There's An Even More Secret Surveillance Program, and It's Called PRISM
Google, Apple and Facebook are all implicated-and they're all denying it.

The New Republic's Lydia DePillis posed a great question: When it comes to protecting your user data, phone companies fold but tech companies fight. Why?
The idea is that because of the network operators' status as a legacy industry with a long history of experience tangling with Washington, they're more susceptible to co-optation by the government. Tech firms, meanwhile, are nothing without their users, who can all decide to abandon a service and effectively kill it off. The libertarian culture of the Web also helps to foster norms about privacy and respect.
But now it seems as though there isn't the bright line separating Silicon Valley from the telcoms like we thought. The Washington Post and The Guardian crack open the White House surveillance scandal even wider by uncovering a secret program called PRISM-a six-year-old classified intelligence program that "[taps] directly into the central servers of nine leading U.S. Internet companies, extracting audio, video, photographs, e-mails, documents and connection logs."

It was followed by Yahoo in 2008; Google, Facebook and PalTalk in 2009; YouTube in 2010; Skype and AOL in 2011; and finally Apple, which joined the program in 2012. The program is continuing to expand, with other providers due to come online.
PRISM allegedly involves data collection by the FBI, the fruits of which are then relayed to the NSA. If the report is true, the surveillance scandal will have crossed from simple metadata and envelope surveillance into the realm of wiretapping, which by definition involves the collection of actual content.

The National Security Agency and FBI are interested in more than just your phone records - they are also interested in your audio, video, photographs, emails, documents, and connection logs, according to a bombshell report from The Washington Post.
Although the massive Internet surveillance program, code-named "PRISM," reportedly began in 2007, we are only now learning about it because an anonymous intelligence officer apparently leaked the information to the press.
"Firsthand experience with these systems, and horror at their capabilities, is what drove a career intelligence officer to provide PowerPoint slides about PRISM and supporting materials," the report notes, "in order to expose what he believes to be a gross intrusion on privacy."
"They quite literally can watch your ideas form as you type," the officer said.

Secretary of State John Kerry last month secretly sent $1.3 billion in U.S. military aid to Muslim Brotherhood-controlled Egypt, waiving the restrictions put in place by Congress to withhold such aid unless the country could meet certain democracy standards.
"Under U.S. law, for the $1.3 billion to flow the secretary of state must certify that the Egyptian government 'is supporting the transition to civilian government, including holding free and fair elections, implementing policies to protect freedom of expression, association and religion, and due process of law'," Reuters reports.

Ariz. Sheriff Joe Arpaio Suspends His Efforts to Combat Illegal Immigration - Here Are the Details

PHOENIX (TheBlaze/AP) - An Arizona sheriff who led the way for local police across the country to take up immigration enforcement is reconsidering his crackdowns - and other law enforcement officials who followed his lead are expected to eventually back away, too.
Joe Arpaio, the sheriff for metropolitan Phoenix, has temporarily suspended all his immigration efforts after a federal judge concluded, as TheBlaze previously reported, two weeks ago that the sheriff's office had racially profiled Latinos in its patrols, Arpaio spokesman Brandon Jones told The Associated Press.
Arpaio critics, including the federal government, are gaining ground in their fight to get the sheriff out of immigration enforcement. Even before the ruling, Washington had stripped Arpaio's office of its special federal immigration arrest powers and started to phase out the program across the country. . .

Google Needs Extra Time to Spy on Your Kids
It seems that Google is constantly falling afoul of conservatives, consumers, pundits, regulators and really everyone else on earth (except for the Obama campaign) for its privacy-infringing tendencies.
It got hammered for "alleged" spying in the Safarigate scandal, where it wound up agreeing to a record-breaking $22.5 million fine in connection with charges it surreptitiously tracked Apple Safari users who Google had said could opt out of tracking, and did what Google said was necessary to opt out. WE'RE GOING TO WASHINGTON, D.C! On Wednesday, June 19, 2013 Tea Party Patriots (and maybe some other grassroots groups), are putting together an "Audit the IRS" Rally in D.C. Right now, the bus situation is up in the air, but TPP is working on it. In the meantime, I suggest that as group leaders/coordinators, you put together car pools and get as many of your members to Washington, D.C. as possible on the 19th. PLEASE DO NOT WAIT FOR TPP to make bus arrangements! If they put something together, we'll know about it and get the word out immediately. Set up carpools and be on the West Lawn of the U.S. Capitol by 12:00PM. If you're carpooling and you live in the Philadelphia area, leave no later than 6:00AM, otherwise you'll spend 2-3 hours trying to get from Delaware to D.C. As far as parking goes, you can park your car at Union Station for $20.00 for the day and walk or take a cab over to the Capitol. Below is a link from the TPP website. Please pass it on to everyone on your groups' email list and get as many of your group members to D.C. as possible.
If you are a member or if you are interested in going with us, our group, the Philadelphia Tea Party Patriots-Lower Bucks will be carpooling. We will be leaving from our house at 6:00AM SHARP! When President Obama unveiled his Race to the Top initiative in 2009, the idea was to award $4.35 billion in federal grant money to states to replicate policies that boosted student achievement. That quickly changed and the federal money was instead used to persuade states to adopt administration-backed nationalized K-12 English and math standards and tests. By last year, most states had adopted the standards, known as Common Core, and it seemed a foregone conclusion that the United States would join countries like France in having a uniform curriculum.
But what a difference a year makes. Today, a full-blown epidemic of buyer's remorse has taken hold. Popular resistance is rampant and bills to pull out of Common Core are making their way through multiple state legislatures.
Had the Obama administration been interested in policies with a proven record of improving students' academic performance, it would have looked to Massachusetts. In the early 1990s, Massachusetts was an above average but unremarkable performer on the National Assessment of Educational Progress (NAEP) and SATs. After enactment of the Bay State's landmark 1993 education reform law, SAT scores rose for 13 consecutive years. In 2005, Massachusetts students became the first state ever to score best in the nation in all four categories on the NAEP's fourth and eighth grade reading and math assessments. The next three times the tests were administered-in 2007, 2009, and 2010-this feat was repeated.

'Common Core' Nationalizes and Dumbs Down Public School Curriculum
by Ron Paul: In addition to shredding civil liberties, launching a utopian global war for democracy, and going on a spending spree that would make LBJ blush, the so-called "conservative" Bush administration dramatically increased federal control over education via the "No Child Left Behind" act. During my time in Congress I heard nothing but complaints about this law from teachers, administrators, and, most importantly, students and parents. Most of the complaints concerned No Child Left Behind's testing requirements, which encouraged educators to "teach to the test." Sadly, but not surprisingly, instead of improving education by repealing No Child Left Behind's testing and other mandates, the Obama administration is increasing national control over schools via the "Common Core" initiative. Common Core is a new curriculum developed by a panel of so-called education experts. The administration is trying to turn Common Core into a national curriculum by offering states increased federal education funding if they impose Common Core's curriculum on their public schools. This is yet another example of the government using money stolen from the people to bribe states into obeying federal dictates. Critics of Common Core say it "dumbs down" education by replacing traditional English literature with "informational texts". So students will read such inspiring materials as studies by the Federal Reserve Bank of San Francisco, the EPA's "Recommended Levels of Insulation," and "Invasive Plant Inventory" by California's Invasive Plant Council. It is doubtful that reading federal reports will teach students the habits of critical thinking and skepticism of government that the Founders considered essential to maintaining a free republic. Like Obamacare, Common Core (now dubbed "ObamaCore" by some) has sparked a backlash in the states, leading some to propose legislation forbidding state participation in the scheme. I hope these efforts lead to states not just opting out of Common Core, but out of No Child Left Behind and all other federal education programs as well. Parents can also effectively "opt out" of programs like Common Core by seeking alternatives to government education. It is no coincidence that, as federal control over education increases, the quality of public education has declined and more parents have chosen to homeschool.
 Push Against Common Core Gains MomentumAs parents, citizens, and legislators learn more about Common Core, some are deciding it is not the best means of improving American education. Parents in many states are mounting grassroots campaigns against Common Core's standardization of learning and federal testing of students. In April, the Republican National Committee issued a resolution rejecting Common Core, saying it is a "plan [that] creates and fits the country with a nationwide straitjacket on academic freedom and achievement." Critics of Common Core say it is an untried experiment that lacks legitimacy and empirical study and is now being foisted upon the entire U.S. school system. It has the potential to waste billions of dollars, multiple years of education efforts, and the learning potential of all schoolchildren. Several state legislatures are considering withdrawing from Common Core (CC), delaying or not funding implementation, or withdrawing from national testing by government-funded consortia. Four states never adopted CC: Alaska, Nebraska, Texas, and Virginia. Minnesota accepted CC English standards, but rejected CC math. Private organizations developed CC; it was neither debated in public nor enacted by state legislators. Certainly many Common Core promoters believe further centralization of education will improve educational outcomes, but power and cash may also be motivating some supporters. There is an immense amount of money flowing to public education because of Common Core implementation, and also to specific companies that are CC public-private partners that develop curriculum, create tests, and train educators to teach Common Core. I wonder what it is going to take to make our legislators step back and really look at what Common Core is presenting to our children and listen to the TRUE facts. They want to raise our scoring levels up so the "states" are first - not giving any thought as to what they are being taught by using something that is going to dumb them down to the Skinner and Pavlov type of indoctrination. The Growing Threat of Smart Meters
Sustainable Development is code for a policy designed to transform human society, essentially eliminating individual life decisions and replacing them with top - down, one-size-fits-all government control. In steady fashion, the agenda for this new policy, designed at the international level, is put into place piece by piece with a new government council here, and new regulation there, each designed to appear as a "local" development program. Like the proverbial frog in the slowly boiling pot, many Americans fail to notice the rise in government heat. The main course of action to impose the new agenda is through the pretense of environmental protection; "Sorry about your rights, but if we don't save the planet, then we will all perish!" And so with the devastation of a thousand pin pricks, America and its form or government is being changed through the creation of non-elected boards, councils and regional governments, designed to enforce the new regulations and "assure that we protect the environment."
The pin pricks come disguised as such issues as controls on community development; controls on use of private property; controls on use of open space; creation of development areas, many times under the excuse of historic preservation; communities designed on the blue print of pack and stack housing; making it harder to drive as roads are narrowed, even forcing cars to share the road with bicycles; the enforcement of expensive mass transit boondoggle projects; and the never ending spending spree on inefficient, unworkable alternative energy, such as wind and solar power.
In fact, control of energy and water are the two most effective tools in the enforcement of the Sustainable Development agenda. Without energy and water, human society stops. Using strict controls on how, or even if, energy and water can be used provides government with the power to dictate every aspect of society.

Harry Reid's Ploy to Plow Through the Farm Bill

The U.S. Senate is expected to vote this morning on a measure that will effectively end debate on the misnamed "farm" bill, cutting off opportunities to fix the deeply flawed legislation. At a cost of a nearly $1 trillion -- 80 percent of which goes to the food-stamp program -- American taxpayers deserve a robust debate. Senate Majority Leader Harry Reid (D-NV) won't let that happen. This isn't the first time Reid has pulled this stunt. His iron-fisted approach to running the Senate is one reason Americans hold Washington in such low regard and have a strong distrust of politicians. Reid's obstructionist move marginalizes the opposition by refusing to allow amendments to be considered. By muzzling reformers, Reid is also demonstrating a blatant disregard for the Senate's deliberative nature -- one that should welcome an open and hearty debate on a 1,150-page bill that would cost taxpayers $955 billion. Reid's sense of urgency isn't too surprising, though, considering members of the Senate Agriculture Committee dispensed of the bill in a mere three hours. >>> SHARE THIS PICTURE: Facebook | Pinterest | Tumblr Reid's need for speed certainly fits well into another problem plaguing Congress -- a lack of transparency and accountability. By steamrolling the process, Reid is hoping to avoid problems rampant in the bill itself. For example, in its current form, the bill allows the food-stamp program to continue along as if its costs had not skyrocketed. The legislation also contains new and expensive farm programs that would attempt to eliminate almost all risk for farmers -- even minor losses would be covered courtesy of taxpayers. Reformers have ideas for fixing this behemoth of a bill. Senators should start by stripping the food-stamp program from the bill, and then move on to reforming farm policy by proposing a real "farm" bill. By making this change, both issues would get the proper attention they deserve. There's no sound policy reason for these two distinct issues, food stamps and farming, to be combined into one massive bill. Of course, farm bill proponents know this all too well. Senator Thad Cochran (R-MS) admitted: "[Food stamps] should continue to be included purely from a political perspective. It helps get the farm bill passed." >>> LEARN MORE: 10 Things You Should Know About the Farm Bill Until Congress addresses the two issues separately, lawmakers should realize that "fully informed discussion, let alone necessary reform, is all but impossible when the food-stamp program is carried under the banner of a farm bill," as Senator Ron Johnson (R-WI) and Heritage Action CEO Michael Needham explained in a National Review op-ed. But none of this can occur if Reid succeeds in slamming the door. And if that door closes this morning, it's just another example of Washington politicians ignoring our staggering $17 trillion debt and choosing special interests over taxpayers' best interests. The 'Gay Pride' Merit Badge
Gender Disorientation Pathology and the BSA

Six months ago, in a letter to an Eagle Scout, my son, I responded to his dismay over a proposal by the Boy Scouts of America National Board to remove the membership restriction regarding sexual orientation. As a long-time BSA Council member, Troop leader and father of another young man about to attain his Eagle rank, I shared my older son's dismay -- to put it mildly.
Two weeks ago, the Left's relentless campaign of cultural degradation and devolution, specifically their crusade to undermine the "third pillar of Liberty," faith and family, succeeded in a decade-long strategy to do to the uniformed ranks of the BSA what Barack Hussein Obama has done to the uniformed ranks of the U.S. military (and the rest of the nation).
As you might recall, one of Obama's earliest campaign promises was to repeal the "Don't Ask, Don't Tell" proscription against open homosexuality in the military ranks. On December 22, 2010, Obama signed that repeal after it had been passed by his outgoing NeoCom House majority. This occurred just weeks before Tea Party Republicans, who decimated the Democrats in the 2010 midterm elections, took over the House.
Earlier this year, consistent with his assault on the moral fiber of our military, Obama quickly gave this verbatim endorsement of homosexuals scouts and leaders in the BSA: "I think that, uh, you know, my attitude is, is that gays and lesbians should have, uh, access, and, and, opportunity, uh, the same way everybody else does, uh, in every institution and walk of life, and, um, you know, the, the Scouts are a great institution, uh, that, are, uh, promoting, uh, young people and exposing them to, uh, you know, opportunities, and, and..." ad nauseam.
As dictated by the laws of gravity, the political effluent from Obama's pathological narcissism, and the most faith-intolerant administration in the history of our Republic, flows downhill. On May 23, it swamped the BSA with its fetid waste.
At the 2013 annual meeting, the BSA's National Board, under the "leadership" of wealthy corporate-types completely out of touch with grassroots Scouting values, promoted and implemented a national policy to invite open homosexuals into Scout troops. In doing so, they intentionally opened the door for a much broader "gay agenda." Many of those elitist BSA board members have already implemented that agenda within their own corporations, so they fully understand and eagerly anticipate the consequences of this BSA policy change.
For two decades, the BSA has been stacking its national board with elitist execs, because they hobnob around in wealthy circles and can collect money for national BSA projects. While most BSA regional Councils like the one I serve are self-supporting, and in fact send a small percentage of locally raised funds to support the BSA corporate office, the national BSA board has obligated itself to major real estate developments that are seriously underfunded -- thus, the pursuit of affluent board members as the solution.

Recently RedState's own Erick Erickson found himself at the center of a controversy over the implications of a new Pew Research study. The report stated that mothers are now the primary source of income in 40% of American households. The trouble for Erickson came when he dared to give his opinion on the findings, saying, "Having mom as primary bread winner is bad for kids and bad for marriage." He also attempted to explain the traditional dynamic of the nuclear family in terms liberals could understand: what typically happens in the biological world. Unfortunately, he used the term "dominant," which works as a head explosion device for many women - who immediately thought, "No one is going to dominate me!" At that point, the facts went out the window and pitchforks came out on both sides of the aisle. The question isn't, however, was he right. Erickson was correct and the facts back him up, whether anyone likes it or not. The question is why were women so immediately incensed at him saying something that has most certainly been said before; especially women on the right. 3. The Latest on the Farm Bill
Yesterday, the Senate invoked cloture on the 5-year farm bill, S. 954. The 1150-page Senate bill costs $955 billion over 10 years and creates a new shallow loss program covering up to 90% of a farmer's income - on the taxpayer dime. Roughly 80% of the cost is related to food stamps. For good measure, this bill contains sugar subsidies, biofuels subsidies, and conservation programs. This mega-bill was rushed through the committee process and has only been subject to four amendments on the floor. I guess Reid is agog with enthusiasm to get to the amnesty bill.
The House bill is, more or less, the same thing; it just cuts an extra few billion of the baseline spending for food stamps, while adding more spending to socialist price support programs for Big Ag special interests. As an added bonus, it contains a Soviet-style milk productions regulatory regime and new taxes on rocks! . . . please click here for the rest of the post →
4. Bill Shuster Wants to Bring Back Earmarks
The problem of earmarking goes far beyond the actual pork projects set aside for a specific politician. The problem is not about the relatively low cost of a single earmark. It's about the $500,000 earmark that is used to buy off a conservative vote for a $1 trillion omnibus, farm bill, bailout, or some other terrible transformational legislation. The earmarks are used as the magic "grease" to garner majority support for big-government legislation. Once we reinstate the practice of earmarking, we will never be able to mobilize a majority within the conference to oppose any big-government legislation. Most of them will be seduced into supporting bad legislation through personal earmarks for their districts. This is the "multiplying factor" of earmarks. Throw in a personal perk for each district, and you can get a majority of the House to vote for anything.

As the Association backed this bill, it is an important victory for us. At the same time, it is a setback for ObamaCare. Look for the law to be challenged in court. It could easily develop into a test case of the Tenth Amendment.

Last night, a dozen members of the Association joined Rich Zeoli, the WPHT Team, and numerous Zeoli fans (packed house) at the Irish Pub during a live broadcast of The Rich Zeoli show (normally aired 6-10 PM, Mondays-Fridays on 1210 AM).
It was a lot of fun and Rich was kind enough to include us in his lineup.
This morning, we attended the Republican Jewish Coalition breakfast for a Meet and Greet with a very impressive Philadelphia District Attorney candidate named Daniel Alvarez.
No doubt about it, Attorney Alvarez is a smart and thoughtful conservative newcomer to the Philly political scene. Stay tuned. We think you'll be hearing a lot about him.

Fitzpatrick: TSA Made the Right Call to Halt Knives on Planes
WASHINGTON, D.C. - Congressman Mike Fitzpatrick (PA-8) issued the following statement
Wednesday regarding the announcement of the Transportation Safety Administration's
decision not to ease restrictions on carrying knives on airplanes:
"Securing safe travel aboard airplanes for passengers is a fundamental objective of the
Transportation Safety Administration (TSA)- I'm pleased to see that their decision today
honors that commitment.
The easing of rules to allow objects like knives onboard flights would have been a reckless,
potentially dangerous, decision by the TSA- a concern I addressed to TSA Administrator
Pistole in May.
I've worked on airline safety legislation with Ellen Saracini - widow of terror victim, and pilot,
Victor Saracini - who knows the importance of airline security first-hand. In the process I was
able to hear from pilots, passenger safety advocates, and law enforcement officials who knew
it was wrong to allow knives back on planes. I am glad the TSA listened to their concerns.
Travelers and airline employees deserve to feel safe while flying- the agency's decision today
ensures another level of safety and allows TSA agents to focus on enforcing important security
protocols already in place."

Newspapers on both sides of the Atlantic broke a story by the left-wing British paper the Guardian that the Obama Administration is not only seizing the phone records of journalists, but of millions of other Americans too. The Guardian reports that Obama's National Security Agency obtained a secret court order demanding Verizon turn over all of its phone records on an "ongoing, daily basis." Phone calls were not being listened to, but the information collected would allow the government to know "the identity of every person with whom an individual communicates electronically, how long they spoke, and their location at the time of the communication." One left-wing civil rights group called the order, "the broadest surveillance order to ever have been issued: it requires no level of suspicion and applies to all Verizon subscribers anywhere in the U.S." As the story developed throughout the day, leading senators on the Intelligence Committee said the program has been in place for seven years and that Congress has been routinely briefed. Other senators disputed that. Sen. Lindsey Graham defended the program. However, some senators have said that Americans would be "stunned" if they knew the full extent of the surveillance of U.S. citizens. In war, it is often necessary to do things that you would not do in peacetime. But such things are done ultimately to preserve all of our liberties. If Ronald Reagan or George W. Bush were in office, I and other Americans might be more comfortable with this program, knowing we could trust them not to abuse the information. But with this regime -- given all we know about its attempts to intimidate the news media and to use the IRS to silence its critics -- I have no tolerance for this sort of massive data seizure. Think about this: Obama's politically correct military missed all the signals about the radicalization of Fort Hood shooterNidal Hasan. Even after he murdered 14 people, top officers fretted about "diversity." We were told that the government missed the Tsarnaev brothers because the anti-terror database was "too big" and "vague." Yet, the same government is seizing all our phone records, and the IRS is zeroing in on a mother in Alabama for merely wanting to promote the values of our country's founding. Something is very wrong. Add this latest development to the growing list of items requiring congressional review and oversight. Speaking Of The IRS... Here are some quick updates on the various scandals involving the IRS.
- Two IRS employees in the Cincinnati office have reportedly identified Carter Hull, an IRS attorney at the agency's Washington headquarters, as the individual who directed their efforts to target Tea Party groups.
One Cincinnati agent, Elizabeth Hofacre, said she was "furious" when Washington officials tried to pin the blame on her office, adding, "I was essentially a front person, because I had no autonomy or no authority to act on [applications] without Carter Hull's influence or input." It is not clear whether Hull is the person who first ordered the IRS harassment of conservative and Christian groups. But it is abundantly clear that the Cincinnati office got its orders from Washington. Now let's wait to hear what Mr. Hull has to say to House investigators. - The Daily Caller reports that Sarah Hall Ingram, who now directs the IRS office responsible for the implementation of Obamacare, visited the White House 165 times. None of her 165 meetings coincided with former IRS Commissioner Douglas Shulman's 157 meetings.
So these two IRS officials visited the White House more than 300 times. Top cabinet secretaries did not have that kind of access to the president! That suggests how much influence the IRS has in the Obama Administration and will have in your life if Obamacare remains the law of the land. - Two IRS officials, one of whom is Ms. Ingram's deputy in the Obamacare enforcement office, were suspended yesterday for accepting free gifts in connection with the lavish conferences that have caused so much outrage in recent days.
Meanwhile, Senator Tom Coburn (R-OK) is demanding to know why the IRS lied to him. Coburn, a fierce critic of government spending, was told last year that the IRS spent $500,000 on just five conferences, when in fact the real figures are $50 million on more than 200 events.
D-Day Remembered Usually much of this report is about bad things that happen in Washington. Sadly, I want to predict that today will be marked in part by what will not happen. Today is the 69th anniversary of D-Day, the Allied invasion of France and the beginning of the end of World War II. The World War II generation is inevitably falling to the ravages of time. As they pass away, our collective national memory of what they did, what this country did, what free men and women all around the world did, to defeat Hitler, Mussolini and Hirohito is passing away with them. Sometimes people will write to me and ask how they can make a difference. Here's something you can do: Ask your child or grandchild today, "Do you know what D-Day is?" If you discover that they do not know, use the opportunity to talk to them about World War II and the courage it took to preserve our freedom. Even if our schools are failing at it, you can still produce young patriots in your home. Good Job, Roy! Kudos to Roy Costner, IV. The valedictorian of Liberty High School in Liberty, South Carolina, literally tore up his speech and began to recite the Lord's prayer. He did it in response to efforts by the ACLU and the Freedom From Religion Foundation to drive faith from the public square. His faith was important to him and he wasn't going to let anybody tell him to shut up. I often get messages from good people who are depressed about the state of culture, and I get it. Sometimes they suggest crazy ideas like secession. My friends, we don't need to break up the country. What we need is for more people to stand up and demonstrate the same level of commitment and courage as Roy Costner! Think about Martin Luther King, Jr. The civil rights movement did not take off until enough black men and women, led by their pastors, stood up and said, "Enough! I am going to sit here! I am going to express myself! I am going to exercise my rights!" While a few of our pro-life and Catholic friends have raised the issue, on the whole the conservative, pro-family movement has not yet seriously considered the concept of civil disobedience. Now just imagine priests, pastors and rabbis -- and whole congregations -- waking up every morning with the courage of Roy Costner -- and acting on it!

June 6, 2013 Senator exposes flaws in immigration bill Please sign our Open Letter to the congressional leadership! On June 5th, Senator John Cornyn of Texas announced he would introduce a significant amendment to the proposed immigration reform legislation. In a media release (highlights added), Senator Cornyn described the same flaws we pointed out in an email earlier this week, and what his proposed amendment will do:

For starters, its border-security triggers are talking points disguised as policy: Legalization of the estimated 11 million illegal immigrants in the United States would be activated by meaningless promises rather than concrete results. Haven't we heard enough of that from Washington? Meanwhile, the bill would actually make it harder for us to prevent visa overstays, even though such overstays account for nearly half of all illegal immigrants living in the United States. It would also allow violent criminals to gain immediate legal status; it would prevent law enforcement from sharing information; and it would do absolutely nothing to bolster infrastructure and personnel at U.S. ports of entry along the southern border. Unless these flaws are corrected, I will not be able to support the legislation. Therefore, I will introduce my RESULTS amendment that addresses the full range of concerns listed above. RESULTS stands for Requiring Enforcement Security (and safety while) Upgrading Lawful Trade (and travel) Simultaneously. More specifically, the RESULTS amendment would require the Department of Homeland Security to achieve (1) full situational awareness of the entire U.S.-Mexico border and (2) complete operational control of every single border sector. It would define "operational control" as apprehension of at least 90 percent of all illegal border crossers.

A Note from the NSA: Call Your Mother, Our Records Indicate It's Been a While
If you've ever wanted to feel like an Associated Press reporter, good news!
The National Security Agency has been collecting the telephone records of millions of U.S. customers of Verizon under a top secret court order, according to a report in Britain's Guardian newspaper.
The order was granted by the secret Foreign Intelligence Surveillance Court on April 25 and is good until July 19, the newspaper reported Wednesday. The order requires Verizon, one of the nation's largest telecommunications companies, on an "ongoing, daily basis" to give the NSA information on all telephone calls in its systems, both within the U.S. and between the U.S. and other countries.
The newspaper said the document, a copy of which it had obtained, shows for the first time that under the Obama administration the communication records of millions of U.S. citizens were being collected indiscriminately and in bulk, regardless of whether they were suspected of any wrongdoing.
The Associated Press could not authenticate the order because documents from the court are classified.
Verizon spokesman Ed McFadden said Wednesday the company had no comment. The White House declined comment and referred questions to the NSA. The NSA had no immediate comment.

IRS: Okay, We'll Stop Taking Free Food When Asking about the Content of Your Prayers
Turn the Internal Revenue Service into a partisan cudgel, and nobody blinks. But man, if you take free food, you're toast. And you can't even accept that toast, apparently.
Acting IRS Commissioner Daniel Werfel is placing two officials -- including a top staffer implementing the health care law -- on administrative leave for violating government ethics rules at a 2010 conference.
"When I came to IRS, part of my job was to hold people accountable," Werfel said in a statement Wednesday. "There was clearly inappropriate behavior in this situation and immediate action is needed."
Werfel didn't specify which staff members he disciplined but congressional sources tell POLITICO one official is Fred Schindler, the director of implementation oversight at the IRS Affordable Care Act office. The other is Donald Toda, a California-based employee.
The staffers received $1,100 in free food and other items at the conference, the sources said.
$1,100 in free food? Just how much did these two guys eat? What, did they order the surf and turf and say, "man, this is so good, let's get a dozen more for the road?"
Well, at least these two guys are . . . wait a minute. "Suspended employees are often paid during suspension while supervisors decide how to proceed."
You're going to take this paid vacation indefinitely, buster!

Recent press reports focused on the 157 visits to the White House by former IRS Commissioner Douglas H. Shulman, but there has been little scrutiny of the 165 White House visits by the IRS 'Obamacare' official Sarah Hall Ingram.
According to White House visitor data, Shulman never attended any of Ingram's meetings, and Ingram never attended a White House meeting with Shulman.
All of Ingram's 165 meetings were with White House staff, while only 151 of Shulman's visits were with staff. Shulman attended six meetings with President Barack Obama.
Ingram attended 62 White House meetings in 2011, 90 in 2012 and 13 this year (though February).
But wait, there's more on the IRS front today!
Two Internal Revenue Service employees in the agency's Cincinnati office told congressional investigators that IRS officials in Washington helped direct the probe of tea-party groups that began in 2010.
Transcripts of the interviews, viewed Wednesday by The Wall Street Journal, appear to contradict earlier statements by top IRS officials, who have blamed lower-level workers in Cincinnati.
Elizabeth Hofacre said her office in Cincinnati sought help from IRS officials in the Washington unit that oversees tax-exempt organizations after she started getting the tea-party cases in April 2010. Ms. Hofacre said Carter Hull, an IRS lawyer in Washington, closely oversaw her work and suggested some of the questions asked applicants.
I Tuned In to The Fosters and Was Disappointed Dan Wasn't In It
The editors of the Washington Times are pretty up in arms about the latest offering from the Family Channel:
The ABC Family cable channel's slogan is "A different kind of family." The programs it offers are different, sure enough, different from a family almost any other American family would recognize, and certainly different from the channel's programming when it was founded in an earlier century by the Rev. Pat Robertson. Now owned by Disney, the network's newest series, "The Fosters," takes the concept of "different" to an entirely new level.
The prime-time Monday show is about an interracial, married lesbian couple and their brood of adopted, biological and foster children. The program joins an ABC Family lineup that includes "Pretty Little Liars," another drama featuring lesbian characters, which premieres its fourth season next week. "The Secret Life of the American Teenager," which ended a five-year run on Monday, had an abstinent homosexual male character, along with lots of straight teens sleeping around and creating out-of-wedlock pregnancies. The channel's "Make It or Break It," which ended a three-season run in May 2012, showcased a male character who "came out" as bisexual.
The network seeks to reshape society by portraying characters that tick every politically correct box. In "The Fosters," the black and white lesbians' family comprises two adopted Hispanic twins, the biological son of the white half of the "two moms" by her Hispanic ex-husband, and a white juvenile-delinquent teen girl they take in as a foster child. In the premiere episode, we learn that the Hispanic twins -- a boy and a girl who don't really look much alike -- have a biological mother who abandoned them to engage in promiscuity.
Advertisers obviously like such "family" programming. More than 30 commercials aired during the program, shilling for big-name brands such as Gatorade, Kellogg's, Toyota, Tyson's chicken and Wendy's.
If you've been getting to the movies early lately, you may have seen an extended preview of the series.
Clearly, this show aims to sell a particular message, that "Lesbian mothers are caring parents, too!" Whatever your perspective of lesbian mothers, I'm not likely to persuade you of the opposite view. Let me offer two separate observations . . .
If the parents of this show were not lesbians, would the series be made? The review in Entertainment Weekly quickly noted how central that aspect was to the concept of the show:
An easy criticism of this new show would be that it tries to fit in too many ''controversial'' topics into one show -- The Fosters takes on homophobia, child abuse, drug addiction, and abandonment right away. But let's just remember: Seeing a lesbian, biracial couple on a family TV show is a big deal. It shouldn't be a big deal at this point -- shows should offer diverse casts -- but if you look at the demographics of most TV shows, it's easy to realize how important, and deliberate, this choice was.
The series appears intent upon portraying these lesbian foster parents as heroic figures, and there's a part of me that is cheered that Hollywood even remembered that foster parents exist, much less decided to portray foster parents as good people. A 2005 study found:
To find out how foster parents are portrayed in the popular media, [the National Center for Youth Law] surveyed newspapers, magazines, mainstream Hollywood movies, television, and popular novels. A comprehensive, systematic study of newspaper and magazine coverage found it to be generally evenhanded, and containing a high percentage of positive portrayals. However, front-page stories about problems plaguing the foster care system and foster parents' abuse of children in their care were common. Television, with its penchant for crime dramas like "Law and Order" and "CSI," generally portrays foster parents as malevolent. Hollywood movies and popular literature, too, consistently pit an abusive or uncaring foster parent against child protagonists.
So, while there is a considerable amount of positive coverage overall in the media, the positive portrayals are heavily outweighed by negative ones, particularly in movies, television, and popular fiction.
But here's where political correctness is really likely to rear its ugly head: The creators of this show have really stacked the deck in making their protagonists the kind of characters that the audience has no choice but to like. One mom is a "dedicated police officer"! Another is an "altruistic school principal" who just can't accept that the system could let these kids fall through the cracks, and who often declares in her dialogue that she just can't let these kids fall through the cracks! They're foster parents and adoptive parents!
This family is astonishingly happy anywhere -- even a Pottery Barn armchair randomly placed on an unusually unoccupied beach.
Do these characters have any flaws? Well, Altruistic School Principal tends to unilaterally decide to bring foster children to live with them without checking with Dedicated Police Officer, which in many marriages would be a sign of serious problems with communication, trust, and mutual decision-making. "Hi, honey, I decided we would become foster parents to a teenager who I found in a juvenile detention center. Hope you're okay with that." But because this is television land, Dedicated Police Officer purses her lips a bit, but then says it's okay after a hug.
Maybe this show will prove me wrong. But I suspect its social mission will require Altruistic School Principal and Dedicated Police Officer to be one-note characters, endlessly wise and caring and patient and understanding. After watching the pilot, where the parents come across so saintly, one can't help but suspect that the writers will be terrified about portraying them with any flaws, either because they'll be afraid they're portraying gay parents negatively, or because they fear their audience will be even momentarily repelled by characters that the entire show's purpose is to get you to love and accept.
In other words, if Hollywood is afraid to portray a gay character as human, with strengths and failings, moments of character and moments of weakness, and so on . . . are they really being all that groundbreaking or brave or honest in their creation?
ADDENDUM: The latest poll from NBC/Wall Street Journal: "The poll shows 49 percent of Americans say they believe the Affordable Care Act is a bad idea. That's the highest number recorded on this question since the poll began measuring it in 2009. Just 37 percent say the plan is a good idea."

There was no shortage of awkward moments when Democratic Rep. Jim McDermott and TV host Megyn Kelly clashed during an on-air debate surrounding the contentious Internal Revenue Service hearing. Many people are outraged after seeing the video a mother posted showing her daughter's accident. The clip (which is disturbing to some) shows a teen girl who broke both of her feet after jumping off a roof and landing on concrete instead of the intended swimming pool. Three weeks ago, Breitbart News published an article listing 10 questions the Obama Administration must answer about the Internal Revenue Service's (IRS) targeting of conservative groups for scrutiny and harassment throughout the 2010 and 2012 election cycles.
Yet after weeks of House and Senate hearings, and much grandstanding by Obama Administration officials, not a single question posed has been answered.

Last week Senator Robert Menendez (Democrat Santa Domingo) said the Gang of Ocho's plan to erase our borders did not have the votes to pass in the Senate. While that technically could mean 59 votes, but if that was the case we would know about it. It's more likely that there are at best 56 votes lined up, but that might be a generous interpretation of where it stands just a month from the Senate's July 4th recess.
Getting this bill passed is a top priority for the Democrats as it will lead to millions of new robotic voters who don't care about Democrats shredding the Constitution and in fact will be only too happy to help them sacking what remains of America's White majority's wealth.

Turn on the television and wait five minutes and it begins playing. "It's in our blood, our DNA," the painfully high voice sings, "Because we're stronger than the storm." The ad closes with New Jersey Governor Chris Christie and his family playing on the beach.  The 25 million dollar ad campaign feels like it has been in rotation forever. The earnest warbling of the song can be heard everywhere. It probably isn't doing much to move tourists to the Jersey Shore, but that isn't what it's there for. It's there to remind everyone that Christie is the guy who flew over the state in a helicopter after Hurricane Sandy. We're not stronger than the storm, is the message. Christie is. The 25 million dollar ad campaign like the 24 million dollar special election is about the Governor of New Jersey. Some Democrats have criticized both moves as cynical elections ploys and that's true and it isn't. The election, against a placeholder candidate, is no threat to Governor Christie who is running 60 to 28. No matter how many minority voters Cory Booker brings to the polls (and it's no sure bet that he will bring any, Booker for the moment is far more popular among white liberals than among the inner city voters he is deserting in Newark) there is no conceivable way that Christie could lose this election. But it's not just about winning another four years. It's about 2016.

A Case Study in Denial and Fanaticism

In its desperation the climate campaign resorted to calling climate skeptics "denialists" for quite a while now, with some going so far as to make an explicit comparison with holocaust deniers, just in case anyone didn't get the point. Well, who are the "denialists" now? Our friends at CFACT (Committee for a Constructive Tomorrow) are on hand this week at the latest round of UN climate talks in Bonn. What?-you didn't know there was another round of climate talks under way? Where they argue for hours about whether to place a semi-colon in a particular spot in their latest draft declaration (true story)? Just mark it as another sign of the media's waning interest in the issue.
Anyway, CFACT took its video cameras around to ask delegates whether they were aware of the fact that global temperatures have stopped rising for the last 15 years or so. Hilarity (and some revealing comments about how the facts don't really matter to these folks) ensues. Who are the "denialists" now? I'd give these guys a Green Weenie, except they've already won so many that I don't want them to start hoarding.

The Obamacare blame game - a contest the Democrats can't win

Although the Obama administration scandals that have emerged since Election Day are hurting the Democrats a bit, Obamacare remains the real threat to the Dems in 2014. As Tevi Troy points out in Commentary, by most every measure, things are going badly on the Obamacare front:
Health-insurance premiums are becoming more expensive, which is particularly striking when you consider that the act's advocates promised it would decrease costs by $2,500 per person. A majority of states have chosen not to create state-based exchanges-the highly regulated ObamaCare insurance-policy marketplaces. Thus, the federal government must now scramble to figure out how to develop as many as 33 state-based exchanges. The new requirement that employers provide their full-time employees with health insurance is already skewing hiring patterns and delaying efforts to get the wounded American labor force back to work. As the Los Angeles Times reported, "rather than provide health care to more workers, a growing number of employers are cutting back employee hours instead." A startling new study of Medicaid, on which ObamaCare relies to cover about half of the soon-to-be insured people in the country, found that Medicaid does not produce improved health outcomes for its recipients. The cost of the bill, initially estimated to be around $898 billion, has doubled, to about $1.85 trillion. A minority report from the Senate Budget Committee has the figure at $2.7 trillion. All kinds of regulatory deadlines in the bill have been missed, and confusion reigns among plans, patients, and administrators alike. That's why Montana Senator Max Baucus, an original sponsor of the bill and the Democratic chairman of the Senate Finance Committee, has stated that the implementation of the bill is shaping up to be a "huge train wreck."
The question is: on whom will the train wreck be blamed? The logical answer is: on the Party that voted Obamacare into existence, not the Party that said it would never work.
The Democrats hope to evade this logic, and its electoral consequences, by attributing the emerging (but always latent) Obamacare difficulties to Republican obstructionism. Troy collects specimens of the blame-shifting, including this rather garbled statement by President Obama:
When you're doing it nationwide, relatively fast, and you've got half of Congress who is determined to try to block implementation and not adequately funding implementation, and then you've got a number of members of, or governors-Republican governors-who know that it's bad politics for them to try to implement this effectively, and some even who have decided to implement it and then their Republican-controlled state legislatures say, don't implement, and won't pass enabling legislation-when you have that kind of situation, that makes it harder.
Fortunately, this blame-shifting looks like a political non-starter. Why? Because Republicans very publicly predicted the adverse consequences of Obamacare from the beginning and, accordingly, were unanimous in their opposition. As Troy states:
In March 2010, Democrats rammed ObamaCare through the House without a single Republican vote. Republicans objected to the bill on numerous grounds, and predicted that premiums would go up, costs would not go down, and employers would lay off employees in droves. In the 2010 election, the American people sent a very clear signal that they objected to ObamaCare: Their votes flipped 63 House seats and the majority in the lower chamber to Republicans, as well as six additional Senate seats. Between 2011 and 2013, during the 112th Congress, Republicans voted to overturn the Affordable Care Act 36 times. The GOP standard-bearer in 2012 advocated the repeal of ObamaCare, and the other candidates seeking the nomination campaigned on it as well.
Meanwhile:
Democrats have continued to press forward, passing the 2,700-page law without Republican support or input, writing more than 20,000 pages of regulations to implement it, and they have spent colossal sums of taxpayer dollars to put in motion (and publicize) this legislation. Now, as GOP analyses of the plan's unworkability is starting to come true, and the implementation is proving to be just as challenging as Republicans predicted, President Obama, Senator Reid, and Secretary Sebelius have the audacity to say that the failings of their strong-arm approach are the responsibility of those who said it would never work.
In sum, events are proving that the Republicans were right and the Democrats wrong on the key factual questions surrounding the most publicized, and arguably the most important, issue of the Obama years. Voters can't help but notice. The Democrats probably will pay a price at the polls next year, and the price might be steep.

Now, he can't help his name, of course, but why haven't we gotten the obvious parody video from someone, entitled Faris Fink's Day Off? Oh, that's right-this wasn't a day off at all, but another day at the "office" for our self-entitled bureaucrats. Fink has "apologized," but defended the indefensible in his "apology" by saying "I think it is important to point out that in carrying out this 2010 meeting, we followed IRS and government procedures that were in place at the time."
That's exactly the problem. As Michael Kinsley famously remarked many years ago in one of his rare lucid moments, what's amazing in Washington isn't what's illegal, but what's legal. That such an egregious event as the IRS conference where this video was produced and displayed was within the existing government guidelines tells us all we need to know about what's wrong with our bloated, entitled government today.
3. Don't suppose this kind of bureaucratic presumption is limited to the IRS. The EPA, it turns out, has been building secret "man caves." Probably as a place to stash "Richard Windsor." Heh.

Samantha Power and neoconservatism

The label "neoconservative" has been misused and abused so frequently that it has lost most of its substantive meaning. Without getting deep into the details, consider that the most famous neoconservative article ever published, Jeanne Kirkpatrick's "Dictatorship and Double Standards," argued against democracy promotion as a guiding principle of American foreign policy:
Although most governments in the world are, as they always have been, autocracies of one kind or another, no idea holds greater sway in the mind of educated Americans than the belief that it is possible to democratize governments, anytime, anywhere, under any circumstances. This notion is belied by an enormous body of evidence based on the experience of dozens of countries which have attempted with more or less (usually less) success to move from autocratic to democratic government. Many of the wisest political scientists of this and previous centuries agree that democratic institutions are especially difficult to establish and maintain-because they make heavy demands on all portions of a population and because they depend on complex social, cultural, and economic conditions.
But these days, neoconservatism is most commonly viewed as entailing an over-arching commitment to the promotion of democracy.
Even more confusion arises when neoconservatism is viewed as entailing anything like a Jimmy Carter style commitment to promoting human rights. Neoconservatism picked up steam (and adherents, including me) due in good measure to its disgust with the way Carter executed his human rights policy.
Kirkpatrick's famous article began by condemning the Carter administration for its role in the demise of regimes in Iran and Nicaragua, both of which committed significant human rights abuses but were pro-American. Kirkpatrick also wondered: "How can an administration committed to nonintervention in Cambodia and Vietnam announce that it 'will not be deterred' from righting wrongs in South Africa?"
Yet, we are now told that Samantha Power, the nominee for ambassador to the United Nations, enjoys neoconservative support because of her advocacy of using the U.S. military in response to major human rights abuses and genocide. The "neocons" cited are John McCain, Max Boot, Joe Lieberman, and Alan Dershowitz.
As Keith Urbahn, who served as chief of staff to former Defense Secretary Rumsfield, says Jeanne Kirkpatrick is "turning in her grave right now."
Max Boot's praise of Power is probably causing Kirkpatrick to turn the most. Boot expressed hope that Power will "call countries out on misconduct."
That hope is not unreasonable; Power has a record of calling countries out on human rights matters. Unfortunately, Israel is probably the country she has most persistently called out.
Jeanne Kirkpatrick believed in calling out our enemies, not our allies.
When it comes to Israel, Alan Dershowitz vouches, Chuck Schumer style, for Power - as Max Boot has done in the past. Dershowitz assures us that "I've known Samantha for many many years and have been to many gatherings where Israel has been discussed off the record and have never heard her express any views that could be characterized as anti-Israel."
Dershowitz expresses a Phenomenalism that would make Bishop Berkeley proud. No doubt, the Harvard professor is an important guy. But there is a world that exists outside of Dershowitz's earshot. To defend Power requires an analysis of her written work and her interviews, not just her statements made in the presence of Dershowitz and Boot. After all, Hillary Clinton probably never heard Power call her "a monster."
Dershowitz brushes aside one set of Power's statements about Israel - her 2002 comments in which she suggested "external intervention" may be necessary to broker peace between Israelis and Palestinians, which may mean "alienating a domestic constituency of tremendous political and financial import" (i.e. Jewish Americans). According to Dershowitz, Power told him she regrets making the statement.
I'm sure she does. But the statement nonetheless betrays animus towards Israel, as do others Power has since made - statements Dershowitz doesn't address.
Let's give the last word on Power and neoconservatism to Urbahn. He remarks: "[I]t might be helpful to have someone [representing] America at the UN who doesn't think we are the source of the world's ills." That Power doesn't fit this description is evident, says Urbahn, from a 2003 article in which Power called for a "historical reckoning" with America's foreign policy evils.
When Jeanne Kirkpatrick said "they always blame America first," she wasn't referring to neoconservatives. She was referring to people like Samantha Power.

Now They're Messing with Miss World [Updated With Comment By John]

I knew John would be first in line to cover the congressional campaign of Erika Harold, but there's another beauty pageant story breaking today that Power Line will need to un-cover fully: the Miss World pageant, to be held this year in Indonesia, has decided to ban bikinis to-wait for it-avoid Muslim threats:
BIKINIS have been banned from this year's Miss World contest - to ward off Islamic hardliners in Indonesia who threatened Lady Gaga. The pageant is taking place in the Far East country for the first time and organisers are wary of upsetting Muslim fanatics. In a bid to calm any tensions, the 137 women will ditch the traditional swimsuit round and instead wear more conservative outfits like sarongs. The move comes after pop icon Lady Gaga was last year forced to scrap a gig in the world's most populous Muslim country.
Here's a suggestion for Lady Gaga: if she wants to get even, next time she decides to wear a dress made of meat, as she did at the 2010 MTV Awards, make it out of pork instead of beef.
Meanwhile, our pal Remi Munasifi ("Go Remy") is out with a new video today entitled "Just Dance (Saudi Version)." I especially like this lyric: "You hokey-pokey and you put your left hand in, you might not take your left hand out. . ." Enjoy!
JOHN adds: The Miss World organizers come by their skittishness honestly: in 2002, more than 100 people were killed in Muslim riots over the pageant's presence in Nigeria. But still: if pageant officials don't think you can wear swimsuits in an Islamic country, then they should stop holding the pageants in such countries. In this particular case, the organizers seem over-cautious; women wear bikinis in Bali all the time. Which serves to emphasize the point: if Miss World thinks being in a Muslim country equals a per se ban on swimsuits, the contest should go somewhere else.

New Jersey Gov. Chris Christie (R) appointed state Attorney General Jeff Chiesa (R) to fill deceased Sen. Frank Lautenberg's (D) seat until the upcoming October special election.
Christie said on Thursday, three days following Lautenberg's passing, that he believes Chiesa is "the best person for the job."

Obama sponsored bill that would have made Verizon order illegal By Brendan Sasso
President Obama co-sponsored legislation when he was a member of the Senate that would have banned the mass collection of phone records that his administration is now engaged in.
The SAFE Act, introduced by former Sen. Larry Craig (R-Idaho), would have amended the Patriot Act to require that the government have "specific and articulable facts" to show that a person is an "agent of a foreign power" before seizing their phone records.
The bill was referred to the Judiciary Committee in 2005, but never received a vote. It had 15 co-sponsors in all, including then-Sens. John Kerry (D-Mass.) and Chuck Hagel (R-Neb.), who are now members of Obama's Cabinet.
Experts said the bill that Obama supported in the Senate would have prohibited the sweeping surveillance that has come to light at the National Security Agency.

A bipartisan House immigration group has lost one of its eight members, as conservative Rep. Raul Labrador (R-Idaho) informed colleagues Wednesday that he could not sign on to legislation the group hopes to release in the coming weeks.

 | Internet Sales Tax Will Kill My Small Business |
Catesby Jones owns a small business in Virginia called Peace Frogs. Along with his three dozen employees, he makes T-shirts, baseball caps and other "cool" stuff, which he sells online.
He credits his success to the internet. "By reaching out to a worldwide base of customers, companies in rural parts like ours can thrive and have a much bigger presence than they otherwise would through traditional sales."
Jones is incredibly concerned with the threat of the Internet Sales Tax. Big businesses with the money to lobby Congress are pushing for the measure, which they can afford to pay. But it would hurt small internet-based businesses like Peace Frogs.

The farm bill continues to rock the boat on Capitol Hill. The House version of the farm bill actually includes a tax on rocks. Yes, rocks.
The tax revenue would be directed to a new organization, the Natural Stone Research and Promotion Board, which would be overseen by the USDA. Just as under the Christmas tree tax, affected businesses would be forced to support this marketing association whether they want their marketing services or not. This would allow the existing trade association to focus on other tasks - such as lobbying Congress for more favors.

Even if a rock tax could somehow be justified, there's just no rationale for it to reside in the farm bill or come under USDA jurisdiction. There are rock gardens, to be sure, but there are no farmers anywhere who grow rocks.

The farm bill is a misnomer because the majority of the spending for the bill - 80 percent! - goes to food stamps. Tacking on ridiculous taxes for rocks and Christmas trees just adds to the absurdity of the bill. If the farm bill passes, there will be no rocking around the Christmas tree this year.

On Marriage, Inevitability Is a Choice We Can Reject by Ryan T. Anderson, William E. Simon Fellow
Today, a new Pew opinion poll shows that a majority of Americans believe the redefinition of marriage is "inevitable."
We've heard "inevitable" language before, particularly from statists of all stripes. History is filled with supposedly "inevitable" causes that turned out not to be so. Nothing in life is inevitable except death and taxes-and at The Heritage Foundation we're doing what we can about taxes.
So, too, on marriage. Consider some facts about the polls that matter most: elections. Citizens have gone to the polls to vote about marriage in 33 states. The truth about marriage has prevailed 30 of those 33 times. In only three states have citizens voted to redefine marriage-all in the 2012 election-and in each state the truth about marriage far outperformed the Republican candidate. For example, in liberal Maryland, Mitt Romney received 36 percent of the vote, while marriage received 48 percent. All this in a campaign in which proponents of redefinition had a 4:1 financial advantage. Just last week, citizens in deep-blue Illinois prevented their legislature from voting to redefine marriage-and they did this despite a Democratic supermajority in the statehouse-and despite President Barack Obama, Governor Pat Quinn (D), and Chicago Mayor Rahm Emanuel (D) all urging passage of the bill.
And just last year at this time, marriage won in a landslide-61 percent to 39 percent-in a referendum in the swing state of North Carolina, a state Obama had carried in 2008 and lost narrowly in 2012.
Still, no one can deny that Americans' support for marriage is not what it once was. This is largely because we have done an insufficient job of explaining what marriage is, why marriage matters, and what the consequences will be if we redefine marriage.

Marriage is founded on the anthropological truth that men and women are different and complementary, the biological fact that the union of a man and woman also creates new life, and the social reality that children need a mom and a dad.
For decades, social science has shown that children tend to do best when reared by their married mother and father. Government recognizes marriage because it is an institution that benefits society in a way that no other relationship does.
All the polls in the world cannot undo the truth about marriage. But they can obscure the truth and make it less likely that men and women commit to each other permanently and exclusively. This in turn reduces the odds that children will know the love and care of their married mothers and fathers.
If those on the left really believed that the redefinition of marriage was "inevitable," they wouldn't be asking the Supreme Court to do their bidding-they would respect the democratic process. Laws that reflect the truth about marriage are constitutional. And the Court should respect the constitutional authority of citizens and their elected officials to make marriage policy-not issue an activist ruling redefining marriage by judicial fiat.
A careful look at the polls reveals complex and dynamic trends. But how those polls change will depend on human choice, not blind historical forces. The question is not what will happen but what we should do.
After all, there's no such thing as being on the "right" or "wrong" side of history. There's only being on the right or wrong side of truth.

Deflating Hospitals' Arguments for Obamacare Medicaid Expansion
The Obamacare Medicaid expansion debate continues in the states, and many hospitals are lobbying their state lawmakers to accept the expansion. The hospitals argue that because Obamacare cut their payments for charity care-so-called disproportionate share hospital (DSH) payments-they need their states to expand Medicaid coverage so as to increase the number of insured patients to make up for the loss of DSH payments. But this argument is faulty for a variety of reasons; here are the three main ones:- DSH payments through 2015 will not be based on whether a state expands Medicaid. The Obama Administration has recently released a proposed rule to allocate the first two years of DSH cuts using the most recent data on state uninsured rates. That means that the allocation will not vary based on whether states have agreed to expand Medicaid next year.
- Even under the planned DSH payment cuts, most hospitals will still be profitable. For instance, in Ohio, a recent investigative study reported data extracted from tax filings by 88 Ohio hospitals and hospital systems, finding that the vast majority would remain profitable even without any charity care offsetting payments. Lawmakers in other states would be well advised to conduct similar investigations and compare the facts to what they are hearing from hospital lobbyists.
- There is ample money for charity care. Contrary to the "poor mouthing" that state lawmakers hear from their hospitals, there is, in fact, plenty of money in the system, though much of it is currently misallocated. A report by the Government Accountability Office (GAO), based on 2007 data, found that "41 states made DSH payments to 717 hospitals that exceeded the individual hospitals' uncompensated care costs as calculated by the auditors" (emphasis added). Furthermore, the GAO separately reported that, in addition to DSH payments, hospitals also receive billions more in other (non-DSH) supplemental Medicaid payments.

Senators Cannot Trust Obama and Reid
Next week, the U.S. Senate will begin debate on the Gang of Eight's amnesty bill.
The push for amnesty is kicking into overdrive and we have to stop it. Unfortunately, some in the Senate Republican Caucus seem unwilling to block the bill from coming to the floor. For some reason, they think they can work with Barack Obama and Harry Reid to make this amnesty bill better. The sad truth is that Obama and Reid are not to be trusted.

- Prohibits the deportation of illegal aliens until their amnesty application is processed.
- Does not require any additional border fencing or completion of current border fence requirements.
- Does not require illegal aliens to learn English or pay back taxes in order to be amnestied. In fact, the pro-amnesty majority of the Senate Judiciary Committee expressly rejected an amendment that would have required illegal aliens to pay back taxes.
- Does not prohibit criminal street gang members from obtaining amnesty.
- Allows in-state tuition and federal financial aid for illegal aliens, subsidized by taxpayers.
- Does not require a biometric entry-exit system as already required by current law at all land, air, and sea ports of entry to ensure visitors don't overstay their visas.
- Finally, the S. 744 amnesty will cost U.S. taxpayers $6.3 trillion in federal spending over the course of 50 years!
