Cover-Up: Benghazi Review Board Says Nobody Should Be Held Responsible

Secretary Clinton's "Accountability Review Board" (ARB) declared multiple times in its unclassified report that although there were multiple failures in leadership, "management ability," allocation of security resources and communication, the board could not find "reasonable cause" to discipline (or even name) one person in the State Department.

The report states that there was a breakdown in communication between Libya and Washington. It confirmed previous testimony given on Capitol Hill that the personnel in Libya did ask for increased security. However, the ARB found that those working at the embassy in Tripoli "did not demonstrate strong and sustained advocacy" for increased security at the "special mission" in Benghazi.

Chinese State Media Demands US Citizens Be Disarmed

The official Chinese government news agency, Xinhua, has demanded the US immediately adopt stricter gun control measures to reduce the number of firearms the US populace is permitted to possess.

The Chinese state-controlled media's statement, titled "Innocent Blood Demands No Delay for US Gun Control," is primarily focused on the Newtown tragedy in which 26 Americans were killed by a mad gunman. Twenty of the victims were young children.

The Chinese government stated, "Their blood and tears demand no delay for the U.S. gun control."

In an apparent effort to restrict information to their populace, the Chinese government wrote of a number of US mass shootings but failed to mention they were either stopped by a citizen legally carrying a firearm or otherwise only occurred in the controversial gun-free zones that critics say make prime targets for madmen.

The Chinese government states:

The past six months have seen enough shooting rampages in the United States. Just three days ago, three people were shot dead at a shopping mall in Oregon. Two weeks ago, a football player shot his girlfriend dead and then committed suicide. Five months ago, 12 people were killed and 58 wounded in a shooting spree at a midnight screening of a Batman film in Colorado.

The government went on to express a strong dislike of the National Rifle Association while also attacking the Republican Party as somehow complicit in the violence. Conversely, the article heaps praise on the Democratic Party:

The Clinton government launched a series of gun control policies at the end of last century. And the Democrats lost the Congressional election in 1994 and the presidential election in 2000, with the shadow of the NRA present in both defeats.

The current Chinese government, the communist People's Republic of China, was established in a revolution led by Mao Zedong, who killed an estimated 40-70 million people with starvation, executions, and re-education camps.

We are hearing more and more about Agenda 21. Knowing that 40 minutes with a guest speaker at a local meeting is not nearly enough time to cover the scope of the entire Agenda 21 objectives we would like to hold a Seminar on Sustainable Development (Agenda 21) on January 26 (date tentative depending on response).

The Seminar, at this point would be internal, but would make heavy use of outside sources as well as provide you with necessary materials including the original Agenda 21 proposal.

The 4 major points in covering this Seminar would include:

  • A comprehensive overview of Sustainable Development-Agenda 21.
  • Agenda 21, ICLEI, NGO's and the Administrative State - how they work together to bypass the Constitution and implement law through regulation. (this is important so people understand how non-binding U.N policy become federal law that then moves down to our local government. This would also contrast the difference between a bottom up government (our Republic) and a top down government (a Soviet).
  • Global governance through local initiative.
  • Property Rights - the principle that formed the nation!

What we need to know is interest so we can establish a place for the meeting. We expect a fee of $10 to cover materials and rental of the facility and we expect this to cover at least 3 to 4 hours depending on group participation.

The Great Betrayal: Obama's Wars and the War in Iraq

Daniel Greenfield's new Freedom Center pamphlet, The Great Betrayal: Obama's Wars and the War in Iraq, is an effort to understand the politics of the "war on terror" which has now reached a final punctuation point with the U.S. decision to speed its withdrawal from the battlefields of Iraq and Afghanistan (where success was once deemed so crucial to national security), and to practice an incoherent form of regime change in Libya while ignoring more serious threats in Syria and Iran.

 

The war on terror began, Greenfield shows, as an admirable bipartisan commitment soon after the tragedy of 9/11-an effort to transcend party lines not only to punish those who attacked our country but also to interrupt planning for further attacks and try to stop the international spread of the Islamic jihad behind the attacks. But the Democratic Party, with the honorable exception of a few individuals like Richard Gephardt and Joe Lieberman, turned its back on a war soon after authorizing it, and did so at a time when American troops were facing hostile enemy fire.

 

Although Senate Democrats on the intelligence oversight committee had been granted access to every piece of data available to the White House, they now accused President Bush of tricking them to secure their approval. In fact, their own about-face was entirely dictated by political considerations when a Sixties antiwar activist, Howard Dean, surged ahead in the Democratic primary polls and it appeared for a moment that Americans were on the side of retreat and capitulation.

 

Although regime change in Iraq had been official U.S. policy since Bill Clinton signed the Iraq Liberation Act of 1998, Democratic senators such as John Kerry who only months earlier had supported the war effort now launched demoralizing attacks on the American commander-in-chief and his troops in the field, stigmatizing it as "the wrong war in the wrong place at the wrong time." If the truth was the first casualty of their war against the Bush administration, the second casualty was the principle of bi-partisanship that had guided foreign policy debates throughout the Cold War, the principle that "politics stops at the water's edge." Now partisan politics trumped security.

 

The unrestrained attacks on the Iraq War as illegal and unjustified went largely unanswered by Republicans who failed to call the Democratic saboteurs of the nation's war effort to account or to decry the risk their cynical attacks posed to American servicemen and women on the battlefield. As Greenfield demonstrates, the Democrats' partisanship had consequences not only in Iraq but elsewhere in the region: the paralysis that resulted from their "anti-war" campaign led straight to the destruction of Lebanon and the installation of a terrorist army, Hezbollah, there as a regime within a regime. And it emboldened an overtly Islamofascist regime in Iran not only to supply the IEDs responsible for most of our troop fatalities in Iraq but also to proceed with a nuclear program aimed directly at Israel and the West.

 

The Great Betrayal shows that Barack Obama's abandonment of Iraq is a betrayal of all the Americans and Iraqis who gave their lives to establish freedom in that country. And the result of his policies in Afghanistan has been as disastrous. While the President presented his rationale for pursuing war there as the pursuit of al-Qaeda, after abandoning his "surge" (which resulted in two thirds of all America's Afghan casualties there and the resurgence of the Taliban allies of al-Qaeda), he blithely prepared for withdrawal as if national objectives had been met.

1.  Obama's Outrageousness

Lost in the midst of the fiscal cliff drama are President Obama's outrageous offers. A cursory review of his plans reveals he is fundamentally unserious about addressing our nation's coming fiscal crisis. This should come as no surprise, of course. Throughout his presidency and even during his reelection campaign, President Obama spurned serious solution in favor of big-government gimmicks.

 

President Obama's initial offer was, as Heritage said, "totally misguided." The package consisted of "at least $4 of tax increases to $1 of spending cuts." Funny, I don't think Americans in swing states saw Obama for America running ads touting a $1.6 trillion tax increase. Nor did the Obama campaign announce they'd ask for carte blanche authority to increase the nation's debt limit. They saved all of that for AFTER they were guaranteed another four years. . . . please click here for the rest of the post

 

2. A Time for Choosing

Obama has spent four years asserting that his plan to let the Bush tax cuts expire on the top two brackets is not a tax increase, rather just a continuation of the current law (pursuant to the sunset provision) for the wealthy, and a tax cut for 98% of taxpayers.   Republicans spent the past 4 years sans the last month arguing that this would constitute a job killing tax hike, and that we needed to cut spending, not raise taxes.

 

Last month, Republicans began to use the parlance of the left by saying that we need to raise revenue and that it will come from the rich.  However, they swore that it would only come through closing deductions (which they began referring to as loopholes), not raising marginal rates.  Well, now Boehner is putting a proposal before the House to raise the marginal rate on those earning more than $1 million.  We have come full circle.

 

There is absolutely no benefit to voting for this over voting for full extension (along with repeal of Obamacare tax hikes and a further middle class tax cut).  Either way, Obama has promised to veto the bill, so why die on a hill that is unprincipled and that will get us on record as facilitating a tax increase? . . . please click here for the rest of the post

Ohio Education Association (OEA) President Patricia Frost-Brooks was paid $267,916 in dues taken from Ohio teachers during fiscal year 2012, according to the union's latest staff and officer data submitted to the U.S. Department of Labor. Chicago ranks #1 as the deadliest Alpha world city


NBC Chicago reports on some of those "Chicago values" the city's Mayor Rahm Emanuel (Democrat, naturally) touted, justifying his alderman's refusal to grant a license to a Chick-fil-A potential franchisee.

Chicago likes to compare itself to other world cities, so Ward Room thought it would find out how we rank in violence. It turns out no one can top us. Among what are considered Alpha world cities, Chicago has the highest murder rate -- higher even than the Third World metropolises of Mexico City and Sao Paolo.

Chicago's murder spree of 19.4 per 100,000 is more than three times that of New York's (6 per 100,000) and more than two and a half times of Los Angeles' (7.5 per 100,000), its closest American competitors. Caracas, Venezuela, which apparently is not an Alpha world city--thank you Hugo Chavez--has a higher murder rate of 130 per 100,000.

In the American cities mentioned, most of the murders are committed with guns. These cities all have laws against murder. They even have laws against guns; Chicago has some of the strictest gun control laws in the nation. But, no matter. As President Barack Obama (D)approvingly quoted from the gangster movie The Untouchables when on the campaign trail in Philadelphia four years ago,

"If they bring a knife to the fight, we bring a gun," Obama said. "Because from what I understand folks in Philly like a good brawl. I've seen Eagles fans."

Of course, this attitude was prior to Obama's evolution on gun control.

Interestingly, Obama thought guns were a rural, small town phenomena, not part of normal life in his big city, as evidenced by comments he made at an elite fund raiser in San Francisco also four years ago.

"They get bitter, they cling to guns or religion or antipathy to people who aren't like them or anti-immigrant sentiment or anti-trade sentiment as a way to explain their frustrations."

Hmmm, wrong again.

GUN CONTROL AND ASSAULT WEAPONS

 

As Rahm Emanuel stated when Chief of Staff for Obama, "Never let a good crisis go to waste!"

 

While the massacre of the innocents in Connecticut is horrendous, the gun control advocates are out in force with specious and egregious lies, deceptions, and outright Marxist politics! Obama has failed to address the Fort Hood massacre of our soldiers or the 500+ American citizens gunned down in his home town of Chicago just this year. These murders and acts of terrorism do not figure into the Marxist agenda of gun confiscation as the precursor to total government control. Hitler, Mao, Stalin, Mussolini, and all other dictators involved in attempting full government control over their citizens knew that the nullification of the citizen's right to bear arms in case the government turned rogue was a priority. So, let's take a hard look at the problem by the numbers.

 

        1.  "Assault Rifles"

 

What is the legal definition of an "Assault Rifle"? The word "Assault" in military or law enforcement parlance is the breaching of a defensive position to achieve possession of it. Several generations ago specific rifles were designed to achieve this. The requirement was that they be light, shorter for close quarters than main battle rifles such as the M1, and use smaller and lighter caliber ammunition because they would be used in close quarters. Aside from heavy machine guns requiring multiple personnel, the assault rifle had to be individually carried. The primary function of the assault rifle was that it had to be able to fire like a machine gun in fully automatic fire - hold the trigger rearward and the rifle would continue to fire until you released the trigger or you ran out of ammunition. Google the "St. Valentine's Day Massacre" back in Chicago 80 years ago and you will find the gangsters using Thompson Sub-Machine guns that fired the .45ACP cartridge. They used detachable cartridge drums that held lots of rounds, much more than any magazine. During WW2 the Thompson was a premier assault rifle used to breach defensive positions. It was also modified to use a 30-round magazine instead of the drum, which was subject to failing.

 

In 1965 the US began to issue M16 full-auto assault rifles for use in Vietnam. The M16 replaced the M14 which was in use once the M1 (8 rounds in a clip loaded from the top of the receiver, and NOT full-auto) was phased out in the late 1950's. The M14 was a main battle rifle using nearly the same powerful long-range cartridge as the M1, but the M14 was able to fire full-auto. It was magazine fed at the base of the receiver. The M16 was designed specifically as an assault rifle to use in Vietnam in close quarters in the jungle. It was light, short, and used small but powerful .223 ammunition, the bullet being nearly equal to the normal .22LR used in target rifles and pistols. (.22 equals 22 thousandths of an inch, or nearly ¼ inch in diameter, but the .223 cartridge as used in the M16 and the M4 carbine, a shorter version of the M16, is more powerful, but basically the same bullet.)

Most assault rifles have a selector lever on the receiver that designates what rate of fire the user wishes such as "AUTO" (continues to fire like a machine gun if the trigger is held rearward), "BURST" (only fires a 3-round burst to save ammunition), "SEMI-AUTO" (will only fire when the trigger is pulled rearward one at a time), and "SAFE" that prevents the rifle from firing at all.

The two most used assault rifles ever produced are the Russian AK47 and the American M16/M4. Because of their military popularity the manufacturers decided to produce civilian versions that are NOT FULL-AUTO or "BURST" as the military versions are. They only appear cosmetically to the FULL-AUTO military versions. In the US you may not own or purchase any FULL-AUTO firearm without a specific license issued by the Bureau of Alcohol, Tobacco, and Firearms (BATF), and these licenses are highly controlled and supervised. Again, NO FULL-AUTO firearm, including "Assault Rifles" can be purchased by civilians without the license.

 

  1. Civilian rifles cosmetically appearing to be "Assault Rifles"

There are several civilian copies of military assault rifles. One of these is referred to generically as the "AR15". The "AR" stands for the Armalite Company who produced the first M16 rifle issued to our troops in Vietnam back in 1965. Once it was approved Colt purchased the rights and the majority were then produced by Colt. However, the AR15 is a civilian version of the M16 military model, but with a significant difference. IT IS NOT FULL-AUTO! There is a firing selector lever on the receiver, but it has only TWO positions, "FIRE" and "SAFE". In all other respects it cosmetically mirrors the military model. In the "FIRE" position the rifle will ONLY fire ONE round each time the trigger is pulled. This is identical to many other rifles in use today as well as shotguns. They are termed "SEMI-AUTO" because it requires the pull of the trigger for each shot. Most law enforcement pistols are also SEMI-AUTO such as the SIG-SAUER, GLOCK, H&K, etc. SEMI-AUTO only means that each time the trigger is pulled it fires a bullet until the ammunition is completely depleted. Therefore, an AR15 rifle is NOT an "Assault Rifle"!

 

You can modify AR15 rifles in various ways such as adding a flashlight, a laser aiming light, scopes of varying types, but the ONLY modification you can't legally perform is a modification that allows it to fire FULL-AUTO! That is a FELONY! So, what did the "Assault Weapons" ban issued under Clinton in 1994 really accomplish? NOTHING! It expired in 2004 with no great fanfare.

In California we still have an "Assault Weapons" law codified in the Penal Code. It has achieved nothing with respect to controlling true assault rifles which are controlled by Federal law. If you actually read the penal code sections they ALL refer to cosmetic differences except for high-capacity magazines, which will be discussed shortly. The California Penal Code section 12276.1(a) defines "Generic Characteristics Defining Assault Weapons". It exempts AR15 rifles unless they have installed any ONE of these listed "characteristics" such as a "pistol grip", a "thumbhole stock", a "folding or telescoping stock", a "flash suppressor", or a "forward pistol grip" to name just a few. If you compare the AR15 to an M16/M4 cosmetically they are identical in appearance. The main difference again is the M16/M4 is FULL-AUTO while the AR15 is NOT by Federal law. There are several semi-auto rifles of .223 caliber that do NOT fall under this California law such as the Ruger Mini-14. This rifle has a normal rifle stock without any of these listed "features". It fires the same .223 cartridge and operates in the identical manner. It just isn't scary looking.

If you purchase an AR15 with any of the above-described installed "characteristics", then the law states you MUST have to use a "tool" to push the detachable magazine release button. There appears on the right side of the receiver a normal-looking release button, but it has a hole in the center of it. That hole is where you must insert the "tool" to depress the interior spring releasing the magazine. If you just push on the button itself nothing happens. The idea is that, if it takes a tool it requires more time to change magazines, and therefore it gives more time for law enforcement to arrive and prevent the shooter from inserting a new magazine. In short, the idea is ridiculous! This button has been referred to from the outset as the "Bullet Button" because you can use the pointed nose of the .223 cartridge to push the release by inserting it into the hole in the button!

 

Reviewing the "Generic Characteristics Defining Assault Weapons" in California, it is very simple to modify an AR15 from one with the described features and a "Bullet Button" to one not requiring the "Bullet Button". All you need to do is remove the pistol grip, unscrew the flash suppressor, and changed the folding or telescoping stock to the fixed M15 stock, etc. If you do all this (about $125 in parts) you can removed the "Bullet Button" and install a regular spring-loaded magazine release button that can be pushed without using a "tool". You have now converted your scary-looking AR15 into a simple rifle not covered in the law.

 

  1. High-capacity magazines

California Penal Code section 12020 prohibits anyone person from using any firearm, rifles, pistols, and shotguns, having an ammunition capacity of more than 10 rounds. What is most interesting is that the code states, "Possession of large capacity magazines...by private citizens is not (emphasis in the code!) controlled." The code merely states that a person is prohibited from "manufacturing, importation into the state, offering for sale, keeping for sale, exposing for sale, giving, and lending of a large capacity magazine." In other words, you may "possess" a large capacity magazine, but don't try to lend it or sell it to someone else. It would appear that, if you modified your AR15 to remove any scary features, and you "possessed" a high-capacity magazine, you could use it. (Check with an attorney first!)

 

In conclusion, an assault rifle is one that is capable of firing FULL-AUTO. The AR15, by Federal law, is NOT capable of firing FULL-AUTO, and therefore does NOT meet the definition of an "Assault Rifle". It is high time to discuss problems using the TRUTH!

Hardly had the blood been scrubbed off the floors in Newtown than everyone who was anyone had begun shifting the blame from Adam Lanza to some intangible social failure.

 
Back in 2002, Michael Moore trundled his bulk over to Colorado to exploit the Columbine massacre for a general rant about gun culture, American foreign policy and how hard it was to find a shop selling bacon grease by the ton at two in the morning.

In his film, which won an Oscar for Best Documentary, Moore gave his audience what they wanted, lots of scenes of "hicks and hillbillies" buying, selling and giving away guns all over the place to illustrate the murderous ravages of American gun culture. Some of those scenes were staged, but it didn't matter since Moore was catering to an audience that had nothing but contempt for working class Americans and would believe any awful thing about them.

What did gun culture have to do with a plot by two disgruntled dorks upset over being called "Faggots" a few times too many? About as much as gun culture has to do with Adam Lanza, another award winning product of the, "Maybe some people deserve to get beaten up" club.

Your average school shooter is unhappy and angry, irreligious, incapable of fitting into a community and filled with rage that he exercises through violent fantasies. His culture isn't gun culture. It's loner culture. Video games do not cause him to kill, but they are how he entertains himself until he can get a taste of the real thing.

Adam Lanza, Dylan Kleibold, Eric Harris, Seung-Hui Cho, James Holmes, One L. Goh and Jared Loughner had as much in common with what the Michael Moore Fan Club thinks of as "gun culture" as Michael Moore does with the working class. Whatever gun culture they had was not the American Scots-Irish culture of the hunter, the rancher and the militia member, but the urban posse of emasculated men of no worth that brandishes weapons as a way to get respect.

Obama Sidelines Gun Control

You think the Democrats are anxious to charge once more into the gun control lists? Think again. Byron York reports that President Obama has sidelined any move toward new gun legislation, at least for the time being, with Washington's hoariest delay tactic:

With President Obama's announcement of a commission to study and recommend ways to reduce gun violence, the two most important Democrats in government - Obama and Senate Majority Leader Harry Reid - have both indicated a desire to slow the momentum toward gun control in the wake of the Newtown, Connecticut school shootings. The president's decision to appoint a blue-ribbon panel - the classic Washington ploy to defuse and delay consideration of an issue - along with Reid's inaction on the gun question will undoubtedly frustrate many in their party who want immediate action.

The commission is supposed to report in January, and Obama vows that it won't be "something where folks are going to be studying the issue for six months and publishing a report that gets read and then pushed aside." Like, say, Simpson-Bowles. But the effect of Obama's action is obvious:

Obama's move will likely dissipate the energy behind gun control advocacy on Capitol Hill. It's unlikely that even the most pro-gun-control Democrats would want to get out in front of the Biden Commission and pass specific measures. And the political world, and the emotional intensity behind the gun issue, could be quite different even a month from now. So Obama is stopping Democratic momentum, and he knows it.

Harry Reid has no intention of doing anything on guns, either. This exchange is priceless:

QUESTION: What gun control measures would you support going forward?

REID: I watched the prayers, I watched everything that took place in Connecticut Sunday night. No one law can erase evil; that's what the president said, and he's right. But we need to accept the reality that we're not doing enough to protect our citizens. I'm very happy that the president's going to do everything he can administratively. We must engage on a thoughtful debate about how to change laws and culture that allow violence not continue to grow. Every idea should be on the table as we discuss how best to keep our children safe.

QUESTION: Can you speak specifically [about any] particular gun control measure?

REID: No. No, I've been very clear here. I think we have to have a full discussion.

I'm not sure whether Obama has seen poll data he doesn't like, or is just being cautious and wants to let a few months go by before taking the public's temperature on the issue. But for now, at least, he has stopped any movement toward increased gun regulation in its tracks.

 

Has Hagel revised his view of military action against Iran? [UPDATED: Hagel Out?]

Yesterday, I noted several instances in which Chuck Hagel denounced the option of attacking Iran in response to its development of nuclear weapons. Hagel's supporters will point, however, to a more recent op-ed in the Washington Post of September 28, 2012 that Hagel signed. The other names on the op-ed are Retired Adm. William J. Fallon, former Indiana congressman Lee Hamilton, former undersecretary of state Thomas Pickering, and Retired Gen. Anthony Zinni.

The op-ed is a weak reed upon which to claim that Hagel has undergone a conversion - whether of the confirmation variety or some other. The op-ed is a spin-off of an analysis by TheIranProject, released the same month, called "Weighing Benefits and Cost of Military Action Against Iran."Hagel was one of a group of a few dozen individuals who supported publication of that analysis.

TheIranProject's analysis is essentially a brief against the option of attacking Iran as a response to its development of nuclear weapons. The analysis concludes that the objective of preventing Iran from developing a nuclear "is unlikely to be achieved through a military action that relies on aerial strikes supplemented by cyber attacks, covert operations, and perhaps special operations forces." To accomplish that objective would likely require the occupation of Iran, which would entail "a commitment of resources and personnel greater than what the U.S. has expended over the past 10 years in the Iraq and Afghanistan wars combined."

The analysis goes on to discuss other costs associated with attacking Iran. They include direct Iranian retaliation against the U.S., strikes against Israel, damage to America's global image, and the "increased likelihood of Iran becoming a nuclear state."

If a U.S. attack on Iran will increase the likelihood of Iran obtaining nukes, it would be insane for the U.S. to attack Iran. That, behind all of the standard-issue policy speak, is the finding of the analysis that Hagel backs.

To be sure, the op-ed authors say that they "do not agree with every word in the report." But they do not disavow any of its findings. Rather, they affirm that they "have shared understandings of its message." That message is clear: "Don't attack Iran."

As to whether the nuclear option should be on the table, the Op-ed Five won't say. They note that "the U.S. government has indicated that if Iran were to produce weapons-grade enriched uranium and build a weapon, the military option must be considered." But Hagel and company don't say whether they agree with this "indication." Instead, they state that if Iran makes "a dash for a nuclear weapon" there will be "sufficient warning time to decide how to respond."

The Op-ed Five also say: "Our position is fully consistent with the policy of presidents for more than a decade of keeping all options on the table, including the use of military force, thereby increasing pressure on Iran while working toward a political solution." But that's not the same thing as saying that the use of military force SHOULD be on the table. It would have been easy enough to make that statement, if that's what Hagel and the others believe. Instead, it sounds as if someone worked overtime to formulate language that can be viewed as favoring keeping the military option on the table without actually saying that it should be.

In any event, the key point is Hagel's support of a report concluding that the use of military force makes no sense. To say that the option should be kept on the table in order to help push Iran into a political settlement (which Hagel and company stop short of saying), while at the same time arguing that a military attack is a fool's errand, would be absurd. Iran won't be influenced by the possibility of a military option that analysts believe would have huge costs and would, if anything, be counterproductive.

If Hagel wants to execute a confirmation conversion on the military option, he'll need to do better than this. And while he's at it, he should consider converting on the host of other issues as to which he has taken a pro-Iranian line.

UPDATE by JOHN: The Washington Free Beacon is reporting that Hagel may no longer be Obama's pick for Secretary of Defense, on account of the negative reaction his proposed nomination has received.

 

Hagel's not the right choice for Defense Secretary, says the Washington Post

I like to say that the Washington Post's editorial page is one of the last bastions of respectable liberalism in America. It's also the reason why I eventually accepted defeat in our long running family battle over whether to subscribe to the Post.

Today, the Post's editors come down hard against the idea of nominating Chuck Hagel for Secretary of Defense. The Post focuses on two vital issues: defense spending and Iran. It concludes that Hagel's positions on both "fall well to the left of those pursued by Mr. Obama during his first term - and place him near the fringe of the Senate that would be asked to confirm him."

As to defense spending, the Post observes:

The current secretary, Leon Panetta, has said the defense "sequester" cuts that Congress mandated to take effect Jan. 1 would have dire consequences for U.S. security. Mr. Hagel took a very different position when asked about Mr. Panetta's comment during a September 2011 interview with the Financial Times. "The Defense Department, I think in many ways, has been bloated," he responded. "So I think the Pentagon needs to be pared down."

While both Republicans and Democrats accept that further cuts in defense may be inevitable, few have suggested that a reduction on the scale of the sequester is responsible. In congressional testimony delivered around the same time as Mr. Hagel's interview, members of the Joint Chiefs of Staff said the sequester would lead to "a severe and irreversible impact on the Navy's future," "a Marine Corps that's below the end strength to support even one major contingency" and "an unacceptable level of strategic and operational risk" for the Army.

As to Iran, the Post observes:

[Hagel] repeatedly voted against sanctions, opposing even those aimed at the Iranian Revolutionary Guard Corps, which at the time was orchestrating devastating bomb attacks against U.S. troops in Iraq. Mr. Hagel argued that direct negotiations, rather than sanctions, were the best means to alter Iran's behavior. The Obama administration offered diplomacy but has turned to tough sanctions as the only way to compel Iran to negotiate seriously.

Mr. Obama has said that his policy is to prevent Iran from obtaining a nuclear weapon and that containment is not an option. Mr. Hagel has taken a different view, writing in a 2008 book that "the genie of nuclear weapons is already out of the bottle, no matter what Iran does."

The Post acknowledges that Hagel seemed to shift his position on Iran in an op-ed he signed a few months ago. I am working on a post about that op-ed. But the Post is more than fair to Hagel when it concludes:

[President Obama] will need a defense secretary ready to support and effectively implement a decision. . .to contemplate military action if Iran refuses to negotiate or halt its uranium-enrichment program. Perhaps Mr. Hagel would do so; perhaps he would also, if installed at the Pentagon, take a different view of defense spending. (Mr. Hagel declined through a spokesman to speak to us about his views.)

What's certain is that Mr. Obama has available other possible nominees who are considerably closer to the mainstream and to the president's first-term policies. . . .

 

Robert Bork's Revenge?

The distinguished jurist Robert Bork has died at the age of 85. Roger Kimball recalls him here, noting with understatement that the Left's scorched-earth opposition to his Supreme Court nomination was "obscene." I have a long account of it in The Age of Reagan, but the core of the matter is this: "George Will was not alone in calling Bork 'the most intellectually distinguished nominee since Felix Frankfurter.' That was exactly the problem for the Left."

At least no one drowned in "Robert Bork's America"

Bork's nomination brought out the highest hypocrisy of the Left. Take the current Vice President, Wide-Mouth Biden, as an example. When President Carter nominated the liberal Abner Mikva to an appeals court in 1979, Biden rebuffed conservative complaints about Mikva's activist liberal philosophy: "I think that the advice and consent responsibility of the Senate does not permit us to deprive the President of the United States from being able to appoint that person or persons who have a particular point of view unless it can be shown that their temperament does not fit the job." Ted Kennedy said on the Senate floor: "If strong political views were a disqualifying factor from serving on the federal bench, then all of us here today-and every man and women who has ever served in either house of Congress, or held political office-would be disqualified." Kennedy had made a similar argument in 1967 in defense of Thurgood Marshall's appointment to the Supreme Court. That all went out the window with Bork, of course.

Bork's death today might well represent his ultimate revenge on the Left: had he been confirmed to the Court, his passing today (there's no special reason to think he would have retired) would have opened up an appointment for President Obama to name a new Justice and tip the Court to the Left. Instead, the man Reagan put in the seat Bork would have filled, Anthony Kennedy, will carry on, determined, I am reliably told, to serve at least until Obama is gone in part because he was offended by Obama's demagogic attack on the Citizens United decision that Kennedy wrote. Another irony is that the chief reason Reagan selected Scalia over Bork for an open seat on the Court in 1986 was that he thought he might not get any more high court appointments, and wanted to place a jurist on the Court who would serve for a long time.

Some months ago the Daily Beast's Lloyd Grove caught up with Bork, and suggested that his obituary would dwell on his role in the 1973 "Saturday Night Massacre" of the Watergate scandal. Bork (whom I knew slightly) responded as I would have expected:

"I'd like to know how you know what my obituary is going to say," Bork gruffly demands when I suggest the above-mentioned scenario. In any case, he adds, "I have no control over it-so I refuse to worry about it."

The irony, surely lost on liberals, is that the serious criticism of Bork's jurisprudence would come from the Right, rather than the Left (though it was not disqualifying for the Court, to be sure). Bork, like Scalia, was a strict textualist, and has little regard for the natural law tradition of the American founding, or its implication, for example, in the Ninth Amendment. In this Bork was reacting against the abuse of the 9th and 14th Amendments by liberal judges to "discover" positive "rights" in the "emanations and penumbras" of the Constitution. In other words, Bork was something of a legal positivist-but of the Right rather than the Left. Had he been confirmed, a Justice Bork would likely have followed Chief Justice Rehnquist in upholding most exercises of state power so long as they were reasonably spelled out in statutes.

Ironically the person who was on to this was Judiciary Committee chairman Joe Biden, who cleverly undermined Bork from the Right. In questioning from Biden, Bork compared the Ninth Amendment to an "inkblot"-as a clause without useable meaning. "Nobody has ever to my knowledge understood precisely what the Ninth Amendment did mean and what it was intended to do," Bork told Sen. Biden. It was hard to escape the conclusion that much of Bork's dislike of the Ninth Amendment stemmed from its use by Justice Arthur Goldberg as the basis for discovering a "right to privacy" in Griswold. But can it really be that a passage of the Constitution is practically meaningless, that there are rights which judges are powerless to protect? Were the Founders bad draftsmen? Was Bork truly unaware of Alexander Hamilton's argument in Federalist 84 against including a bill of rights in the Constitution, namely, that a positive enumeration would have the effect of mis-instructing the people as to the nature and extent of their rights, as well as laying a pretext, by omission, for the government to grab more power than the Constitution intended? Hamilton's argument was rejected, though his logic has certainly been vindicated with the passage of time.

None of this, as I say, is disqualifying for a Supreme Court seat, and in fact it is nearly the identical outlook as Justice Scalia's. Still, I doubt any of the obituaries that will appear today will make note of this most interesting aspect of Bork's story. The legacy of the vicious and obscene campaign against Bork is not just a new verb in the dictionary, but a permanently warped judicial confirmation process that now reaches lower judicial appointments. If it were possible to confer "contempt of court" rulings against the Left, the case of Bork would easily meet any standard of probable cause. Instead we should remember Bork by holding the Left in contempt of the public, which is their default position.

 

Climate Alarmism: The Beginning of the End?

John reported here the other day about the leaked portion of the forthcoming report of the Intergovernmental Panel on Climate Change (IPCC) which admits the possible role of cosmic radiation in cloud formation. This may be the first time the IPCC has acknowledged this as a possible factor, even though the hypothesis has been around for more than 20 years. But the big ball game all along in climate science has been whether estimates of climate sensitivity to greenhouse gas levels would change in future IPCC reports. Here's what I wrote about the matter in the Weekly Standard in 2010:

Eventually the climate modeling community is going to have to reconsider the central question: Have the models the IPCC uses for its predictions of catastrophic warming overestimated the climate's sensitivity to greenhouse gases? . . . The next wave of climate revisionism is likely to reopen most of the central questions of "settled science" in the IPCC's Working Group I.

Today Matt Ridley has a must-read article in the Wall Street Journal on this issue. He thinks the turning point has arrived. He's been speaking with an inside reviewer, Nic Lewis, who, though prohibited from quoting from drafts-in-progress, says some of the draft material "is dynamite." If you're without a Journal subscription, here's some of the key bits:

In short: We can now estimate, based on observations, how sensitive the temperature is to carbon dioxide. We do not need to rely heavily on unproven models. Comparing the trend in global temperature over the past 100-150 years with the change in "radiative forcing" (heating or cooling power) from carbon dioxide, aerosols and other sources, minus ocean heat uptake, can now give a good estimate of climate sensitivity.

The conclusion-taking the best observational estimates of the change in decadal-average global temperature between 1871-80 and 2002-11, and of the corresponding changes in forcing and ocean heat uptake-is this: A doubling of CO2 will lead to a warming of 1.6°-1.7°C (2.9°-3.1°F).

This is much lower than the IPCC's current best estimate, 3°C (5.4°F).

Of course, Ridley warns that this may not be the lead story in the news media when the full IPCC report is issued next year:

The big question is this: Will the lead authors of the relevant chapter of the forthcoming IPCC scientific report acknowledge that the best observational evidence no longer supports the IPCC's existing 2°-4.5°C "likely" range for climate sensitivity? Unfortunately, this seems unlikely-given the organization's record of replacing evidence-based policy-making with policy-based evidence-making, as well as the reluctance of academic scientists to accept that what they have been maintaining for many years is wrong. . .

The scientists at the IPCC next year have to choose whether they will admit-contrary to what complex, unverifiable computer models indicate-that the observational evidence now points toward lukewarm temperature change with no net harm. On behalf of all those poor people whose lives are being ruined by high food and energy prices caused by the diversion of corn to biofuel and the subsidizing of renewable energy driven by carboncrats and their crony-capitalist friends, one can only hope the scientists will do so.

But even if the politicized scientists carry the day with the next IPCC, it will be with an air of increasing desperation and will likely receive lukewarm (pun intended) media coverage. The whole scheme is slowly unraveling. Read Ridley's whole article if you can.

Obama's Real Plan: Soak the Middle Class

ObamaTaxEVERYONECongress The opportunity here to get confused in this debt deal and the fiscal cliff is huge. There's something that I think needs to be stated and understood. There is not a single tax cut being proposed as we speak. There is nobody, no Republican, no Democrat that is talking about tax cuts. There aren't any. The reason I'm making a big deal out of this is that Jay Carney and his sound bite from the White House just now, rejecting John Boehner's latest proposal, is filled with lies about how the Republicans are cutting taxes for the rich. I want you to understand, there are no tax cuts. There are no tax cuts contemplated. There are no tax cuts scheduled.

 

We have current tax rates. They have been the same since 2003. These tax rates were put into place by an agreement that Congress made with George Bush. They are to this day called the Bush tax cuts, but they are not tax cuts. They were at the moment they were passed because the new rates were smaller than what existed in 2003. But they have been the effective tax rates since 2003. There are no tax cuts, my friends. So when you hear Jay Carney or anybody in the media, or anybody on a cable TV show talking about the Bush tax cuts, there aren't any tax cuts. And nobody has proposed a tax cut.

 

What is going to happen on January 1st is that the current tax rates are going up. The question is, on who? If we go over the fiscal cliff, everybody's income tax rates are going up. The capital gains tax rate is going up. There is a 1% - actually .9% - there is a 1% income tax surcharge on everybody for Obamacare, everybody, no matter what else happens. There is a 3.8% surcharge on capital gains, independent of whatever the tax rate is on capital gains, and that's an Obamacare tax. So if nobody does anything, everybody's taxes are going up potentially 4.8%. A 1% income surcharge on everybody for Obamacare, and a 3.8% surcharge on any capital gains. If you sell your house at a profit, if you sell a stock at a profit, in addition to whatever the capital gains rate is, add 3.8% to it. It's an Obamacare tax. Both of these are.

 

The Republicans are not proposing tax cuts, and neither is President Obama. When he talks about tax cuts for the middle class as part of the deal, all he means is that the current tax rates will not go up for the middle class. But nobody is getting a tax cut. The president has not proposed one. The Democrat Party had not proposed one. And, sadly, the Republicans have not proposed one. So when you hear people talk about a middle-class tax cut with the fiscal cliff, there isn't one. It is political doublespeak. It exists by continuing to call the current rates the Bush tax cuts and then claiming that people who will not see a tax increase are getting a tax cut, when they aren't. Their rates are going to stay the same. There is no tax cut anywhere for anybody any time on the table.

Right-to-Work Gives Michigan Workers a Choice

 
Conservatives won an enormous victory in Michigan last week. The state just passed a right-to-work law that makes union dues voluntary. Starting next year, union contracts cannot require employers to fire employees who do not pay union dues. The state that gave birth to the United Auto Workers union has become America's 24th right-to-work state.

Trade Deficit Increase Not Necessarily a Bad Thing

 
The U.S. Bureau of Economic Analysis (BEA) announced last week that imports and exports both declined in October while the overall trade deficit increased.

Reactions to the BEA report were misleading. For example, the Associated Press reported: "A wider trade deficit acts as a drag on growth."

In fact, U.S. trade deficits have almost always heralded a booming U.S. economy.

What's at Stake in the Democratic Republic of Congo

Hollywood actor Ben Affleck brings his star power to Congress today to testify on the security situation in the Democratic Republic of the Congo (DRC) and its implications for the United States. Affleck will be joined at the hearing by Heritage's James Jay Carafano, who will explain why the Obama administration should rethink support for the U.N. peacekeeping mission there. This is the second hearing in two weeks on the issue.

Affleck's activism in the DRC has helped elevate awareness about the country's instability. Today's hearing before the House Armed Services Committee is an opportunity for Americans to learn more about what's happening in the central African nation.

In a new report, Heritage's Morgan Lorraine Roach and Brett D. Schaefer explain the country's troubled history and the plight of DRC citizens, who are among the world's poorest and suffer from high infant mortality and low life expectancy.

The current crisis stems from the mid-1990s clash between DRC and neighbors Rwanda and Uganda. The most prominent rebel group officially disbanded after a March 23, 2009, peace deal, that was supposed to integrate rebel troops into the Congolese army. Earlier this year, DRC president Joseph Kabila ordered the arrest of former rebel leader, Bosco Ntaganda, prompting his former troops to again rebel under the new name "M23" in reference to the March 23 peace deal. M23 launched an offensive in eastern Congo and, just last month, occupied and later withdrew from eastern Congo's largest city of Goma.

Failure of the ill-trained and unprofessional Congolese armed forces to stop the rebels' assault reflects poorly on the U.N. peacekeeping mission. The U.N. Organization Stabilization Mission in the Democratic Republic of the Congo, known as MONUSCO, has a budget of an annual $1.4 billion. The U.N. peacekeepers are charged with protecting civilians, but as the recent advance of M23 reveals, it has failed to effectively carry out its mission.

To make matters worse, Kabila's government has used violence, corruption, and cronyism to maintain power. Yet the international community continues to endorse his government and its support, supplemented by U.N. peacekeepers, allows Kabila to disregard his governance and security responsibilities.

What should the United States do? In the last fiscal year, American taxpayers provided more than $110 million in humanitarian assistance for the Congolese people. There are five steps the Obama administration should consider immediately, according to Roach and Schaefer:

 

  • Acknowledge that the DRC government lacks legitimacy and cannot deliver on its commitments. The U.S. should press Kabila to decentralize authority and transfer power to provincial and local governments.

 

  • Enforce sanctions on supporters of rebel groups. The recent cut of $200,000 in security assistance to Rwanda for supporting rebels is a welcome sign that the U.S. is prepared to enforce its policy.

 

  • Encourage regional economic integration. Rwanda and Uganda have much to gain from a stable eastern DRC, particularly one with greater autonomy that would be open to trade and investment.

 

  • Diminish the size of MONUSCO, limit its mandate, and establish a framework for terminating the mission. It's time for the United Nations to transition its work and acknowledge it's not the proper force for implementing peace in eastern Congo.

 

  • Support the creation of an African Union peacekeeping force. An African-led strategy helped address the dismal situation in Somalia and could bring regional attention to resolving the DRC crisis.

 


It's time the United States made these much-needed changes to more effectively address the plight of the Congolese people.

But, we're the grassroots conservative movement. We've got to fight.

What in the world happened to Chris Matthews? We may never know the answer - but for now, we can enjoy the gaffes.
