SUPREME COURT INVALIDATES KEY PART OF VOTING RIGHTS ACT

WASHINGTON (TheBlaze/AP) - The Supreme Court ruled Tuesday that a key provision of the landmark Voting Rights Act cannot be enforced unless Congress comes up with a new way of determining which states and localities require federal monitoring of elections.
The justices said in 5-4 vote that the law Congress most recently renewed in 2006 relies on 40-year-old data that does not reflect racial progress and changes in U.S. society.
The court did not technically strike down the advance approval requirement of the law that has been used, mainly in the South, to open up polling places to minority voters in the nearly half century since it was first enacted in 1965. But the justices did say lawmakers must update the formula for determining which parts of the country must seek Washington's approval, in advance, for election changes.
In short, the provision is unenforceable as it stands, but could be updated.

The process of reigning in federal abuses begins with our election systems - today's decision serves as momentum in our favor.

The preclearance portion of the 1965 Voting Rights Act prohibited certain states from making any changes to election laws and procedures without gaining official authorization from either the U.S. Department of Justice or a three judge panel in the D.C. Most states adopting CCSS did so to be eligible to compete for federal funding. To have a chance at that money, recession-racked states agreed to adopt the CC standards and the aligned national tests sight unseen. Only five states did not sign on to the CCSS; so unless you live in Alaska, Nebraska, Minnesota, Texas, or Virginia, this will affect your school system.

This is it!! We have a small window in which to act! The State budget is due on June 30th so the timing is right. Call! Let the representatives in our State government know we are aware. We know what they did back in 2001 and we want them to undo it! We know their pension plans are responsible for PA's $47 billion unfunded liability which is equivalent to $3700 for each Pennsylvanian. We know this pension crisis will cause more cuts to educational programs and more teacher layoffs. Demand they take taxpayers off the hook for their lavish pension packages. Our public servant representatives need to fix the problem of untenable state worker pensions. It's not that we resent paying it, it's just that we can't afford it. Action Items 1. Call your representative and Senator and tell them you want to see pension reform that brings our state budget into balance. Talk to two friends or family members and convince them to make the phone calls and get two others to do the same, and so on, and so on.

WHAT IS COMMON CORE?Common Core, or the Common Core State Standards Initative (CCSSI), as it is known at the State and Federal level, is a set of national education standards that will fulfill the No Child Left Behind (NCLB) Act, through a waiver system. (The NCLB Act was put into place by Congress in 2001 and signed into law by President George W. Bush). Many states were failing to meet the NCLB Act requirements and, therefore, wanted something to replace NCLB.Common Core is part of the UN's plan for complete federal control over our education systems and the "Dumbing-down" of America. Common Core State Standards Initiative (CCSSI) are not state standards in the first place, and are nothing more then further federalization of our state education systems. COMMON CORE IS A TROJAN HORSE AND TIED TO THE UNITED NATIONS (UN)If you cannot see that Common Core is tied to the United Nations you have not done your homework! The major funder of the Common Core Movement is the Bill and Melinda Gates Foundation which has pledged $60 million dollars to this effort. Bill and Melinda Gates are tied to UN through-and-through and have spent money in America and overseas for UN programs in Africa and all over the world for decades. From the Conservative Teachers of American organization, they wrote an article entitled: "Common Core Standards and the Federalization of Education." In this article we read: "Many are concerned that the Common Core Standards, once successfully implemented, will provide unfettered access of our educational system by the United Nations. Some textbooks and curricula for our public schools have already been written by the [United Nations Educational, Scientific, and Cultural Organization] UNESCO and the International Baccalaureate program, that is currently in many school districts, across the United States. Grabbing additional access is a natural next step. Once they write the curricula, they must have authority to develop all testing tools."
The UN involvement in the American educational system has already been facilitated by treaties signed by American presidents from both parties. Those documents include but are not limited to: Universal Declaration of Human Rights, Treaty on the Rights of the Child, Civic Education: Classroom Connections, and Agenda 21. The US Partnership for Education for Sustainable Development (since 2003), is the nexus of the UNA-USA and Global Leadership Coalition at the Department of Education, which altogether leverages the UN Decade on Education for Sustainable Development 2005-2014. UNESCO, the lead agency of the Decade, defines Education for Sustainable Development as "education for everyone everywhere" for the "lifelong learning" of "present and future generations". The UNA-USA sponsors Model UN across America and tailors its Global Classrooms curricula to whichever setting the kids happen to be participating. Children are unknowingly trained to respond with prescribed consensus to the situations, simulations and stimulation's of the particular activity (Delphi Technique). Global Kids is the CFR arm of Connect All Schools Consortium, a new Department of Education network, led by Independent Sector and The White House via United Planet Partners. Global Kids is preparing children for Agenda 21. The White House, NSA and CIA now have website divisions aimed at kids. The Public Education Network is a national association funded by Independent Sector donors: plus Goldman Sachs, JP Morgan, the Carnegie Corporation of New York and the Department of Education "Funders" of the Rockefeller Foundation-backed International Council for Local Environmental Initiatives (ICLEI), "Members" of the the Sustainability Consortium, backed by the EPA and BSR (Rockefeller Foundation, Rockefeller Brothers Fund, State Department) and the Bill and Melinda Gates Foundation-backed International City/County Management Association (ICMA): Center for Sustainable Communities (an ICLEI "Partner") are "partnered" with local schools and governments. From the Partnership for 21st Century Skills aligning the Common Core State Standards with "professional development" content for teachers and principals and Lego Robotics curricula for students (Carnegie Mellon/Lego Education); to software curricula through websites like: cyberschoolbus.un.org, icivics.org, atomiclearning.com, renlearn.org, brainpop.com and ttl4.sunburst.com; to the weekly deliveries of Time for Kids magazine and textbook curricula into classrooms; kids are programmed with UN-defined values. State Governors administer Federal funds to "Community-Oriented Policing" systems like Crime Stoppers (The UN, FBI and other law enforcement and corporate partners administer Crime Stoppers International), the local student-equivalent of the Department of Homeland Security's' "See Something, Say Something" campaign; whereby children see hand-drawn posters of child characters on school walls displaying "Eyes Looking", "Ears Listening", "Mouth Reporting" with a hotline to call. Presidents Bush and Obama have personally followed the George H. W. Bush/Clinton trail of the Agenda 21/ Sustainable America megabanks-maze in "bipartisan" fashion. UNESCO PLEDGES SUPPORT OF COMMON COREFrom UNESCO's document "The Vision of Education Reform in the United States" it states: "My department has been pleased to partner with the US Agency for International Development to help ensure that our best domestic practices are shared world-wide. The United States provides over a billion dollars annually to partner countries working on educational reform. Our goal for the coming year will be to work closely with global partners, including UNESCO, to promote qualitative improvements and system strengthening....Ultimately, education is the great equalizer. It is the one force that can consistently overcome differences in background, culture, and privilege." THE UN'S AGENDA 21- COMMON CORE IMPLEMENTER!In the United Nations Agenda 21 (Guide for the 21st Century), Chapters #25 and #36 specifically talk about education of our children: Principle #25- "Children and Youth in Sustainable Development." In the "Activites 25.9.d" it states: "Ensure access for all youth to all types of education, wherever appropriate, providing alternative learning structures, ensure that education reflects the economic and social needs of youth and incorporates the concepts of environmental training, implementing innovative methods aimed at increasing practical skills, such as environmental scouting." Principle #36- "Promoting Education, Public Awareness and Training." In the Activities Section of this document in "36.5.g" we read: "Within two years the United Nations system should undertake a comprehensive review of its educational programmes, encompassing training and public awareness, to reassess priorites and reallocae resources. The UNESCO/UNEP International Environmental Education Programme should, in cooperation with the appropriate bodies of the United Nations system, Governments, non-governmental organizations and others, establish a porgramme within two years to integrate the decisions of the Conference into the existing United Nations framework adapted to the need of the educators at different levels and circumstances. Regional organizations and national authorities should be encouraged to elaborate similar parallel programmes and opportunies by conducting an analysis of how to mobilize different sectors of the population in order to assess and address their environmental and development education needs." In the Activities Section of this document in "36.5 h" we read: "There is a need to strengthen, within five years, information exchange by enhancing technologies and capacities necessary to promote environment and development education and public awareness. Countries should cooperate with each other and with the various social sectors and population groups to prepare educational tools that include regional environment and development issues and initiatives, using learning materials and resources suited to their own requirements." Sounds just like PARCC and SLDS. ASU's Institute for Global Sustainability and their "Sustainable Cities Network" is doing a fine job "brain-washing" our students in our high schools on sustainability, global warming (aka climate change), etc. Go here to meet the ASU sustainability schools! The proponents of Common Core say that the standards ARE state led because they were developed by The National Governors' Association.

I don't think I want them developingeducational standards! Please read to the bottom for transcripts from the 1987 NGA meetings chaired by Bill Clinton. These transcripts are eye-opening. They are clearly more concerned with workers for the manufacturing. They seem to have concerns that we have students who can't read well enough (non-English speaking especially) to function in the manufacturing plants, and then on the other end of the spectrum... too many with higher ed degrees who don't WANT to work in the manufacturing. So... what to do about all this? Hummm.... standards! Make sure they read well enough to function as the industrial workers, but not so well that they don't want to!!! This is the John D. Rockefeller goal of the early 20th century when he started pushing for compulsory government schooling and funding the building of government schools.

Tim Scott discusses his amendment to Harkin's bill. Instead of states being forced to adopt blanket standards like Common Core as a prerequisite for funding, let's put decision-making back in the hands of parents and teachers in our communities." 2:31:00 - It is admitted that states who want to change the CC standards,the Secretary of Education would have to approve it. States DO NOT have the ultimate decision making abilities! 2:39:00 - Alexander reads page 89 of the bill stating that any changes to standards MUST go through the Secretary of Education for approval. As are most of the amendments offered by Republicans to this education bill, the Scott Amendment is defeated 12-10. DATA COLLECTING: Senator Burr at the 1:00:00 mark reveals information about ADDITIONAL data points that this legislation will add to the data mining. He says that his count is now 500 data points. TEACHER EVALUATIONS: Senator Alexander at 2:00:00 mark discusses his amendment to end federally mandated school and teacher evaluations. He says states had a "gun to their head" to adopt the teacher evaluations because they were desperate for NCLB waivers. He makes the charge that the Harkin bill creates a "NATIONAL SCHOOL BOARD." The Gates Foundation involvement is mentioned frequently. Harkin says over and over "this is voluntary." If states don't want to implement the programs in the bill we just don't accept the money!" More strong evidence that our states need to "just say no" to all federal education dollars. Sustainable Development is code for a policy designed to transform human society, essentially eliminating individual life decisions and replacing them with top - down, one-size-fits-all government control. In steady fashion, the agenda for this new policy, designed at the international level, is put into place piece by piece with a new government council here, and new regulation there, each designed to appear as a "local" development program. Like the proverbial frog in the slowly boiling pot, many Americans fail to notice the rise in government heat. The main course of action to impose the new agenda is through the pretense of environmental protection; "Sorry about your rights, but if we don't save the planet, then we will all perish!" And so with the devastation of a thousand pin pricks, America and its form or government is being changed through the creation of non-elected boards, councils and regional governments, designed to enforce the new regulations and "assure that we protect the environment."
The pin pricks come disguised as such issues as controls on community development; controls on use of private property; controls on use of open space; creation of development areas, many times under the excuse of historic preservation; communities designed on the blue print of pack and stack housing; making it harder to drive as roads are narrowed, even forcing cars to share the road with bicycles; the enforcement of expensive mass transit boondoggle projects; and the never ending spending spree on inefficient, unworkable alternative energy, such as wind and solar power.
In fact, control of energy and water are the two most effective tools in the enforcement of the Sustainable Development agenda. Without energy and water, human society stops. Using strict controls on how, or even if, energy and water can be used provides government with the power to dictate every aspect of society.

Mandatory Biometric Enrollment Lawsuit - UPDATE (fingerprinting, facial recognition, iris scan, DNA, etc.) By Mark Lerner: Co-Founder Constitutional Alliance
If you value liberty and understand how dangerous government mandated biometric ID is to our freedom, you need to read and understand every word of what I am writing about today. Something very important is happening so stay with me. Over the years, the Constitutional Alliance has consistently fought against mandatory biometric ID and for the right of all citizens to be free of it. Government mandated biometric ID is the lynchpin of the modern surveillance society. The amount of control this system gives government over individuals is an anathema to a free society and we oppose it being imposed on anyone - period. You cannot reconcile a free society with a surveillance society. The founders of this country called religious freedom "the first freedom" because it is a precondition for other important rights.. Try to imagine the value of freedom of speech, or freedom of association without religious freedom and you will quickly see why religious freedom, also referred to as 'freedom of conscience' is so important. Here is the Big News This past week, 19 June 2013, a Motion for Summary Judgment was filed in Kaye Beach's lawsuit in the state of Oklahoma (You can read it here). This is a pre-trial motion that presents the undisputed facts of her case and makes the strongest assertion based on those facts, that her rights are being violated. The Motion for Summary Judgment asks the Judge, based on these undisputed facts, to rule in her favor. Kaye fully expects a favorable ruling on this Motion but in the event that this doesn't happen, her lawsuit will continue on. You need only to read the first 30 pages of the Motion to understand the arguments Kaye and her attorneys have made. If you choose to read further you can read about the answers the Department of Public Safety (the department that oversees the issuance of driver's licenses) gave to Kaye's "Discovery Motion". Kaye Beach's lawsuit, is the only substantial challenge to government mandated biometric ID, to my knowledge, that exists anywhere in our country. Here is a brief recap of the issue and basis for Kaye's legal challenge; Kaye is opposed to mandatory biometric identification which is required of her if she wishes to have a state issued driver's license or ID card. As we know, the ability to drive a vehicle and also banking, many financial transactions, as well as a host of other necessary daily activities are dependent upon having a government issued photo ID most commonly presented in the form of state driver's license or ID card. Try to go without one and you will soon find (like Kaye has!) that not having a valid ID is no small matter. In September, 2011 Kaye filed a lawsuit against the state of Oklahoma for the unwarranted collection of her biometrics and for violating her religious freedom, both of which are protected under Oklahoma law. Late last week, the IRS admitted to sending $46,378,040 in tax refunds to 23,994 illegal immigrants... who were all registered at the same address.
For a "non-political" agency, the IRS certainly has a funny way of enforcing the law.
While True the Vote was jumping through the IRS's hoops for three years, the IRS was sending nearly $50 million in tax refunds to illegal immigrants with no questions asked.
It's time to stand up for our rights and get justice from the IRS.
That's why True the Vote became the first organization in the country to launch a lawsuit against the IRS for its political targeting of grassroots groups.

1. Why America Hates Washington
I sat in the first class section of the Acela Express once from New York to Washington. I was on a book tour and the publisher was whisking me from New York to DC for events. Thomas Freidman sat diagonally from me. His single seat backed up to where the First Class Stewards worked.
As the train pulled into DC, the overworked steward hadn't taken Friedman's tray. Friedman yelled angrily about this being why the nation was collapsing. I kid you not. I was the tipster.
First Class of the Acela Express has more to do with what is wrong with America than the Steward who works there. The New York-Washington bubble remains largely disconnected from the rest of the country. When last I made that point, Dylan Byers of the Politico tweeted along the lines of this being as preposterous as the French claiming Paris truly wasn't France. Of course, de Gaulle popularized the notion of La France profounde - that Paris really wasn't indicative of the rest of the country.
There is a disconnect. It is not everywhere nor with everyone in the NYC-DC corridor. There are people who and places that anchor themselves to the values outside what more and more people are calling the "ruling elite," but there is a disconnect that I think explains both Congress and the President's falling approval ratings (not that Congress can get much lower).
Listen to the rhetoric in Washington, DC and you learn a few things.
With a few exceptions, they're all mostly cool with the NSA spying on ordinary Americans.
Congress thinks immigration reform that will give immigrants preferential hiring status to existing Americans is the most important thing ever.
The President thinks shutting down coal power plants is the most important thing ever.
The IRS is out of control and Congress would rather bribe each other to pass immigration plans than look into it.
Oh, and the rest of America just wants a FREAKING JOB!
There is a massive disconnect between the chattering classes and politicos of Washington and New York and the rest of America. 2. Marco Rubio Steps Closer to an Obama Hug
You may remember lessons when you were a child by your parent or Sunday School teacher that doing bad things leads to a life of ruin. That telling one little white lie often leads to other lies to cover up the first one, which can lead to worse things.
Which brings me to my disappointment in Marco Rubio and how he came to support the very policies he attacked liberal and now Democrat Charlie Crist for supporting in 2010.
By now, we all know that in 2010, Crist supported amnesty and Rubio attacked him for it. While some of us will be able to forgive Marco Rubio's rather rapid shift toward the very position he once vocally opposed, others probably will not be so forgiving.

Things That Will Cost More Under Obama's Climate Change Plan

President Obama doesn't "have time for a meeting of the flat-Earth society." And he probably considers you a member if you disagree with him on his crushing regulatory approach to climate change. The heck of it is, the policies he advocates actually would not help the Earth. Before Obama's speech yesterday, Heritage's Herbert and Joyce Morgan Fellow, Nicolas Loris, explained the President's dilemma:
But let's pretend we were able to stop emitting all carbon immediately. Forget the electricity to cool our homes in the summer months. Shut down the power plants. Stop driving our cars. No talking. The Science and Public Policy Institute found that the global temperature would decrease by 0.17 degrees Celsius-by 2100. These regulations are all pain no gain.
That's what President Obama's climate change plan would not do. What President Obama's climate change plan would do: increase the price of just about everything. Whether it's regulating appliances or eliminating coal from the nation's energy diet, Obama's plan has the same effect: hiking the cost of living. Think through your day. Everything you buy, everything you eat, everything you wear... it was all produced using energy. Just a few of the things that will be more expensive under Obama's plan:
- Heating and cooling your home
- Buying a car and driving-from your work commute to soccer practice and everywhere in between
- Washing and drying clothes
But that's not all. Think even bigger. What will it mean for President Obama's war on coal to hike natural gas prices by 42 percent? Sure, you may have a gas-powered furnace or oven. But natural gas is powering much more, as Heritage's Loris, David Kreutzer, and Kevin Dayaratna explain:
Natural gas is not only a critical source of electricity generation; natural gas and other gases extracted from natural gas provide a feedstock for fertilizers, chemicals and pharmaceuticals, waste treatment, food processing, fueling industrial boilers, and much more.
From food processing to waste treatment-the entire cycle of life will cost more! Of course, it doesn't help that you will also have less income. Forthcoming research from these Heritage experts shows that Obama's anti-coal policies will cause a family of four to lose more than $1,000 in annual income. Didn't hear this on the news? The mixed messages coming out of Russia surrounding Edward Snowden, the former National Security Agency (NSA) contractor who leaked sensitive information, have now been clarified. According to a RT news report, President Vladimir Putin told reporters today that Snowden remains at the Moscow airport - and that he will not, despite U.S. demands, be extradited.
The president said that Snowden has committed no crimes in Russia and that he is free to move about the country at his own free will. As for the allegations that Russia has been assisting the leaker, Putin called any and all claims "nonsense and rubbish."

What jihad has cost Americans by Guy Rodgers Executive Director
Perhaps you've noticed. Every time there's a jihadist attack, whether foiled or successful, government leaders, media mouthpieces, Muslim Brotherhood front organizations, and academic apologists bend over backwards urging us not to rush to judgment. They collectively decry "Islamophobia" and wring their hands in fear for all the Muslims who will now be persecuted by "bigoted" Americans. It's so predictable, it's like watching a bad remake of the movie "Groundhog Day." Perhaps you've also noticed that the alleged bigoted wave of Muslim persecution never comes. If it did, it would be front page news all over America.
What you won't find on the front page news is the horrific cost in lives, money, and freedom, that America specifically, and the West generally, has paid-and continues to pay-thanks to the rising tide of global Islamic jihad.

Most of us have some awareness of the cost in lives, from 9/11 to Ft. Hood to the Boston Marathon bombings. The direct cost in dollars is tougher to calculate. Since its creation we've spent over $400 billion for the Department of Homeland Security. The wars in Iraq and Afghanistan have cost close to $1.5 trillion. Throw in the creation of the TSA; extra costs for security at every level of society; the costs for Guantanamo Bay and every prosecution of every Islamic terrorist; and I'd estimate we're conservatively talking about $2.5 trillion since 9/11. We're paying that with our taxes and the national debt we're piling on our children and grandchildren. What's more, as soon as a jihadist blows up something at one of our ports we'll have to implement heightened security and screening measures not now in place. Ka-ching. And all these costs don't include the indirect cost in dollars due to the recession after 9/11. Hundreds of billions? Who knows? I know my IRA took a huge hit after 9/11.
But what about the intangible costs we've incurred? The costs in loss of freedom, rising fear, and impositions on our way of life?

- Onerous shakedowns, pat-downs, put-downs, and invasive imaging at airport security.
- Extra time we have to allow to go through long security lines at airports.
- Watching the TSA agent throw away your expensive bottle of perfume you forgot was in your carry-on bag.
- Explosion of public surveillance cameras.
- Extra time we have to allow when attending any public event where security is considered necessary (such as sporting events).
- Fear of going to public events.
- That knot in our stomachs when we see an abandoned backpack in a public place.
- The time law enforcement has to spend preventing terrorism and tracking down terrorists-time that takes them away from keeping us safe from murderers, rapists, thieves and vandals.
- Bag searches at theme parks like Disney World.
- Endless intimidation tactics, such as the persecution of free speech, name calling and threats ("Islamophobe," "racist," "bigot," etc., etc.). I'm thinking of that wonderful teacher in Concrete, Washington, whose reputation has been smeared by CAIR-Washington because she dared to tell the truth about the Taliban and Hamas.
- Government intimidation, such as reported instances where government agents (e.g., police), have shown up at people's homes to question them after complaints of "Islamophobia." I wonder how many burglaries occurred while those police were busy interrogating innocent people?
- Messing with the minds of our children and grandchildren thanks to biased and inaccurate public school textbooks.
- Heightened security precautions for every person or organization that speaks out against the threat of radical Islam. For instance, some of our chapter leaders use pen names. Brigitte Gabriel has been the target of death threats.
- Government surveillance of our websites and blog sites.
- The NSA (National Security Agency) collecting phone records nationwide. The justification for this, and it's understandable even if disconcerting, is the terrorist threat to our national security. No terrorist threat, no phone records seizure.
- Banking and financial regulations that impose often unseen burdens on our ability to engage in financial transactions. One group of nuns actually had their bank account frozen because they were suspected of terrorism. Why? One of the nuns didn't have her Social Security number and photo ID on the account!

In short, the entire fabric of American society has been dramatically altered by the rising tide of global Islamic jihad. There is no aspect of our lives that hasn't been negatively impacted by this. We have less privacy, less freedom, more cost, more fear-the inevitable consequence of jihadist terror.

And the jihadists know this. They know their actions are negatively impacting our lives. It's part of their strategy to break our will. I'm not saying Islamic jihad is the only threat that has spawned all of these changes to our lives. But clearly, it's the most predominant, by far. As I assess the incredible price we're paying for jihad, I've grown weary of hearing how Muslims are being inconvenienced or feel uncomfortable or feel like their rights are being infringed upon. Join the club. Every time I have to virtually undress at the airport, I feel violated and my rights infringed upon. I've lost patience with the complaining about how bad Muslims are being treated in America, about the price they're paying. We're ALL paying a price. Where's the sympathy and empathy for us non-Muslims who didn't ask for this? To the degree that Muslims are suffering repercussions, they're paying a price for the actions of other Muslims. If they really want things to change, they can do something about it by going to the heart of the problem and standing up to the stealth and violent jihadists in their midst, including their leaders.
- Stop screaming "Islamophobia" and start exposing all the hate-filled, violent and jihadist literature in the majority of mosques in America.
- Join together with reformist Muslims and organizations who are confronting the Muslim Brotherhood and its alphabet soup of legacy organizations in America (CAIR, ISNA, MAS, MPAC, MSA, IIIT, NAIT, etc., etc., etc.).
- Start asking why historically open and tolerant countries like the Netherlands, who welcomed Muslim immigration for decades, are now experiencing a growing citizen pushback against that immigration.
- Start putting yourselves in the shoes of us non-Muslims. We're paying a hefty price for something we didn't ask for and we didn't deserve.

And please, no more lectures about how supposedly "intolerant" Americans are. It's a remarkable commentary on the goodness and tolerance of Americans when you consider the enormous price we've paid thanks to jihad, which we've shouldered virtually without retaliation against the Muslim community. So the next time someone complains to you about the price Muslims are paying, however that price is defined, nod your head and say "I hear you. Have you ever calculated the price non-Muslims are paying because of global Islamic jihad?" And then spell it out for them. Who knows? You might change a few minds along the way. This is an action alert to let you know what the Environmental Protection Agency is up to.
A few weeks ago the EPA finished a biased study that they are trying to use to preempt a mine in Alaska. The area known as The Pebble Project is one of the largest copper deposits in the world and the company considering development hasn't even applied for a permit yet. But that hasn't stopped EPA and environmental pressure groups from trying to preemptively veto the project.
This is just one in a series of decisions by the EPA to impact the creation of jobs in our country.
It's made worse because the mine in this case doesn't even exist, the EPA made up a fictional mine and then bemoaned a parade of horribles that would result from its development. However, EPA didn't take into account all of the modern techniques a mine owner might use to mitigate any impact on the region. The study is rigged to give EPA the outcome they want: a veto over a mine that doesn't even exist yet.

Breitbart News reported on Monday about a special provision of the new Obama stimulus jobs program inserted into the newly repackaged version of the "Gang of Eight" bill. That provision could allow beneficiaries to receive taxpayer-funded vehicles, like cars, motorcycles or scooters.

In climate speech, Obama sets carbon limits on Keystone By Justin Sink
President Obama said Tuesday that the controversial Keystone XL pipeline should only be approved if the project would not "significantly exacerbate" greenhouse gas pollution.
"Allowing the Keystone Pipeline to be built requires a finding that doing so would be in our national interest," Obama said during a speech at Georgetown University on his climate change plans.
"Our national interest will be served only if this project doesn't significant exacerbate the problem of carbon pollution," Obama said. "The net effects of the pipeline's impact on our climate will be absolutely critical to determining whether this project can go forward."

Sarah Slams Senate Immigration Bill In a Facebook post Sunday evening that was liked by more than 3.5 million people, former Alaska Governor Sarah Palin slammed the Senate's immigration bill and ripped into Florida Senator Marco Rubio. Palin wrote that Senate Democrats were trying to "Pelosi" the amnesty bill -- "They'll pass it in order to find out what's in it." She blasted Senate "amnesty supporters" for repeatedly voting down strict border security amendments, and Palin included Marco Rubio among the "amnesty supporters." Palin also echoed remarks I have been making: We cannot trust this gang to secure the border. She wrote:
"If D.C. expects us to just sit back and 'trust' them despite our permanent political class and Washington bureaucrats proving themselves so very untrustworthy, then I have a bridge to somewhere in Alaska to sell them. Our government is awash in one scandal after another involving blatant lies and violations of our basic liberties, and the leader of the pack ventures out on one road trip after another to avoid accountability.
Harry Reid has vowed to ram the bill through the Senate before the July 4th recess. Yesterday Barack Obama said he wanted the House to "get this done" before August. There is a reason they are in such a rush. The left is worried that protests and demonstrations against the bill during the summer August recess could persuade House members to oppose it. And they should be worried about protests -- it's a terrible bill! Don't wait until August, my friends. Members of Congress are scheduled to be back home next week for the July 4th recess. A Victory For Common Sense The Supreme Court today struck down a key section of the 1965 Voting Rights Act. The act routinely subjected the laws of nine states and many other local jurisdictions to the intense scrutiny of the Justice Department whenever they sought to change any aspect of their election laws. For example, Attorney General Eric Holder used the Voting Rights Act to block popular voter ID laws in Texas and South Carolina. While congressional and state redistricting was left to most state legislatures, certain states were required by the Voting Rights Act to get "preclearance" or approval from the Justice Department in order to complete their plans. Today the Supreme Court declared that regime unconstitutional. The court's majority objected to the fact that the law relied on "a formula based on 40-year-old facts, having no logical relationship to the present day." Writing for the majority, Chief Justice John Roberts rightly observed, "Our country has changed." Indeed it has. America has elected and reelected its first black president. During his campaigns, Barack Obama won two southern states -- North Carolina and Virginia. Senator Tim Scott, a black man, now represents the state of South Carolina. Senators Marco Rubio and Ted Cruz, both Hispanics, represent Florida and Texas. Susana Martinez, who is Hispanic, is governor of New Mexico. Brian Sandoval, also Hispanic, is governor of Nevada. Indian Americans Bobby Jindal of Louisiana and Nikki Haley of South Carolina are governors of their respective states. The Voting Rights Act seems unnecessary when states like Louisiana and South Carolina are electing minorities to high office. This ruling was a victory for common sense. Tomorrow morning we will find out whether the court has enough common sense to uphold the definition of normal marriage. Obama Declares War On Coal President Obama delivered a speech today which the New York Times labeled "a sweeping plan to address climate change." In reality he is declaring war on the coal industry and your wallet. Don't take my word for it. The New York Times quoted Daniel Schrag, a member of Obama's presidential science panel, which is advising the White House on this issue. "The one thing the president really needs to do now is to begin the process of shutting down the conventional coal plants," Schrag said. "Politically, the White House is hesitant to say they're having a war on coal. ...a war on coal is exactly what's needed." This is not a sudden shift. Don't forget that in 2008 Obama promised to bankrupt the coal industry. Combatting climate change might sound like a laudable goal to some. But this is a very radical idea. In fact it is so radical that Obama could not get it passed by the Democrat Congress in 2010, when his party controlled a super-majority vote in the Senate. There were plenty of reasons why many Democrats opposed Obama's climate change plan then and those reasons are still valid today. Here are just a few:
- Higher energy costs. Even with low natural gas prices, coal still produces most of our electricity.
- Higher gas prices. If you think gasoline is too expensive now, just wait until Obama's carbon tax kicks in. A 2010 Harvard study estimated that to achieve Obama's climate change goals, gasoline prices would have to rise to $7 a gallon.
- Higher food prices. Carbon taxes and regulations would have a tremendous impact on the price of fertilizers and pesticides, not to mention all the goods in your local grocery store that are transported by trucks paying $7 a gallon for diesel!
- More foreign aid. Obama is pledging billions of your hard-earned dollars for "international climate mitigation and adaption projects," but many developing nations are demanding far more.

It would be easy say Marco Rubio has had a change of heart about amnesty after a careful consideration of the facts, but that would be too simplistic. The indications are that he has more likely become a careful liar about his intentions toward us.
Until recently Rubio seemed like a nice young man who understood why America is so great. He was supposed to be the Republican who would bring Hispanics to conservatism (please don't say they are there already) and build a coalition of minorities that would counterbalance African American's socialism. Time has proved those assumptions wrong.
In 2010 his freshness and seeming honesty catapulted him right passed the hapless Charlie Crist(running as a who knows what?) and Democrat Kendrick Meeks to win election to the United States Senate.

Debt is the surest and shortest path to a global economy. Punishing all actors in local economies but those who are "too big to fail" empowers "too big to fail" systems and "too big to fail" economies. Encouraging debt and the eventual assumption of debt passed on and commodified by increasingly larger political and economic entities creates supraentities built on debt and dedicated to economic regulation. The assumption of state debts by the Federal government was a major step in the federalization of the United States. The growing assumption of micro and macro debts by the United States government and by international bodies allows for greater macro and micro regulation of economic activities. Rewarding and promoting irresponsible economic behavior creates debt which creates opportunities for intervention. Individuals are encouraged to engage in irresponsible day to day consumer spending and large scale home and college loans. Financial institutions package irresponsible loans into commodities of debt. Governments bail out financial institutions by amassing even more debt to pay for the bailouts. The buck keeps getting passed on until everyone is in debt from the micro to the macro level, from the citizen who has his own debts, the annual and the lifelong, and those of the nation which he is also being taxed to repay, up to banks and governments, where the same experts move imaginary numbers around until everyone is in debt and also a debt holder and then a global state of debt has become universalized. The universalization of debt leads to the universalization of economic authority and eventually planned economies. By indebting everyone from the individual to the government, everyone is forced to maintain a bankrupt and broken system. Debts are obligations. Obligating everyone to the same system forces everyone to comply with the system.

Jennifer Rubin and the excommunication impulse

Jennifer Rubin, writing in the Washington Post, detects "two starkly different visions of the GOP, as well as two potential paths for the GOP." The question, she believes, is whether the GOP will become the party of:
Rand Paul or Kelly Ayotte [I would have said John McCain, but I understand why Rubin wants to say Ayotte] on national security;
The Gang of Eight or the Gang of Mike Lee, Ted Cruz, and Jeff Sessions on immigration; and
Rob Portman or Rick Santorum on gay marriage
In Rubin's view, only the Ayotte, Gang of Eight, and Portman's side is truly conservative. For it only this side that "wants to conserve what is good" (talk about a question-begging definition of conservatism) "while recognizing the habits, morals, and desires of 21st century America (all of them, without question?)
The other side, by contrast, isn't conservative. It is "reactionary" or "radical," Rubin announces.
This is name-calling disguised as argument. It seems that Rubin has what Peter Wehner calls "the excommunication impulse."
Unfortunately, even using Rubin's dubious definition of conservatism, (didn't William Buckley say something about standing athwart history yelling "stop"), she fails to make a case for excommunicating those on the right with whom she disagrees.
Take national security. I'm closer to John McCain than to Rand Paul in this area. But Paul's views - e.g., on matters of foreign intervention and domestic surveillance - may well be more in line with the current "habits, morals, and desires of 21st America."
I say "current" habits, morals, and desires because these can change quickly, as anyone who has been paying attention during the past 12 years knows. But that's part of my point. Conservative views on national security shouldn't be contingent on an assessment of "the habits, morals, and desires of 21st America." They should depend on our national security requirements, balanced by our Constitution.
As for immigration, the Gang of Eight's position is probably consistent with the morals, habits and desires of Hispanics. But Hispanics are an insular minority. I doubt that most of the rest of the population consider the legalization of 11 million or more illegal aliens prior to securing the border consistent with their morals, habits, and desires. Nor is there any reason to believe that most Americans favor the influx of, say, 30 million Central Americans into the ranks of our citizenry.
Finally, we come to gay marriage. Here, one can see the trace of a connection between Rubin's misguided definition of conservatism and the side she favors in the debate. Even so, the country seems divided about 50-50 on the issue. Indeed, liberal California recently voted to define marriage as between a man and a woman.
I believe the trend is running the other way. But since when does one jeopardize one's status as a true conservative by refusing to yield on a matter of principle in anticipation that the wind is blowing the other way? It is silly to suggest that those who insist on the age-old, essentially universal definition of marriage are less conservative than those who want to change that definition.
Equally silly is Rubin's conclusion that the "true conservatives" - i.e., the folks who agree with her on key issues, as opposed to Ted Cruz, Mike Lee, Jeff Sessions, etc. -- need to "be fiercer" if they wish to prevail in 2014 and 2016.
John McCain called Republicans who disagree with him "wacko birds." Marco Rubio claimed that certain right-wing groups opposed to amnesty legislation aren't conservative, and are motivated by an anti-life, pro-abortion impulse. Few who have tangled with Chris Christie would say he's insufficiently fierce for a politician.
In any event, Rubinesque ferocity against popular conservative politicians like Ted Cruz is not the path to victory in 2016 for a Rubio, a Christie, or an Ayotte. Neither is excommunicating a large chunk of the Republican base by denying its conservatism.

Supreme Court strikes a blow for a more sensible Voting Rights Act

Today, the Supreme Court decided an important Voting Rights Act case. In Shelby County v. Holder, it held that the formula defining covered jurisdictions for section 5 preclearance is unconstitutional. Amy Goldstein of Scotusblog explains:
The preclearance provisions of the Voting Rights Act were designed to prevent discrimination in voting by requiring all state and local governments with a history of voting discrimination to get approval from the federal government before making any changes to their voting laws or procedures, no matter how small. In an opinion by Chief Justice John Roberts that was joined by Justices Scalia, Kennedy, Thomas, and Alito, the Court did not invalidate the principle that preclearance can be required.
But much more importantly, it held that Section 4 of the Voting Rights Act, which sets out the formula that is used to determine which state and local governments must comply with Section 5's preapproval requirement, is unconstitutional and can no longer be used. Thus, although Section 5 survives, it will have no actual effect unless and until Congress can enact a new statute to determine who should be covered by it.
John Fund correctly sees this ruling as a "civil rights" victory:
Section 4 of the Voting Rights Act forced states that had poor minority registration or turnout numbers in the 1960s to remain in a permanent penalty box from which they were forced to seek Justice Department approval for the most basic of election-law decisions. Its consideration of state requests for election changes was often arbitrary and partisan, as witnessed by the recent smackdown that the DOJ got from a federal court when it tried to block South Carolina's voter ID law.
The rest of the Voting Rights Act remains in place and will be used to ensure minority voting rights. Congress is free to come up with a different, updated coverage formula for pre-clearance, but given the DOJ's current stained reputation Congressional action looks unlikely in the near future.
Clint Bolick, director of litigation for the conservative Goldwater Institute in Arizona, says the demise of Section 5 of the Voting Rights Act will also reduce the balkanization of racial gerrymandering that has become so popular lately. "Voting districts drawn on racial or ethnic lines divide Americans," he says. "This decision helps move us toward the day in which racial gerrymandering becomes a relic of the past."
JOHN adds: I see the Court's decision as a little more far-reaching. It seems to me that the Court has finally declared an end to Reconstruction, and to the institutionalized second-class citizenship of the Southern states. It is noteworthy that Chief Justice Roberts' opinion places considerable weight on the constitutional principle of equality among the states, and also cites the Tenth Amendment as reposing control over voting procedures with the states. Further, while discriminatory voting practices are still banned under Section 2, what we have come to think of as the "Voting Rights Act" is effectively done for. The Court approved the concept of pre-clearance that is contained in Section 5, but of course there won't be any pre-clearance until Congress writes new, defensible criteria to replace those the Court struck down-something that I assume will never happen. So the principal provisions of the Voting Rights Act, which should have been allowed to expire long ago-and would have, if that were politically possible-are finally gone.

The new IRS chief is throwing sand in the eyes of those trying to see what the IRS has on display in the scandals roiling the agency. The AP story carrying the IRS man's contribution is "New IRS chief: IRS screening was broader." The IRS man's line is that right-leaning and left-leaning groups were similarly abused by the IRS. That would of course explain why we have heard from so many "progressive" groups complaining of their mistreatment by the IRS (not).

Affirmative action forever

A few months ago I anticipated the somewhat disappointing result produced by the Supreme Court in the Fisher case addressing the issue of "affirmative action." I thought pessimism was warranted and that the pessimistic view has been vindicated, although that isn't entirely clear. In his column this morning George Will capably elaborates on the damage the Court has preserved. I'm taking the liberty of reiterating my own observations on the subject below.
The principle of equal treatment without regard to race is one that is close to my heart. Accordingly, one of my favorite books on a legal subject is Andrew Kull's The Color-Blind Constitution. (I learned of the book at the time of its publication through Judge Alex Kosinski's 1993 New Republic review/essay.) It is a book that is by turns inspiring and maddening. I recommend it without reservation to readers interested in the subject.
The book is full of surprises. For example, Kull devotes two chapters to the separate but equal doctrine approved by the Supreme Court in the 1896 case of Plessy v. Ferguson. The case represents the bygone era of Jim Crow, yet at the outset of his discussion of the case Professor Kull makes this astounding observation: "The majority opinion in Plessy makes a comfortable target, and it is routinely vilified. But in its broad holding, as opposed to its particular application, Plessy has never been overruled, even by implication. On the contrary, it announced what has remained ever since the stated view of a majority of the Supreme Court as to the constitutionality of laws that classify by race."
The principle of equal treatment was adopted as the law of the land in the great civil rights legislation of 1964 and 1965, or so we foolishly thought at the time. It may even have been the law for a minute or two. Then the federal government began building the whole edifice of affirmative action and racial preferences that we live with today and that has been addressed by the Supreme Court in a number of important cases. Certainly insofar as higher education is concerned, the affirmative action regime and the treatment of students based on the color of their skin are entrenched more deeply than ever under the shibboleth of "diversity."
One of the lessons of Kull's great book is that the Court wants to retain for the judiciary the discretion and authority to approve varieties of racial discrimination. The ideal of the color-blind Constitution remains permanently on the horizon. To paraphrase George Wallace, affirmative action today, affirmative action tomorrow, affirmative action forever.

How Could a Goofy Techie Expose Our Government's Incompetence?

The goofy techie, of course, is Ed Snowden, and the question might seem hard to answer if the Obama administration's incompetence were not on display for all to see. The international press, belatedly catching on to the fact that our president is a fool, is having fun with the U.S. Thus, Reuters headlines, with a snicker: "Questions turn to U.S. competence in Snowden saga."
As well they might.
The Obama administration has spent the past few weeks arguing it can wield power responsibly after Edward Snowden unveiled its sweeping spying programs. Now the administration must prove it can wield power effectively.
Well, it certainly can domestically. Not only can it sic the IRS on its political opponents, it can buy whatever votes may be necessary with other people's money. Dealing with foreign countries, where such powers come up short, is another story.
As the 30-year-old leads the world's lone superpower on a global game of hide and seek, U.S. government officials faced questions about whether they had botched the effort to extradite Snowden from Hong Kong to face charges related to his leak of classified information.
Actually, they botched much more than that. How in the world could the NSA allow a random employee of a contractor, Booz Allen, who had been on the "job" for only a couple of months, such unfettered and apparently uncharted access to secret materials? The fact that the NSA did so is the best argument against that agency's being a trustworthy custodian of Americans' secrets.
The latest wrinkle in the Snowden saga poses a different set of questions for an administration that has spent weeks fending off questions about whether it has abused its power to collect taxes, investigate criminal activity and fight terrorism.
Abusive and incompetent! That's Barack Obama.
On Monday, administration officials said they had done all they could to bring Snowden to justice. Chinese defiance, rather than bureaucratic bungling, had allowed the 30-year-old former contractor to slip out of Hong Kong as officials there weighed Washington's request for extradition, they said.
Well, yeah. The Chinese hold our mortgage, so why would they pay any attention to Barack Obama? Obama's policy of borrowing $17 trillion isn't what a sane person would consider smart.
Snowden's exact whereabouts were a mystery on Monday as Russia resisted White House pressure to stop him during his journey to escape U.S. prosecution.

Add to that Putin's support for Iran's nuclear ambitions and his crackdown at home. (The Washington Post writes that in "an attempt to suppress swelling protests against his rigged reelection and the massively corrupt autocracy he presides over, Mr. Putin has launched what both Russian and Western human rights groups describe as the most intense and pervasive campaign of political repression since the downfall of the Soviet Union."). Taken all together, you can see that the Obama "reset"-which at the dawn of the Obama administration was described as a "win-win" strategy for both nations-has been a rout for the Russians.
With the Snowden situation, Vladimir Putin seems intent not only defying America but embarrassing her. It turns out that an irresolute amateur like Barack Obama was the best thing that the brutal but determined Putin could have hoped for.
He's cleaning Obama's clock.
Let's not lose sight of the fact that the "reset," and the disaster of American foreign policy over the last four years, have been attributable not only to Obama, but to our old-lady-president in waiting, Hillary Clinton.
Snowden's decision to go on the lam creates another headache for the Obama administration, which has seen priorities like immigration reform threatened by a string of scandals.
That, plus the fact that the immigration "reform" bill is a disaster.
When it comes to the NSA revelations, most lawmakers were already aware of the surveillance program and few have raised objections. Republicans by and large have focused their criticism on Snowden and China rather than the administration.
That may change if the ordeal drags on. Republican Representative Peter King of New York on Monday said Obama should have taken a harder line with the Chinese authorities who ultimately control the semi-autonomous region of Hong Kong.
"I hate to be in the middle of a crisis second guessing the president, but where is he? Where is the president? Why is he not speaking to the American people? Why is he not more forceful in dealing with foreign leaders?" King said on CNN television.
Those are rhetorical questions, obviously. Barack Obama has never been a real president. He has never led. He seems to view his job duties as an unfortunate distraction from golfing and partying with celebrities. How could anyone be surprised to learn that he is an inept, ineffective president?
There are also likely to be increasingly embarrassing questions about how Snowden managed to download and take many highly sensitive documents when he was working in Hawaii for NSA contractor Booz Allen Hamilton. The head of the NSA, General Keith Alexander, said on Sunday that he did not know why the NSA did not catch Snowden before he left Hawaii for Hong Kong in May.
Well, that's reassuring! The NSA has wonderful technical capabilities to spy on everyone in the world, but can't figure out how its own contract employee made off with a pocket full of secrets. Maybe that's a sign that the U.S. would be ill-advised to go down the road of totalitarian, all-knowing government. Maybe we can start by repealing Obamacare.
Obama first learned that Snowden had turned up in Hong Kong on Sunday, June 9, as he flew back from a weekend of talks with Chinese President Xi Jinping.
But Obama does not appear to have played a direct role in trying to get him back.
Really? There's a shock! Obama hasn't played a "direct role" in anything other than an election campaign since he first ran for the Illinois State Senate.
Obama declined to say on Monday whether he has spoken directly with Russian President Vladimir Putin or other foreign leaders about the extradition efforts. Obama had an icy meeting with Putin a week ago at the G8 summit in Northern Ireland.
Reset! Reset! Remember how contemptuous the wet-behind-the-ears Barack Obama and his newly-minted Secretary of State Hillary Clinton, whose only claim to fame was her marriage to Bill, were of the Bush administration's Russia policy? Reset! Putin thinks Obama is an idiot. Can you blame him?
Obama's public schedule leaves little room for the extradition effort. He makes a major speech on climate change on Tuesday, and then leaves on a week-long trip to Africa.
This is really pretty funny. Obama would surely deal with the crisis that was brought about by his administration's incompetence, only he is too busy! He's going to prevent climate change-sure he is! Just dial down that CO2 thermostat! Well, our small part of it, anyway. And no doubt his trip to Africa will be just as productive as the hundred or so trips to Africa by his predecessors have been. Too busy to actually function as president? That's our Barack! With luck, he will be able to squeeze in a couple of rounds of golf.
Though the White House has distanced itself from the Snowden affair...
Of course! The White House distances itself from everything. If you have ever wondered what it would be like to live in a U.S. that didn't have a president-vis-a-vis foreign countries, at least-you are now finding out.
Officials from the FBI, the Justice Department and the State Department worked with their counterparts in Hong Kong to extradite Snowden over the next several days, culminating in a telephone call between U.S. Attorney General Eric Holder and Hong Kong's Secretary for Justice, Rimsky Yuen, on June 19.
"There was a sense that the process was moving forward," a Justice Department official said, speaking on condition of anonymity.
Hong Kong officials asked for more information and evidence two days later, but did not give the United States enough time to respond before Snowden left the Chinese territory on June 23.
We should have known that Eric Holder would be involved in the fiasco, somehow. One can only imagine what the Chinese think of Holder.
George Terwilliger, who served as the Justice Department's No. 2 official under President George H.W. Bush, said it was too early to know whether the agency should be blamed for failing to get Snowden.
"These are not legal issues, per se. They're political and diplomatic issues, and most of the skills that are exercised are exercised away from the public eye."
Or not exercised, as the case may be. When you read these stories in which European journalists make fun of the Obama administration, you need to keep in mind that most of them, along with the European elites whom they represent, want the United States to be weak. That is why they awarded Obama a Nobel prize before he had done anything at all: it was a Nobel prize for weakness. But even the Euros can't resist laughing at what a fool we have for a president. A fool, anyway, if you assume that we all want the United States to be a strong and prosperous nation.

The Senate advanced a new version of the Gang of Eight's amnesty bill yesterday by a 67-26 vote.
The new version weighs in at 1,200 pages long and was introduced just last Friday. So did lawmakers have a chance to read through the monster bill and understand it enough to vote on it in just three days?
That's difficult to believe. The Heritage Foundation's Amy Payne points out that

Senators and the American people [had] just one weekend to look it over. Apparently, the Senate doesn't feel it needs more time to debate such a sweeping piece of legislation that will cost taxpayers trillions of dollars. Now, final passage is expected in a couple of days.

What's in the new version of the bill? First and foremost, it still does not stop illegal immigration. Additionally, it includes new spending that our nation simply cannot afford.
While the bill is sailing through the Senate, it may have a tougher time in the House of Representatives. Before this monstrosity becomes law, Americans should demand a better way.

The Supreme Court will announce decisions this week on two cases relating to same-sex marriage.
The first case challenges the constitutionality of Proposition 8, an amendment to California's state constitution passed by a popular vote in 2008. It defines marriage for state purposes as the union of one man and one woman.
The second case involves the Defense of Marriage Act, a federal law passed by overwhelming majorities in both houses of Congress and signed into law by President Bill Clinton in 1996. It defines marriage for the purposes of federal law as the union of one man and one woman. It also ensures that each state is free to make its own marriage policy and does not have to recognize another state's revision of marriage policy.
The Court should uphold these marriage laws and allow the debate over marriage to proceed in the democratic process.

Some Senators have been selling their pro-amnesty vote in return for an improvement in the bill that, nonetheless, doesn't come close to being worth the pain of giving out 33 million more work permits to foreigners the next 10 years.
Other Senators are selling their vote for nothing more than fig leaves that they hope will give them cover by appearing to improve enforcement without actually doing so.
And other Senators are selling their amnesty vote for what pretty much could be considered pork for their state or some special interest that they feel they have to serve.
Just because the Gang of Eight is targeting the Senators on this list doesn't mean they are inviting horse-trading. But your calls are absolutely necessary to make sure they know it is not in their state's or their own best interest to trade or sell their vote for anything.

The Senators are color-coded based on their first vote on the Schumer-Corker-Hoeven amnesty amendment on Monday. Green means they voted against the amendment, red means they voted for the amendment, and blue means they didn't vote.

Here is what the National Review wrote (and pretty much what we are hearing from our own sources):
Republican sources are telling National Review Online that Gang of Eight members were less-than-thrilled by the outcome of yesterday's vote to advance their immigration reform bill, and they are now looking for ways to win -- or buy -- more GOP votes. The bill is certain to pass, of course, but proponents are hoping for 70 votes, meaning they will need more than the 15 Republicans who voted for cloture on Monday.
Opponents of the bill are concerned that, sometime within the next 24 to 48 hours, the Gang of Eight will come to an agreement with Senate m ajority leader Harry Reid (D., Nev.) to allow votes on a series of amendments that have been handpicked by the Gang, and are designed to placate wavering Republicans and win their votes for the final bill. It will not be an open process, as was originally promised, and could involve more giveaways like the "Casino Cash-out" and the "Crabhusker Kickback" the functional equivalent of earmarks, which have been banned since 2011. It's another backroom deal," says one GOP aide. "This is how we do earmarks these days."
The effort will likely be cast as an appeal to Republicans, who have expressed concern that so few amendments (nine) have been voted on thus far. By comparison, 46 amendments received votes during the 2007 immigration-reform debate. A group of 14 Republican senators sent a letter to Reid on Monday urgi ng at least as many amendment votes on the current legislation, and criticizing the bill's supporters for "collecting yes votes as the price of admission into that back negotiating room." Senator John Cornyn (R., Texas) said Reid's effort to control the amendment process resembled a "dictatorship." If Reid does attempt to bring a Gang-approved amendment package to the floor, however, opponents will likely try block it using procedural tactics. They would insist that they get to choose some of the amendments to be voted on.

You have a lot of reason to shame them in front of their staffs this afternoon. And it is still quite possible that they could decide to uphold their campaign promise against amnesty and vote NO on the final chance to kill the bill (probably Thursday morning).

Republicans (and red state Democrats) used to tell voters amazing things about their oppositi on to amnesty. Then they got elected and supported legislation that actually weakens border security and puts people on a path not just to legalization, but to citizenship, before ever securing our borders.
1. Rubio: "I would vote against anything that grants amnesty because I think it destroys your ability to enforce the existing law and I think it's unfair to the people who are standing in line and waiting to come in legally. I would vote against anything that has amnesty in it."
2. Corker: "We need a new immigration policy that reflects America's values. First, secure this border. Allow people to work here but only if they're legal. No amnesty. Those employed but here illeg ally must go home and return through legal channels."
3. Wicker: "I agree that illegal immigration is a major issue that needs to be addressed. However, I oppose amnesty as the solution."
4. Ayotte: "For the people who are here illegally, I don't support amnesty; it's wrong. It's wrong to the people who are waiting in line here, who have waited for so long. And we need to stop that because I think that's where the Administration is heading next."
5. Flake: "I've been down that road, and it is a dead end. The political realities in Washington are such that a comprehensive solution is not possible, or even desirable given the current leadership. Border security must be addressed before other reforms are tackled."
6. Hatch: "We can no longer grant amnesty. I fought against the 1986 Simpson-Mazzoli bill because they granted amnesty to 3 million people. They should have to get in line like anybody else if they want to come into this country and do it legally."
7. Heller: "I believe it is an amnesty program, a back-door amnesty program for the 12 to 15 million people who are here illegally."
8. Alexander: "We cannot restore a system of legal immigration "which is the real American Dream "if we undermine it by granting new benefits to those who are here illegally."
9. Collins: Before 2008 reelection, voted no on McCain-Kennedy amnesty.
10. Hoeven: Hoeven said the U.S. needs to secure its borders and crack down on employers who hire illegal immigrants.
11. McCain: "Complete the danged fence."
12. Graham: Amid withering criticism from his constituents, Graham, who is up for reelection next year, began to argue that it was time to approach the immigration problem in stages. On Thursday, he likened the decisive vote to pass his amendment to "having been robbed 12 million times and finally getting around to putting a lock on the door."
13. Kirk: "The American people believe our borders are broken. It is a fundamental duty of our government to know who is entering the country, making illegal entry nearly impossible. In the coming Congress, we have an overwhelming bipartisan consensus to restore confidence in the security of our borders "before we pursue other immigration proposals."
14. Murkowski: "With regard to undocumented aliens, I believe that those who illegally entered or remained in the United States should not be granted amnesty. Granting amnesty to illegal aliens sends the wrong message and is not fair to the vast majority of immigrants who abided by U.S. immigration laws. Granting amnesty would only encourage further illegal immigration."
15. Chisea: Joined most other Republicans, including opponents of the legislation, in supporting a proposal, which was defeated largely along party lines, that would have blocked legalization until the government can prove U.S. borders are secure. Chiesa said he sees border security as a top priority given his law enforcement background, and has yet to decide his stance on citizenshi p for immigrants without authorization.
Red State Democrats
1. Pryor: "I voted against the president's immigration plan today because the border security and enforcement measures are inadequate and the bill fails to effectively address the individuals who are already here illegally." Pryor says it's time for changes, "It's time for a new approach. I advocate that we strengthen and implement the enforcement measures in this bill and show we can fully enforce immigration laws."
2. Tester: He wants secure borders and no amnesty fo r law breakers.
3. Landrieu: "Sen. Landrieu is a leader in the U.S. Senate fighting against illegal immigration," Schneider said. "She has fought against amnesty for illegal immigrants and to provide more resources for border security. The new NRSC attack is designed simply to mislead voters about Sen. Landrieu's record."
4. Donnelly: "Eliminate amnesty because no one should ever be rewarded for breaking the law."
5. Hagan: Hagan said she supported increased border security and opposed amnesty.
6. McCaskill: Claire does not support amnesty. As a former prosecutor, Claire believes people who break the law should be held accountable, both illegal immigrants and the employers who exploit them for cheap labor. Claire does not believe we need any new guest worker programs undermining American workers.
7. Stabenow: Do you support path to citizenship for illegal immigrants? STABENOW: I voted no, because it went too far and cost us jobs. I do think it's important to have border security and legal system that is fair and effective. My focus is on our jobs that we're losing because of failed policies.

'Unforgivable Sin' - Senate Immigration Bill passes big test
The immigration bill passed a huge test in the Senate last night, and it appears as though it will sail through the final Senate vote later this week. Thanks to 15 votes from defecting Republicans, the bill received 67 votes, seven more than needed to ultimately pass. Glenn expressed his frustration, particularly with 'colossal disappointment' Jeff Flake and 'made out of liverwurst jello' Lindsey Graham. See Glenn's passionate reaction from radio today.
Glenn: 'Courage is contagious'
Glenn has been talking about the coming Civil Rights movement - a fight each of us will be part of if America is to remain the land of the free.
