Senator: White House Providing Us Memos to Justify Drone Use

(TheBlaze/AP) - The Senate Intelligence Committee is scheduled to vote on President Barack Obama's pick to lead the CIA after weeks of wrangling with the White House over access to top-secret information about the use of lethal drone strikes against terror suspects, and the attack on the U.S. diplomatic mission in Benghazi, Libya.
On Tuesday, Feinstein announced that the White House is providing the panel with all of the top-secret Justice Department memos that justify the use of lethal drone strikes against terror suspects- including American citizens.
But Glenn Beck said on his radio program Tuesday that Senator Rand Paul (R-KY) could break previously-unheard information about the American drone program later in the day.
Beck said of the potential announcement: "If this is true, which Rand says it is, I think - maybe the biggest story in our lifetime?"
Neither gave specifics about what that information might be.
Brennan so far has escaped the harsh treatment that former Sen. Chuck Hagel, even though Brennan is one of Obama's most important national security aides and the White House official who oversees the drone program.

It is being reported by the media that Gov. Tom Corbett is pondering a flip-flop on Obamacare. Specifically, Gov. Corbett is considering a reversal of his initial decision to reject Obamacare's expansion of Medicaid to Pennsylvanians with incomes of up to 138% of the Federal Poverty Level. Currently, the eligibility threshold is 100% of the Federal Poverty Level.
This flip-flop would be financially and economically catastrophic for Pennsylvania. Here's why:
Medicaid costs are already spiraling out of control, presently consuming 30 cents out of every tax dollar spent by Harrisburg. The disheartening reality is that Medicaid is our state's largest expenditure, dwarfing public education. In 2001, three Pennsylvanians were working for every individual getting welfare benefits; today, the ratio has dropped to two to one. The Obamacare expansion would add 800,000 more Pennsylvanians to Medicaid, bringing our state's Medicaid enrollment to three million people, approximately one-fourth of our population.
The cost of the Obamacare expansion would be in excess of an additional $5 billion over eight years. While President Obama claims the federal government will cover the cost of Medicaid expansion, it would be unwise to rely financially on an entity that is $16 trillion in debt and has another $80 trillion in unfunded liabilities. When it comes to government, there is no free lunch; it will only be a matter of time before the heavy cost of expansion would be transferred to the Commonwealth.
Ed Haislmaier of the Heritage Foundation astutely noted that "a core principle of welfare policy should be that able-bodied, non-elderly adults receive public assistance only if they are working, preparing for work or actively seeking work. There is no such requirement in the Medicaid expansion. In fact, 82% of the individuals eligible for coverage under the expansion are working-age adults without dependent children. To expand welfarelike benefits with no work or behavioral requirements to a population of primarily young, childless adults is simply a prescription for achieving Western European levels of social and economic atrophy."
Why is Gov. Corbett wavering? It's hard to know for sure, but Gov. Corbett raised eyebrows two weeks ago when, as reported by the media, he traveled to Philadelphia to receive $200,000 in fundraising and an endorsement from David Cohen. Mr. Cohen is a Democrat power player who raised $1.2 million for Barack Obama's election. The media also reported that Gov. Corbett is going to aggressively court labor union support. With only 45 percent of Republicans supporting Gov. Corbett for re-election, perhaps he has decided to secure his political fortunes by appeasing Democrats instead of sticking to Republican principles.
Whatever the reason for Gov. Corbett's sudden wavering, we must urge him to stand by his decision to reject the Obamacare Medicaid expansion - as several other Republican governors have done - and instead push for a voucher program for Medicaid recipients to purchase private insurance from an array of health care providers. Florida implemented such a voucher program to give its Medicaid recipients a broad choice of private insurance, and today the Sunshine State spends one-third less on Medicaid than Pennsylvania does.

The death of Venezuelan President Hugo Chavez has unsurprisingly elicited strong opinions from many Americans, including several members of Congress who see his death as an opportunity for Venezuela to rise above his regime.
However, shortly after Chavez's death was confirmed, Rep. Jose Serrano (D-N.Y.) took to Twitter to pay his respects to the controversial and notorious leader.
"Hugo Chavez was a leader that understood the needs of the poor. He was committed to empowering the powerless. R.I.P. Mr. President," he wrote.

Democratic Strategist's Shocking Claim: Women Don't Need Guns for Self-Defense, Just Tell Men 'Not to Rape Women'

Appearing on Fox News Tuesday night, Democratic Strategist Zerlina Maxwell argued that preventing rape should start by simply "telling men not to rape women." She was arguing against women using guns as a means of self-defense when she made the questionable remarks.
Host Sean Hannity began by slamming the "ignorant politicians" in Colorado for trying to remove a woman's right to use a firearm to defend herself against an attacker via gun control legislation.

PA Liquor Sales Privatization
What is going on with PA Liquor privatization? PA House majority leader Turzai will introduce a House Bill on March 4. The bill number is HB 790. This bill is supported by Governor Corbett and will essentially privatize liquor sales in Pennsylvania. With control of both the Senate and the House in the control of Republicans, this bill should "sail through" both chambers and be signed by the Governor. The problem is that not all Republicans are on the same page. Rep. John Taylor, the lone Republican House member from Philadelphia is the Chair of the House Liquor Control Committee. He has previously gutted privatization bills. He has stated that he "wants to slow things down" and "avoid the chaotic process that other states have experienced." Therefore, we need citizens to email and call members of the committee and ask them to support privatization now. Example: Dear Representative ________ I urge you to support HB 790 to privatize the PA State Stores. Please do not allow special interest amendments to slow the process down with partial privatization over time. It is time to quit talking and take the action supported by the citizens of the state and Governor Corbett. GOP Backtracking? Medicaid Expansion & Liquor Freedom Corbett Considering Expansion of Medicaid
Stand against ObamaCare's Medicaid expansion Now is the time to urge Gov. Corbett (717-787-2500) to stand by his decision not to expand Medicaid to accommodate ObamaCare. Although the governor continues to express concerns about the costs of an expanded Medicaid program being unsustainable, the surrender of other Republican governors to pressure from the federal government and special interests apparently has caused him to reconsider. The governor has spoken to U.S. Health and Human Services Secretary Kathleen Sebelius and has agreed to discuss a Medicaid expansion in the future. Dr. Nick Pandelidis, Pennsylvania Vice President of Docs4PatientCare, writes that Medicaid expansion makes a terrible national fiscal situation worse and fails to provide quality care to the poor while other more affordable approaches are available. Americans for Prosperity is encouraging people to register on its website to take specific actions this week to ensure that a ruinous expansion of Medicaid is not brought to Pennsylvania.
Liquor Privatization The Commonwealth Foundation reported today that the Chairman of the PA House Liquor Control Committee, Rep. John Taylor, has proposed an amendment to the Governor's liquor store privatization plan that guts true privatization plans.

"Chairman Taylor's proposed amendment to HB 790 falls short in providing what the citizens of Pennsylvania demand: convenience, choices, and limiting the PLCB to its proper role as regulator. There are several reasons why the proposal fails to meet the demands of the most important stakeholders in this debate - consumers and taxpayers:
- The proposal maintains the government's monopoly of the wholesale and distribution system for wine and spirits. This ensures government bureaucrats retain the power to choose which wines and spirits can and cannot be sold in Pennsylvania.
- The proposal keeps the government in the business of selling wine and spirits. Pennsylvanians want the ease of purchasing alcohol in grocery stores and convenience stores - the same conveniences afforded to the citizens in most states.
- The proposal maintains the PLCB's conflict of interest. The PLCB should serve as the regulator of wine and spirits, not the purveyor. Pennsylvanians do not believe that the sale of alcohol is a core function of government.

Metcalfe Seeks to Make Federal Gun-Grabbing A Criminal Offense in Pennsylvania
|
HARRISBURG - State Representative Daryl Metcalfe (R-Butler) today announced his legislation that would make any new federal gun control laws unenforceable within the Commonwealth.
"Passage of my legislation will send the message that there will never be additional gun control, anywhere in Pennsylvania," said Metcalfe. "Whether by White House executive orders, congressional fiat, or judicial activism, we will never allow the left to benefit from the wicked acts of murderers in order advance their senseless gun-grabbing agenda which would only succeed in replacing one of our most sacred personal liberties with the chains of government tyranny."
Similar to legislation most recently introduced in Wyoming and Texas, Metcalfe's Right to Bear Arms Protection Act (House Bill 357) would:
- Prohibit enforcement of any new federal registration, restriction or prohibition requirement for privately owned firearms, magazines and ammunition.
- Require the state of Pennsylvania, including the Office of Attorney General, to intercede on behalf of Commonwealth citizens against any federal attempt to register, restrict or ban the purchase or ownership of firearms and firearms accessories which are currently legal products.
Final enactment of Metcalfe's Right to Bear Arms Protection Act would mean that anyone - even federal agents - who try to enforce any type of gun control restriction within state borders would face arrest and being charged with a felony offense.
"The right of the citizens to bear arms in defense of themselves and the State shall not be questioned," said Metcalfe. "Article 1, Section 21 of the Pennsylvania Constitution makes it crystal clear that no level of government, especially the federal government, has any authority whatsoever to impose senseless restrictions on law-abiding firearms owners, or worse, the confiscation of legally owned firearms. The purpose of my legislation is to force any gun-grabbing federal official to count the costs of unconstitutionally disarming or denying Pennsylvania citizens their God-given right to keep and bear arms."
Metcalfe is also calling on all Pennsylvania citizens who support Constitutional liberty to attend Pennsylvania's annual Second Amendment Action Day on Tuesday, April 23, beginning at 10:00 a.m. in the State Capitol Rotunda, and to sign the all-new Armed Pennsylvania: Say to No Gun Control petition by visiting RepMetcalfe.com.

Important Dates:
- February 15 - March 27, 2013 - Debt Ceiling: Sometime in this date range we are expected to reach the debt ceiling (Technically we have already hit the debt ceiling, but this is the date range when we will reach a point where the Treasury can no longer implement "extraordinary measures" to meet our spending obligations.
- February 28, 2013 - Sequestration: The "fiscal cliff" bill created a new manufactured crisis that will happen sometime at the end of February. This is when the sequestration can was kicked down the road.
- March 31, 2013 - Continuing Resolution: The current Continuing Resolution that the government is operating under expires on March 31. This means that they will have to pass a CR between now and then.
- April 15, 2013 - Budget Resolution: This is the date by law in which both Houses should have a budget resolution passed. We are already hearing that the President is late in submitting his budget, the House is reporting that they will not meet their deadline for a budget, and the Senate... well they haven't passed a budget in over 1,350 days.

Mike Henry was hired as the Philadelphia Regional Coordinator for Heritage Action. Mike will be speaking to our group at the meeting. He joined Heritage Action after successfully running a local outreach campaign as an intern for American Majority Action in southeastern Pennsylvania. During the campaign, he worked closely with local tea party groups to organize their canvassing efforts. He is an alumnus of Archmere Academy, in Claymont, Delaware, and will be a 2013 graduate from Pennsylvania State University. Heritage Action is the Pennsylvania think tank of Heritage Foundation which is being led by former Senator Jim DeMint (R-SC).

We would like to clarifiy the Prothonotary candidates for the upcoming Republican Primary are Michelle Christian (not Diane) and Pat Bachtle. It does not change a call for an open primary in this race.
Why all the fuss about a Prothonotary race?
If you have wondered what a Prothonotary is, you are not alone. In addition, whoever thought that it would be the focus of a power struggle within the Bucks County GOP for the 2013 elections?
There are two people running for Prothonotary this May. Pat Bachtle a long time incumbent and a newcomer Diane Christian. On paper this looks ok, but when you take a closer look, more questions than answers arise.
The Tea Party should be happy to see a newcomer on the ticket. Right?
We should be happy to see the incumbent challenged by a newcomer. Right? Except this newcomer was hand selected by Bucks County GOP Chairwoman Pat Poprik.
Do you remember the countless "newcomers" who have tried to run for office in the past few years? They were handily dismissed by the party leadership and told that positions only go to those who have worked hard for the party over several years. Pat Bachtle is the incumbent Prothonotary and has worked for the party for many years. Now Pat Poprik is embracing a newcomer that she has hand selected with no prior experience or record. There is clearly a double standard.
One does not have to think too hard to figure out what the reaction would be to an unknown Tea Party candidate running against an established incumbent. Remember when the GOP called the Constables to intervene against non-endorsed GOP candidates in 2010?
Why is the party chair deciding to pick this fight when Bucks County is becoming more liberal? This has the potential to leave the seat wide open for a Democrat grab. Bucks County GOP money should not be spent in a primary for a Prothonotary seat. This is foolish and wasteful use of resources.
We at The Kitchen Table Patriots
are calling for an Unendorsed Primary. Let the best candidate win. The registered Republicans of Bucks County should decide on primary election day who should be the next Prothonotary on the Republican ticket. Not a small group of GOP County Executives, half of which were appointed by the Chair of the Party. It doesn't seem like a fair process does it.

All of these issues are of great importance to the citizens of PA.
Also joining us will be Matt Hissey of Americans for Prosperity who will update us on the near term activities of AFP.
One of their recent successful projects was working to stop healthcare exchanges in PA that many of us helped with.
And very important, will be an open mic' discussion of VFP's focus for 2013. Please give this some serious thought and bring your ideas to the meeting. One big issue is Voter Fraud and how and with whom we should address this. Some members have signed up to work with True the Vote as well as Club for Growth who helped elect Senator Toomey.

Has Communist Ideology Overtaken America? Education is crucial. Today I want to share two very interesting lists with you, and rather than adding an extensive amount of my commentary, I want to give you the chance to examine the facts for yourself. It is my opinion that many communist goals have already been accomplished. I also believe that advancement has been made in other areas. But, you owe it to yourself to do your own research. I believe not only in the freedom of speech, but also in the responsibility of free thought. So please don't take my word for it. Examine the facts for yourself.
Again, I want to share two lists with you. The first is a list that was entered into 1963 Congressional Record. The second is the 10 planks of The Communist Manifesto.
If you can't see this happening in America, and a ton of progress being made, then I offer two potential explanations:
- You are one of the "useful idiots" of communist teaching.
- I am one of the "village idiots" that your Mama probably warned you about.
Some of these points will be open for debate and some will not. In some cases it is blatantly obvious that they have achieved their goals. It is even rumored that our own President has deep communist ties. You might want to check that out as well but I will withhold my opinion at this point. Let's just lay it out and you can interpret it.
This list was originally printed in "The Naked Communist" by Cleon Skousen. It was entered into Congressional Record in 1963 as the 45 goals of "The Communist Takeover of America."

Calvin Coolidge and the Moral Case for Economy

The following is adapted from a talk given at Hillsdale College on January 27, 2013, during a conference on "The Federal Income Tax: A Centenary Consideration," co-sponsored by the Center for Constructive Alternatives and the Ludwig von Mises Lecture Series. 
With the Federal Debt spiraling out of control, many Americans sense an urgent need to find a political leader who is able to say "no" to spending. Yet they fear that finding such a leader is impossible. Conservatives long for another Ronald Reagan. But is Reagan the right model? He was of course a tax cutter, reducing the top marginal rate from 70 to 28 percent. But his tax cuts-which vindicated supply-side economics by vastly increasing federal revenue-were bought partly through a bargain with Democrats who were eager to spend that revenue. Reagan was no budget cutter-indeed, the federal budget rose by over a third during his administration.
An alternative model for conservatives is Calvin Coolidge. President from 1923 to 1929, Coolidge sustained a budget surplus and left office with a smaller budget than the one he inherited. Over the same period, America experienced a proliferation of jobs, a dramatic increase in the standard of living, higher wages, and three to four percent annual economic growth. Who's Really Refusing to Compromise on the Sequester?
Over the weekend, Ezra Klein wrote that Obama has already made all of the concessions on entitlement programs that Republicans are looking for, and that the main problem is that congressional Republicans just haven't read Obama's proposals closely enough:
It's a continuing source of frustration among Republicans that the Obama administration, which seems so comfortable taxing the rich, isn't comfortable with "means-testing" entitlements - which is to say, asking wealthier seniors to bear a heavier burden for their health-care costs or receive less coverage from Medicare.
But on page 34 of the White House's most recent budget, President Obama proposes to do exactly that. Medicare, it's important to note, is already a partially means-tested program, with richer seniors - about 5 percent of them - paying income-related premiums for their hospital and drug insurance. Obama would increase those premiums by 15 percent, and he'd freeze the threshold such that, over the next decade or two, 25 percent of seniors were paying part of the cost of their coverage.
Monday he returned to the topic, once again contending that long-term fiscal and budgetary Nirvana would be within our reach if the Republicans weren't so darn stubborn about tax increases:
But it's unpopular for Republicans to simply say they won't agree to any compromise and there's no deal to be had - particularly since taxing the wealthy is more popular than cutting entitlements, and so their position is less popular than Obama's. That's made it important for Republicans to prove that it's the president who is somehow holding up a deal.
This had led to a lot of Republicans fanning out to explain what the president should be offering if he was serious about making a deal. Then, when it turns out that the president did offer those items, there's more furious hand-waving about how no, actually, this is what the president needs to offer to make a deal. Then, when it turns out he's offered most of that, too, the hand-waving stops and the truth comes out: Republicans won't make a deal that includes further taxes, they just want to get the White House to implement their agenda in return for nothing.
There's a fairly key point that Klein keeps glossing over: Republicans feel they just made a concession on tax hikes - gobs and gobs of them, in fact:
Tax increases the fiscal cliff deal allowed:
1. Payroll Tax: increase in the Social Security portion of the payroll tax from 4.2 percent to 6.2 percent for workers. This hits all Americans earning a paycheck-not just the "wealthy." For example, The Wall Street Journal calculated that the "typical U.S. family earning $50,000 a year" will lose "an annual income boost of $1,000."
2. Top marginal tax rate: increase from 35 percent to 39.6 percent for taxable incomes over $450,000 ($400,000 for single filers).
3. Phase out of personal exemptions for adjusted gross income (AGI) over $300,000 ($250,000 for single filers).
4. Phase down of itemized deductions for AGI over $300,000 ($250,000 for single filers).
5. Tax rates on investment: increase in the rate on dividends and capital gains from 15 percent to 20 percent for taxable incomes over $450,000 ($400,000 for single filers).
6. Death tax: increase in the rate (on estates larger than $5 million) from 35 percent to 40 percent.
7. Taxes on business investment: expiration of full expensing-the immediate deduction of capital purchases by businesses.
Obamacare tax increases that took effect:
8. Another investment tax increase: 3.8 percent surtax on investment income for taxpayers with taxable income exceeding $250,000 ($200,000 for singles).
9. Another payroll tax hike: 0.9 percent increase in the Hospital Insurance portion of the payroll tax for incomes over $250,000 ($200,000 for single filers).
10. Medical device tax: 2.3 percent excise tax paid by medical device manufacturers and importers on all their sales.
11. Reducing the income tax deduction for individuals' medical expenses.
12. Elimination of the corporate income tax deduction for expenses related to theMedicare Part D subsidy.
13. Limitation of the corporate income tax deduction for compensation that health insurance companies pay to their executives.
Some Republicans feel you should go, I don't know, at least a couple of months between tax increases.
Oh, and if you demand policy Y "in return" for enacting X, you're not really in support of X. You may be amenable to X, but you're not really helping with the lift, making the case for it to a public that remains utterly oblivious to fiscal realities. Americans want to reduce spending while increasing spending or maintain it at current levels for 18 of 19 programs. Our debt, the deficit, the long-term fiscal health of our entitlement programs - all of these would be easier to deal with if the public understood budgetary reality, instead of thinking we can solve all our problems by enacting the Buffett Rule and relishing its $3.6 billion per year in revenue. Projected deficit for 2013: $900 billion.
And when "X" is an unpopular but probably necessary reform to keep entitlement costs from exploding, I don't know how many "political courage" points you should get for declaring that you're only willing to support it if you get what you originally wanted, which is even more tax hikes.
Oh, and listing an idea as an option on page 34 of the budget report barely counts as "support," although I suppose we should be thankful it wasn't relegated to a footnote.
Obama's Cabinet: The Sky Is Falling, and It's All Sequester's Fault, Honest!
No sooner than one cabinet secretary apologizes for peddling implausible lines about the sequester's effect...
Education Secretary Arne Duncan said Monday he misspoke when he recently claimed schools were already firing teachers in anticipation of sequester cuts taking effect.
"When I said 'pink slips' that was probably the wrong word," Duncan said to reporters, according to multiple reports. "Language matters, and I need to be very, very clear."
. . . than another one gets herself into trouble:
Both the Transportation Security Administration and U.S. Customs and Border Protection predict sequestration budget cuts will mean more time stuck in line for travelers using America's airways, but three days in, only some of those increases have materialized.
Enter your airport's information on the TSA's website for a quick listing of line times at each security checkpoint. A spokesperson at Reagan National Airport said Monday that neither Reagan nor nearby Dulles International Airport were seeing a change in wait times.
TSA's press office said on Friday that the sequester would not trigger an immediate increase in wait times, but as they put in place a hiring freeze and see staffing levels drop, peak wait times at large airports could go up to an hour or more.
A second website allows flyers to see which airports are experiencing flight delays, which can also lengthen travel time.
The only airport showing delays on the Federal Aviation Administration website Monday afternoon was San Francisco International where weather was slowing planes out of the gate.
Homeland Security Secretary Janet Napolitano said Monday waits at Customs had already gone up by 150 to 200 percent.
Look on the bright side: We got the secretary of education to concede that "language matters."

The Nobel Peace Prize, a Rapidly Depreciating Asset
The Nobel Peace Prize has been in a long rebuilding stretch for a while, hasn't it? The EU, President Obama, Al Gore, Jimmy Carter, Kofi Annan...
Who's feeling excited about this year's pick?
A record 259 nominations have been received for this year's Nobel Peace Prize, with candidates including a Pakistani girl shot by the Taliban and a U.S. soldier accused of leaking classified material to WikiLeaks. Fifty of the nominations were for organizations.
The secretive committee that awards the prize doesn't identify the nominees, but those with nomination rights sometimes announce their picks.
Names put forward this year include Bradley Manning, the U.S. Army private who has admitted sending hundreds of thousands of classified documents to the secrecy-busting website WikiLeaks and 15-year-old Malala Yousafzai, an education activist who was shot in the head by Taliban militants while on her way home from school in Pakistan.
Manning, huh? Who nominated him, al-Qaeda? Then there's this little detail:
Three peace prize laureates - South African Archbishop Desmond Tutu, Mairead Maguire of Northern Ireland and Adolfo Perez Esquivel from Argentina - insisted the prize money of $1.2 million should not have been paid out in 2012 because they said the EU contradicts the prize's values because it relies on military force to ensure security.
Oh, really? How about the 2009 winner who has his own personal "kill list" and has asserted the authority to kill American citizens through a drone strike without trial? Is that really the Nobel mindset?
Of course, our Jay Nordlinger wrote the book on the Nobel and its winners...

1. Today, House Conservatives Will Prove They Are the Problem
Yesterday, the White House announced it would stop White House tours in response to sequestration.
Congressman Louie Gohmert of Texas responded by offering an amendment to the pending continuing resolution that would prohibit federal dollars spent to cover the costs of President Obama's golf games.
Speaker John Boehner and the Republican Leaders ruled that Congressman Gohmert's amendment was not relevant to the continuing resolution and threw it out.
Today, House conservatives will join with their Republican colleagues to vote on what is called a "closed rule." This is a vote that will allow Republican leaders to bring to the floor of the House of Representatives the continuing resolution without having to deal with Congressman Gohmert's amendment.
It will also prevent Republicans from being able to defund Obamacare.
Today, House Republicans will vote on a rule in the House of Representatives that, once approved, will allow the continuing resolution to pass while enabling and funding Obamacare.
House Conservatives will make it happen. In fact, House Conservatives who vote for the rule are voting to fund Obamcare. Passing the rule then conveniently voting against the actual continuing resolution cannot be given a pass.
2. Coin-operated government
Why should any self-respecting citizen agree that Uncle Sam must be paid off with fresh tax revenue, before he'll even consider cutting down on the fruit-fly sex studies and federally subsidized Star Trek conventions? After years of relentless federal growth - and just two months after massive tax increases, whose last-minute imposition is wreaking havoc among our already stressed-out tax serfs - why should it be unthinkable to call for some big spending cuts first? Notice how politicians of every stripe are perpetually promising to eliminate billions in waste, fraud, and abuse... but they never actually do it. That's always a carrot dangled above our heads, and we might just get a nibble, if we agree to close a few "tax loopholes" and pay Washington a few billion dollars more. 4. Planned Parenthood Clinic Faces Lawsuit Claiming Negligence, Battery
A doctor at Planned Parenthood of the Rocky Mountains allegedly performed an abortion with no anesthesia against the will of Colorado Springs resident Ayanna Byer, according to charges in a lawsuit Byer filed on February 6. Byer's suit brings claims of negligence, battery, uninformed consent, false imprisonment, extreme and outrageous conduct (emotional distress), and breach of fiduciary duty against the Planned Parenthood facility and a doctor identified in the complaint only as "Dr. John Doe." . . . please click here for the rest of the post →
5. Medicare Trustee Cautions States on Obamacare Medicaid Expansion
Medicare Board of Trustees member Charles Blahous released a Mercatus Center report on March 5 recommending states take advantage of the U.S. Supreme Court's June 2012 Patient Protection and Affordable Care Act (PPACA) ruling by mostly rejecting the law's Medicaid expansion. When AIPAC Went AWOL

Washington Times title: "Israel lobby tiptoes around Hagel nomination"
Chuck Hagel's notorious 2008 statement about the American Israel Public Affairs Committee (AIPAC), the leading institution of the pro-Israel lobby, claimed that "the Jewish lobby intimidates a lot of people up here [in Congress]. I'm a United States senator. I'm not an Israeli senator."

Then a strange thing happened: no sooner did Barack Obama nominate Hagel for secretary of defense on Jan. 7, when AIPAC announced it would not oppose the former Republican senator from Nebraska. Indeed, so neutral did it wish to be on this delicate topic that its spokesman even avoided mentioning Hagel's name, declaring only that "AIPAC does not take positions on presidential nominations." AIPAC then kept a complete silence through Hagel's confirmation on Feb. 26. More important, it did not lift a finger to influence the vote.
AIPAC's initial logic made some sense: Obama, having just won an impressive reelection effort, had chosen his man and Republicans were likely to put up a merely token resistance to him, so why antagonize a soon-to-be very powerful figure and a principal player in the U.S.-Israel relationship? As my colleague Steven J. Rosen explained back then, "AIPAC has to work with the secretary of defense." It also did not want to antagonize increasingly skittish Democrats.
Subsequently, an intense search into Hagel's record found more ugly statements about Israel. He referred in 2006 to Israel's self-defense against Hizbullah as a "sickening slaughter." In 2007, he pronounced that "The State Department has become adjunct to the Israeli foreign minister's office." And in 2010 he was cited as warning that Israel risked "becoming an apartheid state."
Still, the senator who spoke of an intimidating "Jewish lobby" got a complete pass from that same lobby. It makes one wonder just how intimidating it is.
Other pro-Israel organizations took a different approach. The Zionist Organization of America produced 14 statements arguing against Hagel's nomination between Dec. 17 (urging Obama not to nominate the "Iran- & Terrorist-Apologist & Israel-Basher Chuck Hagel") to Feb. 22 (a listing of "Ten Important Reasons to Oppose Chuck Hagel"). Not itself primarily a lobbying organization, ZOA's calculus had less to do with the prospect of winning and more to do with taking a principled and moral stand.
In large part because of the Nebraskan's Middle East policies of appeasing Tehran and confronting Jerusalem, Republican opposition to Hagel became much more than token. Several senators indicated to the ZOA's Morton Klein that if AIPAC "had come out and lobbied against Hagel, he would have been stopped." Charles Schumer (New York), indisputably the key Democratic senator on this issue, publicly cited the absence of "major Jewish organizations" as one reason why he had "no qualms" about endorsing Hagel. Still, despite the real and growing possibility of defeating Hagel's nomination, AIPAC kept radio silence and did nothing.

The high committee of Palestinian Authority President Mahmoud Abbas' Fatah party made a quiet decision yesterday to stop disarming members of the Al Aqsa Martyrs Brigades terrorist group, according to an informed Palestinian security source.
The decision to allow the Brigades, Fatah's so-called military wing, to bear arms is in violation of a 2007 amnesty agreement signed with Israel that requires Brigades members to completely disarm.

Fresh from an interview dustup with the Fox News Channel's Sean Hannity, the first Muslim elected to Congress still is unable to explain evidence that his association with the anti-Semitic, anti-white Nation of Islam was much closer than he has claimed.
Newspaper reports from the 1990s indicate Ellison was known as a supporter and activist for Louis Farrakhan's Nation of Islam, even speaking on behalf of the controversial group as a "representative."
The information and timeline provided by the newspaper reports are at odds with Ellison's public explanation of his association with the group.

The 1983 attack on American Marine barracks in Beirut was the largest non-nuclear bombing post-World War II. The jihadi attack that killed 241 was Iranian prozxy, Hezbollah's, coming-out party.
To this day, the attack is lauded on its TV channel Al-Manar. A Hezbollah "poet," Atef Moussa, appeared on May 22, 2005, and said,"Who says we are afraid of war? ... Who can compare to the men of Hezbollah? ... These enemies [the American military] turned out to be as light as cardboard. Bush knows it. Beirut remains dangerous for the Marines. Our proof is here, they left in shame. Our people sail the seas of martyrdom."
In an anti-American speech mocking the American military on March 8, 2005, Hezbollah's leader, Sheik Nasrallah, also referred to the attack: "I address the following to America ... to President Bush ... to Condoleezza Rice ... and to American-Lebanese field commander Satterfield ... Lebanon will not ... throw its heart to your soldiers' dogs so they will eat it ... You can make yourself heard by the commander of the American forces in the region, who is of Lebanese origin, John Abizaid ... Are you Lebanese afraid of the American naval fleets? These naval fleets have come in the past, and were defeated, and if they come again, they will be defeated again..."
Since Hezbollah's founding, its leadership has threatened America openly. In a March 1985 Newsweek article about Hezbollah, an Islamic teacher at the Bir Al-Abed Mosque in Beirut, Alia Hamden, promised a future attack by the terror organization within America. Similarly, in a July 2003 interview with the Christian Science Monitor, Shiek Nasrallah said that if America tried to dismantle his organization, American interests throughout the world will be at risk, "through any means and at any time and any place."
Al-Manar is Hezbollah's main vehicle for spreading its anti-American ideology. Such messages surface in news programs, music videos, and even game shows. (More at here at New York Sun)
So this win for the victims' families is wonderful news, despite Obama's pro-jihad opposition. Victims triumph in one of the worst Islamic attacks on Americans in the late twentieth century.

Suppose that you are a Soviet agent in the 1950s. Your cover is that of an insurance salesman. Of your two "jobs", the Soviet agent part is more important, but you need to be a good insurance salesman to maintain your cover. Being a good insurance salesman doesn't clash with being a good Communist, because your job selling life insurance allows you to pursue your real job. And you cannot conflate the two jobs. You can't sell insurance to your KGB bosses or pitch Communism to your insurance prospects. If you do that, then worlds will collide. But if Communism is on the way up, then you can stop selling insurance and tell everyone who walks into your office that Communism is their best insurance. You are no longer a Communist who sells insurance. You are just a Communist running an insurance agent's office. This state of affairs has applications beyond Communism and life insurance. Suppose you are a liberal in the 1950s. You don't support some gang of reds goosestepping their way across the country and rounding up people into gulags. Nor do you want any of the revolutions that some of the radicals hanging around outside NYU sometimes recite poems about. You believe that the best pathway to a liberal society is through liberal institutions. You disdain the Marxists with their rigid party orthodoxy for closing off their minds to open inquiry and healthy debate.

There are 200 State Senators and Representatives in Massachusetts. Only 33 are Republicans; the rest are Democrats. Massachusetts sends only Democrats to represent her in the US Senate and Congress. Massachusetts obviously likes being subject to the whims of the hardcore Left which is its choice, but willfully becoming the toys of the power hungry unbalanced has its price. Whenever Democrats gain such total power they become increasingly dangerous and their lunatic streak comes bubbling to the fore.
Not surprisingly, the latest example of what Democrats will do to their subject victims comes from Massachusetts. A New Bedford Democrat has introduced a bill that would hand over the determination of what is and what is not proper and "acceptable" treatment of animals to private citizen PETA types.

Liberal Insanity I am becoming increasingly convinced that the worldview of many on the left is simply insane. There is no other word to describe it. I was reminded of this in the last couple of days by some recent events that have taken place in our schools. These incidents speak volumes about the bizarre set of values that direct leftist thinking. But I am most concerned about the effect it has on normal little American boys and girls. From the city of Fountain, Colorado, comes news of liberal parents who believe their little boy is actually a little girl on the "inside." They are insisting that their six-year old son be allowed to attend classes dressed as a girl and that he be allowed to use the girls' bathroom. Eagle Elementary School was initially willing to accommodate this young transvestite/transgender. But in December the school changed its policy and informed the parents that their son could no longer use the girls' restrooms. Last week, with the help of the Transgender Legal Defense and Education Fund, the parents filed a discrimination complaint with the Colorado Civil Rights Division. Meanwhile in Maryland, a state dominated by the left, there has been another incident demonstrating just how dangerous food can be. On the morning of Friday, March 1st, a seven year-old boy in the D.C. suburbs of Anne Arundel County was eating a breakfast pastry. (Apparently Michelle Obama's food police were on vacation that day.) After taking a few bites, the boy noticed that his pastry looked like a gun, and he said, "Bang, bang." In my world, this should have gone unnoticed as the normal imagination of a little boy. But in the left's world, the boy was suspended for two days. School officials were so shaken by the incident that they sent a letter home to every parent, warning them that food was used by a child for an inappropriate gesture and that child was removed from class. The letter went on to say that school counselors would be available to talk to any children who were troubled by the incident. I don't know whether to laugh or cry. Was the pastry a "pop" tart? On a more serious note, it is impossible to deny the cultural left's grip on our public education system: explicit sex education, American history that is all too often anti-American revisionism; introducing the radical homosexual agenda at the earliest ages; blocking Judeo-Christian values at the schoolhouse door; and gun-free zones that will never stop a killer. Now hard-left political correctness has made a criminal out of a seven year-old playing with a pastry, while turning a six year-old cross-dresser into the latest civil rights hero. If while watching the November election returns, you found yourself, like many of us, wondering what has happened to this country, you need to look no further than to the indoctrination that is happening daily in classrooms all across America. A House Divided? With the fiscal cliff and the sequester behind them, House Republicans are looking ahead to the next budget battle. Congress must pass another short-term funding measure by the end of the month in order to avoid a government shutdown. Some conservatives may say, "Shut it down!" But some House Republicans are worried. The last time we did that, under Newt Gingrich, we lost the PR war. The public rallied around a charismatic Democrat president (Bill Clinton) who defended popular services. He was easily reelected in the next election. Yesterday House Republicans introduced legislation to keep the government running for the remainder of the fiscal year and they also proposed some tweaks in the sequester law. Before anyone accuses the GOP leadership of betrayal, it is important to know that the $85 billion in spending reductions will stay in place. Because President Obama is refusing to use his authority to make responsible cuts, the GOP plan restores some funding to the Pentagon and provides additional resources for embassy security, which is understandable in the wake of the Benghazi attacks. The bill also provides a boost to the FBI, and prohibits immigration officials from releasing illegal immigrants. This additional spending is paid for by extending a salary freeze on federal employees, including members of Congress. At the same time, there is another battle brewing. Some House conservatives are pushing a more aggressive balanced budget plan. Other conservatives are urging caution because such a plan would likely violate a promise not to affect the Medicare and Social Security benefits of those older than 55. Americans that close to retiring have been planning on a certain level of benefits. We need to restore fiscal sanity, but it is important that the Republican Party not come across as a party of bean counters only obsessed with cuts and austerity. We must be the party of economic growth and opportunity. While it is important to cut unnecessary spending, economic growth will do more than anything else to close the budget deficit. Here's my take on the split: No balanced budget plan, whether it is 10 years or 20 years, is going to become law as long as Democrats control the Senate and Obama sits in the Oval Office. The only thing that proposing new and deeper cuts in Medicare and Social Security will do is provide fodder for TV ads that Obama and his allies will run next year to take back the House and prevent us from taking back the Senate. How does that help us achieve the goal of balancing the budget? Political parties in Europe running only on austerity are getting clobbered all across the continent. We need to be smart as we enter this debate to avoid the same fate. The Bible Scores Big! Now for some encouraging news. The New York Post reports that the History Channel's mini-series "The Bible" scored a record audience of 13 million viewers, "the year's best numbers for a cable entertainment series." For comparison, 8.2 million viewers tuned in to watch the season finale of "Downton Abbey," another hit show. Of course, the Bible is far more than just entertainment. Producers Mark Burnett and Roma Downey said, "This #1 series is a tribute to all those who have helped us to spread the Word." And it shows that in spite of the incredible hostility of Hollywood and media elites, there are millions of Americans who are drawn to stories of faith, with messages of hope and redemption.

Death comes for "passionate but polarizing" Hugo Chavez

Hugo Chavez has died. The Washington Post calls him "passionate but polarizing." That's a way of putting it, I suppose.
Eventually, the Post provides a few examples of Chavez's polarizing passion:
He criticized the U.S.-led invasions of Iraq and Afghanistan and, in a speech at the United Nations in 2006, said President George W. Bush was "the devil." He called Tony Blair, then Britain's prime minister, "an imperialist pawn who attempts to curry favor" with the Americans. He accused Israel of genocide, saying its treatment of the Palestinian people was akin to a "new Holocaust."
Mr. Chavez sought out relationships with assorted rebel groups, rogues and pariah governments. He exchanged letters with Ilich Ramirez Sanchez, a Venezuelan-born terrorist known as Carlos the Jackal, who was held in a French prison. He asserted that Moammar Gaddafi's Libya was a model of participatory democracy.
Closer to home, Mr. Chavez expressed affinity for the Revolutionary Armed Forces of Colombia, or FARC, a potent guerrilla group fighting Colombia's U.S.-friendly government. His closest aides built a close relationship with FARC commanders, according to Colombian officials, rebel documents seized in army raids and former rebels.
But Chavez's softest spot was reserved for Cuba.
After taking office, Mr. Chavez began providing 100,000 barrels of oil a day to Castro's government at subsidized rates; in exchange, Castro shipped thousands of Cuban workers, from intelligence agents to doctors and sports trainers, to Venezuela.
And let's not forget about his friendship with the odious Iranian regime. In Ahmadinejad, almost as much as in Castro, Chavez found a soul mate.
With Chavez gone, the focus turns to succession. I wrote here about the Obama administration's efforts to cozy up to Nicolas Maduro, Chavez's vice president and the architect of some of the Chavez regime's worst anti-American policies, including its tilt to Iran.
Sooner or later, we can expect a power struggle. I wish I had confidence that Obama will take the anti-hard left side in that struggle, but I don't.
Tone down the rhetoric in the quotes above from Chavez pertaining to U.S. policy in Iraq, Great Britain's involvement, and Israel's treatment of the Palentinians. How far away from Obama's real views are you? Not very, in my opinion.

Greatest Interview Ever

This has nothing to do with current events, but it is pretty funny, so I thought I'd share it with our readers. Actress Mila Kunis is doing interviews in support of her new movie, Oz the Great and Powerful, and one of the interviewers turns out to be an inexperienced young guy from the BBC, who begins by announcing that he is "petrified," apparently because this is his first interview ever. Things go uphill from there, as Kunis chats with the BBC guy, who seems a dead ringer for a young Hugh Grant, about soccer, pubs, awful-sounding drinks, and more. Before you know it the interviewer is trying to score a date; it is never quite clear whether he succeeds. The video has gone viral and at the moment has around a half million views on YouTube:

No Doubt Where Jeff Sessions Stands on Caitlin Halligan

Yesterday, Senate bellwether Jeff Sesssions delivered these remarks on the Senate floor regarding D.C. Circuit Court nominee Caitlin Halligan. His indictment of Halligan is scathing, but not intemperate: he cites chapter and verse and is, to my mind, utterly persuasive. Note that at one point Sessions quotes Andy McCarthy, another sign of good judgment:
Mr. President, I rise to express my opposition to the nomination of Caitlin Halligan to be a judge for the U.S. Circuit Court of Appeals for the D.C. Circuit. That is an important court, one of the most important courts, one step below the Supreme Court.
I would note that the Senate has already once rejected proceeding with consideration of this nomination and, in my opinion, for good reason. We do not do that lightly.... But it is an important question, and nominees do have to clear the Senate, and the Senate is not a rubber stamp.
Ms. Halligan has a well-documented record of advocating extreme positions on constitutional issues, pushing legal arguments beyond what I think is reasonable, including in cases involving Second Amendment gun rights, abortion, the death penalty, and others.
But one of the most troubling of her views pertains to the war on terror and the detention of enemy combatants. This is alarming not only because the arguments she has advanced in this regard are contrary to well-settled law, but because the court she seeks to join the-D.C. Circuit-has a critical role in national security matters, including deciding habeas petitions of terrorist detainees.
As a member of the Association of the Bar of the City of New York's Committee on the Federal Courts, she joined a 2004 report, the self-described purpose of which was specifically to "address, in particular, the role the federal courts should play in striking [the] balance [between, in this case, national security and civil liberties concerns] with respect to the detention and trial of suspected terrorists or their accomplices designated as 'enemy combatants' by the executive branch."
The report comes to the untenable conclusion that the congressional Authorization for Use of Military Force does not authorize the indefinite detention of enemy combatants.
These are prisoners of war. Not only did the Supreme Court hold that it does, in fact, authorize indefinite detention in Hamdi v. Rumsfeld, but the Obama administration has argued for a broad construction of that authority itself. And, in a series of rulings joined by judges across the ideological spectrum, the D.C. Circuit has adopted, itself, that broad definition. ...
The report also adopts the unsupported view that the war on terrorism "seems closer to a law enforcement effort than to a military campaign."
But I would say to that, the Congress voted and declared it to be a military effort. Tell that to the soldiers in Afghanistan chasing down al-Qaeda operatives, that it was not a war.
The report goes on. But this was part of the attempt at the time to undermine President Bush's ability to effectively manage the war effort. The report argues vigorously against the use of military commissions-that is where you try prisoners of war for violations of the rules of war, in military commissions-and maintains that the preferred place to try them are Article III civilian courts, normal civilian courts, except in "exceptional circumstances."
They say, of course, to try them in a civilian court would provide the terrorists-enemies of the United States, participating in a war against the United States-with all the same constitutional rights that a person who defrauded the IRS or robbed a bank would have. But it is a different situation. You do not give those kind of rights to people at war with the United States, whose goal is to destroy the United States and to replace the government. That has never been the position in our country, nor in any other nation in the world that I am aware of. But that is the position she signed on.
While Obama surrogates and supporters during the campaign often attacked Bush and made these kinds of allegations, the Obama administration, after taking office, has been forced to abandon those positions. They are untenable.
One of the report's flawed arguments of why you should try unlawful enemy combatants-that is people at war against the United States in Article III civilian courts is as follows: "It seems self-evident that the same [constitutional] protections [afforded ordinary criminals] should presumptively extend to those individuals whom the government has seized and proposes to detain for an extended, and perhaps indefinite, period of time because they are suspected of having engaged in conduct intended to further terrorist aims, thus violating applicable criminal laws."
Well, applicable criminal laws were violated, but it was an attack on the United States, not a normal crime. And the Nation made a very clear decision on which I thought all of us were in agreement that we had moved from a time of criminal activity to a time of war, and we acted in that fashion. So there is nothing self-evident about the position in the report that an unlawful enemy combatant whose only connection with the United States is his acts of war against it should be afforded the constitutional due process rights of an American citizen who committed a crime.
Andy McCarthy, a former longtime Department of Justice veteran prosecutor, who tried the Blind Sheik case, said this:
The only thing the framers might have found more appalling is the notion that the Constitution licenses lawfare - i.e., that it permits the American people's courts (which, other than the Supreme Court, are creatures of statute not required by the Constitution) to be used by foreign enemies to put on trial the armed forces of the American people over the manner in which they conduct wartime combat operations that have been authorized by the American people's representatives.
I think Andy McCarthy is right about that. I think that is basically what happened. I do not dispute it is fully acceptable for lawyers to defend unpopular clients. However, it is curious to me that while this Nation has hundreds of thousands of fine lawyers and thousands of proven prosecutors, the ones who seem to have a leg up-I am saying this carefully because I have observed this now for 4 years. I think it is significant. The ones who seem to have a leg up in this administration's nomination process are those who have challenged the legal policies of the former President of the United States as he attempted to conduct a war to defend the United States against an enemy dedicated to its destruction.
Time and time again, these are the people who have been nominated for high Department of Justice offices and to the courts. The lifetime appointment, to which Ms. Halligan has been nominated, demands independence and a commitment to the rule of law and not to a political agenda.
At her hearing, she did attempt to distance herself from the report, variously claiming she had not seen it until just before the hearing and that she had not attended all the meetings at which the report was discussed. She admitted, however, that she could have requested that her name not be on the report, as did four other members of the committee, but she did not. She signed it.
In fact, according to her own testimony, she never took any action to repudiate the report or its contents before her nomination or even before her hearing. The first time she expressed any disagreement with the report, it seems, was at her confirmation hearing. Some call that a confirmation conversion. A serious attorney would have taken swift action to either remove their name from the report or to repudiate it. No serious attorney would affix their name to a report on such important matters in a time of war without studying it carefully, surely.
It can only be assumed the report represented her views on the role of a civilian Article III court with respect to detention and trial of enemy combatants. It would have done more for her credibility to own up to that fact, rather than paying lip service to what might be more helpful during the confirmation process.
The report continues its irresponsible description of the al-Qaeda supporter and convicted terrorist Ali al-Marri as a "civilian in this country legally, [who] seems suspected of providing logistical support for al-Qaeda sleeper cells: presumably criminal activity, if proven, but not 'combatant' activity under any likely definition of the term." Al-Marri eventually pleaded guilty to providing material support to al-Qaeda and was sentenced to eight years in federal prison. In his guilty plea, he admitted that he attended terrorist training camps in the years prior to the 9/11 terrorist attacks; that he was instructed by Khalid Sheikh Mohammed, the mastermind of 9/11, to enter the U.S. just prior to 9/11 and await further instruction from al-Qaeda; and that while here, he researched chemical weapons and communicated with al-Qaeda members. Investigators also discovered that he had made several phone calls to Mustafa al-Hawsawi who had wired money to the 9/11 hijackers.
When al-Marri's case came before the Supreme Court, Ms. Halligan, as a private practitioner, donated her legal services pro bono to co-author an amicus brief on his behalf. The brief argued the United States lacked the authority to detain al-Marri as an enemy combatant, and that the AUMF did not authorize his seizure and indefinite military detention, without criminal trial. At the hearing, Ms. Halligan claimed-unconvincingly in my view-that the brief did not represent her personal views. But the fact remains that she chose to donate her professional legal services to defend a radical Islamic terrorist instead of the millions of Americans who need legal representation, or victims of terrorism in this country and all over the world, or women in Afghanistan fighting for equal rights, or those suffering from religious persecution in Islamic countries. The fact that she would sign her name to the Bar report, and her decision to co-author and file an amicus brief in the al-Marri case, is a very serious matter. And those actions cast doubt on her testimony that she was not aware of the contents of the Bar report.
Much of Ms. Halligan's testimony did not match up with her record as an attorney both in private practice and public service. During her testimony, she attempted to evade the activist views she spent her career advancing, claiming, for example, that she now embraces original intent as the preferred method of Constitutional interpretation. At the same time, however, she was forced to admit that, prior to her "confirmation conversion," she had never once espoused such views. That is not surprising, given her well-documented record over the course of many years of advocating for the restriction of Second Amendment rights, including in favor of liability for gun manufacturers, for same sex marriage, for limiting the death penalty, for back pay for unauthorized illegal alien workers, and for affirmative action. All positions utterly unsupportable by an original intent approach to constitutional interpretation.
Her attempts to distance herself from her record were simply unconvincing. There is no question where she stands on these issues. She herself has said that the 'courts are the special friend of liberty . . . the dynamics of our rule of law enables enviable social progress and mobility.'
Her testimony did nothing to convince me that her written record does not paint the accurate picture of what her tenure on the bench would look like if she were confirmed. We have judges who follow their oaths to serve under the Constitution and the laws of this country. They are never above it. They are never free to alter the meaning of words to advance a personal agenda.
We have written many times over the years about the Senate's responsibility to advise and consent with respect to presidential nominees. My own view is that, while certainly there are limits, the Senate should be highly deferential to the president's desire to staff his own administration with aides and officers of his choosing. But judicial appointments raise entirely different issues: a president's cabinet is charged with executing the president's policies, not designing its own, and it leaves office when he does. Judges, on the other hand, serve for life. They will be with us long after the president who appointed them has left office. More important, they are appointed not to carry out the president's policies-for which the public presumably has voted-but rather to execute independent judgment as part of an independent and co-equal branch of government. For these reasons, judicial nominations are not entitled to the same degree of deference that the Senate rightly extends to the president when he is merely staffing his own administration. A nominee like Ms. Halligan, who is clearly out the mainstream and has shown poor judgment on some of the most critical issues that may come before judges of the D.C. Circuit, should be rejected.

Where does Lindsey Graham stand on Caitlin Halligan?

Over the weekend, I urged readers to ask Republican Senators to block the nomination of Caitlin Halligan to the U.S. Court of Appeals for the District of Columbia. I argued (1) that Halligan's leftist views - e.g., regarding guns and national security - are outside of the mainstream and (2) that she did not testify candidly during her confirmation hearing.
Lindsey Graham was foremost among the Senators I urged readers to contact. Graham isn't big on filibustering judicial nominees, which is not an unreasonable position. But as a member of the old "Gang of 14," he supported filibusters under "extraordnary circumstances." Applying that standard, he helped block at least one key Bush nominee.
Halligan's far-leftism and lack of candor before Congress should satisfy the extraordinary circumstances standard. Indeed, Graham stood with his fellow Republican Senators in 2011 when the Senate refused to proceed on her nomination.
Where does Graham stand on Halligan now? There has been speculation that Chuck Schumer is pressuring the Republican Senators he's working with on immigration reform - Graham, John McCain, Marco Rubio, and Jeff Flake - to relent on Halligan in exchange for some sort of a fine-tuning of the deal they are concocting on immigration.
Now there are reports that Graham will not support the blocking of Halligan. On the other hand, I've been told that Graham has announced no decision regarding the nominee.
We'll soon find out for sure where Graham stands on Halligan. Let's hope that he will not deal conservatives a double blow by paving the way for an ultra-liberal judge in the interest of paving the way for citizenship for illegal immigrants.

Runaway government debt could stifle the economy, resulting in stagnant growth for the foreseeable future. As more and more debt accumulates, private investment is crowded out. That means less money is available for entrepreneurship or other investments that drive growth.
When debt reaches 90 percent of GDP, economies experience significant growth problems. Heritage Foundation economist Salim Furth explains:

In one study, Manmohan Kumar and Jaejoon Woo of the International Monetary Fund (IMF) find that high-debt economies grew 1.3 percentage points slower than their low-debt counterparts. The negative effects of debt builds steadily as debt grows from low (below 30 percent of GDP) to high (above 90 percent). Over a decade, a difference of 1.3 percentage points of growth would be $11,000 more-or less-every year per family in the U.S. That's enough to send the kids to a state college or move to a nicer neighborhood.

Over the last several years, government debt has risen at an alarming rate. Counting federal, state and local debt, "U.S. debt has zoomed from 48 percent of GDP in 2007 to 84 percent in 2012," Furth reports.
"We stand at the 84 percent threshold," he continues, "and we may either lurch ahead into a future where high debt and low growth are facts of life for a generation or hold back and allow our economy to grow faster than our debts.
There is a way out of this. We still have time to tackle the national debt-but time is running out. Heritage's "Saving the American Dream" plan outlines how we can restore economic growth by slashing federal spending, making taxes fairer and flatter, and otherwise getting government out of the way.

Policy makers and the media have largely ignored Latin America in recent years, focusing instead on the Middle East and Asia. This oversight is misguided especially when considering the strong economic, political and geographic ties that connect us deeply with our southern neighbors.
With the socialist regimes in Venezuela and Cuba under Hugo Chavez and the Castro brothers potentially coming to a close, new opportunities are emerging for the U.S. to reassert its regional leadership, expand commerce, and support democracy and human rights.
Trade with Latin America already supports millions of American jobs, and new free trade agreements could create millions more. With over 550 million consumers and a rising middle class in Latin America, Latin America offers new markets for American goods and services.

Though it may seem counterintuitive, imports are vital to U.S. manufacturing, explains Heritage Foundation economist Terry Miller.
Statists often favor subsidizing exports as a way to bolster the economy, but Miller says this kind of intervention can dangerous. "Export promotion is misguided at best," he says, "and seriously harmful if policies include restrictions on imports or manipulation of currency to cheapen the value of the dollar."
To boost the manufacturing sector, Miller suggests the Obama administration remove government restrictions on commerce instead of focusing solely on exports.

To Fix the Debt, Must Cut More
Sequestration barely even slows the growth in government spending, let alone cuts any spending out of the overall budget. Even with sequestration, federal spending will still grow by 67 percent. Much larger spending cuts are needed to rein in growing spending and debt and avoid a debt crisis.

One hundred years ago this week, 5,000 women marched for women's suffrage in Washington, D.C. The goal was to "give expression to the nation-wide demand for an amendment to the Constitution enfranchising women." A few years after the parade, the 19th Amendment was ratified, which guaranteed that the right to vote would not be abridged on account of sex. It's often thought that the amendment was necessary because the Constitution prohibited women from voting. But this is not the case. Busting 5 Myths About the Minimum Wage
When someone says "minimum wage," what comes to mind? Do you think of teenagers flipping burgers? Or a single parent trying to feed several kids? While President Obama and other proponents of a higher minimum wage want you to visualize that single parent, the truth is that a burger-flipping teenager or college student with a part-time job paints a much more accurate picture of the minimum wage in America. In his State of the Union address, President Obama called for an increase in the minimum wage from $7.25 to $9 an hour. Today, Democrats in Congress are arguing that the President didn't go far enough, proposing an increase to more than $10 an hour. Minimum-wage increases reduce the number of entry-level minimum-wage jobs available-actually hurting many of the workers proponents want to help. And who are these workers? The President and others keep going back to five key myths about minimum-wage workers. Heritage labor expert James Sherk has already debunked them all. Myth #1: Hordes of Minimum-Wage Workers Very few Americans are actually working for the federal minimum wage-it's just 2.9 percent of all workers in the United States. In other words, 97 percent of American workers make more than minimum wage. Myth #2: The "Working Poor" Getting By on Minimum Wage More than half of minimum-wage workers are between the ages of 16 and 24. These young people tend to work part-time, and a majority of them are enrolled in school at the same time-so the after-school burger flipper or college student with a part-time job is the real deal. A hike in the minimum wage primarily raises pay for suburban teenagers, not the working poor. In fact, America's poor aren't the "working poor" at all. Sherk explains that "Contrary to what many assume, low wages are not their primary problem, because most poor Americans do not work for the minimum wage. The problem is that most poor Americans do not work at all." Cutting down the number of entry-level jobs by raising the minimum wage surely isn't going to help these people who need jobs. Myth #3: Minimum-Wage Workers Trapped in Poverty The average family income of a minimum-wage worker is more than $53,000 a year. How is this possible at $7.25 an hour? Few workers with minimum-wage jobs are the primary earners in their families. This is also true of older minimum-wage earners. Three-fourths of workers 25 and older earning the minimum wage live above the poverty line. In fact, 62 percent have incomes over 150 percent of the poverty line. Myth #4: Lifelong Minimum-Wage Earners Minimum-wage earners don't stay in those jobs forever. It's easy to get the idea from politicians that "minimum-wage workers" are a permanent class of people. But in fact, two-thirds of minimum-wage workers earn a raise within a year. As they gain experience and employment skills, they become more productive and can command higher wages. Entry-level, minimum-wage jobs are the first rung on many workers' career ladders. Myth #5: More Single Parents on Minimum Wage Very few single parents are working full-time in minimum-wage jobs. Unfortunately, politicians overuse that example. A greater proportion of employees in the overall workforce (5.6 percent) are single parents working full-time jobs, while for minimum-wage workers that proportion is 4 percent-because so many minimum-wage workers are secondary earners. Don't be fooled by the myths. A minimum wage increase will not reduce poverty. Instead, it will hurt many of the workers its proponents want to help. As James Sherk and Rudy Takala sum it up:
A higher minimum wage would help some workers, but few of them are poor. The larger effect is hurting the ability of potential workers living in poverty to get their foot in the door of employment. A minimum wage hike might help politicians win plaudits from the press, but it wouldn't reduce poverty rates.
