenwald appeared June 5. It published COMINT documents. So, again, did anyone abet Snowden?

Massive protests and counter-protests are under way in Egypt. It is hard to be optimistic about events in that part of the world, but who knows? The course Egypt is on is unsustainable, as its economy is close to utter collapse. I don't see how the current Muslim Brotherhood regime can stave off that collapse, so change of some sort seems inevitable. Perhaps it will be for the better.
Meanwhile, the Obama administration's policy toward Egypt, as toward other Muslim countries, is a mystery. Fox's Bret Baier posted this photo, which was sent to him by a friend who is on the scene in Cairo:
Well, yes. So he does. What is bizarre is that Obama hasn't just tolerated the Brotherhood's rise to power, he has abetted it. It would be defensible to argue that we have little power to influence events in Egypt, and, moreover, attempts on our part to exercise influence are likely to backfire; therefore we should stand aside and do nothing. But why Obama would consider it a good idea to put America's thumb on the scale on the side of the Brotherhood is beyond me.

To the extent that Spain and Brazil have been vulnerable during the Confederations Cup tournament, it has mostly been to attacks down the right flank. Brazil's vulnerability stems from the propensity of its left back, Marcelo, to play as a winger. As with his predecessor, the great Roberto Carlo, left back is more of a mailing address than a position for Marcelo.
Spain has a better-rounded left back in Jordi Alba, rated by most as the best in the world at his position. Yet, Italy found great joy attacking down his side through Maggio and Candreva. It wasn't all Jordi Alba's fault. Spain's midfielders and wide-left attacker should have provided more help. But the left back was beaten one-on-one several times.
What will happen on the right flank today? Brazil hasn't been using a true right-winger; Dani Alves, like Marcelo a marauding fullback, has supplied nearly all its width on the right side. So unless Brazil changes its tactics, Jordi Alba should have an easier time of it against his Barcelona teammate than he did against the Maggio-Candreva combo.
Spain can call on forward Pedro for pace down the right flank, but Arbeloa, the Spanish right back, isn't a huge attacking threat. The real potential game-changer, though, is Navas. He's probably the most impressive winger in the tournament, but Spain has used him only off the bench. If he plays today, Marcelo will probably have his hands full.
Spain's style of play may count more than its personnel. If Spain plays its short-passing, possession game, then Marcelo shouldn't be out of position and the right flank shouldn't be all that vulnerable.
But if Spain plays a more vertical, counter-attacking game (either by choice or out of necessity), Marcelo's positioning could become problematic.
Soccer matches can be won or lost anywhere on the pitch, and the play on the right flanks may turn out to largely irrelevant. But I'd keep an eye on those areas today.

EJE: The Snowden variations

Ed now wonders "Who helped Snowden steal state secrets?" We previewed Ed's intriguing Wall Street Journal column here.
I wrote Ed this morning to ask him what he made of today's story that the NSA was monitoring EU offices and other European sources. Ed writes:
It is further part of the orchestration. Is it news that NSA operates abroad? Isn't that its job? What is news, in my view, is that there was a well-planned penetration of America's most well-protected intelligence service. The plan activated in January a temporarily unemployed IT worker who had a security clearance. The worker Snowden then selected an opening via Booz Allen in March, and downloaded more data than had ever before been stolen, and was exfiltrated to Hong Kong where he (wrongly) believed he would be protected.

Another Obama Red Flag Appointment

Scott wrote yesterday about the problematic appointment of Ron Binz to the Federal Energy Regulatory Commission. He's not the only one. Obama's new secretary of energy, Ernest Moniz of MIT, has chosen as his chief of staff Kevin Knobloch, who up to now has been the president of the Union of Concerned Scientists (UCS). The UCS leans far to the left, and long ago became a partisan adjunct of the Democratic Party. Given that UCS began its organization life chiefly in opposition to nuclear weapons and nuclear power, it seems an ill omen that Knobloch will have such a senior position in the government agency that oversees all things nuclear in America. That nuclear renaissance we keep hearing about? I'd be skeptical the Obama Administration is going to push it.
Moniz, despite his wacko haircut, is a decent appointment to be secretary of energy given his serious work on the subject at MIT, but Knobloch represents the worst kind of politicized science. I can recall my own very indirect tangle with UCS back in 2004. UCS had put out a report blasting the Bush Administration's supposed suppression and distortion of science. The report is no longer available on the UCS website. But there's still this Grist.com interview with Knobloch that bears on a particular point where I weighed in:
Take the story about EPA's research into the toxicity of mercury. At the same time that the White House was proposing a weak rule to clean up mercury from power-plant emissions and had crippled the new-source review program that required power plants to have state-of-the-art pollution cleanup equipment, EPA was preparing to release a study showing that 8 percent of women of childbearing age had sufficient mercury in their bloodstream to harm their as-yet-unborn children should they become pregnant. And before EPA could release that study, the Office of Management and Budget said, "Excuse me, but we need to review that," and then the study disappeared. They sat on it for months on end, and it was only when someone at EPA leaked that research to The Wall Street Journal that it saw the light of day.
This statement was wrong from start to finish, including "and" and "the," as Mary McCarthy might have put it. First of all, Bush didn't "cripple" New Source Review. But that's a long and very wonky story; if you are a glutton for punishment, you can see my long papers about NSR here and here. But perhaps it suffices to note that the Obama EPA has not returned to the Pre-Bush NSR regime, which shows how this was merely a Bush-bashing talking point.
Much more deceptive and inaccurate was Knobloch's second point here about mercury. The impression he gives is that the Bush White House was suppressing for many months data showing that 8 percent of women of childbearing age had high levels of mercury in their blood. That data had already been published months before by the Centers for Disease Control. In fact, it was the CDC data that the EPA was going to republish in its own report. There was no suppression taking place at all, except in the paranoid minds of the UCS, which seemed unaware of the CDC report (the bi-annual National Report on Human Exposure to Environmental Chemicals) where these data are published.
But he further misstated the CDC data. The CDC report did not say that 8 percent of childbearing women had mercury levels high enough to harm their unborn children. In fact, the EPA did not identify a single woman with blood mercury levels above the EPA's lowest level of harm from mercury. Rather, they found 8 percent of women with blood levels above the EPA's "reference dose," which is set ten times lower than the lowest dose the EPA believes will cause health risk. The EPA and other health agencies set the "reference dose" ten times lower that the identified dose for real risk partly to account for uncertainty, and partly as a regulatory tripwire, especially if the trends are adverse over time. The actual data from the CDC is displayed in the first figure below, which shows the distribution of mercury levels by percentile.

Unfortunately because of the usual privacy protocols we don't know who the 8 percent of women were who came in above the reference dose, where they live, or what might have been the source of their mercury levels. Remember Knobloch's bit about how the evil Bushoisie was "weakening" mercury regulations? Not only have mercury levels consistently fallen according to EPA data, but subsequent CDC screenings have found no women-none-above the .95 percentile of the reference dose. This trend is displayed in the second figure here. No wonder the UCS report on Bush is no longer on their website. Talk about an epic fail. After I presented the foregoing in a press conference at the National Press Club in 2004, the UCS more or less dropped the subject. It was clear the report was intended as a political hit on Bush in an election year, just as during election years environmentalists and their media toadies "discovered" that Texas had the nation's worst smog under/because of Bush-a thoroughly risible charge.

By the way, today the EPA is looking high and low for elevated levels of mercury to worry about. Right now the group they single out for special attention is: Laotian subsistence fishers. I'm not making this up. As Glenn Reynolds likes to say, the country's in the very best of hands. Unfortunately, for a staff position, Knobloch doesn't have to be confirmed by the Senate, or ever face committee hearing questions. Too bad.

There's something about Proud Mary

John Hinderaker to the contrary notwithstanding, I have long held that there's something about "Proud Mary." Ike and Tina Turner may have ruined the song for many, as they did for John. Marc Myers helps us return to the song with fresh ears in his wonderful Anatomy of a Song column in the Wall Street Journal a few weeks back.
Myers checked in with John Fogerty, the composer of the song. Myers notes that when Fogerty wrote "Proud Mary" 45 years ago, "he had never cleaned a lot of plates in Memphis or hitched a ride on a riverboat queen. But he was on to something with those lyrics." The lyrics paint an America idyll that traces its roots to Huckleberry Finn. In the heyday of the hippie ethos and radical chic, Fogerty ingeniously crafted a downriver idyll of freedom and benevolence at the heart of America. Great line: "But I never saw the good side of a city till I hitched I ride on a riverboat queen."
Creedence Clearwater Revival was Forgety's band. CCR was a blue-collar, Bay-area band anchored by Fogerty and his brother Tom. They paid their dues touring for nine years in various incarnations of the band that became Creedence before "Proud Mary" hit paydirt for them in January 1969. ("Proud Mary" was backed with "Born on the Bayou," another great rootsy song sounding like it had been retrieved from an archive somewhere in the Louisiana swampland.)
So much for the lyrics of "Proud Mary," but what about the music? Here Myers struck gold. Fogerty told Myers:
Back in the fall of 1967-before the release of our first Credence album-I bought a small notebook and began keeping a list of song-title ideas. My first entry was "Proud Mary." I didn't really know what those two words meant but I liked how they sounded together. At the time, I was living in an apartment in Albany, Calif., near San Francisco, with my wife at the time and our newborn son. I was still in the Army Reserve and was concerned about being sent to Vietnam. One day in the early summer of '68, I saw an oversize envelope on the steps of our apartment building. It was my honorable discharge. In the blink of an eye, I was a civilian again. I did a handstand and flipped a few times on the small lawn out front. Then I went inside, picked up my Rickenbacker guitar and began playing a song intro I had been working on. The chord riff was based on the opening to Beethoven's "Fifth Symphony," which I had first heard on TV growing up. I didn't like how Beethoven had composed it. I preferred hitting the first chord hard for emphasis, not the fourth. When I added rhythm to the chords, the song had the motion of a boat. I had always loved Mark Twain's writing and the music of Stephen Foster, so I wrote lyrics about a riverboat. The line "rollin' on the river" was influenced by a movie I once saw about two riverboats racing. I finished most of it in two hours. Then I opened my notebook for a song title. There was "Proud Mary."
"Proud Mary" opened the door for the remarkable string of beautifully crafted hit singles Creedence then reeled off, all written by Fogerty: "Bad Moon Rising" b/w "Lodi," "Green River" b/w "Commotion," "Down on the Corner" b/w "Fortunate Son," "Travelin' Band" b/w "Who'll Stop the Rain," "Up Around the Bend" b/w "Run Through the Jungle," "Lookin' Out My Back Door" b/w "Long As I Can See the Light," "Have You Ever Seen the Rain" b/w "Hey Tonight," and "Sweet Hitchiker." At the end of the road, appropriately enough, was "Someday Never Comes." Somebody forgot to tell these guys you weren't supposed to put hits on both sides of a single, but Fogerty wrote few disposable songs.
The striking thing about this string of hits is the spirit that dominates them. The songs are filled with metaphorical expressions of foreboding and populist, chip-on-the shoulder bitterness punctuated by the occasional idyll, but with hardly a girl in sight. That's a tough act to pull off in pop music; I can't think of a body of work quite like it. I identify with Fogerty's foreboding, his resentments, his daydreams - foremost among them, "Proud Mary." Thanks to Myers for giving us a chance to hear the song afresh.
PAUL ADDS: I don't entirely disagree with John's assessment of the Ike and Tina Turner version of Proud Mary. But there's just one thing. You see, they never, ever did nothing nice and easy. They always did it nice and rough.

At last, Spain vs. BrazilPosted: 29 Jun 2013 03:44 PM PDT (Paul Mirengoff) Since 2008, Spain has dominated international soccer, winning the European Championship that year and in 2012, and the World Cup in 2010. Even in 2006, Spain was as good as any side at the World Cup, but the coach's tactics let the team down in a knock-out match against France. Before 2006, Brazil was soccer's dominant nation. It won the World Cup in 1994 and 2002 and finished second in 1998. Moreover, Brazil has traditionally been the world's best national side. No country has won as many World Cups (five). Finally, Brazil's 1970 World Cup winning team has generally been considered the best international team in soccer history. But given Spain's back-to-back-to back success, many soccer devotees think that one or more of these successful Spanish sides now can claim to be the best ever. For years, therefore, soccer fans have craved a Spain-Brazil match in a serious tournament. We were denied that pleasure in the 2009 Confederations Cup because the U.S., of all teams, somehow knocked off Spain in the semifinal. Brazil went on to defeat the U.S. and claim this Cup. At the 2010 World Cup, Brazil stumbled against an inferior Holland team. The Dutch went on to lose to Spain the final. This year, our wait is over. Spain and Brazil will finally square off for a trophy at the Confederations Cup. Neither team made it to final easily. Brazil, playing at home, needed a goal in the last few minutes of its semifinal to squeeze past reigning South American champions Uruguay, 2-1. Spain had an even tougher time, drawing Italy 0-0 over two hours before finally prevailing on penalty kicks. In that shoot-out, the two best goalkeepers of the past decade (Spain's Casillas and Italy's Buffon) failed to save a single kick out of 14 taken. The stalemate finally ended when an Italian defender skied his kick over the bar. What should we expect in tomorrow's final? Spain has looked slightly the better side so far. That's natural because Spain is a settled side - at least 10 members of its typical starting 11 have been playing together for a while. By contrast, Brazil has a new coach (the one who guided the team to the 2002 world title) who has only just identified what he believes is his best 11. On the other hand, Brazil is playing at home and with an extra day of rest. And Spain, who will be playing with just two days rest, had to run around for an extra half hour in severe heat to beat Italy. Thus, the final looks on paper like an even contest. The one thing we can reasonably expect is a fairly open match. Spain is too good to defer to Brazil by defending first. Brazil, presumably, is too proud to defer in front of its fans. Moreover, although the Confederation Cup isn't nothing, neither is it the World Cup. There is no compelling reason for either team to be particularly cautious. If I'm right about this, tomorrow's match will be worth the wait. |

Better this Gould. . .
So I've got a lot of idle jottings and thoughts piling up from the week, and need a place to get them out. Twitter is too short.
I'm puzzled: liberals says conservatives don't like Darwin, but then they say we're all a bunch of "Social Darwinists." Something doesn't add up here. Well, at least there's one form of Darwinism that liberals disapprove.
To be sure, I will admit that most conservatives prefer Jay Gould to Stephen Jay Gould. But I think what's really going on here is more projection. Who was it who said we ought to have a "Darwinian" Constitution? Woodrow Wilson. Among others.
. . . than this Gould.
Was the Titanic the anti-Noah's Ark? That's one of the questions Pascal Bruckner planted with me earlier this week.
Jim Manzi, a blazingly successful entrepreneur and author of the terrific book Uncontrolled: The Surprising Payoff of Trial-and-Error for Business, Politics, and Society, remarked the other day about the subject of innovation that "If there's already a name for what you're trying to do, you're not really innovating. . . Real innovators should be doing something all the 'experts' think is stupid." I like that.
Finally, here's a link to my turn on the Kudlow Report last Monday afternoon, talking about climate change and Obama's climate speech. The link seems to be a bit twitchy, though.

Kenneth Minogue, RIP

Yesterday brought the sad news of the passing of Kenneth Minogue, long time professor of politics at the London School of Economics and one of the giants of modern conservative intellectual life. At an early point I contemplated attending the LSE for graduate school to study with Minogue (and Oakeshott); fortunately I was lucky enough to meet and converse with him on two memorable occasions, once in my early 20s, and just a couple of years ago when he came through Washington. Scott wrote of him here way back in 2003; I did more recently here.
His best book, in my mind, is his The Liberal Mind, first published back in the 1960s. It holds up extremely well today (and thanks to Liberty Fund for bringing it back into print a few years ago). His matchless description of liberalism is worth repeating again:
The story of liberalism, as liberals tell it, is rather like the legend of St. George and the dragon. After many centuries of hopelessness and superstition, St. George, in the guise of Rationality, appeared in the world somewhere about the sixteenth century. The first dragons upon whom he turned his lance were those of despotic kingship and religious intolerance. These battles won, he rested for a time, until such questions as slavery, or prison conditions, or the state of the poor, began to command his attention. During the nineteenth century, his lance was never still, prodding this way and that against the inert scaliness of privilege, vested interest, or patrician insolence. But, unlike St. George, he did not know when to retire. The more he succeeded, the more he became bewitched with the thought of a world free of dragons, and the less capable he became of ever returning to private life. He needed his dragons. He could only live by fighting for causes-the people, the poor, the exploited, the colonially oppressed, the underprivileged and the underdeveloped. As an ageing warrior, he grew breathless in his pursuit of smaller and smaller dragons-for the big dragons were now harder to come by.
He also wrote one of the better Oxford Very Short Introduction series books on politics: Politics: A Very Short Introduction. I have used it with great effect in classes for undergraduates. It is quite different-and way better-than any other introductory textbook most students have to suffer.
His final book was The Servile Mind: How Democracy Erodes the Moral Life. The New Criterion ran an excerpt of the book in 2010. Here's a worthy sample that nails the Age of Obama and Bloomberg:
My concern with democracy is highly specific. It begins in observing the remarkable fact that, while democracy means a government accountable to the electorate, our rulers now make us accountable to them. Most Western governments hate me smoking, or eating the wrong kind of food, or hunting foxes, or drinking too much, and these are merely the surface disapprovals, the ones that provoke legislation or public campaigns. We also borrow too much money for our personal pleasures, and many of us are very bad parents. Ministers of state have been known to instruct us in elementary matters, such as the importance of reading stories to our children. Again, many of us have unsound views about people of other races, cultures, or religions, and the distribution of our friends does not always correspond, as governments think that it ought, to the cultural diversity of our society. We must face up to the grim fact that the rulers we elect are losing patience with us.
No philosopher can contemplate this interesting situation without beginning to reflect on what it can mean. The gap between political realities and their public face is so great that the term "paradox" tends to crop up from sentence to sentence. Our rulers are theoretically "our" representatives, but they are busy turning us into the instruments of the projects they keep dreaming up. The business of governments, one might think, is to supply the framework of law within which we may pursue happiness on our own account. Instead, we are constantly being summoned to reform ourselves. Debt, intemperance, and incompetence in rearing our children are no doubt regrettable, but they are vices, and left alone, they will soon lead to the pain that corrects. Life is a better teacher of virtue than politicians, and most sensible governments in the past left moral faults to the churches. But democratic citizenship in the twenty-first century means receiving a stream of improving "messages" from politicians. Some may forgive these intrusions because they are so well intentioned. Who would defend prejudice, debt, or excessive drinking? The point, however, is that our rulers have no business telling us how to live. They are tiresome enough in their exercise of authority-they are intolerable when they mount the pulpit. Nor should we be in any doubt that nationalizing the moral life is the first step towards totalitarianism.
We might perhaps be more tolerant of rulers turning preachers if they were moral giants. But what citizen looks at the government today thinking how wise and virtuous it is? Public respect for politicians has long been declining, even as the population at large has been seduced into demanding political solutions to social problems. To demand help from officials we rather despise argues for a notable lack of logic in the demos. The statesmen of eras past have been replaced by a set of barely competent social workers eager to take over the risks of our everyday life. The electorates of earlier times would have responded to politicians seeking to bribe us with such promises with derision. Today, the demos votes for them.

Enter Ron Binz

I've been writing this week about Obama's war on America, the war that Obama has his heart in. If you're going to fight a war, you need troops, and Obama has staffed his administration and supposedly independent regulatory agencies with loyalists. Enter Ron Binz.
This week Obama nominated Ron Binz, the former Chairman of the Colorado Public Utilities Commission (CoPUC), to be the Chairman of the Federal Energy Regulatory Commission. In keeping with many of Obama's appointments, Binz is a far-left ideologue. It is undoubtedly what what endears him to Obama. If confirmed, Binz will predictably further the administration's agenda to shut down low-cost baseload coal plants across the country in favor of expensive, low capacity wind and solar. The confirmation of Binz would accordingly portend bad news for electric rates.
Binz's regulatory record carries a few wrinkles. As Chairman of the CoPUC Binz cowrote a state law with the utilities he was regulating. The law requires investor-owned utilities to shut down coal plants in exchange for the right to build their own natural gas plants. The law will shut down about 1,000 MW of coal-fired energy in Colorado. The baked-in rate increases will start hitting in earnest around 2017.
After the the bill passed the legislature, Binz then presided over the CoPUC case to shut the coal plants down. The Denver Post covered the outcome here. Surprise: Binz et al. made the necessary findings to shut down the plants.
Colorado law provides that commissioners should disqualify themselves "in any proceeding in which their impartiality may reasonably be questioned," and should be removed by the governor should they "lend the prestige of their office to advance the private interests of others," or "convey the impression that special influence can be brought to bear upon them." Binz refused to recuse himself from the regulatory proceeding implementing the law he had helped draft. The Denver Post's Vincent Carroll recalled the story last week:
It makes no difference whether Binz has [no] friends in the coal industry; for the Obama administration, that fact may very well be a plus. What matters is whether it was proper for Binz to help craft highly controversial legislation in 2010 whose implementation he would then, as a key regulator, be charged with overseeing in the midst of competing claims. The coal industry insisted it was not proper, and with good reason.
Binz didn't merely offer an opinion about the practicality of this or that aspect of the fuel-switching bill when asked by lawmakers. Months before the 2010 legislative session began, he engaged in meetings with executives from the natural gas industry and Xcel Energy, as documents obtained under open records laws later revealed.
By early March 2010, he was even reassuring Xcel officials on how the commission would treat cost recovery under draft language - eventually crowing, "The eagle has landed. The commission and Xcel have agreed on language for cost recovery."
So much for commissioners maintaining an image of impartiality in the discharge of their duties.
Binz's ethical challenges were not limited to acting as a commissioner whose impartiality could reasonably be questioned. Binz also violated Colorado law by accepting a free trip to Houston sponsored by a natural-gas company. Binz, incidentally, while a board member of Common Cause, promoted the ethics law he violated as CoPUC chairman. Vincent Carroll adds a note regarding Binz's love of travel:
The audit noted [that] one unnamed commissioner was so partial to junkets that it was "difficult for division staff to meet with him and ensure his preparedness for meetings and hearings." Who was this nameless, globe-trotting commissioner? The auditor refused to comment, but suffice it to say no PUC honcho surpassed Binz's travel blitz. In the 3½ years from June 2007 through November 2010, Binz spent about 200 days on the road. As I summarized his junketeering shortly thereafter, "In short, Binz spent the equivalent of at least one in four workdays at conferences, jetting to Greece, Jordan, Santa Monica, San Diego, Santa Fe, Whitefish (Mont.), Las Vegas, Hawaii, San Francisco, Amelia Island (Fla.), Park City, Seattle, Austin, Los Angeles, and numerous other hardship outposts."
Binz was sufficiently tainted by the end of his term that Binz withdrew from consideration for reappointment and new (Democratic) Governor John Hickenlooper obliged. Binz has spent his time since leaving the CoPUC advocating that states shun coal and nuclear plants in favor of renewables because, he claims, renewables are less risky. He has at the same time been running hard to be nominated to FERC and this week he got his wish.
What damage can FERC do with Binz at the helm? A lot. It can socialize the costs of giant transmission projects to carry wind and solar to California, inflict new "externality" costs on coal in restructured markets to hasten coal's demise, and so on. Binz's nomination fits in perfectly with Obama's declaration of war on coal this week.
Unless Senators Manchin and Landrieu vote against Binz in committee, or some Senator places a hold on the nomination, Binz will be working to hike your electric bill and make the United States less competitive for any business that uses energy. All in a good cause, of course.
UPDATE: A reader with relevant expertise questions "how FERC can impose (inflict, in your words) externality costs in restructured electric markets. FERC oversees wholesale electric markets." The reader cites FERC Order 1000, which allows for socialization of transmission costs for "public policy" reasons. However, he points out, the socialization is based on "beneficiary pays."
I would add that it will be difficult to socialize costs, but it is very much a live issue in FERC circles and Binz will surely work to socialize renewable-related transmission costs as much as possible. It also would be difficult to increase the costs of coal in restructured markets, but again it's not impossible. Binz's record shows that he has the will to power and little regard for the rules.
Our reader adds this important note: "Binz will be a disaster for FERC, but at least there are some decent Commissioners there - Tony Clark is truly impressive - and some very bright policy staff. So, he may be constrained somewhat. Your article fails to mention the damage he could cause on the gas and oil pipeline, reliability, and hydro relicensing aspects of FERC's role. He could do tremendous damage on those."

Who Cares If George Zimmerman Is a Racist?

In writing about the George Zimmerman trial on Tuesday, I said:
I confess that I find much of the commentary on the Zimmerman case, and even a good bit of the evidence, mystifying. There is no question that Zimmerman shot Martin; he claims self-defense. That defense raises a straightforward question of fact. All of the nonsense about whether Zimmerman was a "wannabe cop," and whether he "profiled" Martin, and whether he was or was not a "racist," is utterly beside the point.
That is certainly true as to the issue of self-defense. However, Andrew Branca, a criminal law expert who is covering the trial for Legal Insurrection, wrote to say that I had overstated the point. There is a reason-although, in my opinion, not a good one-for the prosecution's dragging race into the case:
Actually, those elements are being pursued by the State for a good reason-they are essential to the State's ability to prove the "depraved mind" necessary for a murder 2 conviction, which is what the State is pursuing (however foolishly) against Zimmerman.
There are three major buckets of killing crimes, each with various degrees. Murder involves premeditation to kill or, in Florida, a "depraved mind". Voluntary manslaughter involves the intentional use of force against another, and that person dies. Involuntary manslaughter involves a criminally reckless act (but no intent to kill or even use force against another) that results in a person's death-think drunk driving. For all of these the State must prove each and every element of the charge beyond a reasonable doubt.
Self-defense is an absolute justification for the killing of another (assuming you meet all the requirements of the law of self defense), and in most States (Ohio is the only exception) the State must DISPROVE self-defense beyond a reasonable doubt.
In order to prove the second degree murder charge the State brought against Zimmerman they must prove beyond a reasonable doubt that he acted with a depraved mind. To get to a depraved mind they need to show some kind of hatred or ill-will. In most murder 2 cases the people know each other and have a long history of animus, which is the source of the "depraved mind". Here Martin and Zimmerman did not know each other, so the State is forced to pursue some more generalized hatred-such as racism.
Fortunately, there's no evidence of such, so they're flailing. I don't believe they have the slightest hope of proving murder 2.
Proving manslaughter, however, is pretty straightforward-did Zimmerman use force on Martin? Yes. Did Martin die? Yes. Simple. No need to prove a depraved mind, so no need to prove hatred or ill will, racism, whatever.
But that's where the self-defense comes in. Even if the state can prove the elements of manslaughter beyond a reasonable doubt (and I think they can), they now have to disprove self-defense beyond a reasonable doubt.
So if the state had only charged Zimmerman with manslaughter, none of the talk about Zimmerman's racial attitudes, etc., would be admissible. But the state wants a second-degree murder conviction, and that requires proof of a "depraved mind." I fault the prosecutors for dragging race into their case merely because they wanted to over-charge the defendant. Local authorities originally declined to prosecute Zimmerman because strong evidence supported his claim that he acted in self-defense. It was only after the case became a political cause-celebre that a special prosecutor was appointed, and made what was essentially a political decision to charge Zimmerman. The prosecution's effort to exploit the race angle is consistent with the political nature of the prosecution, but is an injustice to the defendant.

Obama's Climate Policy and "Intended Non-Consequences": Another Trip to the CAFÉ?

My Heritage Foundation pal David Kreutzer and his colleagues have produced an initial economic estimate (based on economic assessment models developed by the federal government) for the cost of Obama's climate policy announced on Tuesday, and it portends sticker shock for electricity rate payers: hundreds of thousands of lost jobs, and a total reduction in national income of $1.47 trillion by 2030. (This comes on top of a truly stunning new study that I'm still chewing over that finds federal regulation since 1949 has reduced U.S. national income by 2 percent a year, which compounded means our total potential national income has been diminished by 72 percent below its potential; in other words, in the absence of regulation, national income today would be over $50 trillion as opposed to the $15 trillion that we actually produce. This ought to open the eyes of liberals especially: think how much more redistribution you could do with that kind of total national income! See the figure below from my AEI pal Mark Perry. If this finding is anywhere close to being correct, it ought to launch a serious reconsideration of our entire regulatory state.)
Obama's climate strategy may turn out to be this grim, but Obama is partly right to point out, as he did in his speech, that industry has cried "wolf" about ruinous regulatory costs before and been proven wrong because they underestimated the creativity of America's private sector engineers (the real heroes of environmental progress) to develop lower cost solutions for the regulatory mandates of the Clean Air Act. There is reason to doubt whether the same dynamic will occur with regard to electric power generation, for reasons that are well known to anyone who studies energy.
But there is also reason to suspect that it won't work out according to any simple scenario because. . . Obama doesn't really mean it. Which means the actual policy in practice, while possibly less costly, will actually be much worse, and involve much more needless bureaucracy. Which is really the main point of liberal governance today.
Obama emphasized "flexibility" for different states in his speech. This is code for acknowledging reality-namely, that states like Indiana and Ohio that get more than 80 percent of their electricity from coal will be hit disproportionately hard by anti straight-up anti-coal regulation. So the EPA will devise a program that is not straight up, and will spread the costs around to everyone else everywhere else. Check out this account from Thursday's Wall Street Journal story:
And if environmental regulators follow the model used to reduce auto emissions, as some utilities and many environmentalists hope, the results may not be as costly as critics fear.
Greenhouse-gas emission rates vary greatly by region. In general, emissions are higher in coal-producing areas like the Midwest and southeast than in other regions that use more natural gas for power production, such as Texas and California, or have access to hydroelectricity as the Pacific Northwest does.
Analyst Hugh Wynne of Sanford Bernstein said it is likely "some sort of credit system" will be created to achieve U.S. goals that allows low-emitting resources to offset those that are more polluting.
The president's memorandum to the Environmental Protection Agency, issued Tuesday as he gave his speech, suggests the agency could treat utilities the way it does car makers, taking a portfolio approach to reducing emissions.
Auto makers are required to improve the overall fuel economy of vehicles they sell, using fleetwide averages to calculate results. They can continue to sell gas-guzzlers, but they must also sell large numbers of gas-sippers and electric vehicles to achieve targeted improvements.
If the EPA takes a similar approach to the power sector, instead of imposing strict, rigid emission limits on each power plant, a utility that decided to continue running coal-fired power plants-the biggest emitters of greenhouse gases-could do so. It would just have to generate more electricity from nuclear or renewable resources and probably put in place programs that reduce overall electricity consumption, such as energy-efficiency programs.
That comparison to auto emission standards (the infamous CAFE requirements, or "Corporate Average Fuel Economy") is more revealing than the WSJ reporter knows. Everyone is familiar with the "law of unintended consequences," i.e., how we often get perverse results or even results directly contrary to the intent of a law. A good example is emergency room visits under things like Obamacare. Obamacare and Romneycare are supposed to reduce costly emergency room visits. But instead it is likely to increase them, because many low income/low-information citizens will think that they are now "covered" for medical care and can go to the emergency room when they need to without worry.
But the CAFE regulations are the best example of what my former AEI colleague Chris DeMuth calls the "intended non-consequences" of policy that may well come into play with Obama's coal regulations. CAFE requires the fleet average gas mileage, but does not require that every car meet the standard. And if Ford sells too many Ford Explorers, it simply pays a fine to the federal government. BMW and Mercedes, who can't hope to make the CAFE standards, routinely pay the fine as a cost of access to the U.S. market, and since they are minor players compared to GM and Ford, it's a minor cost of doing business.
One other CAFE wrinkle: Ford and GM could meet the CAFE standards if they were allowed simply to import their European models (including especially diesels). But the CAFE law forbids this, because naturally Congress wanted to protect American auto worker jobs. Likewise, Congress wouldn't dare impose a $2 a gallon gas tax, which would be much more effective in lowering fuel consumption than the indirect CAFE standard, just as a carbon tax would be more effective in lowering CO2 emissions than the EPA Clean Air Act route. Above all, Congress dares not make the cost or pain of policy explicit to citizens. But the intended non-consequence of this policy is that, as Chris explains, "after a third of a century of CAFE, American drivers are consuming more fuel per capita than they did in 1975." Heh.

None of this was foreordained in the nature of government action. If Congress had instead imposed a substantial gasoline tax, say several dollars per gallon, the conservation effects would have been immediate, pronounced, and inescapable and would have been realized in all vehicles of every size, both old and new. Private incentives would have been aligned with rather than against the avowed public purpose. But there would have been another response that would have been even more immediate: there would have been rioting in the streets, and every legislator who voted for the tax would have been retired at the earliest opportunity. Americans do not want their driving incentives realigned. Instead, in the same statute that established CAFE-the misnamed Energy Policy and Conservation Act of 1975-Congress lowered gasoline prices through price controls on domestically produced crude oil. That would have led to more rather than less fuel consumption-except that the cost savings were themselves consumed by the time-costs of the gas station lines of the late 1970s.
The point is: Obama's climate policy is going to be a repeat of CAFE, except for coal plants. It will be a bonanza for state utility regulators, "consumer advocates," Washington bureaucrats and lawyers, and corporate subsidy-seekers and cost-shifters. It will impose the maximum cost for the minimal result, all the while hiding and shifting and obscuring the true cost. And I can guarantee we'll keep using coal. Maybe not as much, but we'll still be using it.

Will there be future challenges to race-based admissions policies?

In response to this week's Supreme Court's decision that raised the legal standards race-based preferential admissions policy must meet in order to survive judicial scrutiny, I suggested, facetiously, that I might come out of retirement to litigate such cases. But this assumes that rejected white applicants will bring suits against universities they believe have discriminated against them.
Stuart Taylor does not believe they will. Neither does David Bernstein. After all, it's expensive and time consuming to litigate against a state university, and most rejected college applicants just want to get on with their lives. Moreover, it may be difficult for the rejected applicant to prove that he or she would have been admitted absent the discriminatory policy.
But Ilya Somin is more optimistic, and so am I. Somin notes that, given the high volume of rejected applicants every year, only a tiny percentage of them need litigate in order to maintain the flow of challenges.
Moreover, we live in a litigious society, and one in which students (and their parents) tend to take college rejection quite personally. This is particularly true when the rejection comes from a state university funded by taxes paid by said parents.
As for the burden of litigation, Somin notes that conservative and libertarian public interest law firms and philanthropists have financed challenges to racial preferences in the past. Presumably, they will be even more willing to do so now that the Supreme Court has increased the odds of prevailing.
Finally, Somin points out that, in order to prevail and obtain relief, a plaintiff need not prove that he or she would have been admitted in the absence of the university's race-based admissions policy. The remedies available to a prevailing plaintiff in the absence of proof that he or she would have been admitted include an end to the discriminatory policy, which is what most such plaintiffs will be aiming for.
So I think we will see more of these suits. I'm not coming out of retirement though.

JOHN adds: And what about Asian students? They are harmed more than any other group by racial discrimination in education. I frankly can't understand why there hasn't already been a major movement among Asian-Americans for equal rights in academia. It seems inconceivable to me that this rank discrimination will be tolerated indefinitely, and I expect that future challenges are as likely to be mounted by Asian-American students as by whites.

Obama sounds a discordant note

Asked about his efforts to support the attempted extradition of Edward Snowden to the United States yesterday, President Obama disparaged Snowden as "a 29-year-old hacker" (video below) who is apparently unworthy of his efforts. Obama announced that he won't be "scrambling jets" to apprehend him. Of course, Obama wouldn't even stay tuned in to the fate of his ambassador to Libya when his life hung in the balance, let alone scramble jets to save him, so that's not exactly a shocker.
Snowden, however, has been charged with espionage, and senior officials of Obama's administration have alleged that Snowden compromised classified intelligence information of vital importance. Obama has big issues like how to impoverish the United States and promote amnesty for illegal immigrants on his mind, but you have to wonder if he realizes his discordance with his own administration here.

Heritage Action CEO Mike Needham told CQ Roll Call there is "a disconnect" between the GOP leadership "and the conservative voters they allegedly represent." Often people complain, "Why can't Congress just work together and get something done?" Be careful what you wish for, my friends. More often than not, big, bi-partisan votes happen when Republicans cave and support liberal ideas. The bill is now headed to the House. So far Speaker John Boehner is saying the right things. At a press conference yesterday, Speaker Boehner told reporters:
"The House is not going to take up and vote on whatever the Senate passes. We're going to do our own bill, through regular order, and it'll be legislation that reflects the will of our majority and the will of the American people. For any legislation -- including a conference report -- to pass the House, it's going to have to be a bill that has the support of a majority of our members. "Listen, immigration reform has to be grounded in real border security. That's what the American people believe, and it's a principle that our majority believes in as well. ...And if immigration reform is going to work, it's essential that the American people have the confidence that it's being done correctly. That's how the House will approach this issue."
We will do everything we can to hold their feet to the fire. Some groups are already coming forward to announce that House members who vote for amnesty will face primary challenges, and they should. I was glad Speaker Boehner mentioned the "conference report." Let's assume the House comes up with a good bill that emphasizes security and guarantees that amnestied illegal immigrants can't access welfare benefits. You would have two very different bills from the House and the Senate that would go to a conference committee of a few selected representatives and senators to work out the differences. Time and again this closed-door, back room "conference" is where conservatives have been betrayed. We're putting the GOP leadership on notice that we won't fall for it again. Perry Orders Legislators Back Kudos to Texas Governor Rick Perry! Perry isn't being pushed around by an angry left-wing mob and its liberal media allies. After a liberal filibuster killed legislation to ban late-term abortions and other important bills, Perry called the Texas legislature back for a second special session. Perry said, "I am calling the Legislature back into session because too much important work remains undone for the people of Texas. Texans value life and want to protect women and the unborn." The media's reporting on Wendy Davis's filibuster speaks volumes about its liberal bias. This previously unknown state senator is now a "national political star" on the left. She has gotten glowing press coverage from virtually every media outlet. Even the White House got in on the act with a tweet from Barack Obama. The mob that shouted down the people's elected legislators was hailed as "democracy in action." Where was Obama's voice when abortionist Kermit Gosnell was standing trial for "snipping" the spinal cords of live babies? Reporters had to be shamed into covering Gosnell's trial. Just imagine how different the coverage would be if a conservative legislator were filibustering a bill to legalize same-sex "marriage" in a liberal state and a crowd of evangelicals, Catholics and Orthodox Jews turned out to support him. There would be no tolerance, much less praise, from CBS or the New York Times. They would be denounced as bigots and fascists attempting to thwart the will of the people. Just How Loony Is The Left? Pretty darn loony. Here's a good measure: A Rasmussen poll this week asked voters to identify the nation's top terror threat. Most said radical Muslims. But voters who approved of President Obama's job performance were split: 29% said radical Muslims, while 26% identified the Tea Party as the nation's top terror threat. My friends, do you understand why I warned yesterday about the threat to religious liberty and Christianity? A quarter of Democrats believe the Tea Party is a greater threat to national security than radical Islamists! How many innocent people have been beheaded or blown up by Tea Party supporters? When a poll came out some years ago indicating that quite a few conservatives thought Obama was a Muslim, MSNBC's Chris Matthews would begin virtually every interview with a conservative guest by asking if they believed Obama was a Muslim or a citizen. No matter what the topic of the show was supposed to be, that is how Matthews would begin. It was clear what he was doing. He was trying to force that senator or congressman to insult many conservatives or look like an extremist to the average viewer. Hello, Sean Hannity! Every liberal who goes on your show should be asked whether he agrees with the quarter of his party that equates the Tea Party with radical Islamists. And here's one more example of loony liberalism run amok. The FBI is seeking the public's help in tracking down its most wanted terrorists. It produced a poster with the pictures of 16 terrorists with the captions "Faces of Global Terrorism" and "Stop a Terrorist. Save Lives. Up to $25 Million Reward." You can see poster the here. Last week left coast liberal Rep. Jim McDermott (D-WA) sent a letter to FBI Director Robert Mueller complaining that the "ad featuring sixteen photos of wanted terrorists is not only offensive to Muslims and ethnic minorities, but it encourages racial and religious profiling." But according to the Seattle Times, "Seven [of the 16] are from African countries, four are from the Philippines, one each is from Malaysia and Chechnya, and three were born in the United States." Nevertheless, Obama's FBI dutifully complied and announced Tuesday that the posters would be taken down. Flood Used as Cover for Firearm Confiscation
Residents of the High River area of Alberta, Canada, who had already been evacuated from their homes for more than a week were further angered Thursday when it was announced that the Mounted Police were seizing firearms from evacuated homes.
The Mounties claimed they had urgent need to enter each of the homes, and they further said that they only seized guns that were stored unsafely in plain sight.
"We just want to make sure that all of those things are in a spot that we control, simply because of what they are," said Sgt. Brian Topham. "People have a significant amount of money invested in firearms ... so we put them in a place that we control and that they're safe."
Officials say the guns will be returned once the evacuation order is lifted -- provided residents can provide proof of ownership.
The whole situation seems a little convenient.
You have to wonder what "urgent need" would require officials to forcibly enter evacuated homes and search for firearms. You might also wonder why the authorities didn't simply patrol flooded areas and guard against looters if they were worried about residents' property.
Then there's the likelihood that not every resident will be likely to have proof of ownership of guns taken from their homes. People inherit firearms, and sometimes they just don't keep records.
"Now what they're doing is looking for firearms and ammunition. How do they have the right to do that? What does that have to do with the disaster? ... This is martial law. What has happened to our country?" business owner Brenda Lackey asked the Globe and Mail.
The evacuees are already angry at what they view as an incompetent government that has not allowed them to return to their homes and deal with flood damage. Late this week, some had threatened to break through barricades keeping them from their property.

ACLU RECRUITS REPUBLICANS IN CAMPAIGN TO SPREAD GAY MARRIAGE TO EVERY STATE

The ACLU has announced a $10 million campaign to convince members of the Republican party to support gay marriage nationwide. In order to "strike down barriers to freedom to marry in states across the country," the ACLU believes it needs the support of the GOP.
The ACLU has hired political consultant Steve Schmidt, formerly a top campaign official for George W. Bush, Arnold Schwarzenegger and John McCain. According to their ownwebsite, the ACLU's effort will be to strike down state-based laws prohibiting same-sex marriage by challenging legislatures and state constitutional provisions.
About his new position, Schmidt comments, "The Republican party stands for freedom [and] for limited government intrusion in our personal lives. The issue of marriage equality is the Republican party's best chance to stand on the right side of history...."
Over the next few years, the ACLU plans to spend around $10 million on garnering Republican support for gay marriage. Another key figure in this ACLU campaign will be conservative strategist Jimmy LaSalvia, the founder of GOProud.
ACLU Executive Director Anthony D. Romero hopes that the next four years will transform our country's landscape so that there will be freedom to marry in every state.

Back to the Future on Discrimination

Still fighting discrimination like it's 1955
The past week was a busy one for the Supreme Court. On Monday, in the area of so-called affirmative action, the Court issued its opinion in Fisher v. University of Texas at Austin, a discrimination case, and, on Tuesday, it issued its opinion in Shelby County v. Holder, which, in effect, negated Section 3 of the Voting Rights Act of 1965.
These cases seem to continue the Supremes' movement away from the Civil Rights Era view of the necessity of race-based preferential treatment. Some background:
Fisher is the latest in a line of discrimination cases that started with the Regents of the University of California v. Bakke in 1978. In Bakke, the Supreme Court ruled as unconstitutional the practice of the University of California (Davis) setting aside seats for minorities to be filled by using different admissions processes in the name of classroom "diversity."
In 2003, the Supreme Court muddied the issue in Grutter v. Bollinger, a 5-4 decision upholding the affirmative action admissions policy of the University of Michigan Law School. Writing for the majority, Justice Sandra Day O'Connor held the Law School had a compelling interest in promoting class "diversity." Therefore, a race-conscious admissions process that favored "underrepresented minority groups" but also took into account other factors evaluated for every individual applicant did not amount to an unconstitutional quota system under Bakke -- at least for 25 years.
While observers hoped that Fisher would clarify some of Grutter's vagueness, it did not.
In Fisher, the plaintiff, a white woman denied admission to UT (Austin), contended that the school's practice of accepting the top 10 percent of each Texas high school's graduating class, regardless of their race, violated the Equal Protection Clause of the Fourteenth Amendment. Some 81 percent of the incoming class was admitted under this procedure. Fisher, with a grade point average of 3.59 and in the top 12 percent of her class, was not. Admission criteria for the remainder of candidates for the incoming class included their talents, leadership qualities, family circumstances and race.
The Supreme Court punted on the main issue. A 7-1 majority (Justice Elena Kagan recusing) voided the appellate court's ruling in favor of UT and remanded the case, holding that the lower court hadn't applied the Grutter and Bakke standard of "strict scrutiny" to the admissions program.
Justice Clarence Thomas, the sole dissenter, wrote that he would have overturned Grutter and thus the whole convoluted legal structure of racial preferences as a violation of the Equal Protection Clause of the Fourteenth Amendment.
There was a more definitive resolution in the Shelby case. Two provisions of the Voting Rights Act (VRA) were in play -- the preclearance requirements of Section 5 and the pre-existing coverage formula in Section 4(b). The part of the VRA that the Supreme Court declared unconstitutional by a 5-4 vote was the coverage formula, which hasn't changed since the inception of the Act. As John Fund at National Review put it, "Section 4 of the Voting Rights Act forced states that had poor minority registration or turnout numbers in the 1960s to remain in a permanent penalty box."
Chief Justice John Roberts, writing for the majority, said, "Congress -- if it is to divide the states -- must identify those jurisdictions to be singled out on a basis that makes sense in light of current conditions. It cannot rely simply on the past."
It is the coverage formula that triggers the preclearance provisions of Section 5. "Covered jurisdictions" must convince the Justice Department or a three judge panel of the United States District Court for the District of Columbia to "preclear" attempts to change "any voting qualification or prerequisite to voting, or standard, practice, or procedure with respect to voting."
Section 5 was left intact. Nevertheless, the Court's four Leftists dissented, with Justice Ruth Bader Ginsburg complaining that the Court is essentially saying the VRA has been so successful that it should be ended. But if there's some reason why the law is still necessary -- say the fact that blacks in Mississippi vote at a higher rate than whites, while the state with the lowest black voter turnout compared to whites is Massachusetts -- Congress could enact a law replacing Section 4 and bringing the preclearance criteria up to date.

Yesterday, the Senate passed the massive and complicated Gang of Eight immigration bill, which would grant amnesty to illegal immigrants. This came after Monday's procedural vote on a nearly 1,200-page amendment to the bill. Senators had only 75 hours to read the immense amendment and consider its implications before that Monday vote.
The bill now goes to the U.S. House, where conservatives are raising questions about the proposal. At the monthly Conversations with Conservatives briefing on Capitol Hill this week, Representatives offered their views on the bill. Watch the video here. Floridians Move To Recall Marco Rubio
UPDATE: The petition site is now showing that this petition is supported by the Democratic Congressional Campaign Committee. While I agree with the sentiment of replacing Marco Rubio, I believe that you should know who is tied to this petition. I was not aware of this at the time of the article.
Earlier in the week, we told you how Arizona has had it with Senators John McCain and Jeff Flake over their persistent push of the Senate's amnesty bill and began petitions to recall them.
Well it looks like the people of Florida have had their fill of Senator Marco Rubio. A petition has been set up to recall the Florida Senator following his vote on Monday concerning the Senate's amnesty bill.
The petition has already gotten 800 signatures at the time of this article. However, it should be noted that the petition is to be signed only by Florida residents, though many from other states have not only signed, but expressed their outrage along with their signature.
